Law's Ethical, Global and Theoretical Contexts examines William Twining's principal contributions to law and jurisprudence in the context of three issues which will receive significant scholarly attention over the coming decades. Part I explores human rights, including torture, the role of evidence in human rights cases, the emerging discourse on 'traditional values', the relevance of 'Southern voices' to human rights debates, and the relationship between human rights and peace agreements. Part II assesses the impact of globalization through the lenses of sociology and comparative constitutionalism, and features an analysis of the development of pluralistic ideas of law in the context of privatization. Finally, Part III addresses issues of legal theory, including whether global legal pluralism needs a concept of law, the importance of context in legal interpretation, the effect of increasing digitalization on legal theory, and the utility of feminist and postmodern approaches to globalization and legal theory.

This chapter explores whether ethical cultures can be created within a financial market context. Ongoing regulatory and legal actions, and press coverage of these, suggest that a definition of ethical problems in terms of ‘rogue traders’ and ‘bad apples’ would be inadequate, since entire business areas have been resorting to collusive illegal behaviour. The concept of ‘bad barrels’ seems to capture the situation rather better: the culture of firms fails to discourage transgression and indeed supports it. Unpacking the links between regulatory objectives and the cultural settings of firms and their employees, this chapter questions the chances of success of measures such as enhanced controls on individuals and restructured reward mechanisms. Financial firms typically have very flat, nodal structures, within which traders conceptualise themselves as an elite, in contrast to back office staff and also in contrast to managers. Traders’ functions and their occupational mobility mean that their linkages and attachments may be much stronger with others outside ‘their’ firm than their firm and those within it. Performance, camaraderie and their linkages are important in all work situations, yet all the more so for traders in financial markets. Thus, whether regulators and senior management combine to send a clear and consistent message to traders – or whether the logic of the financial marketplace leads some firms to continue send conflicting or ambivalent messages to them – misconduct is likely to continue to be a tough nut to crack.

This article outlines the case for peace and conflict researchers to formulate a research covenant to better shape their ethical obligations and responsibilities. This is an urgent necessity given that ethical debates have in some proponents become emotive and are not conducted in an ethical manner. In coming to this assessment, the article reviews trends in the research ethics literature and draws out some of the generic issues addressed in a review of the personal reflexivity that an assortment of individual peace and conflict researchers have engaged in when recounting their fieldwork experiences. These generic issues are reformulated in an attempt to codify appropriate ethical practice in peace and conflict research, and they go towards determining the contents of the research covenant. It is suggested that the research covenant is a more ethical way to debate the ethics of peace and conflict research.

Situado entre o discurso investigativo e o profissional da Didática de Línguas, o presente estudo assenta: num entendimento da educação em línguas como um processo valorizador da diversidade linguística e cultural, tendo como fim último a promoção da intercompreensão e do diálogo intercultural, dentro dos pressupostos de uma didática das línguas e do plurilinguismo; na conceção do professor de línguas como um dos principais atores na educação de cidadãos / comunicadores interculturais, vendo-se, portanto, a braços com novas exigências, para as quais, muitas vezes, não se sente preparado; e nos pressupostos de que a identidade profissional condiciona fortemente a forma como o professor desempenha a sua ação didática, sendo este processo de se tornar professor contínuo e dependente, quer do sujeito-professor e dos seus percursos profissionais e formativos, quer do contexto (profissional, local, nacional, global) em que este se insere. Pretende-se, com este estudo, contribuir para que a educação intercultural seja uma realidade nas nossas escolas, potenciando a sua migração contextualizada dos documentos orientadores das políticas linguísticas e educativas nacionais e transnacionais e dos discursos da investigação em Didática de Línguas. Para o efeito, desenvolvemos um programa de investigação/formação denominado O Professor Intercultural, durante o ano letivo 2006/2007, com professores de línguas (materna e estrangeiras) de três escolas básicas e secundárias do distrito de Aveiro. Este programa integrava um curso (25 horas) e uma oficina (50 horas), ambas as ações de formação acreditadas pelo Conselho Científico-Pedagógico da Formação Contínua. Do ponto de vista formativo, com este programa pretendíamos levar as professoras em formação a desenvolver competências pessoais e profissionais que lhes permitissem gerir a diversidade nos seus contextos profissionais, tendo em vista o desenvolvimento nos seus alunos de uma competência de comunicação intercultural (CCI). Do ponto de vista investigativo, não só pretendíamos compreender as representações dos sujeitos relativamente à educação intercultural em geral e à CCI em particular; como também identificar princípios e estratégias de formação potenciadores do desenvolvimento de competências profissionais docentes para trabalhar a CCI, a partir das perspetivas dos próprios sujeitos. Trata-se, portanto, de um estudo de caso de cariz qualitativo e interpretativo / fenomenológico, com potencialidades heurísticas, que pretende evidenciar os sujeitos, as suas representações, as interações consigo e com os outros e a forma como conceptualizam a identidade profissional docente e as suas dinâmicas de desenvolvimento. Como instrumentos de recolha de dados, privilegiámos os Portefólios Profissionais que foram sendo construídos ao longo do percurso de formação; a sessão “Entre Línguas e Culturas” da plataforma Galanet (www.galanet.eu), recurso de formação no âmbito da oficina (entre fevereiro e maio de 2007); o “Diário do Investigador”; e as “entrevistas narrativas e de confrontação” efetuadas sensivelmente um ano após o final do programa de investigação/formação. Os resultados da análise de conteúdo revelam que os sujeitos consideram a CCI uma competência multidimensional e complexa, reconhecendo três componentes: afetiva (domínio do saber ser e saber viver com o outro), cognitiva (domínio do saber) e praxeológica (domínio do saber-fazer). A componente afetiva constitui, de acordo com os resultados, o motor de arranque do desenvolvimento desta competência, que, posteriormente, é alargada em dinâmicas de informação-(inter)ação-reflexão. Por outro lado, dada a grande pertinência que atribuem à abordagem intercultural e à urgência com que veem a sua integração escolar, os sujeitos consideram a CCI uma das competências inerentes à competência profissional docente, elemento integrador da identidade profissional, numa forte ligação com a missão ética e política que cada vez mais é associada ao docente (de línguas). Para além disso, percecionam o seu desenvolvimento profissional docente como um processo que os acompanha ao longo da vida, fruto das idiossincrasias e predisposições do próprio indivíduo, mas também das dinâmicas da sua formação, das caraterísticas dos contextos em que se movimenta e da colaboração com o Outro, no seu espaço profissional ou fora dele. Importa salientar que este desenvolvimento profissional é potenciado, segundo os nossos resultados, por propostas de formação assentes numa abordagem acional e reflexiva, articulando dinâmicas investigação-ação-reflexão como as propostas no nosso programa de formação, nomeadamente no âmbito da oficina. Neste quadro, concluímos o presente estudo, indicando alguns caminhos possíveis para a formação de professores de línguas para a educação intercultural.

A series of five articles, published over six months in 2010, which explained the key ethical issues relating to sourcing gold. The Ethical Gold Series was written for practising jewellers, industrial jewellery manufacturers and the wider design community. The Ethical Gold Series was published in the Benchpeg Newsletter, an online jewellery industry journal, which in 2010 had over 5,500 subscribers. The material for the articles was drawn from a year of ethnographic fieldwork in the UK jewellery sector, funded by the AHRC, and field visits to preserved, operating and proposed gold mining sites in Alaska, California, Sweden, Wales and Scotland. The ethnographic fieldwork included ‘ethical gold’ promotional events, private industry meetings and jewellery trade shows and meetings with jewellery manufacturers and retailers, assayers, gold refiners and traders and environmental and fair trade campaigners.

The chapter addresses the professional, legal and ethical issues associated with medicines management and the role of the nurse. To ensure safe practice it is imperative safeguards are recognised and applied; therefore pertinent legislative frameworks, policy and professional regulation are discussed. Safeguarding patients when administering prescribed medicines means the nurse must have up-to-date knowledge and skill and a key aspect of this is to ensure consent to treatment from the service user is secured; for this reason drawing on relevant legislation, the consensual process is reviewed. Not infrequently medicine management provokes ethical and legal challenges for the health care professional; these demand reflection and careful consideration; consequently in this chapter legal and ethical parameters and professional boundaries are appraised.

There is a growing literature on the symbolic and cultural meanings of tourism and the ways in which cities are increasingly competing for tourists through the promotion of cultural assets and different forms of spectacle in the `tourist bubble'. To date, research on the role and impact of tourism in cities has largely been confined to those in Western, post-industrial economies. This paper examines the growth of cultural tourism in the central area of Havana, Cuba, and explores the range of unique, devolved, state-owned enterprises that are attempting to use tourism as a funding mechanism to achieve improvements in the social and cultural fabric of the city for the benefit of residents. The paper concludes with an assessment of the implications of this example for our understanding of how the pressures for restructuring and commodification can be moderated at the city level. Purpose: In recent years, there has been a big increase in the use of ethical attributes as marketing appeals. This paper examines consumers’ willingness to pay for three selected ethical attributes, namely ‘Organic’, ‘Recyclable Packaging’ and ‘Fairtrade’ in monetary terms. Design/Methodology/Approach: A modified choice-based experimental design with manipulation of the key constructs was used to estimate the mean value of how much consumers are willing to pay for the selected attributes attached to a box of premium chocolates. The results are based on the responses of a total of 208 consumers. Findings: Of the three attributes, ‘Recyclable Packaging’ has the strongest influence on the purchase decision, although this attribute generates the least additional value. The aggregated result shows that although consumers are willing to pay more for the product with ethical attributes than the one that is without, still around a half of them are not willing to pay more. In terms of demographics, the results show no significant differences between the two genders or different age groups in their willingness to pay for ethical attributes. As might be expected, willingness to pay was correlated with the level of consciousness of the ethical attributes. Originality/Value: The findings of this study help management to think practically about the value consumers willing to pay for the selected attributes. The results show a significant synergy in a combination of ethical attributes in products.
