A Política Educacional de Inclusão constituiu-se no objeto de investigação, tendo como recorte histórico os marcos legais e as ações desencadeadas pelo poder público, que visavam garantir aos portadores de necessidades especais o direito constitucional à educação, a partir dos anos 1990. A Constituição Federal de 1988 assevera o atendimento educacional especializado aos portadores de deficiência, preferencialmente na rede regular de ensino (art. 208, III) e, posteriormente, a LDBEN 9.394/96, por meio do art. 3o, inciso I e do art. 4 o inciso III e do CAPÍTULO V Da Educação Especial (com três artigos) ratificou e disciplinou os dispositivos constitucionais. Além desses documentos basilares, foram editadas outras medidas legais com o objetivo de disciplinar a questão, além de programas e ações propostas pela Secretaria de Educação Continuada, Alfabetização, Diversidade e Inclusão (SECADI), que substituiu, a partir de 2004, a Secretaria de Educação Especial (SEESP). Os sistemas de ensino, em âmbito estadual e municipal, também procuraram disciplinar a questão da inclusão na rede regular de ensino dos portadores de necessidades educacionais especiais. Partindo dessa constatação inicial, uma questão passou a nortear o trabalho: quais as medidas, ações e programas desencadeados pelo poder público municipal para o cumprimento dos preceitos expressos na CF/88, na LDBEN 9.394/96 e na legislação correlata? O objetivo geral desta pesquisa foi analisar as atuais políticas públicas de inclusão dos alunos com necessidades especiais na rede regular de ensino, verificando junto ao sistema municipal de educação de Rio Claro/SP quais medidas, ações e programas que foram desencadeados a partir da década de 1990. Although physical education is regulated by law and recognized as a mandatory component of basic education class, which includes high school, there are many reports that these classes do not actually happen. Such evidence shows the situation experienced by the author of this study, which brought this research to the attention. Therefore, the objective was to investigate and understand the perspective of students, physical education teachers, principals and coordinators forward their ideas to this reality, about the high school physical education in private schools. The research made use of qualitative approach, guided by an exploratory study. The technique was undertaken to collect the questionnaire with open and closed questions, involving 263 students enrolled in high school of four schools in two cities in the state of Sao Paulo and also the director, coordinator and professor of physical education of each one of these institutions, resulting in 12 education professionals. The categories of analysis were defined as: 1. Regarding physical education in high school, 2. The occurrence of physical rducation in high school, 3. Content and dynamic strategies developed in class 4. Student participation in class. The results show that despite, although some schools have physical education classes, there are still many students who do not take them. This reveals a double challenge to the area, which is: although it is essential that such a curriculum component is included in the grades (respecting the regional law legal system) that is not enough students that actually participate in it. As teachers, coordinators and directors recognize the importance of effective physical education, there are numerous of factors that deserve consideration to better understand this reality. This thesis investigates the historical influence of the criminal policy in the context that shapes the first specific law for children and adolescents in Brazil, the 1927 Children's Code, a standard that inaugurates the conceptual scission between children and "minor" and their different treatment by the State. The study addresses the demand for order in the context of changes in the working world in the transition from the slave system to the capitalist mode of production, and the corresponding disciplinary and punitive control mechanisms directed to the segment of childhood and adolescence. The theoretical route proposes a questioning of the political construction of law and justice, as well as the conformation of the punitive techniques, and the construction of the stereotype of the "delinquent", prime target of the criminal policy, focusing on the process of criminalization of the segment in question through the confrontation of the Critical perspective with the approaches of Classical and Positive schools. This research shows the imposition of a bourgeois morality that obscures the social conflict attributing it to people isolated by the criminalization of their conduct; and points out that the historical forms of selective social control were greatly influenced by psychiatry and psychology, either by the elaboration of the image of the "delinquent" or by the expected performance of custodial institutions. Finally, the developments and the permanence of the historical roots of the criminal policy are problematized, relating them to the difficulties currently encountered in the consolidation of the legal garantism paradigm proposed by the Children and Adolescent Statute.

This study has as object eight state vocational schools located in Araguari, Araxá, Frutal, Ituiutaba, Monte Carmelo, Patos de Minas, Uberaba and Uberlândia, in Minas Gerais. The period analyzed comprises the years from 1965 to 1976, from the signature of the Agreement 512-11-610-042 beteween the Ministry of Education and Culture (MEC) and the American Agency for International Development (USAID), which started a series of other agreements, and actions ending up with the creation of the Expansion and Improvement of High Schools Program (Programa de Expansão e Melhoria do Ensino Médio - PREMEM) and, from this, the Vocational Schools. The upper limit of the study, 1976, was the year when these agreements, known as MEC/USAID agreements ceased. The Vocational Schools were characterized as vocation probing schools, directing the professional formation of the population in general, which would happen a posteriori, turning it shorter and more effective, since the labor market would demand, urgently, capable professionals for an expanding economy. The project of Vocational Schools had a national scope, and foresaw, for its unfolding, the complete substitution of State Schools for the new model, called “multi-curricula”. The theme Vocational schools was the object of my Master’s degree study, when I focused the State School Guiomar de Freitas Costa, in Uberlândia. That study raised questionings and concerns that resulted in the central problem of the thesis presented here: understanding the measure in which such schools integrated the country’s development project – mostly in the first half of the military rule – and to understand its structure, functionality and efficacyThe development of the study presented here, demanded the use of several sources: 1) specialized literature about the topics presented, i.e., the situation of national education in a temporal analysis, the political, economical and social context, research methodologies, the theory of human capital, vocational teaching, pedagogical trends and practices, agreements MEC-USAID and PREMEM; 2) national, state and county laws related to the discussion: laws of national education directives and basis, decrees and reports stating about the program of technical cooperation between Brazil and the United States of America, the Program of Expansion and Improvement of Teaching (PREMEM), formation of professors, establishment of Vocational Schools and educational planning; 3) documentation of school archives: books of minutes of Collegiate and of faculty and staff, registrar books with final scores, enrolment, visits of inspector, accounting books, punch clock records, student, professor and staff occurrences, inventory, class schedules, school year calendar, school rules, class reports, payment rolls, bills of sales, exchanged mail, personal documentation of professional personnel, documents of land acquisition, blueprints, manuals of PREMEM, didactic materials/resources used in classes, books available in the school library, structured evaluations for follow-up of school processes, pictures of events, texts prepared for special dates, and news from the official newspaper and, finally, 4) national and local press reports, especially from Folha de São Paulo, Correio de Araxá, Correio de Uberlândia and Lavoura e Comércio (Uberaba). The proposition of Vocational schools was conciliate theoretical and practical formation through an active education permeated by technological resources. The contact with knowledge and several practical activities under professional supervision, the student would identify the knowledge area that would interest him the most and his aptitude. This formation in primary school would make way for the vocation studies in high school, which became mandatory by the law 5.692/71, that reformed school education from the previous levels of elementary, middle high and high school. However, the multi-curricula proposal that would be spread to the other public schools in the country ended up succumbing to the model already established. From its ephemeral existence, maybe the Vocational Schools have not reached the more general goals in political, economic and social aspects; however, this study demonstrated that, for the people that, directly or indirectly, had contact with such schools, a legacy of vocational and quality teaching was made, so much so, that forty years after the end of that proposal, they are still remembered.

The democratic management is a challenge for education, on the one hand for its actualization needs a link between the government and the educational institution. From that, research aims to understand the main challenges faced by the school administration to consolidate the management of public schools in Natal/RN. Against this context the methodology used was multiple cases, qualitative approach in which respondent were manager (director, deputy director and coordinator) of the four municipal schools and two representatives of the Democratic Management Commission of a Government departament of Education, Natal/RN. The analysis was made by peers, between schools that had grade superior IDEB that average stipulated by the federal government and two that had grade lower and between managers and representatives of the Secretary. Were used techniques of categorization and content analysis of the speeches of respondents. Was note that managers understand the importance of the participation about whole community in the democratic management, however only one school highlighted means of attracting the parents against to the difficulty of representing these. The lack of knowledge about the democratic management is evident mainly in the pair of schools with lower IDEB. That schools with a lower IDEB adhere to this management as a way to meet rules. So unanimous, the broad role of director hampers knowledge about the legislation. About relationship of the Government department with managers, there are some contradictions between the understanding of the role of the coordinator by managers and representatives of the Government department. It was perceptible the no uniformity about a good relationship between managers and Government department. It was notable features of democratic management in all school units, well as the efforts of the Government department in this scope. However there are also undemocratic features that deserve further study

Este trabalho teve como foco a presença da área de conhecimento música no curso Normal de duas escolas públicas do município de Pelotas/RS: O Instituto Estadual de Educação Assis Brasil e o Colégio Municipal Pelotense. Considerando que esta modalidade formativa habilita professores para o trabalho na educação infantil e anos iniciais do ensino fundamental, investigamos a educação musical que está sendo desenvolvida no curso Normal e em que concepções se apoia esta prática. Após seis anos de vigência da Lei 11.769/2008, que alterou o artigo 26 da Lei de Diretrizes e Bases de 1996 e incluiu a obrigatoriedade do ensino dos conteúdos de música dentro do componente curricular Arte, esta pesquisa compreendeu o processo de adaptação dos currículos escolares, as discussões em torno da atual legislação e as orientações por parte das mantenedoras, tendo em vista a referida Lei. Outra questão presente nesta pesquisa, refere-se à identificação do profissional responsável por trabalhar os conteúdos de música, já que a Lei 11.769/2008 excluiu, por meio de veto presidencial, o artigo que solicitava formação específica na área. Após o período do canto orfeônico no Brasil, as Leis de Diretrizes e Bases de 1961 e 1971, respectivamente, não ratificaram esta área de forma permanente nos currículos escolares. Em 1996, uma nova LDB, suscitaria novas esperanças aos professores de música e aos pesquisadores da área, no entanto, esta legislação não atendeu as expectativas dos profissionais ligados à música, permanecendo a educação musical ausente em muitos contextos educativos. A partir da Lei 11.769/2008, esta pesquisa objetivou identificar se a efetiva inclusão dos conteúdos de música na disciplina de Arte se concretizou, já que a LDB de 1996 não clarificou quais as áreas deveriam ser contempladas dentro deste componente curricular. Além desses aspectos, esta pesquisa também problematizou a atual situação do ensino de música no contexto geral das escolas estaduais e das instituições municipais de Pelotas/RS.

Incluir alunos com necessidades educativas especiais em turmas e escolas de ensino regular é um assunto pertinente e de uma atualidade relevante. O presente estudo teve como consequência uma preocupação pessoal e profissional relativa à inclusão de alunos com necessidades educativas especiais no ensino regular, considerando a seguinte questão: o ensino regular está preparado para aceitar a inclusão dos alunos com T21? Esta problemática da inclusão de alunos com necessidades educativas, nas escolas regulares, é um teste às escolas, aos seus recursos humanos e materiais. A exigência de incluir alunos “diferentes” nas turmas e escolas, leva-nos a refletir se as mesmas, neste início de século, estão ou não preparadas para receber este tipo de alunos. Se os professores têm formação adequada para acompanhar, criar planos de desenvolvimento, tirar partido das suas capacidades e se estão preparados para dar respostas a esta heterogeneidade nas suas salas de aula? Neste trabalho pretendemos também saber que estratégias de inclusão existem para estes alunos. Pretende-se saber se a metodologia usada, pelos profissionais da educação, é eficaz e se impulsiona na superação das dificuldades apresentadas. Se a legislação protege estes alunos e promove a igualdade de oportunidade no acesso e sucesso à educação e à cultura.
