While substantive EU non-discrimination law has been harmonized in great detail, the enforcement regime for EU non-discrimination law consists merely of a few isolated elements. Thus, the pursuit of unity through harmonization in substantive EU law is accompanied by considerable regulatory autonomy for Member States in securing the efficiency of those laws, reflecting the diversity of national enforcement regimes, and resulting in twenty-seven different national models for enforcing discrimination law in labour markets. This article pursues two connected arguments through a comparison of rules for enforcing non-discrimination law in labour markets in Britain and Italy. First, it argues that enforcing non-discrimination law in labour markets is best achieved when responsive governance, repressive regulation and mainstreaming equality law are combined. Second, the article submits that diversity of national legal orders within the EU is not necessarily detrimental, as it offers opportunities for mutual learning across legal systems.The notion of mutual learning across systems is proposed in order to analyse the transnational migration of legal ideas within the EU. Such migration has been criticized in debates about the ‘transplantation’ of legal concepts or legal irritation through foreign legal ideas, in particular by comparative labour lawyers. However, EU harmonization policies in the field of non-discrimination law aim to impact on national labour laws. The article develops the notion of mutual learning across legal systems in order to establish conditions for transnational migration of legal ideas, and demonstrates the viability of these concepts by applying them to the field of non-discrimination law

RESUMO - A migração transnacional de pessoas tem-se afirmado como um fenómeno global e crescente, provocando, nos diversos contextos nacionais implicados, mudança social e desafios adaptativos das sociedades e instituições. O universo da saúde poderá contudo constituir uma esfera privilegiada de interacção senão de inclusão e coesão social, requestionando os conceitos de cidadania. A sustentação de bons indicadores de saúde, nomeadamente materna e infantil, decorre de estratégias abrangentes de saúde pública e de políticas visionárias que contemplem sempre e também os mais necessitados. Procurando conhecer melhor os contextos em que ocorre o nascimento de recém-nascidos de muito baixo peso, este projecto corresponde a um estudo exploratório na maior maternidade do país, procurando entender a eventual associação de factores de índole social e familiar, nomeadamente ser de origem migrante. --------------------------- ABSTRACT - Transnational migration of people has clearly become a global and growing issue causing, on different national grounds, social change and adaptative challenges to society and its institutions. L’ethnographie de la détention frontalière en France se penche sur le phénomène des migrations transnationales et sur le gouvernement des frontières qui y répond, à travers des pratiques d’enfermement et d’expulsion des étrangers dans une « zone d’attente » aéroportuaire. La construction des camps d’étrangers, dont relève ce terrain, témoigne de nouvelles distributions du pouvoir qui passent par l’accès à la mobilité. L’étude empirique d’une forme particulière de ce contrôle est ainsi le point de départ d’une réflexion plus large sur ce régime de gouvernement, qui dessine une autre topographie politique de la globalisation. L’enquête nous invite à comprendre les pratiques par lesquelles les gouvernements démocratiques administrent des populations non-citoyennes, et la façon dont ces modalités de prise en charge et de surveillance opèrent une reconfiguration des frontières physiques, morales et politiques. L’ethnographie s’interroge sur l’expérience quotidienne de ceux qui sont les sujets de ces régimes juridiques et humanitaires croisés. Le confinement des étrangers entrecroise plusieurs dimensions, qui organisent la recherche : la construction d’un enfermement humanitaire, et les usages institutionnels et militants de différents régimes de droits qui y sont en jeu; les pratiques de prise en charge de populations identifiées comme vulnérables; les reconfigurations de la frontière à travers de nouvelles formes réticulaires et zonales; et enfin, l’expérience de circulation que dessinent les archipels de surveillance, et les pratiques de gestion différentielle des mobilités dont participent les zones d’attente.

El presente trabajo de investigación busca responder cuestiones relativas a los procesos de formación de identidades bajo la lógica de un modelo transnacional de las migraciones. De manera más específica, es un intento por analizar el desarrollo de los sucesos que provocaron en enero de este año el revocamiento del mandato de Zine El Abidine Ben Alí, quien se mantuvo en el poder desde 1987, a la luz de conceptos como la identidad nacional, la migración transnacional y la formación de identidades. ¿Cuál es el proyecto nacional que se está planteando la sociedad tunecina actual y sobre cuáles han sido los factores sociales, políticos, económicos y culturales que han determinado las actuaciones de los tunecinos luego de su independencia de Francia. ¿Han sido estas protestas el reflejo de un cambio en la manera en la cual los tunecinos se identifican unos con otros?, o, en otras palabras, ¿el proyecto político emprendido por la sociedad tunecina actual responde a un cambio en la construcción de identidad de la nación, y cuáles han sido los factores que han determinado ese proceso?

La religión es un tema que se ha ligado a los temas de migración debido al interés en las transacciones e interconexiones que se presentan entre los migrantes y sus familias residentes en los países de origen, así como a la importancia que tienen las prácticas religiosas para los migrantes en sus países de destino. Al examinar casos concretos de migración y al comparar diferentes grupos religiosos –tanto católicos como quienes no están vinculados a una institución religiosa– se observa la continuidad y los cambios de las formas de pertenencia, cuyas raíces provienen de la historia colonial. Analizando los procesos de construcción del espacio religioso se investiga si el traslado de concepciones e imágenes religiosas está provocando nuevos esencialismos o culturas híbridas, en las cuales se articulan bricolajes de ideologías y cosmovisiones. Los casos comparados evidencian que las religiones y sus aparatos tienen una importante influencia en las concepciones y percepciones del espacio, los cuales determinan las prácticas y pertenencias sociales.

Recent research in Sub-Saharan Africa has revealed the importance of children’s caring roles in families affected by HIV and AIDS. However, few studies have explored young caregiving in the context of HIV in the UK, where recently arrived African migrant and refugee families are adversely affected by the global epidemic. This paper explores young people’s socio-spatial experiences of caring for a parent with HIV, based on qualitative research with 37 respondents in London and other urban areas in England. In-depth semi-structured interviews were conducted with young people with caring responsibilities and mothers with HIV, who were predominantly African migrants, as well as with service providers. Drawing on their perspectives, the paper discusses the ways that young people and mothers negotiate the boundaries of young people’s care work within and beyond homespace, according to norms of age, gender, generational relations and cultural constructions of childhood. Despite close attachments within the family, the emotional effects of living with a highly stigmatised life-limiting illness, pressures associated with insecure immigration status, transnational migration and low income undermined African mothers’ and young people’s sense of security and belonging to homespace. These factors also restricted their mobility and social participation in school/college and neighbourhood spaces. While young people and mothers valued supportive safe spaces within the community, the stigma surrounding HIV significantly affected their ability to seek support. The article identifies security, privacy, independence and social mobility as key dimensions of African young people’s and mothers’ imagined futures of ‘home’ and ‘family’.

Hindu diaspora is now a global phenomenon, from the early immigrant experience as coolie labourers through the transnational movement of professional Hindus/Indians to many corners of the globe. In this paper, I intend to contextualize Hindu diaspora experience in Australia in the broader theoretical thinking on transnational migration, globalization and heterogeneity. One concern is to understand how distinctive is the religious diaspora experience of Hindus in Australia from those of the international South Asia diaspora. Much literature on South Asians in the West neglect religion, while recent studies disclose the considerable prominence of religion in various communities, especially in comparison with the secularizing tendencies typical of many white societies.

Place identification in urban sociology has traditionally be associated with a sense of ‘being at home’ and connected to the formation of stable and fixed identities. The rise in transnational migration and the increasing number of refugees around the world has made particular regions and communities, within many western nations, culturally diverse. This has led to a re-conceptualisation and re-examination of the relationship between place and home. In light of this new paradigm I explore the existence of multicultural places and investigate the ways, if any, we can speak of ‘being at home’ in these diverse urban places. If home has been traditionally associated with order, sameness and identity while multicultural places are conceptualised in terms of fluidity, contingency, heterogeneity and difference then there seems to be an inherent tension between these two ideas. Are the ideas of home and multiculturalism mutually exclusive? I maintain that they are dialectically interwoven, especially when we acknowledge that otherness and home should not be conceived in binary terms. In order to examine this complex relationship the paper provides a brief discussion of home within the discourses of modernity and postmodernity and then links these discourses to phenomenological and sociological approaches to home. The concluding section demonstrates how home and otherness are expressed in intercultural moments where sameness and diversity rub against each other causing occasional friction but also moments of intercultural dialogue.

The focus of this data is on the transformation of the village Zavoj in the Republic of Macedonia, due to emigration from the village, recorded through the architectural changes to the houses in the village. The village had become by default a place for the accommodation of elderly people who did not want to join their offspring abroad in the cities of immigration, or in the fringe suburbs of nearby towns.

The data documents the ‘material history’ of the houses, and constitutes a longitudinal research project tracing the transformation of the architectural fabric of the village since 1988. It includes visual documentation such as photographs and drawings, and includes the houses as HOUSE-STATES as follows:

House-Traditional: Vernacular architecture still in use and maintained as a dwelling.
House-Construction: Buildings that are still being constructed, the house as ongoing construction site.
House-Fragment: An eMigrant house-fragment is juxtaposed with the vernacular dwelling. Typical and affordable techniques of single brick cavity and reinforced concrete structure are evident in the new fragment.
House-Closed: Many new houses have only one door and one window, height, size and volume are minimal; and are closed a lot of the time.
House-Ruin: Vernacular traditional dwellings that are deteriorating. Traditional vernacular dwellings are rarely renovated, reconstructed or repaired.

The data is complemented by several field-work methods including participant observation, interviews, documentation of the village as a totality, recording of oral histories and myths, festivities, and archival statistical research about the vicinity.

This dataset comprises photographic documentation, sketch/drawing documentation, digital interview recordings, and interview notes.

The present work attempts a comparative perspective of the apparel industry that make use of foreign workers in the São Paulo City and New York City. We have among the central hypothesis the increase of sector based in the use of illegal immigrants workforce and precarious work relations. Seek to understand the phenomenon from their own mechanisms cultures immigration historically established in these cities and in the productive sector. For such, we use a literature review about the transnational migration of workers and the sector productive organization. We expect to constitute theoretical instrumental that contributes for the understanding of the thematic and allow establishing links between the Brazilian and the U.S experience.

Questo studio propone un'esplorazione dei nessi tra processi migratori ed esperienze di salute e malattia a partire da un'indagine sulle migrazioni provenienti dall'America latina in Emilia-Romagna. Contemporaneamente indaga i termini del dibattito sulla diffusione della Malattia di Chagas, “infezione tropicale dimenticata” endemica in America centro-meridionale che, grazie all'incremento dei flussi migratori transnazionali, viene oggi riconfigurata come 'emergente' in alcuni contesti di immigrazione. Attraverso i paradigmi teorico-metodologici disciplinari dell'antropologia medica, della salute globale e degli studi sulle migrazioni, si è inteso indagare la natura della relazione tra “dimenticanza” ed “emergenza” nelle politiche che caratterizzano il contesto migratorio europeo e italiano nello specifico. Si sono analizzate questioni vincolate alla legittimità degli attori coinvolti nella ridefinizione del fenomeno in ambito pubblico; alle visioni che informano le strategie sanitarie di presa in carico dell'infezione; alle possibili ricadute di tali visioni nelle pratiche di cura. Parte della ricerca si è realizzata all'interno del reparto ospedaliero ove è stato implementato il primo servizio di diagnosi e trattamento per l'infezione in Emilia-Romagna. È stata pertanto realizzata una etnografia fuori/dentro al servizio, coinvolgendo i principali soggetti del campo di indagine -immigrati latinoamericani e operatori sanitari-, con lo scopo di cogliere visioni, logiche e pratiche a partire da un'analisi della legislazione che regola l'accesso al servizio sanitario pubblico in Italia. Attraverso la raccolta di narrazioni biografiche, lo studio ha contribuito a far luce su peculiari percorsi migratori e di vita nel contesto locale; ha permesso di riflettere sulla validità di categorie come quella di “latinoamericano” utilizzata dalla comunità scientifica in stretta correlazione con il Chagas; ha riconfigurato il senso di un approccio attento alle connotazioni culturali all'interno di un più ampio ripensamento delle forme di inclusione e di partecipazione finalizzate a dare asilo ai bisogni sanitari maggiormente percepiti e alle esperienze soggettive di malattia.

Around the world borders are militarized, states are stepping up repressive anti-immigrant controls, and native publics are turning immigrants into scapegoats for the spiraling crisis of global capitalism. The massive displacement and primitive accumulation unleashed by free trade agreements and neo-liberal policies, as well as state and “private” violence has resulted in a virtually inexhaustible immigrant labor reserve for the global economy. State controls over immigration and immigrant labor have several functions for the system: 1) state repression and criminalization of undocumented immigration make immigrants vulnerable and deportable and therefore subject to conditions of super-exploitation, super-control and hyper-surveillance; 2) anti-immigrant repressive apparatuses are themselves ever more important sources of accumulation, ranging from private for-profit immigrant detention centers, to the militarization of borders, and the purchase by states of military hardware and systems of surveillance. Immigrant labor is extremely profitable for the transnational corporate economy; 3) the anti-immigrant policies associated with repressive state apparatuses help turn attention away from the crisis of global capitalism among more privileged sectors of the working class and convert immigrant workers into scapegoats for the crisis, thus deflecting attention from the root causes of the crisis and undermining working class unity. This article focuses on structural and historical underpinnings of the phenomenon of immigrant labor in the new global capitalist system and on how the rise of a globally integrated production and financial system, a transnational capitalist class, and transnational state apparatuses, have led to a reorganization of the world market in labor, including deeper reliance on a rapidly expanding reserve army of immigrant labor and a vicious new anti-immigrant politics. It looks at the United States as an illustration of the larger worldwide situation with regard to immigration and immigrant justice. Finally, it explores the rise of an immigrant justice movement around the world, observes the leading role that immigrant workers often play in worker’s struggles and that a mass immigrant rights movement is at the cutting edge of the struggle against transnational corporate exploitation. We call for replacing the whole concept of national citizenship with that of global citizenship as the only rallying cry that can assure justice and equality for all.
