Admiralty Commissioner's Orders sent to Admiral Sir John Thomas Duckworth, Governor and Commander-in-Chief of Newfoundland, informing him of America's declaration of war against Great Britain and instructing him to seize and destroy all ships belonging to the United States of America which he may encounter. The document is dated October 13, 1812, and is signed by William Domett, Joseph Sydney Yorke, George Warrender, and John Barrow. The paper is marked "duplicate". It is likely that several copies were issued and sent via different ships to ensure that at least one made it to Admiral Duckworth.

Centrée sur une réflexion des droits de l’homme à partir de l’expérience historique de la Shoah, la thèse porte sur l’enjeu fondamental du statut du religieux en modernité. Trois parties la composent, correspondant au génocide, à la modernité politique et à l’histoire du Salut : la première propose une interprétation de l’Holocauste en ayant recours aux catégories empruntées à l’historiographie, à la réflexion philosophique et à la tradition théologique. Elle rend compte de deux lectures concurrentes des Lumières, du renversement de la théologie chrétienne du judaïsme au XXe siècle, de la généalogie idéologique du nazisme ainsi que du contexte explosif de l’entre-deux-guerres. La seconde partie de la thèse avance une théorie des trois modernités, selon laquelle les États-Unis, la France et Vatican II représenteraient des interprétations divergentes et rivales des droits. Enfin, la troisième partie reprend les deux précédentes thématiques de la Shoah et de la modernité, mais à la lumière de la Révélation, notamment de l’Incarnation et de la Croix. La Révélation est présentée comme un double dévoilement simultané de l’identité de Dieu et de la dignité humaine – comme un jeu de miroir où la définition de l’homme est indissociable de celle de la divinité. En provoquant l’effondrement de la Chrétienté, la sécularisation aurait créé un vide existentiel dans lequel se serait engouffré le nazisme comme religion politique et idéologie néo-païenne de substitution. Négation de l'élection d'Israël, du Décalogue et de l’anthropologie biblique, l’entreprise nazie d’anéantissement est comprise comme la volonté d’éradication de la Transcendance et du patrimoine spirituel judéo-chrétien, la liquidation du Dieu juif par l’élimination du peuple juif. Le judéocide pourrait dès lors être qualifié de «moment dans l’histoire du Salut» en ce sens qu’il serait porteur d’un message moral en lien avec le contenu de la Révélation qui interpellerait avec force et urgence la conscience moderne. L’Holocauste constituerait ainsi un kairos, une occasion à saisir pour une critique lucide des apories de la modernité issue des Lumières et pour un renouvellement de la pensée théologico-politique, une invitation à une refondation transcendante des droits fondamentaux, dont la liberté religieuse ferait figure de matrice fondationnelle. La Shoah apporterait alors une réponse au rôle que la Transcendance pourrait jouer dans les sociétés modernes. Mémorial de Sang refondateur des droits de la personne, l'Holocauste rendrait témoignage, il lancerait une mise en garde et poserait les conditions nécessaires d'un enracinement biblique à la préservation de la dignité de l’être humain. Aux Six Millions de Défigurés correspondrait la Création de l'Homme du Sixième Jour. En conclusion, un triangle synergique nourricier est soutenu par l’extermination hitlérienne (1941-1945), la Déclaration universelle des droits de l’homme (1948) et le Concile Vatican II (1962-1965) comme les trois piliers d’une nouvelle modernité, située au-delà des paradigmes américain (1776) et français (1789). La Shoah inaugurerait et poserait ainsi les fondements d'un nouvel horizon civilisationnel; elle pointerait vers un nouveau départ possible pour le projet de la modernité. L'expérience génocidaire n'invaliderait pas la modernité, elle ne la discréditerait pas, mais la relancerait sur des bases spirituelles nouvelles. Cette refondation des droits fondamentaux offrirait alors une voie de sortie et de conciliation à la crise historique qui opposait depuis près de deux siècles en Europe les droits de l'homme et la Transcendance, Dieu et la liberté – modèle susceptible d’inspirer des civilisations non occidentales en quête d’une modernité respectueuse de leur altérité culturelle et compatible avec la foi religieuse.

This thesis is an attempt to explore the problems faced by Indian Women and to examine the ways in which the human rights of women could be better protected in the light of international movements with special reference to national legislation and judicial decisions.The evolution of human rights from early period to Universal Declaration of Human Rights, 1948 is traced in the first chapter. The second chapter deals with the evolution of human rights in India. The evolution of fundamental rights and directive principles and the role played by the Indian Judiciary in enforcing the human rights enumerated in various international instruments dealing with human rights are also dealt with in this chapter. The rights guaranteed to women under the various international documents have been dealt with in the third chapter.It is noticed that the international documents have had their impact in India leading to creation of machinery for protection of human rights. Organised violations of women's rights such as prostitution, devadasi system, domestic violence, sexual harassment at workplaces, the evil of dowry, female infanticide etc. have been analysed in the light of existing laws and decisional jurisprudence in the fourth chapter. The fifth chapter analyses the decisions and consensus that emerged from the world conferences on women and their impact on the Indian Society and Judiciary. The constitutional provisions and legislative provisions protecting the rights of women have been critically examined in the sixth chapter. Chapter seven deals with various mechanisms evolved to protect the human rights of women. The eighth chapter contains conclusions and suggestions.

India is a signatory to the United Nations Declaration of Human Rights 1948 and the International Covenant on Civil and Political 1966, the two major International instruments, building the foundations of the major democracies and the constitutions of the world. Both these instruments give an independent and upper position to right to privacy compared to right to freedom of speech and expression. The freedom of press finds its place under this right to freedom of speech and expression. Both these rights are the two opposite faces of the same coin. Therefore, without the right of privacy finding an equal place in Indian law compared to right to freedom of speech and expression, the working of democracy would be severely handicapped and violations against citizens rights will be on the rise It was this problem in law and need to bring a balance between these two conflicting rights that induced me to undertake this venture. This heavy burden to bring in a mechanism to balance these two rights culminated in me to undertake this thesis titled “Right to Privacy and Freedom of Press – Conflicts and Challenges

Desde la declaración de independencia del territorio autónomo de Chechenia en 1991, el conflicto Checheno- Ruso se ha tornado cada vez más complejo. Este enfrentamiento que comenzó como una reivindicación nacionalista, con el paso de los años se ha convertido en un conflicto étnico y religioso que pone cada vez más en riesgo esta volátil región. Su alta complejidad se debe a que convergen múltiples factores de carácter cultural, histórico, geográfico, político, económico y social que comprometen no sólo los intereses de Rusia como Estado-Nación y de la nación chechena, sino el de una gran variedad de actores internacionales que tiene sus ojos puestos en la importante región del Cáucaso. Aunque Rusia ha finalizado sus acciones anti-insurgentes en el año 2009 con la declaración de fin de la guerra, los cada vez más sangrientos ataques terroristas perpetrados en el territorio ruso, la participación activa del fundamentalismo islámico y la creación del llamado Emirato del Cáucaso, hacen pensar que el conflicto en Chechenia está lejos de llegar a su fin. El presente estudio busca analizar las causas, el desarrollo y las perspectivas a futuro del conflicto Checheno Ruso, permitiendo entender de una manera más clara la situación en esta región tan importante para los intereses económicos y geoestratégicos de uno de los países más influyentes en el sistema internacional, como lo es la Federación Rusa.

El terrorismo en la actualidad es considerado como uno de los conceptos más controversiales en los campos social, académico y político. El término se empieza a utilizar después de la Revolución Francesa, pero recientemente, a raíz de los atentados del 11 de septiembre de 2001, ha tomado suma relevancia y ha motivado numerosas investigaciones para tratar de entender qué es terrorismo. Aunque a la fecha existen varias revisiones sistemáticas, este trabajo tiene como propósito revisar, agrupar y concretar diferentes teorías y conceptos formulados por los autores que han trabajado sobre el concepto de “terrorismo” con el fin de entender las implicaciones de su utilización en el discurso, y cómo esto afecta la dinámica interna de las sociedades en relación con la violencia, las creencias, los estereotipos entre otros elementos. Para lograrlo, se revisaron 56 artículos, publicados entre los años 1985 y 2013; 10 fuentes secundarias entre noticias y artículos de periódicos correspondientes a los años 1995-2013 y 10 estudios estadísticos cuyos resultados nos aportan a la comprensión del tema en cuestión. La búsqueda se limitó al desarrollo histórico del terrorismo, sus diferentes dimensiones y el concepto social de la realidad de terrorismo. Los hallazgos demuestran que la palabra “terrorismo” constituye un concepto que como tal es un vehículo lingüístico que puede ser utilizado con fines, estratégicos movilizando al público conforme a través del discurso e intereses políticos, destacando la necesidad de estudiar las implicaciones psicológicas y sociales de su uso.

El Grupo Visegrád es un escenario de cooperación multilateral, conformado por Polonia, República Checa, Eslovaquia y Hungría, el cual tiene como objetivo principal contribuir al cumplimiento de los intereses de dichos países, por medio de la financiación de proyectos culturales. El interés de esta monografía consiste en determinar la incidencia de la cooperación cultural en la reafirmación identitaria de cada uno de los miembros del Grupo y, por ende, en la manera como éstos se proyectan dentro de la Unión Europea. Así pues, se identifican los principales hechos históricos que han moldeado los intereses de los países del V4 y que condujeron a la creación de una estructura institucional sólida, que ha servido como plataforma para el accionar de dichos países dentro del bloque europeo. Se utiliza la perspectiva constructivista de Alexander Wendt, la cual permite entender la naturaleza de la cooperación y, su relación con las identidades y los intereses de los Estados.

This is a critical review of the empirical literature on the relationship between violence and economic growth in Colombia: an interesting case study for social scientists studying violence, conflict, crime and development. We argue that, despite the rapid development of this literature and the increasing use of new techniques, there is still much room for research. After assessing the contribution of the most influential papers on the subject, we suggest directions for future research.

Background Infant development is adversely affected in the context of postnatal depression. This relationship may be mediated by both the nature of early mother-infant interactions and the quality of the home environment. Aim To establish the usefulness of the Global Ratings Scales of Mother-Infant Interaction and the Infant-Toddler version of the Home Observation for the Measurement of the Environment (IT-HOME), and to test expected associations of the measures with characteristics of the social context and with major or minor depression. Method Both assessments were administered postnatally in four European centres; 144 mothers were assessed with the Global Ratings Scales and 114 with the IT-HOME. Affective disorder was assessed by means of the Structured Clinical Interview for DSM-IV Disorders. Results Analyses of mother-infant interaction indicated no main effect for depression but maternal sensitivity to infant behaviour was associated with better infant communication, especially for women who were not depressed. Poor overall emotional support also reduced sensitivity scores. Poor support was also related to poorer IT-HOME scores, but there was no effect of depression. Conclusions The Global Ratings Scales were effectively applied but there was less evidence of the usefulness of the IT-HOME. Declaration of interest None.

This paper provides some preliminary insights into the emergence and development of indigenous general contractors in Ghana. General contracting is the means by which an individual or organisation takes responsibility for supplying all of the materials, labour, equipment and services necessary for the construction of a project. Whereas the development of general contracting in places like the UK is well documented, the evolution of contractors in Ghana is not clearly articulated in the literature. Therefore, the main question in this paper is: How did indigenous contractors evolve in Ghana? To examine and analyze the research question, a literature review on similar developments elsewhere was first carried out. This was followed by discussions and unstructured interviews with experienced construction practitioners in Ghana most of whom were Quantity Surveyors. Most interviewees narrated their knowledge of contractor development in Ghana dating back to around 1945. From the explanations given, it was possible to develop a general understanding of the research question and to make a qualitative interpretation of the respondents’ comments and to draw some conclusions. General contractors emerged rapidly in the Gold Coast (now Ghana) shortly after World War II. Most were Italian master craftsmen in Ghana who were capitalized by the British colonial government to develop infrastructure in the Gold Coast following devastating effects of the war. Some of the indigenous people learned from the Italians and also established construction firms. Thus, general contracting in Ghana has a relatively short history in comparison to countries like Britain where the profession developed rapidly in the early part of the 19th century in response to the industrial revolution. Although they may possess sufficient technical expertise, many indigenous contractors in Ghana today lack the capacity to carry out major projects because of low capitalization and poor organisational structures. The current construction market in Ghana is dominated by foreign contractors. To become major players in the market, indigenous Ghanaian contractors should build strong organisational structures and pursue mergers and joint venturing to boost their financial, technical and managerial capacity.

1. Nutrient concentrations (particularly N and P) determine the extent to which water bodies are or may become eutrophic. Direct determination of nutrient content on a wide scale is labour intensive but the main sources of N and P are well known. This paper describes and tests an export coefficient model for prediction of total N and total P from: (i) land use, stock headage and human population; (ii) the export rates of N and P from these sources; and (iii) the river discharge. Such a model might be used to forecast the effects of changes in land use in the future and to hindcast past water quality to establish comparative or baseline states for the monitoring of change. 2. The model has been calibrated against observed data for 1988 and validated against sets of observed data for a sequence of earlier years in ten British catchments varying from uplands through rolling, fertile lowlands to the flat topography of East Anglia. 3. The model predicted total N and total P concentrations with high precision (95% of the variance in observed data explained). It has been used in two forms: the first on a specific catchment basis; the second for a larger natural region which contains the catchment with the assumption that all catchments within that region will be similar. Both models gave similar results with little loss of precision in the latter case. This implies that it will be possible to describe the overall pattern of nutrient export in the UK with only a fraction of the effort needed to carry out the calculations for each individual water body. 4. Comparison between land use, stock headage, population numbers and nutrient export for the ten catchments in the pre-war year of 1931, and for 1970 and 1988 show that there has been a substantial loss of rough grazing to fertilized temporary and permanent grasslands, an increase in the hectarage devoted to arable, consistent increases in the stocking of cattle and sheep and a marked movement of humans to these rural catchments. 5. All of these trends have increased the flows of nutrients with more than a doubling of both total N and total P loads during the period. On average in these rural catchments, stock wastes have been the greatest contributors to both N and P exports, with cultivation the next most important source of N and people of P. Ratios of N to P were high in 1931 and remain little changed so that, in these catchments, phosphorus continues to be the nutrient most likely to control algal crops in standing waters supplied by the rivers studied.
