L'arbitrato estero

La tesi tratta l'istituto dell'arbitrato estero sotto la duplice prospettiva internazionale e italiana. Particolare attenzione è dedicata alla disciplina dettata in materia dalla Convenzione di New York del 1958 in tema di riconoscimento e l'esecuzione delle sentenze arbitrali estere, con uno sguardo preferenziale alle interpretazioni e alle applicazioni concrete della stessa in campo internazionale. Ugualmente si affrontano i temi che maggiormente interessano il fenomeno arbitrale, e segnatamente il regime di circolazione del suo prodotto finale, con particolare attenzione ai rapporti fra il fenomeno arbitrale da un lato e i sistemi giurisdizionali dall'altro (con riferimento all'applicabilità a livello internazionale di principi come la Competence-Competence o il rilievo del meccanismo del forum prorgatum). Illuminata la prospettiva internazionale si analizza l'istituto in chiave interna: dalla definizione del concetto di arbitrato interno ed estero secondo l'ordinamento italiano, all'analisi delle condizioni richieste per il riconoscimento e della relativa procedura, fino ad affrontare gli aspetti ancora discussi, in particolare in relazione al trattamento da riservarsi ai lodi de eadem re e in generale al regime giuridico da riconoscersi alla clausola che preveda arbitrato estero, anche il relazione alle evoluzioni giurisprudenziali e legislative degli ultimi anni. Lo studio si conclude con uno sguardo alla circolabilità extra moenia del prodotto arbitrale italiano.

Unions to Die For

The Copper County Strike of 1913 was heroic, tragic, and large in meaning, both for those who lived in it and for those haunted by it in the years that followed. Carl Ross was born in Hancock only hours before the strike erupted. His father was a printer for Työmies. I had the good fortune to meet Carl and work with him for some twenty years. Carl spoke often of the strike—of what it meant for him, his family, and the radical Finnish community in Superior, Wisconsin, where he grew up. I had never heard of the Copper Country strike before I met Carl, but what I heard about that strike resonated with some of my own experiences. I grew up in New Castle, Indiana, a town that left-wing journalist I.F. Stone called a “labor citadel��� in the midst of hostile territory. I want to use these two recollections, Carl’s 1913 Strike reminiscences and my memories of New Castle, to talk about how some strikes carry a moral vision of enormous importance. The presentation will have three parts. In the first part I will relate a little of what Carl had to say about the Copper Country Strike. In the second part I will talk about strikes of my own experience. In the final part, I will talk about the differences in the structures of labor movements and the ethical implications of those differences.

Sensing and modelling mechanical properties of fruits for quality.

Nondestructive techniques are extensively researched for the measurement of physical properties of fruits related to quality. Optical properties can be applied mainly in the detection of those quality features which are related to the chemical composition of the fruit, color (in the VIS region) or chemical constituents (sugar, in the MR region) being the most important. The most relevant mechanical property of fruits is consistency, generally called firmness, and to date only techniques which are able to measure the mechanical properties of the fruit bulk tissue are used for its prediction. Fruits can be modelled as elastic bodies, or at least as partially elastic. Therefore, the measurement of some elastic constants of the fruit can be used for the evaluation of its firmness. The differences in the response to loading are relevant in studying a) fruit firmness and b) bruising susceptibility. Both have been modelled for selected fruit species and varieties.

La crisis de 1930 y las políticas del New Deal : un examen desde la economía y las instituciones

Resumen: La presente investigación consiste en un análisis, desde la perspectiva de la economía y las instituciones, de las políticas del New Deal, implementado por Franklin D. Roosevelt en los Estados Unidos durante la crisis económica de los años 30. Para realizar dicho análisis se presentan los elementos principales de la crisis de 1930, luego se realiza un estudio de las políticas económicas aplicadas en el contexto de un marco de gran innovación institucional, y concluye evaluando las políticas expuestas, tanto desde el enfoque de sus resultados macroeconómicos como de su desempeño institucional. De esta manera el presente documento incluye un diagnóstico histórico del contexto norteamericano en aquel entonces y resalta los aspectos que motivaron a dicha administración a la aplicación de New Deal. Finalmente, se realiza un análisis del impacto macroeconómico de las políticas aplicadas. La conclusión sintetiza las principales enseñanzas de la experiencia desde la perspectiva de política económica y del diseño de la regulación, para concluir con algunas reflexiones acerca de su posible implementación en la actualidad.

Rubén Darío's new unpublished and unknown documents: on La "Isla de Oro", the "Poema del Otoño" and the years of "Mundial"

This article studies and reproduces a group of documents that includes some hand-written and typed texts most likely authored by Rubén Darío, along with others where Darío’s authorship can be easily contested. These documents seem to have originated during the years of Mundial Magazine (1912-1914), and besides the interest for their probably unpublished nature, they also show the cooperation between Darío and his collaborators in the preparation of his original manuscripts right before being sent to the publishers.
