La propuesta en esta ocasión es la de abordar la relación entre archivo y relato en el Río de la Plata durante el siglo XVI y, para esto, se analizará una información levantada por Cabeza de Vaca en su defensa, fechada en 1544, porque en ella se da lugar a la aparición de un conjunto de voces de españoles que denuncian los atropellos, gravámenes y 'vejaciones' sufridas por parte de sus pares en procura de la cobranza del quinto. Estos discursos, no reproducidos por otros textos impresos durante el mencionado siglo, plantean una problemática compleja: la relación entre ley, violencia y espacio conquistado; pero también, otra de distinto orden: los alcances y efectos de discursividades como estas, devenires de un relato cruel detenido en el tiempo del archivo judicial. El presente trabajo busca abordar ambas problemáticas así como darle un lugar a esta serie de voces olvidadas

Former colonies and dependencies in the South Pacific do not have the luxury of entirely ‘homegrown’ laws. Their legal systems are burdened with a ‘legacy’ of transplanted laws, developed for use in a foreign country, imposed on pre-existing systems of custom and culture. As a result, many small island countries are struggling to balance the demands of law from different sources, designed to operate in fundamentally different circumstances. In addition to the conflict that occurs in areas of substantive law, where customary and introduced law may prescribe a different rule for the same situation, the two systems differ in their approach to procedure, penalties and relief. This paper considers the divide between the theory and practice of introduced law and customary law and examines the way in which conflicts have been dealt with by the courts. In particular, it uses the example of banishment to illustrate the type of problems that arise in a plural system. The paper looks at the balancing exercise which has been necessary when custom, in the form of banishment, comes into conflict with introduced law, in the form of constitutional rights.

En este trabajo presentamos un acercamiento a los modos de referirse al pasado en los testimonios dejados por los miembros de la nobleza colonial nahua. La lectura de las fuentes nos permite distinguir dos perspectivas –intelectual y pragmática– asociadas respectivamente con el proyecto de unir las tradiciones históricas indígena y europea y con la búsqueda de argumentos en la lucha por tierras y privilegios. El enfoque del artículo son los conceptos nahuas de «tradición» y «antepasados» (huehuetqueh), manifiestos en ambas perspectivas. Al analizar el vocabulario, retórica e iconografía intentamos entender el significado de estos conceptos dentro de la cultura nahua prehispánica y su modificación bajo las circunstancias coloniales, tanto como su papel en la continuación de la identidad nahua.

This phenomenological study explored Black male law enforcement officers’ perspectives of how racial profiling shaped their decisions to explore and commit to a law enforcement career. Criterion and snow ball sampling was used to obtain the 17 participants for this study. Super’s (1990) archway model was used as the theoretical framework. The archway model “is designed to bring out the segmented but unified and developmental nature of career development, to highlight the segments, and to make their origin clear” (Super, 1990, p. 201). Interview data were analyzed using inductive, deductive, and comparative analyses. Three themes emerged from the inductive analysis of the data: (a) color and/or race does matter, (b) putting on the badge, and (c) too black to be blue and too blue to be black. The deductive analysis used a priori coding that was based on Super’s (1990) archway model. The deductive analysis revealed the participants’ career exploration was influenced by their knowledge of racial profiling and how others view them. The comparative analysis between the inductive themes and deductive findings found the theme “color and/or race does matter” was present in the relationships between and within all segments of Super’s (1990) model. The comparative analysis also revealed an expanded notion of self-concept for Black males – marginalized and/or oppressed individuals. Self-concepts, “such as self-efficacy, self-esteem, and role self-concepts, being combinations of traits ascribed to oneself” (Super, 1990, p. 202) do not completely address the self-concept of marginalized and/or oppressed individuals. The self-concept of marginalized and/or oppressed individuals is self-efficacy, self-esteem, traits ascribed to oneself expanded by their awareness of how others view them. (DuBois, 1995; Freire, 1970; Sheared, 1990; Super, 1990; Young, 1990). Ultimately, self-concept is utilized to make career and life decisions. Current human resource policies and practices do not take into consideration that negative police contact could be the result of racial profiling. Current human resource hiring guidelines penalize individuals who have had negative police contact. Therefore, racial profiling is a discriminatory act that can effectively circumvent U.S. Equal Employment Opportunities Commission laws and serve as a boundary mechanism to employment (Rocco & Gallagher, 2004).
