O objetivo desta dissertação foi o estudo do instituto da desconsideração da personalidade jurídica, em sua modalidade inversa, e sua aplicabilidade no direito de família e sucessões, principalmente na partilha de bens - efetivada no divórcio ou dissolução de união estável -, na execução de alimentos e na sucessão legítima. A escolha do tema decorreu da necessidade do estabelecimento de pressupostos e requisitos objetivos para a aplicação da disregard na seara do direito de família e sucessões. A utilidade e adequação da abordagem da matéria se justifica pela instabilidade jurídica provocada pela acriteriosa aplicação da desconsideração da personalidade jurídica nas relações familiares. Por outro lado, o enfoque crítico desenvolvido no presente trabalho se justifica pela existência de corrente doutrinária que defende a aplicação da desconsideração em inúmeras situações familiares nas quais outros remédios, já seculares, de direito material ou processual seriam igualmente eficazes, sem que fosse necessária a drástica declaração de ineficácia da separação patrimonial entre a pessoa jurídica e seu sócio. Buscou-se apontar, desta forma, os meios existentes para se alcançar o mesmo resultado prático apresentado pela disregard, mas com a utilização de outras figuras, tais como a simulação, a fraude contra credores e a fraude à execução, ficando, por via de consequência, a aplicação da desconsideração da personalidade jurídica, restrita às hipóteses em que não há quaisquer outros meios para se evitar ou buscar a reparação dos prejuízos advindos da utilização das pessoas jurídicas com abuso da personalidade jurídica, desvio de finalidade ou confusão patrimonial.

The recent House of Lords decision in Quintavalle v Human Fertilisation and Embryology Authority has raised difficult and complex issues regarding the extent to which embryo selection and reproductive technology can be used as a means of rectifying genetic disorders and treating critically ill children. This comment outlines the facts of Quintavalle and explores how the House of Lords approached the legal, ethical and policy issues that arose out of the Human Fertilisation and Embryology Authority's (UK) decision to allow reproductive and embryo technology to be used to produce a 'saviour sibling' whose tissue could be used to save the life of a critically ill child. Particular attention will be given to the implications of the decision in Quintavalle for Australian family and medical law and policy. As part of this focus, the comment explores the current Australian legislative and policy framework regarding the use of genetic and reproductive technology as a mechanism through which to assist critically ill siblings. It is argued that the present Australian framework would appear to impose significant limits on the medical uses of genetic technology and, in this context, would seem to reflect many of the principles that were articulated by the House of Lords in Quintavalle.

Com a pesquisa exegética realizada na perícope de Deuteronômio 26,1-11, esta dissertação busca entendê-la, a partir de sua perspectiva social, ao procurar mostrar que esta perícope é uma confissão memorial dos atos redentores, vistos na saída do povo do Egito. Este memorial está entrelaçado com o Deus redentor bem como com a terra doada por este Deus ao seu povo, como meio de expressar sua completa liberdade para dirigir seu destino, em celebração ao Deus redentor. Dentro desta perspectiva social está também que os atos redentores de Javé deveriam resultar em atos sociais de seu povo redimido para com aqueles que eram desfavorecidos dentro da sociedade israelita. A perícope em estudo aponta para dois grupos de desfavorecidos o levita e o estrangeiro.

International migration sets in motion a range of significant transnational processes that connect countries and people. How migration interacts with development and how policies might promote and enhance such interactions have, since the turn of the millennium, gained attention on the international agenda. The recognition that transnational practices connect migrants and their families across sending and receiving societies forms part of this debate. The ways in which policy debate employs and understands transnational family ties nevertheless remain underexplored. This article sets out to discern the understandings of the family in two (often intermingled) debates concerned with transnational interactions: The largely state and policydriven discourse on the potential benefits of migration on economic development, and the largely academic transnational family literature focusing on issues of care and the micro-politics of gender and generation. Emphasizing the relation between diverse migration-development dynamics and specific family positions, we ask whether an analytical point of departure in respective transnational motherhood, fatherhood or childhood is linked to emphasizing certain outcomes. We conclude by sketching important strands of inclusions and exclusions of family matters in policy discourse and suggest ways to better integrate a transnational family perspective in global migration-development policy.

El presente artículo se centra en la evolución de uno de los principales linajes judeoconversos del reino de Córdoba en la época Moderna, el de los Ramírez. Naturales de Espejo, pronto encontraron en Lucena, la capital del marquesado de Comares, el lugar perfecto para ocultar su pasado y ennoblecerse al lado de su señor. Son protagonistas de este estudio su estrecha relación con el marqués, su deseo de fabricar una nueva memoria familiar, y las estrategias matrimoniales y económicas que les permitieron convertirse en uno de los grupos más poderosos de la oligarquía de Lucena y en uno de los ejemplos paradigmáticos de integración de cristianos nuevos en el territorio andaluz.

A substantial number of Australian children are now living in separated families, with many moving between their parents’ homes. This has led to educators being confronted with an increasing number of family law issues. This article discusses the key aspects of family law that involve children. It highlights the need for schools to be aware of all family law orders that relate to children in their care, including family court, domestic violence and child protection orders. It also provides guidance in relation to how schools can adopt child focused approaches in some common scenarios, where parents are in dispute. In particular, we will recommend that educators take a child-focused approach, consistent with the principal provision of the Family Law Act 1975 (Cth) that ‘the best interests of the child’ be the paramount consideration. We will highlight how this contrasts starkly with what can be described as a ‘parental rights’ interpretation, which has unfortunately been taken by some since the 2006 amendments to the Family Law Act, and is, in our view, directly at odds with the intention of the legislation.

Analogy plays a central role in legal reasoning, yet how to analogize is poorly taught and poorly practiced. We all recognize when legal analogies are being made: when a law professor suggests a difficult hypothetical in class and a student tentatively guesses at the answer based on the cases she read the night before, when an attorney advises a client to settle because a previous case goes against him, or when a judge adopts one precedent over another on the basis that it better fits the present case. However, when it comes to explaining why certain analogies are compelling, persuasive, or better than the alternative, lawyers usually draw a blank. The purpose of this article is to provide a simple model that can be used to teach and to learn how analogy actually works, and what makes one analogy superior to a competing analogy. The model is drawn from a number of theories of analogy making in cognitive science. Cognitive science is the “long-term enterprise to understand the mind scientifically.” The field studies the mechanisms that are involved in cognitive processes like thinking, memory, learning, and recall; and one of its main foci has been on how people construct analogies. The lessons from cognitive science theories of analogy can be applied to legal analogies to give students and lawyers a better understanding of this fundamental process in legal reasoning.

We studied the statistical distribution of student's performance, which is measured through their marks, in university entrance examination (Vestibular) of UNESP (Universidade Estadual Paulista) with respect to (i) period of study - day versus night period (ii) teaching conditions - private versus public school (iii) economical conditions - high versus low family income. We observed long ubiquitous power law tails in physical and biological sciences in all cases. The mean value increases with better study conditions followed by better teaching and economical conditions. In humanities, the distribution is close to normal distribution with very small tail. This indicates that these power law tails in science subjects axe due to the nature of the subjects themselves. Further and better study, teaching and economical conditions axe more important for physical and biological sciences in comparison to humanities at this level of study. We explain these statistical distributions through Gradually Truncated Power law distributions. We discuss the possible reason for this peculiar behavior.

The purpose of this paper is to characterize the configurations of the families that live in contexts of social exclusion; provide conceptualizations of their operation mode; highlight the formative effects that neighborhood interdisciplinary practices with such families produce in the just graduated psychologists, included on the Extension Program. We wish to contribute to produce systematic knowledge that can account for such family configurations as potential receiver of integration policies. We are also interested on transferring the approach to diversity in the training of young professionals, in order not to be regarded as a deviation from ideal models, but as an expression of different strategies built by members of a community, to resolve children breeding and to bear their existences. This work is the result about reflections on productions inside a research fellowship: The complexities that takes the breeding in families who lives in a social exclusion situation; researches about breeding, carried out from signature Developmental Psychology II, and from de interdisciplinary work with psychologically assisted families in twelve suburbs of the city of La Plata (University Extension Program "Free Legal Offices" (Convention between Law and Social Sciences and Psychology Faculties, U.N.L.P.). From a qualitative methodology and an interdisciplinary participation, the results have arrive at the characterization and proposed conceptualizations of the included families and at the same time determine the benefits that brings with the work that articulates research and extension activities for the training of advanced students and young graduates.
