The Oxbow Lakes Small Scale Fishermen Project in western Bangladesh is primarily a Social Fisheries Project. The project aims at self-management of the Oxbow lakes fishing and fish farming by members of the local communities and the sharing of the benefits in an equitable manner. Project emphasis is on social and institutional aspects of the community water resource management and on improving the fish yields through better fisheries practices.

O crescente fluxo global de investimentos estrangeiros coloca o tema da regulação dos investimentos estrangeiros no cerne das preocupações do Direito Internacional. Em uma estrutura formal com diversos níveis, o Direito Internacional dos Investimentos passa por constantes readaptações e reconstruções. Diversas alternativas teóricas têm sido propostas para responder aos muitos questionamentos relativos ao futuro do Direito Internacional dos Investimentos. Ao longo das décadas, o Brasil optou por manter-se isolado do regime internacional de regulação de investimentos estrangeiros, de maneira que a questão permaneceu regulada inteiramente por um mosaico normativo disperso entre normas constitucionais e infraconstitucionais. O crescente papel do Brasil como país exportador de capitais especialmente em virtude da expansão da indústria do petróleo e gás levou à recente revisão das diretrizes de política externa em matéria de investimentos estrangeiros. A decisão de negociar acordos internacionais de investimentos pode trazer diversas consequências para o ordenamento jurídico doméstico, dentre as quais se destaca a interferência do padrão de tratamento justo e equitativo no exercício do poder regulatório pelo Estado. A recorrente invocação do padrão de tratamento justo e equitativo contrasta com as incertezas sobre seu conteúdo. Ainda que possa existir uma compatibilidade teórica entre esse padrão de tratamento e o Direito brasileiro, a exposição às interpretações criativas dos tribunais arbitrais pode representar um risco para o Brasil, que deve cuidadosamente avaliar a pertinência de incluir uma cláusula do padrão de tratamento justo e equitativo nos acordos atualmente em negociação.

Spencer Fullerton Baird (Fig. 1), a noted systematic zoologist and builder of scientific institutions in 19th century America, persuaded the U.S. Congress to establish the United States Commission of Fish and Fisheries1 in March 1871. At that time, Baird was Assistant Secretary of the Smithsonian Institution. Following the death of Joseph Henry in 1878, he became head of the institution, a position he held until his own demise in 1887. In addition to his many duties as a Smithsonian official, including his prominent role in developing the Smithsonian’s Federally funded National Museum as the repository for governmental scientific collections, Baird directed the Fish Commission from 1871 until 1887. The Fish Commission’s original mission was to determine the reasons and remedies for the apparent decline of American fisheries off southern New England as well as other parts of the United States. A omissão inconstitucional é um tema desafiador. Este trabalho é dedicado a revisar os pressupostos de sua configuração, buscando explicar a possibilidade de a omissão implicar um estado de coisas inconstitucional. Presente violação massiva de direitos fundamentais decorrente de omissões caracterizadas como falhas estruturais, a Corte Constitucional colombiana declara a vigência de um estado de coisas inconstitucional. Ao assim decidir, a Corte passa a adotar remédios estruturais dirigidos a superar esse quadro negativo. Defendo aqui essa proposta como uma possibilidade para o Brasil e a atuação do Supremo Tribunal Federal. Trata-se, sem dúvida, de exemplo de ativismo judicial em sua dimensão estrutural. Todavia, esse comportamento judicial pode ser legítimo se presentes os pressupostos próprios do estado de coisas inconstitucional e o Tribunal formular decisões flexíveis, determinando a formulação e implementação de políticas públicas, mas deixando aos poderes políticos a tarefa de definir o conteúdo e os meios dessas políticas. O sistema carcerário brasileiro é exemplo de um estado de coisas inconstitucional que requer intervenção judicial da espécie.

Anthropogenic climate and land-use change are leading to irreversible losses of global biodiversity, upon which ecosystem functioning depends. Since total species' well-being depends on ecosystem goods and services, man must determine how much net primary productivity (NPP) may be appropriated and carbon emitted so as to not adversely impact this and future generations. In 2005, man ought to have only appropriated 9.72 Pg C of NPP, representing a factor 2.50, or 59.93%, reduction in human-appropriated NPP in that year. Concurrently, the carbon cycle would have been balanced with a factor 1.26, or 20.84%, reduction from 7.60 Gt C/year to 5.70 Gt C/year, representing a return to the 1986 levels. This limit is in keeping with the category III stabilization scenario of the Intergovernmental Panel for Climate Change. Projecting population growth to 2030 and its associated basic food requirements, the maximum HANPP remains at 9.74 ± 0.02 Pg C/year. This time-invariant HANPP may only provide for the current global population of 6.51 billion equitably at the current average consumption of 1.49 t C per capita, calling into question the sustainability of developing countries striving for high-consuming country levels of 5.85 t C per capita and its impacts on equitable resource distribution. © Springer Science+Business Media B.V. 2009.

The influence of ice on the bacteriological quality of the processed fishery products has been discussed. In almost all the cases ice has been traced to be a major source of contamination depending on the nature of water used for preparing it. The sources of contamination of ice and its remedies have been described.

Baseline survey and Participatory Rural Appraisal (PRA) during January 2003 to December 2004 on the fishing community revealed that unregulated fishing, use of destructive fishing gears, poaching of fishes, difficulties encountered in enforcing fisheries regulation and the helplessness of fishers to find alternative sources of income during banned fishing period (June to October) were the major management problems. CBFM (Community Based Fisheries Management) system as an alternative management strategy has been introduced to ensure active participation of the target group-the poor fishers living around the beet who were previously deprived to get access to the beet. Establishing a leasing system for controlled access, ensuring greater user-group participation through equitable distribution of all resource benefits among members, attempting to enforce penalties for illegal fishing linked with surprise checks to enforce management regulations are some of the recent steps taken by the BMC (Beel Management Committee). Chapila fish intake by the community was 31.25 g/head/day before stocking the beel by carp fingerlings. After stocking, they consumed chapila as fish protein from 8.33 g to 20.8 g/head/day during the fishing season (November to May) indicating that due to introduction of carp fingerlings, chapila production has been decreased in 2003-2004. About 77.5% families around the beel were found to be dependent directly and/or indirectly on chapila and other indigenous fishes of the beel for their livelihood, through fishing, marketing and other activities like net and boat preparation and nets mending etc. Particularly fishers' families were found to face serious problem during non-fishing period like June to October for their livelihood. Analyzing the present research result it was also observed that other than declination in biodiversity, the fishing pressure on promising chapila of the beel was found high and that is why the production of chapila has also been decreased. To get sustainable chapila production from the heel, it is suggested to ensure successful spawning and recruitment as juveniles, and hence the chapila should be undisturbed during its breeding period from March to July, and fishing pressure on the same species needs to be reduced for obtaining sustainable fish production.

Philippine coastal communities can become capable fishery resource managers and that their management practices can become largely self-sustaining if the project approach focuses on assisting fishermen to learn how to help themselves. Community organization is an essential part of the process and should not be viewed as an end product in itself. There are also no quick fixes, and projects require a complex array of activities if large numbers of coastal residents are to be assisted. In some of these projects, the control of illegal fishing combined with limiting of commercial fishing to offshore areas and good coastal habitat management resulted in a doubling of daily fish catch and income for small-scale fishermen. However, even with the best of management, the total fishery harvest is limited and further increases in individual fishing income can only come from reducing total fishing effort. This will require a system of control on access to the resource to limit the number and kind of fishing gears and to divide the resource equitably. Assisting coastal communities to devise and implement realistic equitable access controls is the major challenge facing coastal resource co-management.

Surrounding Net Fishery (laila) and Bottom Long Line Fishery which operate in the coastal waters of Kalpitiya Peninsula, compete for the same fish resources, resulting in a fishery dispute between the respective fishermen. Both fisheries target demersal as well as mid pelagic fishes, such as travellys (parava), mullets (galmalu) and barracudas (ulava). As the dispute had an adverse impact on the social harmony in the fishing community of the area, a socio-economic survey was conducted to study the underlying factors and to suggest policy measures to resolve the issue. The laila fishermen were resident fishermen in the Kalpitiya Peninsula while bottom long line fishermen were migratory fishermen from Negombo and Chilaw areas in the west coast of Sri Lanka. The Kalpitiya peninsula is located in the North West coast, some 50 km away from the west coast. Although the educational level and literacy rate of the laila community was below that of the bottom long line community, the laila community was economically better off. The net economic returns from laila fishery were superior to that from bottom long line fishery. The boat owner's and crew's share per operation of laila fishery were Rs.3,736 and Rs.947 respectively. The same figures for bottom long line fishery were Rs.588 and Rs.327 respectively. The resource rent from laila fishery was Rs.5,860, however, and much higher than that for bottom long line fishery (Rs.275), showing that the laila fishery exploits the targeted fish resource at a much higher rate compared to bottom long line fishery. This situation badly affects the equitable distribution of resources between the two fishing communities and results in unequal economic gains. Based on the findings of this study, certain input/output controls are proposed to address this problem, among which is the need to increase license fee for laila fishery units to offset the higher exploitation rate of fish resources.

The objective of the current report produced for the CGIAR Research Program on Aquatic Agricultural Systems (AAS) is to provide basic information on key constraints driving poverty and vulnerability in aquatic agricultural systems in the Tonle Sap region in Cambodia. Six objectives and corresponding research themes are included in the program: sustainable increases in productivity; equitable access to markets; resilience and adaptive capacity; empowering policies and institutions; reduced gender disparity; and expanded benefits for the resource-poor. In this report, the authors review the main aquatic agricultural systems (status, specific policies and strategies, interventions, challenges, and options), then review the main drivers of change. This leads to an identification of plans and strategies important to AAS, with a particular focus on perspectives, gaps and opportunities in national policies, community engagement, increased benefits, adaptive capacity, and gender. This review, of potential interest to decision makers and all development partners, leads to conclusions and recommendations aimed at policymakers and institutional as well as private investors in development.

Sustainable aquaculture in Asia is discussed, considering in particular the loss of mangroves associated with the rapid increase in production of cultured shrimp. Southeast Asia's development and population growth brought non-sustainable exploitation of its coastline; the destruction has increased through the years as development proceeded and the international markets entered the scenario. An outline is given of the current status of mangroves in some Asian countries. Some worldwide remedies for sustainable aquaculture are described.

We consider the discrete-time dynamics of a network of agents that exchange information according to a nearest-neighbour protocol under which all agents are guaranteed to reach consensus asymptotically. We present a fully decentralised algorithm that allows any agent to compute the final consensus value of the whole network in finite time using the minimum number of successive values of its own state history. We show that the minimum number of steps is related to a Jordan block decomposition of the network dynamics, and present an algorithm to compute the final consensus value in the minimum number of steps by checking a rank condition of a Hankel matrix of local observations. Furthermore, we prove that the minimum number of steps is related to graph theoretical notions that can be directly computed from the Laplacian matrix of the graph and from the minimum external equitable partition. © 2013 Elsevier Ltd. This study investigates modes of vibration in brushless doubly fed machine and brushless doubly fed reluctance machine due to the interaction of its fundamental magnetic fields, via the bending forces they set up in the back iron. It is shown that the presence of two field components of different pole numbers leads to vibration components in addition to those that would be expected in single field machines such as the induction motor. Formulations for the frequencies and magnitudes of the expected vibration components are given and verified experimentally. It is shown that the strength of the vibration components is highly dependent on the choice of pole numbers in the machine, with some much worse than equivalent induction machines and some very similar. The methodology presented enables designers to determine whether their machines are likely to suffer from vibration problems in advance of construction, and to apply remedies where appropriate. © The Institution of Engineering and Technology 2014.

Landslide is a kind of serious geological hazards and its damage is very great. In recent years, landslides become more and more frequent along with increase of scale of engineering constructions and cause greater loss. Consequently, how to protect landslides has become important research subject in the engineering field. This paper improves the method how to compute landslide thrust and solves the irrational problem in the design of piles because of the irrational landslide thrust according to the theory and technology of existed anti-slide piles and pre-stressed cable anti-slide piles. Modern pre-stressing technology has been introduced and load balancing method has been used to improve the stressing behavior of anti-slide piles. Anchor cables, anti-slide piles and modern pre-stressing technology have been used to prevention complicated landslide. It is an important base to select values for the landslide thrust. An improved method to calculate design thrust of anti-slide piles has been presented in this paper on the base of residual thrust method by comparing existing methods to select values of landslide thrust in the design of anti-slide piles. In the method, residual landslide thrust behind the anti-slide piles and residual skid resistance before the piles has been analyzed, equitable distribution of residual landslide thrust behind the piles has been realized, and the method to select value of design thrust becomes more reasonable. The pre-stressed cable anti-slide piles are developed from the common anti-slide piles and are common method to prevent landslide. Their principle is that internal force of anti-slide piles is adjusted and size of section is diminished by changing constraint conditions of anti-slide piles. For landslides with deep slip surface and large scale of slopes, limitation of the method appears. Such landslides are in need of long piles and anchor cables which are not only non-economic but also can generate larger deformation and leave potential danger after prevention. For solving the problem, a new kind of anti-slide piles, inner pre-stressing force anti-slide piles, is presented in this paper, and its principle is that an additional force, which is generated in the inner anti-slide piles by arranging pre-stressed reinforcement or tight wire in a certain form in interior of anti-slide piles and stretching the steel reinforcement or tight wire, may balance out the internal force induced by landslide thrust whole or partly (load balancing method). The method will change bending moment which anti-slide piles are not good at bearing into compressive stress which piles are good at bearing, improve stressing performance of anti-slide piles greatly, diminish size of section, and make anti-slide piles not fissured in the natural service or postpone appearance of the fissures, and improve viability of anti-slide piles. Pre-stressed cable anti-slide piles and inner pre-stressing force anti-slide piles go by the general name of pre-stressed structure anti-slide piles in the paper, and their design and calculation method is also analyzed. A new calculation method is provided in the paper for design of anti-slide piles. For pre-stressed structure anti-slide piles, a new computation mode is firstly presented in the paper on the foundation of cantilever piles. In the mode, constraint form of load-bearing section of the anti-slide piles should be confirmed according to reservoir conditions in order to figure out amount of pre-stress of the anchor cables, and internal force should be analyzed for the load-bearing section of pre-stressed structure anti-slide piles so as to confirm anchorage section of anti-slide piles. Pre-stressed cables of the pre-stressed cable anti-slide piles can be arranged as required. This paper analyzes the load-bearing section of single-row and double-row pre-stressed cable anti-slide piles and provides a calculation method for design of the pre-stressed cable anti-slide piles. Inner pre-stressing force anti-slide piles are a new kind of structural style. Their load-bearing section is divided into four computation modes according to whether pre-stressed cables are applied for exterior of the anti-slide piles, and whether single-row or double-row exterior pre-stressed cables are applied. The load balancing method is used to analyze the computation modes for providing a method to design the inner pre-stressing force anti-slide piles rationally. Pre-stressed cable anti-slide piles and inner pre-stressing force anti-slide piles are applied to research on Mahe landfall in Yalong Lenggu hydropower station by the improved method to select value of design thrust of anti-slide piles. A good effect is obtained in the analysis.
