Penhora on-line é o procedimento utilizado pela justiça para garantir o cumprimento de uma condenação estabelecida numa sentença judicial, sendo, na maioria das vezes, uma condenação pecuniária. O procedimento é utilizado para bloquear as contas-correntes do devedor condenado ao pagamento, mediante requisição à autoridade supervisora do sistema financeiro, a qual informará cerca da existência de ativos em nome do devedor. Embora seja capaz de trazer celeridade processual, sobretudo com a redução de inadimplemento do empregador, trata-se de uma faculdade conferida ao magistrado, não sendo procedimento obrigatório quando do requerimento realizado pela parte, razão pela qual incidem questões polêmicas e pontos controversos sobre esse tema.

Uma das questões críticas relacionadas com um Ambiente Adaptativo de Ensino e Aprendizagem baseado na Web diz respeito à eficácia da aprendizagem do aluno remoto. Assim como diversos trabalhos de pesquisa na literatura, nosso estudo preocupou-se com a modelagem do Estilo Cognitivo de Aprendizagem (ECA) do aluno visando, em um futuro próximo, a adaptação dos conteúdos pedagógicos a esta importante característica individual do aluno. Esta tese descreve a metodologia utilizada para investigar como modelar o ECA do aluno remoto, baseado na observação e análise de seu comportamento em um ambiente de ensino e aprendizagem na Web. Em nosso estudo, o ECA representa o estágio de desenvolvimento cognitivo do aluno, de acordo com a taxonomia de Bloom. Nós acreditamos que os principais benefícios de adaptar a instrução ao ECA do aluno estão relacionados com a possibilidade de oportunizar a ampliação de suas habilidades cognitivas, assim como oportunizar a aprendizagem em profundidade sobre os conteúdos em estudo. A metodologia quase-experimental usada para a modelagem do ECA do aluno compreendeu duas fases distintas: (i) geração das classes de ECA a partir da aplicação de um teste psicológico em uma amostra da população-alvo; e (ii) desenvolvimento do módulo de ensino experimental e o estudo das Trajetórias de Aprendizagem (TA) padrão das classes de ECA, a partir da observação de seus comportamentos durante a execução de uma sessão de estudo na Web. Como resultado deste estudo, identificamos os principais indicadores, que melhor discriminaram as classes de ECA consideradas. Os resultados foram obtidos a partir da observação e análise das TAs na Web. Todo o conhecimento obtido a partir desta investigação deverá nos permitir automatizar o diagnóstico do ECA do aluno remoto. Este conhecimento também será utilizado como base para o desenvolvimento dos conteúdos a serem oferecidos ao aluno pelo Ambiente Adaptativo de Ensino e Aprendizagem baseado na Web.

Emotional Contagion is the mechanism that includes mimicking and the automatic synchronization of facial expressions, vocalizations, postures, and movements with another person and, consequently, convergence of emotions between the sender and receiver. Researches of this mechanism conducted usually in the fields of Psychology and Marketing tends to investigate face-to-face interactions. However, the question remains to what extent, if any, emotional contagion may occur with facial expressions in photos, since many purchase situations are brought on by catalogues or websites. This thesis has the goal to verify this gap and, in addition, verify whether emotional contagion is more common in females than in males as stated in previous studies. Emotions have been studied because it is intuitively apparent that emotions affect the dynamics of the interaction between a salesperson and customers (Verbeke, 1997); in other words, emotions may significantly affect consumer behavior. Therefore, this thesis also verified whether the facial expressions that transmit emotions could be associated to product evaluations. To investigate these questions, an experiment was done with 171 participants, which were exposed to either smiling (positive emotion) or neutral advertising. The differences between the individual advertisements were limited to the facial expressions of figures in the advertisements (either smiling or neutral/without smiling). One specialist and two students analyzed videotaped records of the participants’ responses, and found that participants who saw the positive stimulus mimicked the picture (smiling back) confirming the Emotional Contagion in Photos (the first hypothesis). The second hypothesis was to analyze if there is difference based in gender. The results demonstrated that there is not a significant difference between genders; female and male equally suffer Emotional Contagion. The third hypothesis was related to whether the positive emotions vs. neutral emotions acquired from the positive facial expression in the photo are associated to a positive evaluation of the product also displayed in the photo. Evidences show that the ad with a positive expression could change more positively the attitude, the sympathy, the reliability, and the intention of purpose of the participant compared to those who were exposed to the neutral condition. Therefore, the analysis concludes that the facial expressions displayed in photos produce emotional contagion and may interfere on the evaluation product. A discussion of the theoretical and practical implications and limitations for these findings are presented.

This dissertation was written for the making of a model to be used as reference to the construction and diagnoses of educational projects in on-line environments. The model approaches a series of characteristics, technical and humans, which if considered can increase the potential of awake the interests to the active use of these projects for the students and build conditions to the development of an active posture by the students, fundamental factor to the educational advances. Focused in the students, not in the technology in use, we propose this model as a guide, reference to be used in a critical way in relation with every educational context. This research was made from the qualitative category, trough the method of study of case, using as reference to the analysis the use of the website guanabara.info - website outside of the school context - by it users, heard through the internet, by the use of semi-opened interview, in a data taken of the primary type. We follow as theoretical references Paulo Freire´s work, considering his vision of education and the building of knowledge as a process which occurs between man, and Celestín Freinet, in his pedagogy of humanized and critical insertion of the technologies in the school. At the end, we show the practical utilization of the model constructed using it for the diagnostics of an educational project in the on-line educational environmental moodle

The thesis investigated how social networks online that allows anonymous postings can be used by teachers and students to promote the meeting between the sexual education and the needs and expectations of young people face a crosscutting theme, remarkably a taboo. It needs teaching strategies more efficient than those traditionally defended. With this experience, found in a short course about sexuality and health, we sought to go beyond the use of social networks for social entertainment, showing they can be an field that favors the process of teaching and learning. The research was based on the convergence of the communication concepts from Paulo Frere and another from Jürgen Habermas, as well as the philosophical concepts of utopia, ideology and dialectic are interrelated not only among themselves, but also inside an education field. Methodologically in this thesis, we adopted the category of qualitative research; the method is a combination of case study with action research. The technique was the use of questionnaires, data collection was in attendance and the types of data were primary. Finally, we present, then, the idea the communication is not in the middle, but in the trusty relationship established between the interlocutors. In this way, we can think when a student has met their need to be able answer his questions about sex with their teacher through an online social network that allows anonymity and through which the student knows who responds is their teacher, but the teacher can not distinguish the identity of his students, this dialogic relationship serves to get claims of the validity that are characterized as potential communicative action
