[ES] La crisis económica ha agravado la situación de pobreza y precariedad en las familias españolas y vascas. Ejemplo de ello es el aumento de las familias que han sufrido o están sufriendo un proceso de desahucio. Con esta investigación, además de contextualizar este fenómeno de la pérdida de vivienda, queremos analizar los derechos de la infancia que se vulneran; cómo actúan los distintos agentes encargados de salvaguardar los derechos humanos de las/os menores cuando éstos están inmersos en un proceso de desahucio. En el marco teórico exponemos el fenómeno del desahucio de los derechos de la infancia. La metodología utilizada es cualitativa, y para ello nos basaremos en entrevistas en profundidad y semi-estructuradas a diferentes agentes implicados (dos familias que están viviendo un proceso de desahucio, dos abogadas y una trabajadora social). A partir de las conclusiones del estudio, hemos elaborado unas propuestas de mejora de la situación de las y los menores y la defensa de sus derechos.

Esta pesquisa busca investigar um processo em curso, onde a estratégia do empreendedorismo na gestão das políticas públicas urbanas vem se adaptando e se conformando ao atual contexto de política econômica chamada de neodesenvolvimentismo. Para isso, as parcerias público-privadas tem um papel fundamental na gestão do desenvolvimento urbano, no âmbito das três esferas de poder. Abordaremos, portanto, o histórico das reformas políticas do País que levaram a uma evolução da política de nacional-desenvolvimentismo ao novo desenvolvimentismo, para entendermos o contexto no qual as atuais parcerias público-privadas vem sendo desenvolvidas como modelo para de gerir o território. Mencionaremos também a legislação e os discursos por trás da defesa deste tipo de negócio entre o poder público e o setor privado. Ainda, como o país enfrentou a crise de 2008, chamada de crise das crises, utilizando esse modelo de gestão do território. Os megaeventos esportivos serão analisados como um fator catalizante da atração de investimentos e negócios para as cidades. No Rio de Janeiro, com a escolha da cidade para sediar os Jogos Olímpicos, e também sendo uma das cidades sedes da Copa do Mundo FIFA de 2014, várias de transformações territoriais se iniciaram. Com fortes indícios de que uma série de violações estava por vir, a fim de abrir espaço e ampliar o mercado dos investimentos privados. O Parque Olímpico, como principal local de competições das Olimpíadas de 2016, configura-se como uma imensa oportunidade de negócios com a iniciativa privada, localizado em área de ampla expansão do mercado imobiliário da cidade: a Barra da Tijuca. Diante disso, muitas comunidades pobres vem sofrendo com a política de deslocamento forçado para dar lugar aos investimentos no território. Neste contexto, está a comunidade Vila Autódromo, estabelecida bem ao lado do local de implementação do empreendimento. Sua remoção está prevista no estudo de viabilidade e no edital de concessão. Estudaremos a parceria público-privada realizada para a construção do Parque Olímpico, através da análise dos documentos relacionados ao seu processo licitatório e a escolha do consórcio vencedor. Ainda, como esse empreendimento tem impactado no caso da comunidade Vila Autódromo, que além de já ter sido alvo de outras tentativas de remoção, foi objeto de uma política de regularização fundiária no passado e tem um intenso histórico de resistência e de luta pela permanência.

Animal fights are typically preceded by displays and there is debate whether these are always honest. We investigated the prefight period in hermit crabs, Pagurus bernhardus, during which up to four types of display plus other activities that might provide information are performed. We determined how each display influences or predicts various fight decisions, and related these displays to the motivational state of the attacker, as determined by a startle response, and of the motivational state of the defender, as determined by the duration for which it resisted eviction from its shell. Two displays appeared to have consistent but different effects. Cheliped presentation, where the claws were held in a stationary position, often by both crabs but for longer by the larger, seemed to be honest, and allowed for mutual size assessment. This display enhanced the motivation and the success of the larger crab. In contrast, cheliped extension, involving the rapid thrust of the open chelae towards the opponent, did not seem to allow for mutual size assessment and may contain an element of bluff. It was performed more by the smaller crab and enhanced its success. The complexity of displays in this species appears to allow for both honesty and manipulation.

During agonistic interactions the motivation of each contestant is expected to vary because of increased information and changes in fighting ability. In shell fights between hermit crabs over gastropod shells, attackers rap their shell in a series of bouts against that of the defender whereas defenders remain withdrawn into their shells until the encounter is resolved; either the defender is evicted from its shell or the attacker 'gives up' and the defender retains its shell. We assessed the motivational state of attackers for performing rapping by measuring the duration of startle responses elicited by a novel stimulus. We staged fights between pairs of crabs in six different groups defined by the potential gain in shell quality available to attackers (high or low) and by the point at which the novel stimulus was applied (prior to rapping, after one bout or after four bouts). Startle response duration decreased during the first four bouts of fighting and showed a U-shaped relationship with the relative difference in size between the crabs. There was, no difference in startle response duration between high- and low-gain groups. Individuals showing short startle responses were likely to be victorious and we conclude that the relationship between the relative size difference of the opponents and. startle duration reflects that between size difference and the cost of gaining an eviction. Agonistic interactions between animals are often settled by the use of repeated signals which advertise the resource-holding potential of the sender. According to the sequential assessment game this repetition increases the accuracy with which receivers may assess the signal, but under the cumulative assessment model the repeated performances accumulate to give a signal of stamina. These models may be distinguished by the temporal pattern of signalling they predict and by the decision rules used by the contestants. Hermit crabs engage in shell fights over possession of the gastropod shells that they inhabit. During these interactions the two roles of signaller and receiver may be examined separately because they are fixed for the duration of the encounter. Attackers rap their shell against that of the defender in a series of bouts whereas defenders remain tightly withdrawn into their shells for the duration of the contest. At the end of a fight the attacker may evict the defender from its shell or decide to give up without first effecting an eviction; the decision for defenders is either to maintain a grip on its shell or to release the shell and allow itself to be evicted. We manipulated fatigue levels separately for attackers and defenders, by varying the oxygen concentration of the water that they are held in prior to fighting, and examined the effects that this has on the likelihood of each decision and on the temporal pattern of rapping. We show that the vigour of rapping and the likelihood of eviction are reduced when the attacker is subjected to low oxygen but that this treatment has no effect on rates of eviction when applied to defenders. We conclude that defenders compare the vigour of rapping with an absolute threshold rather than with a relative threshold when making their decision. The data are compatible with the cumulative assessment model and with the idea that shell rapping signals the stamina of attackers, but do not fit the predictions of the sequential assessment game.

This paper examines the position of planning practices operated under precise guidelines for displaying modernity. Cultivating the spatial qualities of Cairo since the 1970s has unveiled centralised ideologies and systems of governance and economic incentives. I present a discussion of the wounds that result from the inadequate upgrading ventures in Cairo, which I argue, created scars as enduring evidence of unattainable planning methods and processes that undermined its locales. In this process, the paper focuses on the consequences of eviction rather than the planning methods in one of the city’s traditional districts. Empirical work is based on interdisciplinary research, public media reports and archival maps that document actions and procedures put in place to alter the visual, urban, and demographic characteristics of Cairo’s older neighbourhoods against a backdrop of decay to shift towards a global spectacular. The paper builds a conversation about the power and fate these spaces were subject to during hostile transformations that ended with their being disused. Their existence became associated with sores on the souls of its ex-inhabitants, as outward signs of inward scars showcasing a lack of equality and social justice in a context where it was much needed.

A diverse body of empirical literature recognizes that investment can influence tenure security, yet this phenomenon has rarely been examined analytically. This paper develops a theoretical model that demonstrates explicitly conditions under which the probability of eviction is endogenous to investment undertaken on illegally encroached land. By accommodating explicitly the government's objective function and its ability to commit credibly to an eviction policy, the model reveals why both those farmers who under-invest, and those who raise their investment levels to improve tenure security, may be behaving rationally. Indeed, both types of behaviour are accommodated within a single model.

Este estudo tem o objetivo de verificar o tratamento dado aos contratos de Locação Comercial de Devedor Locatário em Recuperação Judicial. A lei 11.101/2005 determina, em seus artigos 117 e 119,VII, que os contratos bilaterais não se resolvem pela falência e que na falência do locatário, o administrador judicial pode, a qualquer tempo, denunciar o contrato. Porém, a lei é lacônica a respeito do processo de Recuperação Judicial. Então, o estudo pretende verificar a aplicabilidade dos artigos pertinentes à falência, aos contratos de Devedor submetido ao processo de Recuperação Judicial. Com o intuito de realizar interpretação congruente com a eficiência que se espera da legislação em comento, a metodologia utilizada no trabalho é a da Análise Econômica do Direito, segundo os contornos conferidos pelo autor THOMAS H. JACKSON. Assim, o trabalho aproveita os conceitos do common pool assets e dos executory contracts para auxiliar na compreensão da função dos contratos de locação no Processo de Recuperação Judicial. Nesse sentido, o estudo é importante, pois estabelece parâmetros de interpretação teleológica da legislação concursal, considerando-se as tensões entre o Direito Material e Concursal aplicáveis a hipótese aqui formulada. Então, constatou-se que o tema gera divergência de entendimentos perante a jurisprudência brasileira, no que se refere a possibilidade, ou não, de despejar locatário Devedor em Recuperação Judicial. A controvérsia ronda, principalmente, em torno de duas questões: (a) a aplicação do principio da preservação da empresa, presente no art. 47. da L.11.101/2005 (b) (i)liquidez da ação de despejo por falta de pagamento para fins do artigo 6 da mesma lei. Por fim, o estudo avalia forma pela qual a jurisprudência trata do tema e a sua compatibilidade com a metodologia de Análise Econômica Aplicável ao Direito Concursal.

The study that aimed at understanding the dynamics of forced livestock movements and pastoral livelihood and development options was conducted in Lindi and Ruvuma regions, using both formal and informal approaches. Data were collected from 60 randomly selected Agro-pastoralists/Pastoralists and native farmers using a structured questionnaire. Four villages were involved; two in Lindi region (Matandu and Mkwajuni) and the other two in Ruvuma region (Gumbiro and Muhuwesi). Data were analyzed using descriptive statistics of SPSS to generate means and frequencies. The results indicate that a large number of animals moved into the study area following the eviction order of the government in Ihefu wetlands in 2006/2007. Lindi region was earmarked by the government to receive all the evicted pastoralists. However, by 2008 only 30% of the total cattle that were expected to move into the region had been received. Deaths of many animals on transit, selling of the animals to pay for transportation and other costs while on transit and many pastoralists settling in Coastal and Ruvuma regions before reaching their destinations were reported to be the reasons for the discrepancy observed. To mitigate anticipated conflicts between farmers and pastoralists, Participatory Land Use Management (PLUM) plans were developed in all the study villages in order to demarcate village land area into different uses, including grazing, cropping, settlement and forests. Land units for grazing were supposed to be provided with all necessary livestock infrastructures (dips, charcoal dams, livestock markets and stock routes). However, the land use plans were not able to prevent the anticipated conflicts because most of the livestock infrastructures were lacking, the land use boundaries were not clearly demarcated and there was limited enforcement of village by-laws, since most had not been enacted by the respective district councils. Similarly, the areas allocated for grazing were inadequate for the number of livestock available and thus the carrying capacity exceeded. Thus, land resource-based conflicts between farmers and pastoralists were emerging in the study areas for the reason that most of the important components in the PLUM plans were not in place. Nevertheless, the arrival of pastoralists in the study areas had positive effects on food security and growth of social interactions between pastoralists and farmers including marriages between them. Environmental degradations due to the arrival of livestock were also not evident. Thus, there is a need for the government to purposely set aside enough grazing land with all necessary infrastructures in place for the agro-pastoral/pastoral communities in the country.
