Rapid advancements in the field of genetic science have engendered considerable debate, speculation, misinformation and legislative action worldwide. While programs such as the Human Genome Project bring the prospect of seemingly miraculous medical advancements within imminent reach, they also create the potential for significant invasions of traditional areas of privacy and human dignity through laying the potential foundation for new forms of discrimination in insurance, employment and immigration regulation. The insurance industry, which has of course, traditionally been premised on discrimination as part of its underwriting process, is proving to be the frontline of this regulatory battle with extensive legislation, guidelines and debate marking its progress.

Objectives To quantify the burden of disease attributable to smoking in South Africa for 2000. Design The absolute difference between observed lung cancer death rate and the level in non-smokers, adjusted for occupational and indoor exposure to lung carcinogens, was used to estimate the proportion of lung cancer deaths attributable to smoking and the smoking impact ratio (SIR). The SIR was substituted for smoking prevalence in the attributable fraction formula for chronic obstructive pulmonary disease (COPD) and cancers to allow for the long lag between exposure and outcome. Assuming a shorter lag between exposure and disease, the current prevalence of smoking was used to estimate the population-attributable fractions (PAF) for the other outcomes. Relative risks (RR) from the American Cancer Society cancer prevention study (CPS-II) were used to calculate PAF. Setting South Africa. Outcome measures Deaths and disability-adjusted life years (DALYs) due to lung and other cancers, COPD, cardiovascular conditions, respiratory tuberculosis, and other respiratory and medical conditions. Results Smoking caused between 41 632 and 46 656 deaths in South Africa, accounting for 8.0 - 9.0% of deaths and 3.7 - 4.3% of DALYs in 2000. Smoking ranked third (after unsafe sex/sexually transmitted disease and high blood pressure) in terms of mortality among 17 risk factors evaluated. Three times as many males as females died from smoking. Lung cancer had the largest attributable fraction due to smoking. However, cardiovascular diseases accounted for the largest proportion of deaths attributed to smoking. Conclusion Cigarette smoking accounts for a large burden of preventable disease in South Africa. While the government has taken bold legislative action to discourage tobacco use since 1994, it still remains a major public health priority.

Advances in the field of Assisted Reproductive Technology (ART) have been revolutionary. This book focuses on the use of ARTs in the context of families who seek to conceive a matching sibling donor as a source of tissue to treat an existing sick child. Such children have been referred to as ‘saviour siblings’. Considering the legal and regulatory frameworks that impact on the accessibility of this technology in Australia and the UK, the work analyses the ethical and moral issues that arise from the use of the technology for this specific purpose. The author claims the only justification for limiting a family’s reproductive liberty in this context is where the exercise of reproductive decision-making results in harm to others. It is argued that the harm principle is the underlying feature of legislative action in Western democratic society, and as such, this principle provides the grounds upon which a strong and persuasive argument is made for a less-restrictive regulatory approach in the context of ‘saviour siblings’.

La Loi constitutionnelle de 1867 ne contient aucune disposition expresse concernant un quelconque pouvoir pour les gouvernements fédéral et provinciaux de conclure des traités internationaux - ce pouvoir étant réservé, à l'époque de l'adoption de la Loi constitutionnelle de 1867, au pouvoir impérial britannique. Aussi, une seule disposition prévoyait les modalités de mise en oeuvre des traités impériaux au sein de la fédération canadienne et cette disposition est aujourd'hui caduque. Puisque l'autonomie du Canada face à l'Empire britannique ne s'est pas accompagnée d'une refonte en profondeur du texte de la constitution canadienne, rien n'a été expressément prévu concernant le droit des traités au sein de la fédération canadienne. Le droit constitutionnel touchant les traités internationaux est donc Ie fruit de la tradition du «constitutionnalisme organique» canadien. Cette thèse examine donc ce type de constitutionnalisme à travers le cas particulier du droit constitutionnel canadien relatif aux traités internationaux. Elle examine ce sujet tout en approfondissant les conséquences juridiques du principe constitutionnel du fédéralisme reconnu par la Cour suprême du Canada dans le Renvoi relatif à la sécession du Québec, [1998] 2 R.C.S. 217. De manière plus spécifique, cette thèse analyse en détail l’affaire Canada (P.G.) c. Ontario (P. G.), [1937] A.C. 326 (arrêt des conventions de travail) ou le Conseil prive a conclu que si l'exécutif fédéral peut signer et ratifier des traités au nom de l'État canadien, la mise en oeuvre de ces traités devra se faire - lorsqu'une modification législative est nécessaire à cet effet - par le palier législatif compétent sur la matière visée par l'obligation internationale. Le Conseil Prive ne spécifia toutefois pas dans cet arrêt qui a compétence pour conclure des traités relatifs aux matières de compétence provinciale. Cette thèse s'attaque donc à cette question. Elle défend la position selon laquelle aucun principe ou règle de droit constitutionnel canadien ou de droit international n'exige que l'exécutif fédéral ait un pouvoir plénier et exclusif sur la conclusion des traités. Elle souligne de plus que de très importants motifs de politique publique fondes notamment sur les impératifs d'expertise, de fonctionnalité institutionnelle et de démocratie militent à l’encontre d'un tel pouvoir fédéral plénier et exclusif. L'agencement institutionnel des différentes communautés existentielles présentes au Canada exige une telle décentralisation. Cette thèse démontre de plus que les provinces canadiennes sont les seules à posséder un pouvoir constitutionnel de conclure des traités portant sur des domaines relevant de leurs champs de compétence - pouvoir dont elles peuvent cependant déléguer l'exercice au gouvernement fédéral. Enfin, cette thèse analyse de manière systématique et approfondie les arguments invoques au soutien d'un renversement des principes établis par l'arrêt des conventions de travail en ce qui concerne la mise en oeuvre législative des traités relatifs à des matières provinciales et elle démontre leur absence de fondement juridique. Elle démontre par ailleurs que, compte tenu de l'ensemble des règles et principes constitutionnels qui sous-tendent et complètent le sens de cette décision, renverser l’arrêt des conventions de travail aurait pour effet concret de transformer l'ensemble de la fédération canadienne en état quasi unitaire car le Parlement pourrait alors envahir de manière permanente et exclusive l'ensemble des champs de compétence provinciaux. Cette conséquence est assurément interdite par le principe du fédéralisme constitutionnellement enchâssé.

Blood clotting response (BCR) resistance tests are available for a number of anticoagulant rodenticides. However, during the development of these tests many of the test parameters have been changed, making meaningful comparisons between results difficult. It was recognised that a standard methodology was urgently required for future BCR resistance tests and, accordingly, this document presents a reappraisal of published tests, and proposes a standard protocol for future use (see Appendix). The protocol can be used to provide information on the incidence and degree of resistance in a particular rodent population; to provide a simple comparison of resistance factors between active ingredients, thus giving clear information about cross-resistance for any given strain; and to provide comparisons of susceptibility or resistance between different populations. The methodology has a sound statistical basis in being based on the ED50 response, and requires many fewer animals than the resistance tests in current use. Most importantly, tests can be used to give a clear indication of the likely practical impact of the resistance on field efficacy. The present study was commissioned and funded by the Rodenticide Resistance Action Committee (RRAC) of CropLife International.

The political economy literature on agriculture emphasizes influence over political outcomes via lobbying conduits in general, political action committee contributions in particular and the pervasive view that political preferences with respect to agricultural issues are inherently geographic. In this context, ‘interdependence’ in Congressional vote behaviour manifests itself in two dimensions. One dimension is the intensity by which neighboring vote propensities influence one another and the second is the geographic extent of voter influence. We estimate these facets of dependence using data on a Congressional vote on the 2001 Farm Bill using routine Markov chain Monte Carlo procedures and Bayesian model averaging, in particular. In so doing, we develop a novel procedure to examine both the reliability and the consequences of different model representations for measuring both the ‘scale’ and the ‘scope’ of spatial (geographic) co-relations in voting behaviour.

o trabalho tem como base uma revisão de literatura sobre o tema Governo Eletrônico, estando seu foco voltado para a sua utilização nas 27 assembléias legislativas estaduais do Brasil, no que diz respeito a sua utilização como ferramenta de transparência pública. Mais especificamente, a presente dissertação buscou mensurar o nível de transparência nos portais eletrônicos dessas assembléias legislativas. Para tal desiderato, foi necessário realizar uma pesquisa bibliográfica sobre o tema, que serviu de suporte literário para o devido embasamento das formulações e conclusões que foram apresentadas no decorrer do estudo. A mensuração do grau de transparência dos portais eletrônicos dos legislativos estaduais foi realizada a partir da aplicação de um método de mensuração de transparência eletrônica, com as devidas adaptações, a qual é utilizada pela organização não governamental, Monitor Legislativo, para a monitoração dos portais eletrônicos do legislativo do México, tendo como base a lei de transparência pública e acesso a informações públicas governamentais, hoje em vigor naquele país. Assim, o modelo levou em consideração a disponibilização de informações sobre: função administrativa; controle interno; trabalho legislativo; trabalho das comissões; concessões, permissões e contratos; arquivo histórico e serviços bibliotecários; e controles externos. A mensuração foi feita item a item, já apresentando um quadro da transparência por item. Não obstante, no final do trabalho foi apresentado um ranking geral da transparência eletrônica, no qual foram dispostas todas as assembléias legislativas estaduais com suas respectivas notas e nível de transparência correspondente. Por fim, os resultados da pesquisa foram correlacionados a outras variáveis, com o intuito de verificar se havia algum grau de relação entre as variáveis analisadas e a transparência eletrônica.

The language used in Section 165.002 of the Texas Health and Safety Code renders breastfeeding women vulnerable and susceptible to harassment, discrimination, and persecution via the Texas Penal Code, Sec. 30.05 (Criminal Trespassing), Sec. 21.08 (Indecent Exposure), and Sec. 21.22 (Indecency with a Child). ^ The overall goal of this paper is to develop a solution to this problem via a proposed law or legislative action that offers protection and support for breastfeeding women who choose to nurse in public. Data to inform these recommendations were collected through a literature review and structured interviews with several breastfeeding stakeholders. A literature review of state and federal breastfeeding legislation was conducted to compare and contrast differences between existing legislation in the United States. Interviews were conducted with breastfeeding legislation stakeholders, which included state legislators who have been active in breastfeeding legislation, breastfeeding mothers, and representatives from the Central Texas Healthy Mothers Healthy Babies Coalition (Centex HMHB Coalition), Texas Breastfeeding Coalition (TXBF coalition), La Leche League International, and the Texas Business Association. Data from the literature and legislation reviews and interviews were transcribed and examined for common themes using qualitative data techniques. ^ Overall, most of the stakeholders came to a general consensus on three points, (1) breastfeeding women are supported by stakeholders within the community, (2) other legislation or penal codes should not override the right to breastfeed, and (3) the current breastfeeding legislation needs to be improved to adequately support breastfeeding women. The interviews with breastfeeding legislation stakeholders yielded two major recommendations for the improvement of Section 165.002 of the Texas Health and Safety Code: advocacy efforts to change the wording of the legislation and education to inform people about the legislation. ^ The right to breastfeed is an important public health issue in that it provides a host of health benefits for mothers and children, and is more economical and environmentally superior to alternative feeding methods. While breastfeeding in public is not illegal nor ever has been, adequate legislation is important to affirm this right for women so that they can confidently feed their children without embarrassment or harassment.^

More than ever alternative energy solutions are being discussed including potential legislative action. With the use of fossil fuels being the most abundant and most controversial sources of energy, new solutions must be found. This paper looks at the economic and technical feasibility of different types of alternative energy and cogeneration applications within a steel mill. This paper examines alternative energy systems. The systems examined include Solar systems, thermal electric materials, and an Organic Rankine Cycle cogeneration project. None of the projects has limiting technical feasibility issues however each of the projects face economically limiting factors. Taking into account tangible and non-tangible factors the solar system and Organic Rankine Cycle cogeneration project are recommended for further study and potential installation.
