A teoria da sociedade de risco foi estabelecida por Ulrich Beck no ano de 1986 por meio da obra Risikogesellschaft - Auf dem Weg in eine andere Mordene. Beck propõe um novo rumo para a pesquisa sociológico segundo o qual o parâmetro clássico de estudo das ciências sociais baseado na luta entre classe deveria ser superado, pois esse modelo seria incapaz de explicar as complexas relações da sociedade moderna (pós-industrial) em que a característica principal não mais se encontra na disputa entre detentores do capital e explorado, mas, sim, em tentar reduzir ou repartir de modo mais justo os riscos sociais. Foi estabelecida a teoria da sociedade de risco a partir do incremento da tecnologia (por exemplo, energia nuclear, produção de alimentos transgênicos, etc). Com essas novas técnicas científicas praticamente impossível é conter os riscos sociais, uma vez que são neste momento difusos, ou seja, atingem um número indeterminado de pessoas. Neste ambiente de proliferação de riscos a demanda social direcionada à proteção por meio de intrumentos de controle dos riscos ganha papel de destaque. O sentimento social de insegurança baseia-se, principalmente, no fato de não ser mais o ser humano capaz de prever todos os efeitos das condutas a que está sendo diariamente exposto. Diante desse novo quadro social, o Direito, em especial, o Direito Penal não deve mostrar indiferença às necessidades de proteção. Neste contexto, questiona-se se o Direito Penal clássico, isto é, o Direito Penal produzido segundo bases Iluministas tipicamente liberal-burguesas do final século XIX conseguirá fornecer respostas úteis a um modelo social tão diferente daquele originalmente considerado. É necessário um arcabouço teórico próprio aos dias atuais, sem desconsiderar o avanço no campo dos direitos humanos. Defende-se na presente dissertação ter o Direito Penal por escopo a proteção de bens jurídicos, desde que, evidentemente, estejam lastreados no princípio da dignidade humana que serve de inspiração a todos os ordenamentos materialmente democráticos na atualidade. Não se pode negar o relevante papel assumido pelo bem jurídico-penal individual como contenção do jus puniendi estatal, no entanto, tal instrumento teórico deve ser combinado a outro: o bem jurídico-penal transindividual. Como técnica dogmática visando à gestão dos riscos por meio do Direito Penal destinado à proteção de bens jurídicos transindividuais adotar-se-á, geralmente, a utilização de tipos penais de perigo abstrato. Por fim, expõe este trabalho como pode ser empregado o bem jurídico-penal transindividual em zonas de difusão de riscos como a genética e o meio-ambiente.

O contexto da modernização reflexiva leva ao questionamento sobre o papel das instituições tradicionais, notadamente o Poder Executivo. É possível pressupor que o modelo da sociedade de risco se reflete em alterações no direito e na economia do Brasil. Os riscos tornaram-se uma constante e exigem substituições nas formas de atuação social, o que Ulrich Beck denomina de subpolítica. A mudança é sentida especialmente em setores centrais para economia, tais como o de petróleo e gás, enquanto os riscos globais são sentidos na crise ambiental. Uma vez que as instituições, na Sociedade de Risco, são levadas a rever sua atuação, o empresariado recebe a tarefa de encontrar mecanismos para superar a crise ambiental. A responsabilidade socioambiental da empresa passa a ser exigida como contrapartida pelos lucros obtidos, especialmente para atividades potencialmente poluentes, como a petrolífera. O princípio da precaução, o desenvolvimento sustentável e a equação financeira do contrato podem ser vetores para a adoção da responsabilidade socioambiental pela indústria petrolífera. Mas para que esta possa ser vista como uma nova razão pública deve se demonstrar que ela pode motivar a evolução da sociedade como um todo. A Rio+20 definiu a economia verde como uma nova meta, principalmente para as atividades potencialmente poluentes. O objetivo central do trabalho é investigar a regulação das empresas de petróleo e gás, especialmente sobre a possibilidade de adoção da responsabilidade socioambiental. Ressalte-se que esta visa impor medidas de conservação e ações pró meio ambiente, além daquelas já estipuladas por força legal ou pelo licenciamento ambiental. A pesquisa visa apresentar possíveis soluções para os questionamentos acima, garantindo segurança jurídica para empresas de petróleo e gás, mas ao mesmo tempo visando ampliar a sustentabilidade do setor, propondo novas regras que podem ser adotadas nos editais de licitação e nos contratos de concessão e partilha de produção. Em um momento que se debate a possibilidade de direcionamento dos royalties do petróleo exclusivamente para a educação o estudo de medidas jurídicas para implementar a responsabilidade socioambiental no setor petrolífero torna-se ainda mais necessária.

Gender and Cosmopolitanism in Europe combines a feminist critique of contemporary and prominent approaches to cosmopolitanism with an in-depth analysis of historical cosmopolitanism and the manner in which gendered symbolic boundaries of national political communities in two European countries are drawn. Exploring the work of prominent scholars of new cosmopolitanism in Britain and Germany, including Held, Habermas, Beck and Bhabha, it delivers a timely intervention into current debates on globalisation, Europeanisation and social processes of transformation in and beyond specific national societies.

Gerade männliche Jugendliche nutzen in ihrer Pubertät und Adoleszenz zu einer gelingenden Gestaltung ihres Alltags und zur Ausbildung ihrer Identität zahlreiche Erscheinungsformen des Fantasy-Rollenspielens. In einem Prozess von Aneignung und Entäußerung integrieren dabei die Jugendlichen das überaus reiche multimediale Angebot, welches die Spiele bieten, in ihre Alltagsgestaltung, indem sie sich daraus spezifische Medien-, Text- und Ereignisarrangements bauen. Diese dienen einerseits der sozialen Integration und Distinktion, andererseits der Präsentation ihrer Identitätsentwürfe sich und anderen. Die Jugendlichen schaffen sich mittels dieser spezifischen Medien-, Text- und Ereignisarrangements eine in weiten Teilen von ihnen selbst bestimmte Welt, in der sie ihre Phantasie wie Kreativität mit großer Intensität, ja Obsession, innerhalb integrativer und solidarischer Interaktionsformen selbststeuernd und professionell ausleben. Diese Medien-, Text- und Ereignisarrangements zeigen Angebots- und Nutzungsformen, die sich nach einem medienkommunikativen Aneignungs- und Entäußerungsmodell in der Tradition der Cultural Studies (Stuart Hall) beschreiben lassen. Die Langzeitbeobachtung der Jugendlichen zeigt, dass sie alltagspragmatische Kulturtechniken zur selbstbestimmten Gestaltung von Alltag entwickeln: zunächst eine Strukturierung ihrer kognitiven, affektiven und pragmatischen Interaktion nach Kriterien erfolgreicher intrinsischer Interaktion, mit dem Ziel derer Perpetuierung im Flow-Erleben (Mihalyi Csikszentmihalyi), dann eine Ästhetisierung von Alltagswirklichkeit mittels kollektiver Fiktionalisierung in der Tradition des Collective Story Telling (Janet H. Murray). Diese Kulturtechniken stellen vor dem Hintergrund der Enkodierung und Dekodierung sozialer Codes spezifische Adaptionen von Prozessen der Bedeutungszuweisung und Subjekt- bzw. Identitätskonstitution dar. Die sie evozierenden und mit ihnen korrespondierenden handlungsleitenden Themen der Jugendlichen sind der Wunsch nach Rekonstitution von Gesamtheit in einer sich fragmentarisierenden Wirklichkeit, die Affirmation von Selbstbestimmung- und Autonomieerfahrungen, das Erleben von Reintegration und Solidarität für das sich dissoziiert erfahrende Individuum. Das Handeln der Jugendlichen basiert damit auf dem momentan dominanten Prozess einer Individualisierung von Lebenswelt unter den Bedingungen von Reflexivität und Erlebnisrationalität in der postmodernen Gesellschaft. Mit ihren Versuchen selbstbestimmter Gestaltung folgen sie dem aktuellen gesellschaftlichen Auftrag einer weitgehend in eigener Regie vorzunehmenden Lokalisierung dieses Prozesses. Zunehmend tritt diese von den Jugendlichen selbstgesteuerte Sozialisation neben die traditionell heteronome Sozialisation von gesellschaftlichen Instituten wie etwa die von Schule. Damit wird das Handeln der Jugendlichen zu einer Herausforderung an Pädagogik und Schule. Schule muss, wenn sie ihrem eigentlichen Auftrag von Förderung gerecht werden will, eine Sensibilität für diese Eigenständigkeit von Jugendlichen entwickeln und in der Beobachtung ihres Handelns didaktische Innovationen für Lehren und Lernen entwickeln. Im Mittelpunkt steht dabei die Wiederentdeckung des pädagogischen Dialogs, besonders aber die Entwicklung einer individualisierten Lernkultur und die Förderung jugendlicher Gestaltungskompetenzen, welche von deren alltagsästhetischen Erfahrungen und Kompetenzen im Umgang mit multimedialen Kulturprodukten ausgeht. Schule kann und muss für diese Prozesse selbstgesteuerten Lernens angemessene pädagogische Räume bereitstellen, in denen die Jugendlichen innerhalb eines geschützten Kontextes in der Auseinandersetzung mit eigenen wie fremden Entwürfen ihre Identität entwickeln können.

In 2000, Victoria’s largest regional council, the City of Greater Geelong, allocated $200,000 to fund a community art and place-making project in inner Geelong West. The Walk West project was conceptualised and lobbied by a community group for six years. The project addressed the impact of a large section of freeway installed in the seventies and its consequences for quality of life in the locality.

This article reports on an example of highly developed community relations. It examines public art and placemaking as public communication tools and their relationship to political and social activity in post-amalgamation Victoria. In particular it applies the theories of Ulrich Beck and the notion of reflexive modernity in risk society where citizens’ initiative groups will play an increasingly important role in reclaiming the biological and cultural heritage lost as a result of ‘progress’.

In what Ulrich Beck calls "risk society," and Anthony Giddens a "runaway world," a climate of fear and insecurity has been created by scientific progress, leading to a loss of confidence in the ability of experts to manage risk. Resilience is at the forefront of psychology research informing child-rearing strategies (Luthar, et al.); it entails an approach to child welfare that focuses on fostering internal (psychological) and external (cultural) assets that develop a child's ability to triumph over adversity in the form of individual, familial, and cultural stresses.

This article examines Philip Reeve’s novel for children, Mortal Engines, and M.T. Anderson’s young adult novel, Feed, by assessing these dystopias as prototypical texts of what Ulrich Beck calls risk society. Through their visions of a fictional future, the two narratives explore the hazards created by contemporary techno-economic progress, predatory global politics and capitalist excesses of consumption. They implicitly pose the question: “In the absence of a happy ending for western civilisation, what kind of children can survive in dystopia?”

This paper investigates the high-earning children's series, A Series of Unfortunate Events, in relation to the skills young people require to survive and thrive in what Ulrich Beck calls risk society. Children's textual culture has been traditionally informed by assumptions about childhood happiness and the need to reassure young readers that the world is safe. The genre is consequently vexed by adult anxiety about children's exposure to certain kinds of knowledge. This paper discusses the implications of the representation of adversity in the Lemony Snicket series via its subversions of the conventions of children's fiction and metafictional strategies. Its central claim is that the self-consciousness or self-reflexivity of A Series of Unfortunate Events} models one of the forms of reflexivity children need to be resilient in the face of adversity and to empower them to undertake the biographical project risk society requires of them.

This paper overviews a case study of environmental grassroots activism in Victoria, Australia, between 1995 and 2003. The Otway Ranges Environment Network (OREN) is significant for its successful communication campaign to change forest practices and policy decision-making in the Otway Ranges, and for its intervention in a long-standing and exclusive relationship between government and the timber industry. This paper describes and analyses pivotal parts of the OREN campaign: firstly, the group's strategy to boycott paper and pulp manufacture Kimberly-Clark Australia; and secondly, its decision to participate in the West Victoria Regional Forest Agreement (RFA) process to negotiate the future of Otway forest. Informed by the empirical research and the works of social theorists Ulrich Beck and Jurgen Habermas, this paper outlines a strategic approach to communication that is effective, fair and sustainable, and that can be applied by other non-profits - especially those that operate in politically volatile environments with a grassroots agenda.

Universities are under no less pressure to adopt risk management strategies than other public and private organisations. The risk management of doctoral education is a particularly important issue given that a doctorate is the highest academic qualification a university offers and stakes are high in terms of assuring its quality. However, intense risk management can interfere with the intellectual and pedagogical work which are essentially part of doctoral education. This paper seeks to understand how the culture of risk meets the culture of doctoral education and with what effect. The authors draw on sociological understandings of risk in the work of Anthony Giddens (2002) and Ulrich Beck (1992), the anthropological focus on liminality in the work of Mary Douglas (1990), and the psychological theorising of human error in the work of James Reason (1990). The paper concludes that risk consciousness brings its own risks—in particular, the potential transformation of a culture based on intellect into a culture based on compliance.

Ultramodernity (Willaime 2006), following on from modernity, has been characterised as an era of fear, risk and uncertainty and paradoxically as a time of great hope and global interdependence (Baumann 2006; Beck 2006; Obama 2006). Following the events of September 11, 2001, the Bali and London bombings, a climate of fear has inspired a plethora of policies that have eroded civil liberties, jeopardising trust in state systems and thereby inadvertently elevating the risk of further violence, particularly in so-called Western societies. Conversely, ultramodern scholars, including Jürgen Habermass and Ulrich Beck, have advocated cosmopolitan solutions to more effectively and cooperatively counter global risks. These optimistic scenarios, while reaching populist proportions, have also received their fare share of criticism (Brassett 2008). Indeed, when we look toward the current state of the United Nations it is difficult not to lose hope. Where is the proof that Immanuel Kant’s cosmopolitan condition is coming into being in the global arena beyond these sociological theories? I argue that the rise of multifaith movements in ultramodernity provides this much needed evidence.

 German Sociologist, Ulrich Beck’s seminal political analysis of risk, Risk Society: Towards a New Modernity, in 1992 posited the concept of ‘risk’ that has become privatised, objectified and a matter for individual concern. This study examines how the management of ‘risk’ is achieved through individual scrutiny, audit and review and the impact these practices have on changing VET practitioner identity. Preliminary PhD interviews with VET practitioners, using grounded theory methodology, identified the symbiotic nature of risk management and generation within the current diverse and challenging VET environment. Resistance or acquiescence to compliance practices and the performative VET environment have significant implications for VET practitioners’ identity construction.

Cette recherche propose une analyse critique du droit applicable à deux dimensions de la gestion des risques : l’indemnisation des dommages au moyen de l’assurance et la prévention des risques au moyen du principe de précaution. Dans une perspective interdisciplinaire, l’interaction du droit avec les rationalités politique, économique, scientifique et sociale est soulignée par l’opposition de deux théories : la Société du risque d’Ulrich Beck et la Société assurantielle de François Ewald. L’argumentation révèle les différentes significations de la limite de l’assurance privée en droit et les discours dissonants quant aux stratégies juridiques utilisées face aux risques. Le mémoire fournit ainsi des balises essentielles à la réflexion juridique critique. L’originalité de l’angle d’analyse, qui tient compte de l’évolution du droit en lien avec la modification de la rationalité politique survenue au XIXe siècle avec l’industrialisation des sociétés occidentales, permet d’enrichir l’épistémologie juridique. Il en découle entre autres une réflexion au sujet de l’évolution des conceptions théoriques du droit et de son rôle social escompté.
