La presente investigación tiene como objeto analizar la influencia de la estrategia de guerra jurídica de las Farc en la autonomía del sistema judicial colombiano. Así mismo, se busca desarrollar un análisis de la VIII Conferencia Nacional Guerrillera de las Farc, con el fin de dar cuenta de la evolución de sus planes estratégicos, que han llevado a la inserción en nuevos teatros de operaciones. Lo anterior irá enfocado en la importancia que tiene para la guerrilla de las Farc el paso de la guerra de guerrillas a la guerra asimétrica; y en ésta última será posible encontrar el sustento teórico necesario para realizar el presente estudio. Por último, se pretende resaltar que la evolución del plan ha conllevado a una inseguridad jurídica perjudicial para los principales fines del Estado, causando con esto un debilitamiento de las instituciones.

Toda Constitución es un esquema de poder. Como toda concepción de poder se refiere y tiene por objeto al hombre, implica una toma de posición, un pronunciamiento sobre la libertad y sus garantías. La idea de libertad - garantía, de la libertad defendida, o de las garantías constitucionales de la libertad, se atribuye con justicia al constitucionalismo liberal, creado por la tradición inglesa (Magna Charta, 1215; Petito of right 1627; Hábeas Corpus, Act 1679; Bill of Rights 1689), su secuencia norteamericana (Declaración de Derechos de Virginia, 1776 y Acta de declaración de la independencia, 1776), y el movimiento ideológico francés del enciclopedismo y la ilustración que quedó plasmado en la Declaración de Derecho del Hombre y el Ciudadano de 1789. Generalidad y oponibilidad al Estado constituyen la esencia de las garantías ciudadanas proclamadas por el liberalismo: mecanismos, prestación, servicio, procedimiento de vigilancia y control, reparación, control, moderación o intervención, que tiendan a dar seguridad, vigencia real y eficacia a una libertad para todos, es una garantía.

La parte medular de esta tesis es el estudio de la legitimación en los procesos judiciales y constitucionales que se promueven para la defensa de los derechos colectivos. La legitimación ordinaria es una cualidad derivada de la relación de titularidad del derecho subjetivo o de la obligación, que permite a una persona formular una pretención o contradecirla, en un caso concreto. Las teorías sobre esta materia se dividen en una de corte clásico, según la cual la legitimación nace de la titularidad real de la relación sustancial, y otras de corte moderno, según las cuales existe legitimación, con sólo afirmar esa titularidad, aunque a fin del proceso se establezca que ella no existía. El optar por una o por otra, influye en el tipo de resolución que debe adoptar el juez, sobre todo frente a la falta de legitimación. Respecto de los derechos colectivos, estudiamos los aspectos necesarios para comprender que su presencia ha motivado el aparecimiento de nuevos conceptos procesales o su modificación, entre ellos, el de la legitimación, cuyo ejercicio da origen a un proceso colectivo. Finalmente estudiamos en detalle la legitimación para la tutela de los derechos colectivos. Nos referimos a que ha sido necesario ampliar la noción clásica del concepto para permitir un real acceso a la justicia, en pos de la tutela de esos derechos, sin que, para tener legitimación, haga falta hacer una afirmación de titularidad o invocar una afectación directa. Analizamos quiénes serían los legitimados, con especial referencia a nuestro país, ilustrando los temas con casos resueltos, tanto por la justicia ordinaria como por la justicia constitucional.

Analiza el desarrollo de las garantías jurisdiccionales a partir de una muestra de procesos decididos en la provincia de Pichincha. Evidencia que la acción de protección es la garantía más utilizada, seguida del hábeas corpus y el hábeas data. Constata una tendencia decreciente del porcentaje respecto al total de garantías en los casos de la acción de protección y habeas data, mientras que la interposición de habeas corpus se ha incrementado; establece que la mayoría de accionantes proviene del sector público; confirma la tendencia judicial restrictiva de garantías y derechos, y devela el incumplimiento de los plazos legales, concluye señalando los límites que existen para la efectividad de las garantías y para el aseguramiento de los derechos humanos de la población.

La investigación se concentra en la producción legislativa en el 2010 Y dentro de ella a algunas de las leyes, que se consideran relevantes para el ejercicio de derechos. Por otro lado, muy brevemente se específica, como información que debe ser compartida y conocida, normativa relevante para los derechos humanos y tratados internacionales que han sido ratificados por el estado ecuatoriano. Luego se exponen observaciones generales sobre el proceso legislativo. Una segunda sección del informe relativa a garantías jurisdiccionales estudia el funcionamiento de las mismas en base al análisis estadístico de 1815 procesos constitucionales en la provincia de Pichincha de Enero a Octubre del 2010. Los resultados tanto respecto a las garantías normativas como en a jurisdiccionales arrojan, pese a ciertos avances, un claro déficit en la eficacia de estas garantías, en contraste con la importancia que formalmente les da la Constitución del 2008.

El capítulo uno presenta datos relativos a las garantías constitucionales jurisdiccionales durante el año 2011. Se examina información clave respecto al tipo de derechos reclamados, las características de quienes los reclaman, la forma cómo se decide y el tiempo que los jueces y cortes están utilizando para resolver estas posibles violaciones. La muestra incluye 2204 procesos constitucionales decididos en la provincia de Pichincha del 1 de enero hasta el 31 de octubre de 2011, tanto por jueces de instancia como por salas de la Corte Provincial. Al igual que en el estudio de 2010, la base de datos fue construida a partir de la información de la página en línea de la Función Judicial de Pichincha. Las limitaciones de esta investigación a una provincia tienen relación con la ausencia de información o estadísticas suficientes sobre procesos constitucionales en otras provincias. En todo caso, a efectos de poder fundamentar un mayor grado de generalización, el presente estudio incluye una serie de consideraciones de orden cualitativo aplicables a nivel nacional. El capítulo dos, desde la perspectiva de los derechos humanos, determina si estos derechos inspiraron la producción normativa o si fueron otros intereses diversos y si es que la producción normativa fue aceptable en términos de carga de trabajo durante el año 2011 en Ecuador. Para valorar el trabajo legislativo además de la Constitución. Este capítulo está dividido en cuatro partes. En la primera se hace una reflexión entre los derechos y la producción normativa, para enfatizar la importancia del trabajo legislativo en un Estado constitucional de derechos y justicia. En una segunda sección, se elabora un análisis sobre los aspectos generales del desarrollo parlamentario. En la tercera parte se analiza la iniciativa legislativa. Finalmente, a manera de síntesis, se recogen las conclusiones que se derivan de la investigación.

To characterize the relaxation induced by the soluble guanylate cyclase (sGC) activator, BAY 60-2770 in rabbit corpus cavernosum. Penis from male New Zealand rabbits were removed and fours strips of corpus cavernosum (CC) were obtained. Concentration-response curves to BAY 60-2770 were carried out in the absence and presence of inhibitors of nitric oxide synthase, L-NAME (100 μM), sGC, ODQ (10 μM) and phosphodiestarase type 5, tadalafil (0.1 μM). The potency (pEC50) and maximal response (Emax) values were determined. Second, electrical-field stimulation (EFS)-induced contraction or relaxation was realized in the absence and presence of BAY 60-2770 (0.1 or 1 μM) alone or in combination of ODQ (10 μM). In the case of EFS-induced relaxation two protocols were realized: 1) ODQ (10 μM) was first incubated for 20 min and then BAY 60-2770 (1 μM) was added for another 20 min (ODQ + BAY 60-2770). In different CC strips, BAY 60-2770 was incubated for 20 min followed by another 20 min with ODQ (BAY 60-2770 + ODQ). The intracellular levels of cyclic guanosine monophosphate (cGMP) were also determined. BAY 60-2770 potently relaxed rabbit CC with pEC50 and Emax values of 7.58 ± 0.19 and 81 ± 4%, respectively. The inhibitors ODQ (n=7) or tadalafil (n=7) produced 4.2- and 6.3-leftward shifts, respectively in BAY 60-2770-induced relaxation without interfering on the Emax values. The intracellular levels of cGMP were augmented after stimulation with BAY 60-2770 (1 μM) alone, whereas its co-incubation with ODQ produced even higher levels of cGMP. The EFS-induced contraction was reduced in the presence of BAY 60-2770 (1 μM) and this inhibition was even greater when BAY 60-2770 was co-incubated with ODQ. The nitrergic stimulation induced CC relaxation, which was abolished in the presence of ODQ. BAY 60-2770 alone increased the amplitude of relaxation. Co-incubation of ODQ and BAY 60-2770 did not alter the relaxation in comparison with ODQ alone. Interestingly, when BAY 60-2770 was incubated prior to ODQ, EFS-induced relaxation was partly restored in comparison with ODQ alone or ODQ + BAY 60-2770. Considering that the relaxation induced by the sGC activator, BAY 60-2770 was increased after sGC oxidation and unaltered in the absence of nitric oxide, these class of substances are advantageous over sGC stimulators or PDE5 inhibitors for the treatment in those patients with erectile dysfunction and high endothelial damage. Corpus luteum is a temporary endocrine gland that regulates either the estrous cycle and pregnancy. It presents extreme dependency on the adequate blood supply. This work aims to evaluate goat corpus luteum (CL) vascular density (VD) over the estrous cycle. For that purpose, 20 females were submitted to estrus synchronization/ovulation treatment using a medroxyprogesterone intra-vaginal sponge as well as intramuscular (IM) application of cloprostenol and equine chorionic gonadotrophine (eCG). After sponge removal, estrus was identified at about 72hs. Once treatment was over, female goats were then subdivided into 4 groups (n=5 each) and slaughtered on days 2, 12, 16 and 22 after ovulation (p.o). Ovaries were collected, withdrawn and weighted. CL and ovaries had size and area recorded. Blood samples were collected and the plasma progesterone (P4) was measured through RIA commercial kits. The VD was 24.42±6.66, 36.26±5.61, 8.59±2.2 and 3.97±1.12 vessels/mm² for days 2, 12, 16 and 22 p.o, respectively. Progesterone plasma concentrations were 0.49±0.08, 2.63±0.66, 0.61±0.14 and 0.22±0.04ng/ml for days 2, 12, 16 e 22 p.o, respectively. Studied parameters were affected by the estrous cycle phase. Values greater than 12 p.o were observed. In the present work we observed that ovulation occurred predominantly in the right ovary (70% of the animals), which in turn presented bigger measures than the contra lateral one. There is a meaningful relationship between the weight and size of the ovary and these of CL (r=0.87, r=0.70, respectively, p<0.05). It is possible to conclude that morphology of goat's ovaries and plasma progesterone concentration changed according to estrous cycle stages. We propose these parameters can be used as indicators of CL functional activity.

The present study aimed to investigate the presence of corpus callosum (CC) volume deficits in a population-based recent-onset psychosis (ROP) sample, and whether CC volume relates to interhemispheric communication deficits. For this purpose, we used voxel-based morphometry comparisons of magnetic resonance imaging data between ROP (n = 122) and healthy control (n = 94) subjects. Subgroups (38 ROP and 39 controls) were investigated for correlations between CC volumes and performance on the Crossed Finger Localization Test (CFLT). Significant CC volume reductions in ROP subjects versus controls emerged after excluding substance misuse and non-right-handedness. CC reductions retained significance in the schizophrenia subgroup but not in affective psychoses subjects. There were significant positive correlations between CC volumes and CFLT scores in ROP subjects, specifically in subtasks involving interhemispheric communication. From these results, we can conclude that CC volume reductions are present in association with ROP. The relationship between such deficits and CFLT performance suggests that interhemispheric communication impairments are directly linked to CC abnormalities in ROP. (C) 2010 Elsevier Ireland Ltd. Antiphospholipid syndrome (APS) is a disorder of coagulation that causes thrombosis as well as pregnancy-related complications, occurring due to the autoimmune production of antibodies against phospholipid. Full anticoagulation is the cornerstone therapy in patients with thrombosis history, and this can lead to major bleeding. During a 3-year period, 300 primary and secondary APS patients were followed up at the Rheumatology Division of the authors` University Hospital. Of them, 255 (85%) were women and 180 (60%) were of reproductive age. Three of them (1%) had severe hemorrhagic corpus luteum while receiving long-term anticoagulation treatment and are described in this report. All of them were taking warfarin, had elevated international normalized ratio (> 4.0) and required prompt blood transfusion and emergency surgery. Therefore, we strongly recommend that all women with APS under anticoagulation should have ovulation suppressed with either intramuscular depot-medroxyprogesterone acetate or oral desogestrel. Suicidality is a life-threatening symptom in patients with bipolar disorder (BD). Impulsivity and mood instability are associated with suicidality in mood disorders. Evidence suggests that gray and white matter abnormalities are linked with impulsivity in mood disorders, but little is known about the association between corpus callosum (CC) and impulsivity in BID. We examined the relationship between CC areas, impulsivity and suicidality in BID patients. We studied 10 female BD patients with a history of suicide attempt (mean +/- SD age 36.2 +/- 10.1 years), 10 female BD patients without suicide attempt history (44.2 +/- 12.5 years) and 27 female healthy subjects (36.9 +/- 13.8 years). Impulsivity was evaluated by the Barratt Impulsivity Scale (BIS). We traced MR images to measure the areas of the CC genu, anterior body, posterior body, isthmus and splenium. The genu was divided into anterior, middle and posterior regions. The suicidal and non-suicidal BID patients had significantly higher BIS total, attention and non-planning scores than the healthy subjects (ps < 0.01), and the suicidal BID patients had significantly higher BIS motor scores than the non-suicidal BD and healthy subjects (ps < 0.01). There were no significant differences among the three groups on any regional CC areas, although the suicidal BD patients had the smallest areas. The suicidal BD patients showed a significant inverse correlation between anterior genu area and the BIS total (r = -0.75, p = 0.04), motor (r = -0.79, p = 0.02) and non-planning scores (r = -0.79, p = 0.02). These correlations were not found in the non-suicidal BID patients or healthy subjects. The results suggest that the anterior medial frontal region may be involved in the pathophysiology of impulsive and suicidal behaviors in BD. (C) 2009 Elsevier Ireland Ltd. All rights reserved.

Background: Decreased signal intensity in the corpus callosum, reported in adult bipolar disorder patients, has been regarded as an indicator of abnormalities in myelination. Here we compared the callosal signal intensity of children and adolescents with bipolar disorder to that of matched healthy subjects, to investigate the hypothesis that callosal myelination is abnormal in pediatric bipolar patients. Methods: Children and adolescents with DSM-lV bipolar disorder (n=16, mean age +/- S.D. = 15.5 +/- 3.4 y) and matched healthy comparison subjects (n=21, mean age +/- S.D.=16.9 3.8 y) underwent a 1.5 T MRI brain scan. Corpus callosuin signal intensity was measured using an Apple Power Mac G4 running NIH Image 1.62 software. Results: Bipolar children and adolescents had significantly lower corpus callosum signal intensity for all callosal sub-regions (genu, anterior body, posterior body, isthmus and splenium) compared to healthy subjects (ANCOVA, all p < 0.05, age and gender as covariates). Limitations: Relatively small sample size. Conclusions: Abnormalities in corpus callosum, probably due to altered myelination during neurodevelopment, may play a role in the pathophysiology of bipolar disorder among children and adolescents. The penis is kept in the flaccid state mainly via a tonic activity of norepinephrine and endothelins (ETs). ET-1 is important in salt-sensitive forms of hypertension. We hypothesized that cavernosal responses to ET-1 are enhanced in deoxycorticosterone acetate (DOCA)-salt mice and that blockade of ETA receptors prevents abnormal responses of the corpus cavernosum in DOCA-salt hypertension. Male C57BL/6 mice were unilaterally nephrectomized and treated for 5 weeks with both DOCA and water containing 1% NaCl and 0.2% KCl. Control mice were uninephrectomized and received tap water with no added salt. Animals received either the ETA antagonist atrasentan (5 mg.day(-1).kg(-1) body weight) or vehicle. DOCA-salt mice displayed increased systolic blood pressure (SBP), and treatment with atrasentan decreased SBP in DOCA-salt mice. Contractile responses in cavernosal strips from DOCA-salt mice were enhanced by ET-1, phenylephrine, and electrical field stimulation (EFS) of adrenergic nerves, whereas relaxations were not altered by IRL-1620 (an ETB agonist), acetylcholine, sodium nitroprusside, and EFS of nonadrenergic noncholinergic nerves. PD59089 (an ERK1/2 inhibitor), but not Y-27632 (a Rho-kinase inhibitor), abolished enhanced contractions to ET-1 in cavernosum from DOCA-salt mice. Treatment of DOCA-salt mice with atrasentan did not normalize cavernosal responses. In summary, DOCA-salt treatment in mice enhances cavernosal reactivity to contractile, but not to relaxant, stimuli, via ET-1/ETA receptor-independent mechanisms.

Introduction. Erectile dysfunction (ED) in diabetes is associated with autonomic neuropathy and endothelial dysfunction. Whereas the nonadrenergic-noncholinergic (NANC)/neurogenic nitric oxide pathway has received great attention in diabetes-associated ED, few studies have addressed sympathetic overactivity. Aim. To test the hypothesis that adenosine-induced inhibition of adrenergic-mediated contractile responses in mouse corpus cavernosum is impaired in the presence of diabetes. Methods. The db/db (obesity and type II diabetes caused by a leptin receptor mutation) mouse strain was used as a model of obesity and type II diabetes, and standard procedures were performed to evaluate functional cavernosal responses. Main Outcome Measures. Increased cavernosal responses to sympathetic stimulation in db/db mice are not associated with impaired prejunctional actions of adenosine. Results. Electrical field stimulation (EFS)-, but not phenylephrine (PE)-, induced contractions are enhanced in cavernosal strips from db/db mice in comparison with those from lean littermates. Direct effects of adenosine, 2-chloro-adenosine, A(1) receptor agonist C-8031 (N6 cyclopentyladenosine), and sodium nitroprusside are similar between the strips from lean and db/db mice, whereas relaxant responses to acetylcholine and NANC stimulation are significantly impaired in the cavernosal strips from db/db mice. 5`-Iodotubercidin (adenosine kinase inhibitor) and dipyridamole (inhibitor of adenosine transport), as well as the A(1) agonist C-8031, significantly and similarly inhibit contractions induced by stimulation of adrenergic nerves in the cavernosal strips from lean and db/db mice. Conclusions. Results from this study suggest that corpora cavernosa from obese and diabetic db/db mice display altered neural-mediated responses that would favor penile detumescence, i.e., increased contractile response to adrenergic nerve stimulation and decreased relaxant responses upon activation of NANC nerves. However, increased cavernosal responses to adrenergic nerve stimulation are not due to impaired negative modulation of sympathetic neurotransmission by adenosine in this diabetic model.

There is evidence that several fibroblast growth factors (FGFs) are involved in growth and development of the corpus luteum (CL), but many FGFs have not been investigated in this tissue, including FGF10. The objective of this study was to determine if FGF10 and its receptor (FGFR2B) are expressed in the CL. Bovine CL were collected from an abattoir and classed as corpus hemorrhagica (stage 1), developing (stage 11), developed (stage 111), and regressed (stage IV) CL. Expression of FGF10 and FGFR2B mRNA was measured by reverse transcription-polymerase chain reaction (RT-PCR). Both genes were expressed in bovine CL, and FGF10 expression did not differ between stages of CL development. FGF10 protein was localized to large and small luteal cells by immunohistochemistry. FGFR2B expression was approximately threefold higher in regressed compared to developing and developed CL (P < 0.05). To determine if FGF10 and FGFR2B expression is regulated during functional luteolysis, cattle were injected with PGF2 alpha and CL collected at 0, 0.5, 2, 4, 12, 24, 48, and 64 hr thereafter (n = 5 CL/time point), and mRNA abundance was measured by real-time RT-PCR. FGF10 mRNA expression did not change during functional luteolysis, whereas FGFR2B mRNA abundance decreased significantly at 2, 4, and 12 hr after PGF2a, and returned to pretreatment levels for the period 24-64 hr post-PGF2 alpha. These data suggest a potential role for FGFR2B signaling during structural luteolysis in bovine CL.
