The patent system was created for the purpose of promoting innovation by granting the inventors a legally defined right to exclude others in return for public disclosure. Today, patents are being applied and granted in greater numbers than ever, particularly in new areas such as biotechnology and information andcommunications technology (ICT), in which research and development (R&D) investments are also high. At the same time, the patent system has been heavily criticized. It has been claimed that it discourages rather than encourages the introduction of new products and processes, particularly in areas that develop quickly, lack one-product-one-patent correlation, and in which theemergence of patent thickets is characteristic. A further concern, which is particularly acute in the U.S., is the granting of so-called 'bad patents', i.e. patents that do not factually fulfil the patentability criteria. From the perspective of technology-intensive companies, patents could,irrespective of the above, be described as the most significant intellectual property right (IPR), having the potential of being used to protect products and processes from imitation, to limit competitors' freedom-to-operate, to provide such freedom to the company in question, and to exchange ideas with others. In fact, patents define the boundaries of ownership in relation to certain technologies. They may be sold or licensed on their ownor they may be components of all sorts of technology acquisition and licensing arrangements. Moreover, with the possibility of patenting business-method inventions in the U.S., patents are becoming increasingly important for companies basing their businesses on services. The value of patents is dependent on the value of the invention it claims, and how it is commercialized. Thus, most of them are worth very little, and most inventions are not worth patenting: it may be possible to protect them in other ways, and the costs of protection may exceed the benefits. Moreover, instead of making all inventions proprietary and seeking to appropriate as highreturns on investments as possible through patent enforcement, it is sometimes better to allow some of them to be disseminated freely in order to maximize market penetration. In fact, the ideology of openness is well established in the software sector, which has been the breeding ground for the open-source movement, for instance. Furthermore, industries, such as ICT, that benefit from network effects do not shun the idea of setting open standards or opening up their proprietary interfaces to allow everyone todesign products and services that are interoperable with theirs. The problem is that even though patents do not, strictly speaking, prevent access to protected technologies, they have the potential of doing so, and conflicts of interest are not rare. The primary aim of this dissertation is to increase understanding of the dynamics and controversies of the U.S. and European patent systems, with the focus on the ICT sector. The study consists of three parts. The first part introduces the research topic and the overall results of the dissertation. The second part comprises a publication in which academic, political, legal and business developments that concern software and business-method patents are investigated, and contentiousareas are identified. The third part examines the problems with patents and open standards both of which carry significant economic weight inthe ICT sector. Here, the focus is on so-called submarine patents, i.e. patentsthat remain unnoticed during the standardization process and then emerge after the standard has been set. The factors that contribute to the problems are documented and the practical and juridical options for alleviating them are assessed. In total, the dissertation provides a good overview of the challenges and pressures for change the patent system is facing,and of how these challenges are reflected in standard setting.

Au Québec, la compétence professionnelle à intégrer les technologies de l’information et de la communication (TIC) est une compétence professionnelle à acquérir par les étudiants en enseignement. Cependant, son acquisition est problématique à plusieurs niveaux. Afin d’évaluer et mieux comprendre la compétence, cette thèse présente trois objectifs : 1) décrire le degré de maitrise des TIC et leurs usages dans les salles de classe 2) identifier les facteurs qui influencent l’intégration des TIC en fonction de la compétence professionnelle, et finalement 3) décrire le niveau d’atteinte des composantes de la compétence. Pour atteindre les objectifs de l’étude, une méthodologie mixte fut employée. Ce sont 2065 futurs enseignants du Québec provenant de neuf universités québécoises qui ont complété le questionnaire en plus de 34 participants à des groupes de discussion (n = 5). Cette thèse rédigée sous forme d’articles, répondra à chacun des objectifs visés. Dans le but de mieux comprendre l’utilisation actuelle des TIC par les futurs maitres, le premier article fournira un aperçu de la maitrise d’outils technologiques susceptibles d’être utilisés lors des stages. Le deuxième article visera à identifier les variables externes ainsi que les différentes composantes de la compétence qui ont une influence sur l’intégration des TIC lors des stages. Dans le troisième article, afin de comprendre où se situent les forces et les faiblesses des futurs maitres quant à la compétence professionnelle à intégrer les TIC, une description du niveau d’atteinte de chacune des composantes sera réalisée afin d’en dégager une appréciation globale. Les principaux résultats montrent que pour la moitié des répondants, seuls cinq outils sur 12 sont intégrés en stage et ce sont principalement les outils peu complexes qui sont bien maitrisés. Le logiciel de présentation Power Point, est le plus fréquemment utilisé. Les données considérées dans le premier article suggèrent aussi l’importance d’augmenter, de façon générale, la maitrise technique des futurs enseignants. Les résultats du second article ont permis de constater que la « prévision d’activités faisant appel aux TIC » est une variable prédictive majeure pour l’intégration des TIC. L’analyse des résultats suggèrent le besoin d’enseigner aux futurs maitres comment développer le réflexe d’inclure les TIC dans leurs plans de leçons. De plus, l’appropriation de la sixième composante de la compétence joue un rôle important sur la probabilité d’intégrer les TIC. Les résultats du troisième article indiquent que les composantes 2, 4, 5 et 6 de la compétence sont partiellement maitrisées. La mieux maitrisée est la première composante. Finalement, la troisième composante de la compétence s’est avérée être encore non atteinte et reste à être développer par les futurs enseignants. Cette thèse nous apprend que des efforts considérables restent encore à accomplir quant à la maitrise de la compétence professionnelle à intégrer les TIC. Ces efforts doivent être accomplis à la fois par les futurs enseignants ainsi que par les universités au niveau de la structure des cours de TIC en formation initiale des maitres.

Este tese analise as implicações dos investimentos em tecnologia de informação e comunicação (ICT) em países ainda em desenvolvimento, especialmente em termos de educação, para estimular a implementação de uma infra-estrutura mais moderna em vez da continuação do uso de métodos tradicionais. Hoje, como o interesse e os investimentos em ICT estão crescendo rapidamente, os módulos e as idéias que existem para medir o estado de ICT são velhos e inexatos, e não podem ser aplicados às culturas de países em desenvolvimento. Políticos e investidores têm que considerar estes problemas quando estão pensando em investimentos ou socorros para programas em ICT no futuro, e investigadores e professores precisam entender os fatores importantes no desenvolvimento para os ICTs e a educação antes de começar estudos nestes países. Este tese conclue que investimentos em tecnologias móbeis e sem fios ajudarem organizações e governos ultrapassar a infra-estrutura tradicional, estreitando a divisão digital e dando o resulto de educação melhor, alfabetização maior, e soluções sustentáveis pelo desenvolvimento nas comunidades pobres no mundo de países em desenvolvimento.

In Europe, Cardiovascular Diseases (CVD) are the leading source of death, causing 45% of all deceases. Besides, Heart Failure, the paradigm of CVD, mainly affects people older than 65. In the current aging society, the European MyHeart Project was created, whose mission is to empower citizens to fight CVD by leading a preventive lifestyle and being able to be diagnosed at an early stage. This paper presents the development of a Heart Failure Management System, based on daily monitoring of Vital Body Signals, with wearable and mobile technologies, for the continuous assessment of this chronic disease. The System makes use of the latest technologies for monitoring heart condition, both with wearable garments (e.g. for measuring ECG and Respiration); and portable devices (such as Weight Scale and Blood Pressure Cuff) both with Bluetooth capabilities

Increasing the maturity in Project Management (PM) has become a goal for many organizations, leading them to adopt maturity models to assess the current state of its PM practices and compare them with the best practices in the industry where the organization is inserted. One of the main PM maturity models is the Organizational Project Management Maturity Model (OPM3®), developed by the Project Management Institute. This paper presents the Information Systems and Technologies organizations outcome analysis, of the assesses made by the OPM3® Portugal Project, identifying the PM processes that are “best” implemented in this particular industry and those in which it is urgent to improve. Additionally, a comparison between the different organizations’ size analyzed is presented.

Muestra cómo la aplicación de las Tecnologías de la Información y de la Comunicación (TIC) mejoran la enseñanza y el aprendizaje de la lengua inglesa, enriquecen las habilidades de los alumnos e, introducen nuevos métodos educativos. Los estudios de varios colaboradores de Europa, Australia y América del Norte, consideran que tanto la utilización del material audiovisual tradicional: videos, películas, cintas de audio, cómo la de recursos más recientes: juegos de ordenador, recursos en línea, son materiales valiosos para la práctica educativa.
