This paper integrates the literatures on the social value of lawsuits, the evolution of the law, and judicial preferences to evaluate the hypothesis that the law evolves toward efficiency. The setting is a simple accident model with costly litigation where the efficient law minimizes the sum of accident plus litigation costs. In the steady state equilibrium, the distribution of legal rules is not necessarily efficient but instead depends on a combination of selective litigation, judicial bias, and precedent.

Cultural evolution has long been among the themes of anthropology but it has never ranked high. It is left mainly to archaeologists because they have to make sense of how society works and survives through time–a concern that has pretty much been abandoned by many cultural anthropologists. Anthropologists today seem little motivated to find out how society works, but rather to make the world a better place to live in for a particular population. The challenges of atmospheric change, nuclear proliferation, environmental degradation and resource exhaustion, the emergence of life threatening species–these challenges of contemporary evolution have awakened less interest in anthropology. The concern with cultural evolution seems to be of greater interest to non-anthropologists, such as in the work of Jarrod Diamond (2005), a biologist, and the genre that as emerged as Big History, with the works of David Christian (2005) and others. Among the few contemporary anthropologists who have sought the dynamics of cultural evolution, the work of Joseph Tainter (1996) stands out.

En este artículo se postula que la geografía posee una cierta capacidad para establecer marcos analíticos que sirven a la prospectiva en ciencias sociales. Para ello se acude a las posibilidades del análisis multiescalar como instrumento que, partiendo de los procesos territoriales estudiados a diferentes escalas, da cuenta también de los diferentes tempos que los afectan. Esas distintas temporalidades, al conjugarse en determinados espacios, ponen condiciones a los desarrollos futuros que son de interés para el análisis sociológico. Las actuales condiciones en que se desarrolla la sociedad urbana argentina son analizadas desde esta perspectiva.

Der Begriff der Evolution ist nicht nur den Naturwissenschaften, sondern auch den Sozial- und Geisteswissenschaften vertraut. Die Konzepte der Variation und der Selektion spielen hier eine Schlüsselrolle. An die Stelle der biologischen Vererbung tritt die Imitation erfolgreicher Vorbilder: Soziale Normen und Institutionen beispielsweise, die erfolgreich zur Lösung von Konflikten beigetragen haben, werden mit höherer Wahrscheinlichkeit kopiert als relativ erfolglose Vorbilder. Treten im Zuge dieses Prozesses Kopierfehler auf oder werden rational geplante Veränderungen vorgenommen, können neue Formen entstehen, die möglicherweise erfolgreicher sind als das Original. Diese Ideen können durch mathematische Formalisierung präzisiert und zugespitzt werden. Die vorliegende Aufsatzsammlung vermittelt ein Bild davon. Die Autoren setzen sich mit spieltheoretischen Modellen, Simulationsmodellen und anderen Methoden der Formalisierung auseinander und beziehen diese auf so unterschiedliche Themenbereiche wie die Entwicklung von Kooperation und Vertrauen, die Evolution von Fairnessnormen, auf wissenschaftlichen Wettbewerb, Gruppenprozesse und die Arbeitsteilung in der Familie.

This paper shows the role that some foresight tools, such as scenario design, may play in exploring the future impacts of global challenges in our contemporary Society. Additionally, it provides some clues about how to reinforce scenario design so that it displays more in-depth analysis without losing its qualitative nature and communication advantages. Since its inception in the early seventies, scenario design has become one of the most popular foresight tools used in several fields of knowledge. Nevertheless, its wide acceptance has not been seconded by the urban planning academic and professional realm. In some instances, scenario design is just perceived as a story telling technique that generates oversimplified future visions without the support of rigorous and sound analysis. As a matter of fact, the potential of scenario design for providing more in-depth analysis and for connecting with quantitative methods has been generally missed, giving arguments away to its critics. Based on these premises, this document tries to prove the capability of scenario design to anticipate the impacts of complex global challenges and to do it in a more analytical way. These assumptions are tested through a scenario design exercise which explores the future evolution of the sustainable development paradigm (SD) and its implications in the Spanish urban development model. In order to reinforce the perception of scenario design as a useful and added value instrument to urban planners, three sets of implications –functional, parametric and spatial— are displayed to provide substantial and in-depth information for policy makers. This study shows some major findings. First, it is feasible to set up a systematic approach that provides anticipatory intelligence about future disruptive events that may affect the natural environment and socioeconomic fabric of a given territory. Second, there are opportunities for innovating in the Spanish urban planning processes and city governance models. Third, as a foresight tool, scenario design can be substantially reinforced if proper efforts are made to display functional, parametric and spatial implications generated by the scenarios. Fourth, the study confirms that foresight offers interesting opportunities for urban planners, such as anticipating changes, formulating visions, fostering participation and building networks

El objetivo de este proyecto ha sido el de realizar un análisis del importante desarrollo que han sufrido las telecomunicaciones, haciendo un especial hincapié en la telefonía móvil y el impacto y repercusión que ha causado actualmente en nuestra sociedad. Para ello se hará un repaso evolutivo de las tecnologías de la información y las telecomunicaciones, y se establecerá una relación entre la gran difusión de éstas y su efecto sobre los usos, y cambios percibidos por los consumidores del nuevo siglo. Ciertamente la historia de la tecnología, nos enseña que la gente y las organizaciones acaban utilizándola para unos propósitos muy diferentes de aquellos que inicialmente fueron concebidas. Además cuanto más interactiva sea una tecnología, tanto más probable será que los usuarios se conviertan en productores o modificadores de la misma. Por tanto, la sociedad necesita resolver las incógnitas que pueda suscitar el rápido y continúo cambio de las comunicaciones. Este proyecto trata de ayudar a responder alguna de las cuestiones que actualmente se están planteando. ¿Son los teléfonos móviles una expresión de identidad, artilugios de moda, herramientas de la vida cotidiana, o todo lo anterior? ¿Existen nuevos modelos de comportamiento y conducta social? ¿La comunicación móvil está favoreciendo la aparición de una nueva cultura joven con un lenguaje propio basado en la comunicación textual y multimodal? ¿Tienen los teléfonos móviles efectos nocivos en la salud? La respuesta a estas preguntas afecta a nuestras vidas y también condiciona las políticas públicas y las estrategias de negocio, por eso requiere adquirir un conocimiento cimentado en la información, y la recopilación de datos de diversas fuentes, tanto de estadísticas provenientes de diferentes estudios e investigaciones, como de empresas consultoras, siempre basada en una perspectiva global. En conjunto, se espera dentro de los límites del conocimiento actual, contribuir a establecer las bases para el análisis y valoración de la relación existente entre comunicación, tecnología y sociedad en todo el mundo. Abstract The purpose of this project has been to analyse the significant development undergone by telecommunications, putting a special emphasis on mobile phones and the impact it has caused in society. We will go over the evolution of IT technologies and telecommunications as well as establish a relationship between its spread and effect of its uses and changes understood by the new century consumers. Technology history shows us that people and organizations use it for very different purposes from those originally thought. Furthermore, the more interactive technologies are, the more users will modify or produce it. Therefore, society needs to solve the mysteries of the quick and continuous change of communications. This project tries to help and answer some of the questions considered these days. Are mobile phones an expression of identity, fashionable devices, tools for everyday life or all at once? Are there any new models of performance and social behaviour? Is mobile communication favouring the existence of a new young culture with a typical language based on textual and multimodal communication? Are mobile phones bad for our health? The answer to these questions affects us all and conditions public politics and business strategies so it is required to get firm knowledge based on information. It is also important to compile data from various sources, from statistics of research and studies, based on a global perspective. As a whole, we hope to contribute to establish the bases for the future analysis and assessment of a fundamental trend that is redefining the relationship between communication, technology and society worldwide by transforming the wireless networks that make our lives.

La historiografía ha presentado tradicionalmente la planificación urbana como una técnica progresista que, nacida en el contexto de los reformismos del siglo XIX, tiene por objeto principal la mejora de la calidad de vida a través del tratamiento del espacio urbano y la ordenación del territorio. Sin embargo un estudio detallado de la articulación histórica entre planificación urbana, economía política de la producción de espacio y dinámicas de evolución y cambio de las formaciones sociales revela un escenario muy distinto. Este trabajo sintetiza los planteamientos de la tesis Urbanismo y reproducción social. La planificación territorial de la multitud. A través de una serie de estudios de caso, esta investigación presentó la planificación urbana y territorial como un dispositivo gubernamental encargado de regular espacialmente la reproducción social de las clases subalternas en beneficio de los bloques hegemónicos. Prestando especial atención al efecto de la planificación sobre la vida cotidiana y a través de una historiografía social reflexiva y crítica, se muestra cómo la multitud fue paulatinamente desposeída de recursos materiales, capitales sociales y representaciones colectivas a medida que sus prácticas cotidianas fueron reescritas, recodificadas, reterritorializadas. Historians have traditionally pictured town planning as a progressive technique. Born in the context of nineteenth-century reformist policies, its aim would have been to improve the quality of life through the regulation of urban development and the urban fabric. However a close study of the relationship between town planning, the politics of space and the dynamics of evolution and change of social formations reveals a very different scenario. This work summarizes the main findings of the PhD thesis Urbanism and social reproduction. The territorial planning of the multitude. Through a series of historical case studies, this research showed how town and regional planning evolved to become a governmental dispositif in charge of the spatial regulation of social reproduction. Paying special attention to the effect of planning over everyday life and subaltern classes, and deploying a critical, reflexive social historiography, the thesis described how the multitude was dispossessed of material resources, social capitals and collective imaginaries as its practices were spatially re-written, re-coded, re-territorialised.

Recent applications of Foucauldian categories in geography, spatial history and the history of town planning have opened up interesting new perspectives, with respect to both the evolution of spatial knowledge and the genealogy of territorial techniques and their relation to larger socio-political projects, that would be enriched if combined with other discursive traditions. This article proposes to conceptualise English parliamentary enclosureea favourite episode for Marxist historiography, frequently read in a strictly materialist fashioneas a precedent of a new form of sociospatial governmentality, a political technology that inaugurates a strategic manipulation of territory for social change on the threshold between feudal and capitalist spatial rationalities. I analyse the sociospatial dimensions of parliamentary enclosure’s technical and legal innovations and compare them to the forms of communal self-regulation of land use customs and everyday regionalisations that preceded it. Through a systematic, replicable mechanism of reterritorialisation, enclosure acts normalised spatial regulations, blurred regional differences in the social organisation of agriculture and erased the modes of autonomous social reproduction linked to common land. Their exercise of dispossession of material resources, social capital and community representations is interpreted therefore as an inaugural logic that would pervade the emergent spatial rationality later known as planning.

In the last few years, the European Union (EU) has become greatly concerned about the environmental costs of road transport in Europe as a result of the constant growth in the market share of trucks and the steady decline in the market share of railroads. In order to reverse this trend, the EU is promoting the implementation of additional charges for heavy goods vehicles (HGV) on the trunk roads of the EU countries. However, the EU policy is being criticised because it does not address the implementation of charges to internalise the external costs produced by automobiles and other transport modes such as railroad. In this paper, we first describe the evolution of the HGV charging policy in the EU, and then assess its practical implementation across different European countries. Second, and of greater significance, by using the case study of Spain, we evaluate to what extent the current fees on trucks and trains reflect their social marginal costs, and consequently lead to an allocative-efficient outcome. We found that for the average case in Spain the truck industry meets more of the marginal social cost produced by it than does the freight railroad industry. The reason for this lies in the large sums of money paid by truck companies in fuel taxes, and the subsidies that continue to be granted by the government to the railroads.

The challenge to properly feed a world population of 9.2 billion by 2050, that must be achieved on essentially currently cropped area, requires that food production be increased by 70%. This large increase can only be achieved by combinations of greater crop yields and more intensive cropping adapted to local conditions and availability of inputs. Farming systems are dynamic and continuously adapt to changing ecological, environmental and social conditions, while achieving greater production and resource-use efficiency by application of science and technology. This article argues that the solution to feed and green the world in 2050 is to support this evolution more strongly by providing farmers with necessary information, inputs, and recognition. There is no revolutionary alternative. Proposals to transform agriculture to low-input and organic systems would, because of low productiv- ity, exacerbate the challenge if applied in small part, and ensure failure if applied more widely. The challenge is, however, great. Irrigation, necessary to increase cropping intensity in many areas cannot be extended much more widely than at present, and it is uncertain if the current rate of crop yield increase can be maintained. Society needs greater recognition of the food-supply problem and must increase funding and support for agricultural research while it attends to issues of food waste and over consumption that can make valuable reductions to food demand from agriculture
