Bem jurídico e princípio da proporcionalidade: uma análise crítica da pena em abstrato

A pesquisa constata a existência de dispositivos na legislação penal brasileira em que a pena em abstrato encontra-se desproporcional, seja pela ausência de um bem jurídico merecedor da tutela penal, seja porque o quantum da pena não condiz com os parâmetros da proporcionalidade. Para tanto, apresenta o bem jurídico penal, expondo sua síntese evolutiva, seu conceito, os princípios da intervenção mínima e da ofensividade, bem como as questões pertinentes a existência de bens jurídicos penais supra individuais e a problemática das imposições constitucionais de criminalização. Analisa o principio da proporcionalidade, desenvolvendo seu conceito, conteúdo, sua origem histórica e evolução, a consagração constitucional e a nomenclatura no direito comparado. Quanto ao conteúdo da proporcionalidade, adota a corrente que apresenta os subprincípios da idoneidade, necessidade e proporcionalidade em sentido estrito como elementos formadores da proporcionalidade em sentido amplo. Traz alguns exemplos de normas penais que fogem a regra da proporcionalidade, considerando o bem jurídico sob tutela. Conclui pela necessidade de se adequar a legislação penal brasileira aos parâmetros da proporcionalidade e as imposições da doutrina do bem jurídico penal, descriminalizando condutas ou adequando a pena em abstrato.

Reconfiguração de sistemas de distribuição utilizando metaheurísticas e critérios de confiabilidade

In an ever more competitive environment, power distribution companies must satisfy two conflicting objectives: minimizing investment costs and the satisfaction of reliability targets. The network reconfiguration of a distribution system is a technique that well adapts to this new deregulated environment for it allows improvement of reliability indices only opening and closing switches, without the onus involved in acquiring new equipment. Due to combinatorial explosion problem characteristic, in the solution are employed metaheuristics methods, which converge to optimal or quasi-optimal solutions, but with a high computational effort. As the main objective of this work is to find the best configuration(s) of the distribution system with the best levels of reliability, the objective function used in the metaheuristics is to minimize the LOLC - Loss Of Load Cost, which is associated with both, number and duration of electric power interruptions. Several metaheuristics techniques are tested, and the tabu search has proven to be most appropriate to solve the proposed problem. To characterize computationally the problem of the switches reconfiguring was developed a vector model (with integers) of the representation of the switches, where each normally open switch is associated with a group of normally closed switches. In this model simplifications have been introduced to reduce computational time and restrictions were made to exclude solutions that do not supply energy to any load point of the system. To check violation of the voltage and loading criteria a study of power flow for the ten best solutions is performed. Also for the ten best solutions a reliability evaluation using Monte Carlo sequential simulation is performed, where it is possible to obtain the probability distributions of the indices and thus calculate the risk of paying penalty due to not meeting the goals. Finally, the methodology is applied in a real Brazilian distribution network, and the results are discussed.

Comparação entre as habilidades motoras de chutar e rebater em crianças do primeiro ano do ensino fundamental

This research analyzes the development of motor skills of kicking andhitting 60 children, six years old, from three schools in the city of Bauru. Thestudents were videotaped performing the task of kicking and hitting. Thecollected data were analyzed by three independent evaluators who rated theskills in development stages (early, elementary and mature), following thecharacteristics presented by Gallahue and Ozmun (2005), adding two morecategories: beginner / intermediate, elementary / intermediate. The resultsshowed that there were differences between the skills of kicking and hitting.This may be related to cultural aspects. Also found that most children havenot reached the mature stage of development the two skills, which is contraryto that expected in the literature.

Análise da viabilidade econômica na implantação de inversores frequência em sistemas de bombeamento

The present work aims to conduct a study of the economic feasibility of the implementation of variable frequency inverters in pump systems with variable flow rates. The concern with the reduction of energy expenditure in industries raised in 2001 due to the energy crisis that hit Brazil at that time, forcing industries to reduce their electric costs under penalty of fines if this were not done (MOREIRA, 2008). Frequency inverter is an electronic device that allow greater control in the operation of pumping systems and also a reduction in electrical consumption, being a viable solution to achieve a reduction in energy consumption. For the development of this work, approaching important topics in pumping systems was necessary in order to make a correct choice of hydraulic pumping and also other components responsible for the operation of the system , such as electric motors and frequency inverters. In the case study, a theoretical analysis of the behavior of electrical consumption in systems with variable flow rates was performed, comparing when the system is operated via frequency inverters and when the system is operated without such a device. As expected, the result of the implantation of the device was quite satisfactory, and the primary goal of reducing energy expenditure was achieved. Also important to highlight the environmental issue of this work, as all forms of energy production affects nature in some way, achieving a reduction in consumption also contributes indirectly in environmental conservation

Placing the management of childhood forms considered at risk, we discuss the operation of a welfare institution and its effects on the subjective process. Created to manage the virtues of the poor behavior of children, makes visible to the way technology features disciplinary policies: surveillance is evident of cameras, high walls, electric fences and in the eyes of educators, the penalty stands normalizing practices corrective aimed at standardization bodies, educational meetings are compared to the examination, as they produce dossiers of individual behavior, emphasizing characteristics that are considered dangerous anticipates the administration and production of docile individuals, useful, productive, applying identity models. Following the lines of knowledge and power relations that constitute this space, we used the genealogy in the analysis of discursive practices that cross society in its historical construction, the genealogy allows us to achieve these movements in the consolidation process of the government of life, and also, the deconstruction of hegemonic practices. In an attempt to escape the set, we propose the realization of artistic and cultural activities within a process of collective construction as a strategy of resistance and confrontation with the dominant logic, consolidating practices that favor the enhancement of life in its manifold possibilities.
