This work explores the idea of constitutional justice in Africa with a focus on constitutional interpretation in Ghana and Nigeria. The objective is to develop a theory of constitutional interpretation based upon a conception of law that allows the existing constitutions of Ghana and Nigeria to be construed by the courts as law in a manner that best serves the collective wellbeing of the people. The project involves an examination of both legal theory and substantive constitutional law. The theoretical argument will be applied to show how a proper understanding of the ideals of the rule of law and constitutionalism in Ghana and Nigeria necessitate the conclusion that socio-economic rights in those countries are constitutionally protected and judicially enforceable. The thesis argues that this conclusion follows from a general claim that constitutions should represent a ‘fundamental law’ and must be construed as an aspirational moral ideal for the common good of the people. The argument is essentially about the inherent character of ‘legality’ or the ‘rule of law.’ It weaves together ideas developed by Lon Fuller, Ronald Dworkin, T.R.S. Allan and David Dyzenhaus, as well as the strand of common law constitutionalism associated with Sir Edward Coke, to develop a moral sense of ‘law’ that transcends the confines of positive or explicit law while remaining inherently ‘legal’ as opposed to purely moral or political. What emerges is an unwritten fundamental law of reason located between pure morality or natural law on the one hand and strict, explicit, or positive law on the other. It is argued that this fundamental law is, or should be, the basis of constitutional interpretation, especially in transitional democracies like Ghana and Nigeria, and that it grounds constitutional protection for socio-economic rights. Equipped with this theory of law, courts in developing African countries like Ghana and Nigeria will be in a better position to contribute towards developing a real sense of constitutional justice for Africa.

Ce mémoire vise à analyser le processus de construction de l'identité collective du mouvement queer à Montréal dans un contexte francophone. Bien que plusieurs travaux portent en partie sur les groupes militants queers québécois, aucune recherche ne s'est employée à comprendre comment les militant.es queers à Montréal se constituent comme un collectif qui développe une identité. Pour analyser le processus de construction de l'identité collective du mouvement queer montréalais, je m'appuie sur la théorie de Melucci (1985; 1996), qui définit l'identité collective d'un mouvement selon plusieurs axes : les champs d'action, les moyens employés et les fins visées, ainsi que le mode d'organisation. Afin de répondre à cette question de recherche, j'ai effectué une recherche documentaire ainsi que sept entrevues avec des militant.es queers montréalais.es francophones. L'analyse des données a été faite grâce à divers travaux qui portent sur les champs d'action, les valeurs, les fins et moyens, le mode d'organisation de mouvements contemporains anti-autoritaires et anti-oppressifs, ainsi qu'en fonction de trois dimensions élaborées par Melucci (1985) : le conflit, la solidarité et les limites du système. Je conclus que l'identité collective comme processus s'articule autour de plusieurs enjeux : premièrement, la diversité des champs d'action, les valeurs anti-oppressives, les relations d'affinités, le mode de vie alternatif et le mode d'organisation anti-oppressif des militant.es queers permettent au mouvement de créer une solidarité interne, d'affirmer une position anti-autoritaire qui brise les limites du système dominant et de se différencier du mouvement LGBT mainstream. Par ailleurs, les actions militantes concrètes qui réalisent le changement dans l'ici et maintenant participent à créer une solidarité et une reconnaissance entre militant.es, ainsi qu'à mettre en lumière un conflit avec le système dominant oppressif. Enfin, les perspectives francophones sur le mouvement queer ne semblent pas donner au bilinguisme du mouvement un rôle fondamental dans la construction de son identité collective. Cependant, l'intérêt marqué des militant.es francophones comparativement aux militant.es anglophones pour la politique institutionnelle fait émerger de nouvelles interrogations sur l'impact que pourrait avoir le mélange des cultures francophone et anglophone à Montréal sur la culture politique et l'identité du mouvement.

In this study, the relationship between the country's level of literacy and its national culture will be explored. Cultural differences effect the way that people think and react. Culture is "the value shared amongst distinctive social groups and classes" (Soley and Pandya 2003, 206). House, et al. (2004, 57) define culture as "shared motives, values, beliefs, identities, and interpretations or meanings of significant events that result from common experiences of members of collectives and are transmitted across age generations." Dutch anthropologist Geert Hofstede (1991) considers culture to be "the collective programming of the mind. Culture is a stem of collectively held values" (Hofstede 1981, p. 240).

This paper examines both the processes and outcomes of governance in the context of the EU’s relationship with ACP States within the period of the Cotonou Agreement (CA). It discusses and assesses a variety of governance mechanisms, including the European Commission’s use of the governance concept, EPAs, manifestations of partner preferences, the EDF, the revision of the CA, and Fisheries Partnership Agreements. Specific examples of the wielding of each mechanism are assessed based upon two criteria: a) the extent to which the wielding of the mechanism by the EU is a manifestation of “good governance”, and b) the extent to which the EU’s wielding of the mechanism has resulted, or is likely to result, in the sustainable development of and reduction of poverty in ACP countries. The examples are chosen to illustrate contradictions between rhetoric and practice and the consequential negative (actual and potential) impact upon development in ACP States. The final section offers suggestions for improving the EU’s governance processes and their outcomes for development.

The development of the ecosystem approach and models for the management of ocean marine resources requires easy access to standard validated datasets of historical catch data for the main exploited species. They are used to measure the impact of biomass removal by fisheries and to evaluate the models skills, while the use of standard dataset facilitates models inter-comparison. North Atlantic albacore tuna is exploited all year round by longline and in summer and autumn by surface fisheries and fishery statistics compiled by the International Commission for the Conservation of Atlantic Tunas (ICCAT). Catch and effort with geographical coordinates at monthly spatial resolution of 1° or 5° squares were extracted for this species with a careful definition of fisheries and data screening. In total, thirteen fisheries were defined for the period 1956-2010, with fishing gears longline, troll, mid-water trawl and bait fishing. However, the spatialized catch effort data available in ICCAT database represent a fraction of the entire total catch. Length frequencies of catch were also extracted according to the definition of fisheries above for the period 1956-2010 with a quarterly temporal resolution and spatial resolutions varying from 1°x 1° to 10°x 20°. The resolution used to measure the fish also varies with size-bins of 1, 2 or 5 cm (Fork Length). The screening of data allowed detecting inconsistencies with a relatively large number of samples larger than 150 cm while all studies on the growth of albacore suggest that fish rarely grow up over 130 cm. Therefore, a threshold value of 130 cm has been arbitrarily fixed and all length frequency data above this value removed from the original data set.

Introduction: The major findings and suggested framework for action put forth by the U.S. Surgeon General form the basis for Illinois' plan. Augmenting this foundation is the collective wisdom of citizens, stakeholders and policy makers. The result is a comprehensive vision that can be embraced by all involved in the process. The plan articulates goals, priorities and strategies to improve the oral health of all Illinoisans. Its five policy goals reflect specific priorities and its recommended strategies and action steps suggest how to address each of them. The plan concludes with a call for the establishment of a select committee to monitor and provide guidance in the implementation of the plan.
