Reunião da Mesa da Constituinte discute como será a votação do substitutivo da Sistematização no Plenário geral. Já existem propostas do Centrão e da Mesa. De acordo com o Senador Mauro Benevides (PMDB-CE), presidente em exercício da Assembleia Nacional Constituinte (ANC), a Mesa se encaminhará para a apresentação de outro substitutivo. Sessão solene conclui os trabalhos da Comissão de Sistematização dando por encerrada a votação do substitutivo, este encaminhado à Mesa da ANC. O Deputado Bernardo Cabral (PMDB-AM), faz considerações sobre os trabalhos da Comissão de Sistematização. O Senador Affonso Arinos (PFL-RJ) repete a frase de Benjamin Franklin: "Por haver vivido muito, fui levado a mudar de opinião várias vezes em assuntos importantes, assim aceito este projeto" e conclui declarando aceitar o projeto. O Deputado Amaury Muller (PDT-RS) afirma que embora os Constituintes façam um balanço positivo dos assuntos que foram tratados na Sistematização, reconhecendo seu trabalho, mantém-se a fé e a esperança de que os Constituintes no Plenário possam traduzir com fidelidade os compromissos que assumiram com a sociedade brasileira durante a campanha eleitoral. O Senador Mario Covas (PMDB-SP), a Deputada Sandra Martins Cavalcanti (PFL-RJ) e o Deputado Arnaldo Faria de Sá (PTB-SP) consideram que no Plenário alguns dos pontos do substitutivo serão reformados, enriquecendo o texto. O Deputado Carlos Sant'anna (PMDB-BA) ressalta a necessidade de alterações em questões formais como a língua, a estrutura e a harmonia do texto. O Deputado Luiz Inácio Lula Da Silva (PT-SP) espera que o projeto tenha melhorias no Plenário, pois a sociedade brasileira está na expectativa de que esta Constituição possa retratar sua luta nos últimos anos. O Senador Fernando Henrique Cardoso (PMDB-SP) crê que o resultado dos trabalhos será uma Constituição democrática e moderna.

This document presents the results of the first three monitoring events to track the recovery of a repaired coral reef injured by the M/V Elpis vessel grounding incident of November 11, 1989. This grounding occurred within the boundaries of what at the time was designated the Key Largo National Marine Sanctuary (NMS), now designated the Key Largo NMS Existing Management Area within the Florida Keys National Marine Sanctuary (FKNMS). Pursuant to the National Marine Sanctuaries Act (NMSA) 16 U.S.C. 1431 et seq., and the Florida Keys National Marine Sanctuary and Protection Act (FKNMSPA) of 1990, NOAA is the federal trustee for the natural and cultural resources of the FKNMS. Under Section 312 of the NMSA, NOAA has the authority to recover monetary damages for injury, destruction, or loss of Sanctuary resources, and to use the recovered monies to restore injured or lost sanctuary resources within the FKNMS. The restoration monitoring program tracks patterns of biological recovery, determines the success of restoration measures, and assesses the resiliency to environmental and anthropogenic disturbances of the site over time. To evaluate restoration success, reference habitats adjacent to the restoration site are concurrently monitored to compare the condition of restored reef areas with natural coral reef areas unimpacted by the vessel grounding. Restoration of the site was completed September 1995, and thus far three monitoring events have occurred; one in the summer of 2004, one in the summer of 2005, and the latest in the summer of 2007. The monitoring in 2004 was in the nature of a “pilot project,” or proof of concept. Only the quantitative results of the 2005 and 2007 monitoring are presented and discussed. Monitoring has consisted of assessment of the structural stability of limestone boulders used in the restoration and comparison of the coral communities on the boulders and reference areas. Corals are divided into Gorgonians, Milleporans, and Scleractinians. Coral densities at the Restored and Reference areas for the 2005 and 2007 events are compared, and it is shown that the densities of all taxa in the Restored area are greater by 2007, though not significantly so. For the Scleractinians, number and percentage of colonies by species, as well as several common biodiversity indices are provided. The greater biodiversity of the Restored area is evidenced. Also, size-class frequency distributions for Agaricia spp. (Scleractinia) are presented. These demonstrate the approaching convergence of the Restored and Reference areas in this regard. An inter-annual comparison of densities, within both areas, for all three Orders, is presented. The most noteworthy finding was the relative consistency across time for all taxa in each area. Finally, certain anomalies regarding species settlement patterns are presented. (PDF contains 48 pages.)

The monitoring has consisted of: assessment of the structural stability of restoration modules and comparison of the coral recruitment conditions of the modules and reference sites. Corals are divided into Gorgonians, Milleporans, and Scleractinians and (except where noted) recruits are defined as follows: Gorgonians—maximum size (height) 150 mm at first monitoring event, 270 mm at second; Milleporans—maximum size (height) 65 mm at first event, 125 mm at second; Scleractinians—maximum size (greatest diameter) 50 mm at second event (only one species was size-classed at first event, at smaller size). Recruit densities at the restored and reference areas for each event are compared, as are size-class frequency distributions. For the Scleractinians, number and percentage of recruits by species, as well as several common biodiversity indices are provided. Finally, a qualitative comparison of recruit substrate settlement preference is indicated. Generally, results indicate that restored areas are converging on reference areas, based on almost all parameters examined, with one noted exception. Further monitoring is planned and the trends are anticipated to continue; close attention will be paid to the indicated anomaly. (PDF contains 63 pages.)

This grounding occurred in Florida state waters within the boundaries of the Florida Keys National Marine Sanctuary (FKNMS). The National Oceanic and Atmospheric Administration (NOAA) and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida, (“State of Florida” or “state”) are the co-trustees for the natural resources within the FKNMS and, thus, are responsible for mediating the restoration of the damaged marine resources and monitoring the outcome of the restoration actions. The restoration monitoring program tracks patterns of biological recovery, determines the success of restoration measures, and assesses the resiliency to environmental and anthropogenic disturbances of the site over time. The monitoring program at the Connected site was to have included an assessment of the structural stability of installed restoration modules and biological condition of reattached corals performed on the following schedule: immediately (i.e., baseline), 1, 3, and 6 years after restoration and following a catastrophic event. Restoration of this site was completed on July 20, 2001. Due to unavoidable delays in the settlement of the case, the “baseline” monitoring event for this site occurred in July 2004. The catastrophic monitoring event occurred on August 31, 2004, some 2 ½ weeks after the passage of Hurricane Charley which passed nearby, almost directly over the Dry Tortugas. In September 2005, the year one monitoring event occurred shortly after the passage of Hurricane Katrina, some 70 km to the NW. This report presents the results of all three monitoring events. This document presents the results of baseline monitoring of a repaired coral reef injured by the M/V Wave Walker vessel grounding incident of January 19, 2001. This grounding occurred in Florida state waters within the boundaries of the Florida Keys National Marine Sanctuary (FKNMS). The National Oceanic and Atmospheric Administration (NOAA) and the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida, (“State of Florida” or “state”) are the co-trustees for the natural resources within the FKNMS. This report documents the efficacy of the restoration effort, the condition of the restored reef area two year and four months post-effort, and provides a picture of surrounding reference areas, so as to provide a basis for future comparisons by which to evaluate the long-term success of the restoration. ENGLISH: This is a data report based on information collected from the logbooks of baitboats and purse-seiners engaged in the fishery for yellowfin (Neothunnus macropterus) and skipjack (Katsulvonus pelamis) tuna in the Eastern Tropical Pacific Ocean from 1951 through 1958. The detailed analysis of these data appears in other research bulletins, some already published and others in preparation. SPANISH: Este es un informe basado en los datos contenidos en la información recogida de los registros de bitácora de los barcos de carnada y rederos que se dedicaron a la pesca de atún aleta amarilla (Neothunnus macropterus) y barrilete (Katsuwonus pelamis) en el Océano Pacífico Oriental Tropical de 1951 a 1958. El análisis detallado de estos datos aparece en otros boletines de investigación, algunos de los cuales ya han sido publicados y otros están en preparación.

ENGLISH: Knowledge of the kinds of organisms eaten by tunas, and the relative importance of different kinds of organisms in different situations, is of importance to our understanding of regional and local aggregations and of the behavior of the tropical tunas. Determination of the relative importance of benthic forms in the stomachs of tunas captured in the vicinity of islands and offshore banks, compared with the forms found in the stomachs of those from oceanic areas, distant from these shoal areas, is useful to the understanding of the mechanisms by which the islands and banks attract tuna. A thorough knowledge of the diet may also reveal more about the seasonal and annual variations in the distribution of these fish along the coasts of Mexico, Central America and elsewhere. A knowledge of the diet of the tunas is basic to quantitative studies of the zooplankton and nekton in the Eastern Pacific Ocean with reference to the production of tunas. Studies of the diet of the tropical tunas by examination of stomach contents was, therefore, commenced in late 1957. SPANISH: El conocimiento de las clases de organismos de que se alimentan los atunes, y la importancia relativa de las diferentes clases de organismos en situaciones diferentes, es de valor para nuestra comprensión de las agrupaciones regionales y locales, y de los hábitos de los atunes tropicales. La determinación de la importancia relativa de las formas bénticas en los estómagos de los atunes capturados en la vecindad de las islas y de los bancos apartados de la costa, comparadas con las formas encontradas en los estómagos de los atunes procedentes de áreas oceánicas, distantes de estas áreas poco profundas, es útil para comprender el mecanismo por el cual las islas y los bancos atraen al atún. Un conocimiento completo de la dieta puede revelar también algo más acerca de las variaciones estacionales y anuales en la distribución de estos peces a lo largo de las costas de México, América Central y otras partes. El conocimiento de la dieta del atún es básico para los estudios cuantitativos del zooplancton y del necton en el Océano Pacífico Oriental, con referencia a la producción de los atunes. El estudio de la dieta de los atunes tropicales mediante el examen del contenido estomacal, fué comenzado, por lo tanto, a fines de 1957.

Se basa enteramente en la información recoleetada ,de los diarios de pesca de los barcos rederos y de carnada, que se ocupande la pesquería del atún aleta amarilla (Thunnus albacares) y del barrilete (Katsuwonus pelamis) en el Pacífico Oriental, desde 1959 a 1962.

ENGLISH: Most of the catches of yellowfin and skipjack tuna from the Eastern Pacific Ocean are made by vessels fishing with poles and lines and live bait. From 1931 to 1954, these baitboats, on the average, accounted for over three-fourths of the total annual California landings of yellowfin and skipjack (Shimada and Schaefer, 1956). With the substantial increase in recent years in the production of the tropical tunas, there have been greater demands for live bait. This increased need for larger amounts of baitfishes has given rise to important questions relating to the manner in which these populations may be most wisely used. The Inter-American Tropical Tuna Commission has been concerned with various aspects of this problem since its establishment in 1950. This report presents some of the results obtained from the Commission's studies of the baitfishes important to the fishery for yellowfin and skipjack tuna. It traces briefly the origin and development of the bait fishery, describes its operations, extent, and yield, and discusses some aspects of the effects of exploitation upon the Eastern Pacific baitfish populations, particularly of the anchoveta (Cetengaulis mysticetus). SPANISH: Los barcos que emplean cañas y cuerdas y carnada viva, son los que realizan la mayor parte de la pesca de atún aleta amarilla y barrilete en el Océano Pacifíco Oriental. De 1931 a 1954 estos barcos han desembarcado, en promedio, más de las tres cuartas partes de las pescas anuales de ambas especies (Shimada y Schaefer, 1956). Con el aumento sustancial en dicha producción en los últimos años, ha habido una mayor demanda por carnada viva. Esta creciente necesidad de obtener cantidades mayores de pecescebo, ha originado importantes cuestiones relativas a la mejor forma en que estas poblaciones pueden ser utilizadas. A la Comisión Interamericana del Atún Tropical le ha tocado ocuparse de varios aspectos de este problema, desde que fué establecida en el año 1950. Este informe ofrece algunos de los resultados obtenidos a través de los estudios de la Comisión sobre los peces-cebo importantes para la pesquería de atún aleta amarilla y barrilete; señala brevemente el origen y desarrollo de la pesquería de carnada; describe sus operaciones, extensión y rendimiento, y trata algunos aspectos de los efectos de la explotación sobre las poblaciones de dichos peces en el Pacifíco Oriental, particularmente de la anchoveta (Cetengraulis mysticetus). ENGLISH: In a previous Commission Bulletin, Shimada (1957) has described the geographical distribution of the yearly catches of yellowfin tuna (Neothunnus macropterus) and skipjack (Katsuwonus pelamis) from the Eastern Pacific Ocean for the period 1952 to 1955 inclusive, based on information obtained from logbook records of baitboats and purse-seiners. In view of the seasonal nature of the fishery in different areas, a summary of the catches by smaller time units may be of additional value. Accordingly, statistical data employed earlier by Shimada have been retabulated by quarters of the year and form the basis of the present report. SPANISH: En un Boletín anterior de la Comisión, Shimada (1957) hizo un estudio sobre la distribución geográfica de las pescas anuales de atún aleta amarilla (Neothunnus macropterus) y barrilete (Katsuwonus pelamis) del Océano Pacifico Oriental, en el perlado comprendido por los años 1952 a 1955 inclusive. Dicho estudio fué hecho sobre la base de la información obtenida en los registros de las bitácoras de los barcos carnaderos y rederos. Pero en vista de la naturaleza que imprimen las estaciones a la pesquería en las diferentes áreas se ha considerado que podría tener valor complementario un resumen de las pescas en unidades de tiempo menores. De acuerdo con este criterio, los datos estadísticos empleados antes por Shimada, se han tabulado de nuevo ahora, por trimestres, y constituyen siempre la base del presente informe. ENGLISH: Since its inception in 1950 by agreement between the Republic of Costa Rica and the United States of America, the Inter-American Tropical Tuna Commission has been engaged in studies of the biology, ecology and population dynamics of yellowfin tuna in the eastern Pacific Ocean. Prime consideration has been given to the evaluation of the effects of fishing pressure on the yellowfin tuna in this area in order to estimate the maximum sustainable yield. A portion of the eastern Pacific has been defined by the Inter-American Tropical Tuna Commission (1963) as a regulatory area for yellowfin tuna (Figure 1). SPANISH: Desde su incepción en 1950, por un acuerdo entre la República de Costa Rica y los Estados Unidos de América, la Comisión Interamericana del Atún Tropical ha estado ocupada en los estudios de la biología, ecología y dinámica de las poblaciones del atún aleta amarilla en el Océano Pacífico Oriental. Se consideró primariamente la evaluación de los efectos de la presión de la pesquería sobre el atún aleta amarilla en esta área, para poder estimar el rendimiento máximo sostenible.
