On 13 December 2006, the General Assembly of the United Nations adopted the Convention on the Rights of Persons with Disabilities (CRPD). It is the first comprehensive human rights treaty of the 21st century. The Convention is intended as a human rights instrument with an explicit, social development dimension. It adopts a broad categorization of persons with disabilities and reaffirms that all persons with all types of disabilities must enjoy all human rights and fundamental freedoms. Precisely, the Convention marks a 'paradigm shift' in attitudes and approaches to persons with disabilities The Convention contains two articles directly connected with judicial effective protection, one more than the other, but on the other hand, one cannot be understood without the other. Both articles are Article 12 –Equal recognition before the law- and Article 13 –access to justice- As a scholar in Procedural Law, my contribution to the International Scientific Congress on Private Law of the Philippines and Spain aims to enshrine the relevant importance of the both provisions that guarantee effective judicial protection for persons with disabilities in order to analyze, subsequently, the implementation of them in Spanish legislation

En el presente trabajo se estudian los límites de la autonomía privada desde la perspectiva del derecho a la igualdad y del principio de no discriminación tanto en el derecho norteamericano como en el europeo, con especial incidencia a la doctrina española. Por un lado se plantea si la piedra angular a la hora de establecer límites a la autonomía privada debe ser el concepto de dignidad o el de igualdad, por otro superando dicho debate se propone un acercamiento al problema entendido como una colisión entre derechos fundamentales en la que en cada concreto supuesto ha de estudiarse cual debe prevalecer. Finalmente se estima conveniente seguir el modelo de la Constitución de Sudáfrica y entender que los derechos fundamentales afectan directamente tanto a las relaciones horizontales como verticales, es decir tanto al ámbito público como privado.

The honeydew moth Cryptoblabes gnidiella is the main problem for the wineries in the Northeast of the Brazil, because it attacks the bunch and reduces the quality of the grapes and the wines. In order to stretch out the bunch to facilitate the penetration of the insecticides, it was used gibberellic acid. Six treatments with different concentrations and different dates of application, and the control were compared. The bunches are compact, characteristic of the "Syrah" grapes in the region. The grape berries were analysed at harvest and wines were made by microvinifications. The grape berries showed different qualitative characteristics, as berry weight, number of berries. °Brix, total acidity and heterogeneity of the maturation. The microvinifications were carried out with 50 kg of grapeberries into glass bottles of 20 L at 22°C, for the alcoholic and malolactic fermentations, then stabilized and bottled. The wines were tasted by a panel of ten people and compared on smell and taste plans. The tasting results showed that the control treatment was the best graded wine. The application of gibberellic acid allowed to control the honeydew moth attack, but it caused a heterogeneity on grape maturation, with a lower quality of the grapes and wines compared to the control.

Despite significant advances in building technologies with the use of conventional construction materials (as concrete and steel), which significantly have driven the construction industry, earth construction have demonstrated its importance and relevance, as well as it has matched in an efficient and eco-friendly manner the social housing concerns. The diversity of earth construction techniques allowed this material to adapt to different climatic, cultural and social contexts until the present time. However, in Angola, the construction with earth is still associated with population fringes of weak economic resources, for which, given the impossibility of being able to acquire modern construction materials (steel, cement, brick, among others), they resort to the use of available natural materials. Furthermore, the lack of scientific and technical knowledge justifies the negative appreciation of traditional building techniques, and the derogatory way how are considered the earth constructions in Angolan territory. Given the country's current development status, and taking into account the environmental requirements and the real socio-economic sustainability of Angola, it is considered that one of the viable and adequate options, could be the recovering and upgrading of the ancestral techniques of earth construction. The purpose of this research is to develop the technical and scientific knowledge in order to improve and optimize these construction solutions, responding to the real problems of housing quality as well as to the current social, economic and environmental sustainability requirements. In this paper, a description of the physical and mechanical characteristics of the adobes typically used in the construction of traditional houses in some localities of Huambo, province in Angola, is carried out. The methodology was based on mechanical in-situ testing in adobe blocks manufactured with traditional procedures: i) tensile strength evaluated with the bending test and compressive strength test on earth blocks specimens; and, ii) durability and erodibility test by Geelong method adopting the New Zealand standard (NZS) procedures (4297: 1998; 4297: 1998 and 4297: 1999). The results allow the characterization of the materials used in the construction of raw earth in the Huambo region, contributing to the development of knowledge of these sustainable and traditional housing constructive solutions with a strong presence in Angola [1, 2]. This study is part of a larger project in the area of Earth Construction [3], which aims to produce knowledge which can stimulate the use of environmental friendly construction materials and contribute to develop constructive solutions with improved performance, durability, comfort, safety and sustainability.

The Earth we know today was not always so. Over millions of years have undergone significant ch an g e s brought about by numerous geological phenomena aimed at your balance, some internal order, creating new geological formations and other external order smoothing formations previously created. From t h e tectonic standpoint, Angola is located in a relatively stable area which gives it a certain p ri v i l e g e w h e n compared with some Asian countries or even Americans where quite often occur earthquakes and volcanic eruptions. However, the same cannot be said in relation to the occurrence of an external geodynamics phenomena, such as the ravines, which in recent years has taken shape in many provinces, especially due to anthropogenic activity, giving rise to geological hazards, increasing the risk of damage in buildings and others infrastructures, losses direct or indirect in economic activities and loss of human lives. We understand that the reducing of these risks starts, in particular, by their identification, for later take preventive measures. This work is the result of some research work carried out by the authors through erosion courses of s o i l and stabilization of soils subject to erosion phenomena, carried out by Engineering Laboratory of Angola (LEA). For the realization of this work, we resorted to cartographic data query, literature, listening to s o m e o f the provincial representatives and local residents, as well as the observation in lo co o f s o m e af f e ct ed areas. The results allow us to infer that the main provinces affected by ravine phenomenon are located in Central and Northern highlands, as well as in the eastern region, and more recently in Cuando-Cub an go province. Not ruling out, however, other regions, such as in Luanda and Cabinda [1]. Relatively the causes, we can say that the ravines in Angola are primarily due to the combination of three natural factors: climate, topography and type of soil [2]. When we add the anthropogenic activit y , namely the execution of construction works, the drainage system obstructio n, exploration of m i n e ral s, agriculture and fires, it is verified an increasing of the phenomenon, often requiring immedi at e act i o n . These interventions can be done through structural or engineering measures and by the stabilization measures on the degraded soil cover [3]. We present an example of stabilization measures throu g h t h e deployment of a local vegetation called Pennisetum purpureum. It is expected that the results may contribute to a better understanding of the causes of the ravine phenomenon in Angola and that the adopted stabilization method can be adapted in other affected provinces in order to prevent and making the contention of the ravines.

In Angola, the construction made of raw earth is a cultural heritage widely used by low income households, representing over 80% of the population [1, 3]. In Huila province is evident construction in raw earth in a large scale, either in urban or in periurban and rural areas. The construction methods follow the ancestral standards, distributed throughout the region of Huila, being built by the several ethnic groups. Among the construction techniques in earth, stand out: the adobe, wattle-and-daub and more recently on CEB (Compressed Earth Block). The type of soil used to make the adobes is mainly silty-clayed sand [1]. The most applied materials are: rods, reeds, wood, grass, straw, soil and stone, almost with the same characteristics [2]. The manufacture of adobe, consists essentially in mixing clay and grass (plant fibers), then put the mixture inside a wooden mold, having a size of 42 cm long and 18 cm high and taking three to four days to dry and be applied in housing construction. The application of these materials makes the construction less expensive because they are collected, transformed and applied by the owner himself of housing without any project, based only on the result of the practice and experience acquired from their ancestors. They are simple constructions, presenting a typology of grouped and isolated single-family housing, ranging between 2 and 3 bedrooms [2]. The construction techniques used in such small housings have positive environmental aspects, both as regards the materials employed, such as the manner in which the constructions are raised, showing special concerns for the quality improvement of them, as regards the resistance, durability and comfort [4].

La présente étude de zonage viticole a été faite dans la région de la vallée Central de Tarija(VCT), dans la ville de Tarija, au Sud de la Bolivie; une région avec plus de 400 années de tradition qui présente une vitiviniculture de haute qualité. La Vallée possède une surface total de 332 milles ha.; existant des vignobles entre 1660 y 2300 m.s.n.m. et dans ce rang d?altitude il existe 91 mille ha. avec un haut potentiel pour la culture de la vigne. Pour la détermination des surfaces homogènes de la région ont été considérés les aspects d?environnement avec l?aide d?images satellitaires, des cartes topographiques, des données climatologiques et des cartes géologiques ; pour déterminer les caractéristiques de la région pour la culture de la vigne. Au niveau climatique furent appliqués les indices du Système CCM Géo viticole développés par Tonietto & Carbonneau (2004), lesquelles considèrent des éléments thermiques (Indice Héliothermique), hydriques (Indice de sécheresse) et nictothermiques (Indice de Froid nocturne); nous avons identifié 8 types des climats différents dans toute la région. Dans les particularités du sol furent déterminés la morphologie et il a été géo référencié tous ses caractéristiques (analyses chimique et physique). S?ai fait une classification spécifique des critères de culture de la vigne pour déterminer l?aptitude du sol, en même temps ont été identifié les surfaces avec des limitants pour le conduit des vignobles. L?étude a pour objectif d?identifié les zones potentielles pour la culture de la vigne et de cette façon orienté son élargissement avec le support des politiques d?état et pertinente assistance technique au producteurs de cette région. RÉSUMÉ Il n?existe presque pas d?études qui caractérisent l?effet du climat viticole sur la typicité des vins en considérant les différents types de climats à l?échelle mondiale. Cette étude fait partie d?un projet CYTED de zonage vitivinicole. L?objectif a été de caractériser l?effet du climat viticole sur la typicité des vins sur une macro région viticole du monde. La méthodologie a été appliquée à un ensemble de 45 régions viticoles situées sur 6 pays Ibéro-Américains : Argentine, Bolivie, Brésil, Chili, Espagne et Portugal. Le climat viticole de chaque région viticole a été caractérisé para les 3 indices climatiques viticoles du Système CCM Géoviticole : IH (Indice Héliothermique de Huglin), (IF) Indice de Fraîcheur des Nuits) et IS (Indice de Sécheresse). Les principales caractéristiques sensorielles observées de façon fréquente sur des vins rouges représentatifs élaborés avec des raisins-de-cuve de chacune des ces 45 régions viticoles ont été décrites pour des ?nologues de chaque pays, an utilisant la méthodologie proposée par Zanus & Tonietto (2007). L?évaluation sensorielle réalisée concerne l?intensité de perception de la Couleur (Cou), de l?Arôme Total (Ar), de l?Arôme ? fruit mûr (Ar-Fm), de la Concentration (Con), de l?Alcool (Al), des Tanins (Tan), de l?Acidité (Ac) et la Longueur en bouche (Lon). Les données ont été soumises à l?analyse des corrélations pour l?ensemble des variables et à l?ACP. L?étude indique qu?une partie de la typicité des vins es déterminée par le climat viticole des régions et que les indices du Système CCM Géoviticole sont pertinents pour relier aux caractéristiques sensorielles des vins. Abstract: The State Rio Grande do Sul is the main producer of Brazilian fine wines, with four viticultural regions. The objective is the characterization of the viticultural climatic potential of the State (total surface of 281.749 km2). The methodology use the Géoviticulture Multicriteria Climatic Classification System (Géoviticulture MCC System), based on three climatic indices ? Dryness Index (DI), Heliotermal Index (HI) and Cool Night Index (CI). Based on latitude, longitude, altitude and distance from Atlantic Ocean, the 3 viticultural climatic indices were modeled and the algorithms applied to a DTM using GIS. The results show that Rio Grande do Sul has the following classes of viticultural climate: according to DI ? Moderately Dry, Sub-humid, Humid; according to HI ? Cool, Temperate, Temperate warm, Warm and Very Warm; according to CI ? Cool nights, Temperate nights, Warm nights. Based on the total surface, the most representatives viticultural climates are: « Humid x Temperate » (3,1%), « Humid x Temperate warm » (14,4%), « Humid x Warm » (52,6%), « Sub-humid x Warm » (20,0%) and « Sub-humid x Very warm » (5,8%). According to CI, the viticultural climates have a range of variation as a function of the interaction between « earlyness of the varieties x heliothermal availability ». Summary The objective of this study was to develop a methodology capable of modeling the effect of viticultural climate on wine sensory characteristics. The climate was defined by the Géoviticulture Multicriteria Climatic Classification System (Tonietto and Carbonneau, 2004), based on the Heliothermal index (HI), Cool Night index (CI) and Dryness index (DI). The sensory wine description was made according with the methodology established by Zanus and Tonietto (2007). In this study we focused on the 5 principal wine producing regions of Brazil: Serra Gaúcha, Serra do Sudeste, Campanha (Meridional and Central), Planalto Catarinense and Vale do Submédio São Francisco. The results from Principal Component Analysis (PCA) show the HI and CI opposed to the DI. High HI values were associated to a lower perception of acidity, as well as to a lower perception of concentration (palate) and persistence by mouth. For the red wines, high HI values were positively associated with alcohol (palate), conversely to the DI index, which showed high values related to the perception of tanins and acidity. The higher the CI, the lower were the color intensity, tanins, concentration and persistence by mouth. It may be concluded that viticultural climate - expressed by the HI, CI and DI indexes ? adequately explained much of the sensory differences of the wines made in different regions. The methodology proposed and the enlargement of the database it will maybe open the possibility of modeling the part of wine sensory characteristics as dependent variables of the viticultural climate, as defined by the Géoviticulture MCC System. The lack of pear-compatible rootstocks in Brazil calls for the application of classical genetic techniques. Therefore, in order to obtain select suitable material, the search for genetic segregation must be continuous, being used as alternative scion cultivars. This study aims to assess fruit set, number of seeds, fruit weight and fruit diameter according to crosses between pear cultivars. The trial was carried out from September 2008 to February 2009 in a commercial orchard in the city of Vacaria/RS, Brazil. For the pollination process, pollen was extracted from flowers at full-white stage in the same orchard. The cultivars used were 'Packham's Triumph' and 'Clapps Favorite'. The crossings were defined as: open pollination; selfpollination of 'Packham's Triumph' and 'Packham's Triumph' × 'Clapps Favorite'. The pollinations were done manually in flowers at full-white stage, which were opened, emasculated and then pollinated. Each pollinated flower was then isolated with a fine nylon bag. Open pollination and cross pollination between 'Packham's Triumph' × 'Clapps Favorite' provided higher fruit set (17 and 18%, respectively). Fruit weight and diameter did not differ between treatments. Open pollination provided fruits with a higher number of seeds.

Pears have been grown in the south region of Brazil, where the climatic conditions are favourable. The aim of this work was to determine the harvest maturity index as well as maximum storage period of 'Packham's Triumph? and 'Rocha' pears to maintain quality attributes. The ?Packham?s Triumph? fruit were harvested from a commercial orchard at 7 days intervals and flesh firmness was used as a maturity index (MI1=76, MI2=67 and MI3=58 N). ?Rocha? pears were harvested twice and they were considered as MI1 and MI3 because of the firmness values. The fruit were stored at 1±1C and 90-95% RH for 15, 30, 45 and 60 days and evaluated at the end of each storage period and after five days at room temperature (24±1C), simulating a helflife period. Flesh firmness, water loss, peduncle dehydration, epidermis colour, soluble solids, titratable acidity were measured. ?Packham?s? pears harvested at MI1 and MI2 showed firmness loss after 30 days of cold storage, whereas fruit harvested at MI3 retained the initial values, resulting in firmer fruit after 60 days (P<0.001). Fruit harvested in MI3 had less firmness loss after 5 days at room temperature following 45 and 60 days of cold storage. ?Rocha? pears harvested in MI1 and MI3 showed firmness reduction during cold storage, which was intensified at room temperature. Maximum values of water loss approached 6%. Fruit peduncles of both cultivars dehydrated after 60 days of cold storage, but their colour remained green, independent of harvest maturity index. ?Packham?s Triumph? and ?Rocha? pears harvested at MI3 showed better quality attributes after 60 days of cold storage plus 5 days of shelf-life than fruit harvested at other maturity stages.
