Este artículo analiza la sentencia de la Corte Constitucional que resuelve el conflicto de criterios entre el Procurador General del Estado y el Contralor General. en cuanto a la materia misma de la sentencia, en opinión del órgano más importante de justicia constitucional del país, las tasas son tributos, que no pueden percibirse, cederse, ni administrarse directamente por ninguna persona natural ni jurídica que no sea el estado. el cambio constitucional exige una nueva óptica jurídica en la apreciación de los dictámenes prevenientes de la Procuraduría General del estado, que ya no son simples opiniones de juristas respetables, sino que constituyen normas jurídicas que se deben aplicar. De alguna forma ha renacido con mayor vigor el ius publice respondedi del pretor romano, y estos actos jurídicos han alcanzado la jerarquía de fuentes formales del derecho.

El presente trabajo pretende mostrar de manera objetiva y técnica, las motivaciones, contenidos y demás elementos de sustento utilizados por la Corte Constitucional ecuatoriana en el control abstracto de inconstitucionalidad por omisión normativa. Previo el análisis de la sentencia se presentan conceptos relativos al control de constitucionalidad por omisión en el derecho comparado y en la doctrina, además se hace un breve recorrido histórico del aparecimiento de la mencionada institución jurídica. Finalmente, se revisa la sentencia en cada una de sus partes y se van describiendo los aspectos más relevantes y conflictivos.

Se revisa la sentencia interpretativa no. 0006-09-sIC-CC, caso 0012-08-IC, expedida por la Corte Constitucional para el período de transición. en lo principal, esta sentencia analiza si el segundo inciso del art. 408 de la Constitución ecuatoriana es aplicable al sector de las telecomunicaciones. la mencionada norma dispone que el estado debe participar en los beneficios del aprovechamiento de varios recursos –entre ellos los no renovables y el espectro radioléctrico– en un monto que no debe ser inferior a los de la empresa que los explota. la importancia económica de la decisión de la Corte es evidente, pues incide directamente en el alcance del derecho de propiedad, tanto del estado como de los particulares que realizan actividades en el sector de las telecomunicaciones. Pese a la relevancia económica del asunto, la motivación es escasa, y la línea de argumentación obscura, e inclusive contradictoria.

El presente trabajo analiza de manera crítica el pronunciamiento de la Corte Constitucional para el Período de Transición respecto al control constitucional de las denuncias de tratados bilaterales de inversiones de capital, tomando como caso de estudio el instrumento internacional suscrito entre Ecuador y Alemania, en el cual bajo una corriente constitucionalista, la Corte somete al crisol de la contradicción el contenido del Tratado Internacional con la normativa constitucional vigente. En aquel sentido, analizaremos cómo, a través de este polémico dictamen, se inicia una línea jurisprudencial en la que se configuran temas controversiales como el denominado control automático de constitucionalidad, y, el debate respecto a la soberanía estatal en cuanto al no sometimiento del Ecuador a arbitrajes comerciales internacionales en asuntos de índole comercial.

En el presente documento se presenta un análisis de la sentencia No. 009-13-SEPCC adoptada por la Corte Constitucional del Ecuador. El documento aborda criterios respecto de las formalidades establecidas para el acceso a los recursos, particularmente del recurso de casación, el derecho a la motivación de la sentencia, el tratamiento que se debe dar a un contrato de trabajo en su relación con los derechos laborales y la eficacia de los derechos fundamentales entre particulares, y, finalmente, el esbozo de algunas ideas sobre la cultura de un juez constitucional para la supremacía de los derechos.

This paper aims to analyze the decision issued by the Constitutional Court for Transition within the unconstitutionality presented against the Mining Act. Proponents, in the main, formal allege unconstitutional by the Mining Law have been issued by the Committee on Legislation and Oversight (National Assembly during the Transitional Period after the adoption of the 2008 Constitution) without the prior execution of a legislative pre query, this query being a collective right of national, indigenous peoples and communities recognized in Article 57 paragraph 17 of the Constitution of the Republic. The Constitutional Court ruled Transition to reject the unconstitutionality confirming the constitutionality of the regulatory body and the substantial and non-formal pre-legislative consultation.

The cyanoacetylide complex Fe(CCCN)(dppe)Cp (3) is readily obtained from sequential reaction of Fe(CCSiMe3)(dppe)Cp with methyllithium and phenyl cyanate. Complex 3 is a good metalloligand, and coordination to the metal fragments [RhCl(CO)(2)], [Ru(PPh3)(2)Cp](+), and [Ru(dppe)Cp*](+) affords the corresponding cyanoaceylide-bridged heterobimetallic complexes. In the case of the 36-electron complexes [Cp(dppe)Fe-CCCN-MLn](n+), spectroscopic and structural data are consistent with a degree of charge transfer from the iron centre to the rhodium or ruthenium centre via the C3N bridge, giving rise to a polarized ground state. Electrochemical and spectroelectrochemical methods reveal significant interactions between the metal centres in the oxidized (35 electron) derivatives, [Cp(dppe)Fe-CCCN-MLn]((n+1)+).

Purpose: This document identifies the challenges and opportunities in applying the ontology technology in the Human Resources domain. Target users: A reference for both the HR and the ontology communities. Also, to be used as a roadmap for the OOA itself, within the HR domain. Background: During the discussion panel at the OOA kick-off workshop, which was attended by more than 50 HR and ontology experts, the need for this roadmap was realized. It was obvious that the current understanding of the problem of semantics in HR is fragmented and only partial solutions exist. People from both the HR and the ontology communities speak different languages, have different understandings, and are not aware of existing solutions.

The strategic integration of the human resource (HR) function is regarded as crucial in the literature on (strategic) human resource management ((S)HRM). Evidence on the contextual or structural influences on this integration is, however, limited. The structural implications of unionism are particularly intriguing given the evolution of study of the employment relationship. Pluralism is typically seen as antithetical to SHRM, and unions as an impediment to the strategic integration of HR functions, but there are also suggestions in the literature that unionism might facilitate the strategic integration of HR. This paper deploys large-scale international survey evidence to examine the organization-level influence of unionism on this strategic integration, allowing for other established and plausible influences. The analysis reveals that exceptionally, where the organization-level role of unions is particularly contested, unionism does impede the strategic integration of HR. However, it is the predominance of the facilitation of the strategic integration of HR by unionism which is most remarkable.

Reaction of salicylaldehyde semicarbazone (L-1), 2-hydroxyacetophenone semicarbazone (L-2), and 2-hydroxynaphthaldehyde semicarbazone (L-3) with [Pd(PPh3)(2)Cl-2] in ethanol in the presence of a base (NEt3) affords a family of yellow complexes (1a, 1b and 1c, respectively). In these complexes the semicarbazone ligands are coordinated to palladium in a rather unusual tridentate ONN-mode, and a PPh3 also remains coordinated to the metal center. Crystal structures of the 1b and 1c complexes have been determined, and structure of 1a has been optimized by a DFT method. In these complexes two potential donor sites of the coordinated semicarbazone, viz. the hydrazinic nitrogen and carbonylic oxygen, remain unutilized. Further reaction of these palladium complexes (1a, 1b and 1c) with [Ru(PPh3)(2)(CO)(2)Cl-2] yields a family of orange complexes (2a, 2b and 2c, respectively). In these heterodinuclear (Pd-Ru) complexes, the hydrazinic nitrogen (via dissociation of the N-H proton) and the carbonylic oxygen from the palladium-containing fragment bind to the ruthenium center by displacing a chloride and a carbonyl. Crystal structures of 2a and 2c have been determined, and the structure of 2b has been optimized by a DFT method. All the complexes show characteristic H-1 NMR spectra and, intense absorptions in the visible and ultraviolet region. Cyclic voltammetry on all the complexes shows an irreversible oxidation of the coordinated semicarbazone within 0.86-0.93 V vs. SCE, and an irreversible reduction of the same ligand within -0.96 to -1.14 V vs. SCE. Both the mononuclear (1a, 1b and 1c) and heterodinuclear (2a, 2b and 2c) complexes are found to efficiently catalyze Suzuki, Heck and Sonogashira type C-C coupling reactions utilizing a variety of aryl bromides and aryl chlorides. The Pd-Ru complexes (2a, 2b and 2c) are found to be better catalysts than the Pd complexes (1a, 1b and 1c) for Suzuki and Heck coupling reactions.
