Nesta dissertação, analisa-se o impacto do surgimento do “novo” sindicalismo no ABC Paulista através da ação do Sindicato dos Metalúrgicos de São Bernardo do Campo e Diadema no processo de abertura política. A ação desse importante ator coletivo naquela conjuntura resultou numa gama de novos repertórios de ação coletiva, bem como no reaparecimento da questão operária, após quase uma década de desaparecimento público. Esse novo ímpeto para a ação, produzido na relação conflitiva com os empresários e após com o Estado, serviu não só para produzir uma identidade política para os metalúrgicos do ABC paulista, com também uma agenda de demandas que se ampliava a cada embate e, sobretudo, um tensionamento sobre a esfera política, fazendo avançar o conteúdo nitidamente conservador assumido pela abertura “pelo alto”. A análise se concentrou no período que vai do ano de 1977 ao ano de 1980, avançando, portanto, sobre a data de fundação do Partido dos Trabalhadores, que serviria de referência para a entrada do movimento num campo marcadamente político-partidário. A análise do tema, através do uso de diversos materiais, dentre os quais entrevistas inéditas com sindicalistas que vivenciaram os acontecimentos, além de farta documentação da imprensa sindical do período, possibilitou situar a dimensão alcançada pela luta sindical naquela conjuntura e a forma como repercutiu na política nacional.

A proposta dessa pesquisa é pensar as ações trabalhistas impetradas pelos sindicatos patronais e dos trabalhadores na cidade do Rio de Janeiro que compreendia parte da jurisprudência do Tribunal Regional do Trabalho da Primeira Região, observando os acórdãos coletivos produzidos na segunda instância da Justiça do Trabalho. Foram observadas matérias e diálogos jurídicos encontrados nos acórdãos coletivos do Tribunal Regional do Trabalho ressaltando as principais questões trabalhistas durante os anos de 1964 e 1979 referentes ao direito do trabalho no Brasil. Com o recorte cronológico dos anos de 1964, quando ocorreu o golpe que depôs do presidente João Goulart, até 1979 quando no processo de distensão política, percebe-se uma mudança na atuação da classe trabalhadora no contexto do novo sindicalismo, a pesquisa também pretende analisar a atuação dos agentes do judiciário trabalhista durante o regime civil-militar observando a prática da magistratura trabalhista diante do projeto político e econômico adotado no regime civil-militar que atingia, especificamente, os interesses dos trabalhadores.

Our object of study in this work concerns to the movement of fight for the housing in the Great João Pessoa, Paraíba, Brazil, and looks for to investigate the conditions and context of the occupations of building, public or private, for devoid populations that do not have where to live. Front to the absence of politics effective directed to the habitation or the cities, in a picture of unemployment and impoverishment of the population, the result of the habitation point of view, is the absolute lack of popular housings, the degradation of the cities and the growth of the number of homeless and also of its occupations. The urban occupations today represent a reply of these devoid populations that from an involvement with parties or Not Governmental Organizations, and social movements leave for the class action known by the occupation of abandoning public or private buildings. These occupations, even so initially if assume as pressure instrument or of visibility for attainment of housings, for the delay in obtaining the attention of the public agencies and a solution for the problem, becomes definitive or is drawn out per many years. E this if gives although the deficiencies, of the accumulation or families neither in an adequate, always precarious space nor in sanitary installations, that the necessary privacy does not allow. The study it consisted of an empirical research, through the participant comment and open and half-open interviews, and counted on the audiovisual register of two occupations, one in the downtown of João Pessoa City (old building of the INSS, in the Ponto dos Cem Réis) and other (Community of the Cajueiro), next to the Beach "Praia do Jacaré", in the city of Cabedelo.The choice of the Visual Anthropology as research instrument is on to a concern in better translating other ways of life, therefore the accomplishment of the video in allows them to know with more precision the reality where the citizens of the research live. We also use as methodological resource in the research the deepened interview, in intention to better understand the description of the way of life of the studied families and the movements of fight for the housing, particularly the MDM - Movement of Right for the Housing, and the MNLM- Nacional Movement of Fight for the Housing

The current study is about the legitimacy of lower court jurisdiction as a way of exercising basic legal rights, proposing, therefore, a new legal-administrative model for appellate court. In order to achieve that, a demonstration of the importance of basic legal rights in the Brazilian legal system and an open interpretation in light of the Constitution, as a way to affirm said rights, among which are accessibility to the justice system and proper legal protection, is required. As a result, the legitimacy to access the legal system resides in the Constitution, where the interpreter should seek its basic principles to achieve basic legal rights. It is observed that the lack of credibility regarding lower court decisions comes from the dogmatic view of truth born from power, and therefore, that the truth resides in decisions from appellate court and not from lower court judges. A lower court judge holds a privileged position in providing basic legal rights for citizens, considering his close contact to the parties, the facts, and the evidences brought forth. Class action suit is presented as an important instrument able to lead the lower court judge to provide basic legal rights. Small Claims Courts may be used as paradigm to the creation of Appellate State Courts formed by lower court judges, reserving to higher jurisdiction courts and Federal Circuit Courts, the decisions of original competency and the management and institutional representation of the judiciary system. Instilling an internal democratization of the judiciary is also required, which means the participation of lower court judges in electing their peers to chief positions in the court system, as well as establishing a limited mandate to higher court judges.

Le profonde trasformazioni che hanno interessato l’industria alimentare, unitamente alle accresciute capacità delle scienze mediche ed epidemiologiche di individuare nessi causali tra il consumo di determinate sostanze e l’insorgere di patologie, hanno imposto al legislatore di intervenire nella materia della c.d. sicurezza alimentare mettendo in atto sistemi articolati e complessi tesi a tutelare la salute dei consociati. Quest’ultimo obiettivo viene perseguito, da un lato, mediante disposizioni di natura pubblicistica e di carattere preventivo e, dall’altro lato, dallo strumento della responsabilità civile. Le due prospettive di tutela della salute delle persone costituiscono parti distinte ma al tempo stesso fortemente integrate in una logica unitaria. Questa prospettiva emerge chiaramente nel sistema statunitense: in quel ordinamento la disciplina pubblicistica della sicurezza degli alimenti – definita dalla Food and Drug Administration – costituisce un punto di riferimento imprescindibile anche quando si tratta di stabilire se un prodotto alimentare è difettoso e se, di conseguenza, il produttore è chiamato a risarcire i danni che scaturiscono dal suo utilizzo. L’efficace sinergia che si instaura tra la dimensione pubblicistica del c.d. Public Enforcement e quella risarcitoria (Private Enforcement) viene ulteriormente valorizzata dalla presenza di efficaci strumenti di tutela collettiva tra i quali la class action assume una importanza fondamentale. Proprio muovendo dall’analisi del sistema statunitense, l’indagine si appunta in un primo momento sull’individuazione delle lacune e delle criticità che caratterizzano il sistema nazionale e, più in generale quello comunitario. In un secondo momento l’attenzione si focalizza sull’individuazione di soluzioni interpretative e de iure condendo che, anche ispirandosi agli strumenti di tutela propri del diritto statunitense, contribuiscano a rendere maggiormente efficace la sinergia tra regole preventive sulla sicurezza alimentare e regole risarcitorie in materia di responsabilità del produttore.

La ricerca conduce un’indagine sull’azione di classe, introdotta nell’ordinamento italiano in epoca recente e foriera di numerose incertezze ed ambiguità interpretative, con riferimento sia allo specifico contenuto delle singole disposizioni normative che si sono alternate nel corso del tempo (determinate, sovente, dalla necessità di elidere le- di volta in volta riscontrate- anomalie e contraddizioni del tessuto normativo), sia alle possibili incongruenze tra taluni profili della disciplina oggi prevista dall’art. 140-bis del Codice del consumo e taluni principi generali dell’ordinamento, anche in materia di risarcimento del danno. Viene esaminato, anzitutto, il tema della legittimazione ad agire e del rapporto tra consumatore e l’ente rappresentativo cui questi, eventualmente, si rivolga, tentando la riconduzione di tale relazione alle ordinarie categorie privatistiche. Parimenti, è in termini di qualificazione secondo le tradizionali categorie del diritto civile che si tenta di apprezzare la natura dell’atto di adesione del soggetto che si vanti detentore di un diritto omogeneo a quello della classe cui pretende di appartenere. Vengono, quindi, esaminate le condizioni di ammissibilità dell’azione di classe e le caratteristiche peculiari della fase preliminare del giudizio di ammissibilità dell’azione. La ricerca indaga, quindi, la natura ed i possibili contenuti della sentenza che definisce il processo di classe, e conduce, nell’ultimo capitolo, una disamina relativa alle situazioni giuridiche tutelate.

Verifica-se, na atualidade, grande multiplicação dos conflitos envolvendo a Previdência Social e seus segurados. Embora sejam vários os motivos que levam ao ajuizamento de ações previdenciárias, identifica-se em grande parte dos casos uma linha condutora que unifica os diversos litigantes (segurados e dependentes) em torno de uma questão comum. Olhando-se de longe, o que se vê é uma série de ações individuais, cada uma com suas peculiaridades, que buscam as mesmas reparações e ajustes. Há, nesses casos, o ajuizamento em massa de ações com conteúdo semelhante, o que irá gerar sentenças, recursos e execuções múltiplos e, em vários casos, apresentando soluções divergentes. Desse modo, ainda que se tratem de direitos que podem ser tutelados individualmente, há que se buscar a tutela por um prisma coletivo, de modo a se trazer efetividade e segurança na área previdenciária. E uma dessas formas consiste no uso da ação civil pública em questões previdenciárias. Mecanismo relativamente recente em nosso ordenamento, introduzido em 1985, a ação civil pública encontra-se hoje plenamente integrada àquilo que se chama de microssistema de tutela coletiva, admitindo tanto a defesa de direitos difusos, quanto de coletivos stricto sensu e mesmo de direitos individuais homogêneos. O esforço que merece atenção, portanto, consiste na caracterização do Direito Previdenciário numa dessas três categorias de direitos coletivos lato sensu, vez que a tutela no plano coletivo molda-se de acordo com o tipo de direito que se está a tutelar. Ademais, é necessário também que se afaste a interpretação restritiva já superada pela jurisprudência mais atual que exclui os Direitos Previdenciários da esfera de objetos da ação civil pública.

Un año después de su promulgación, entró a regir el 6 de agosto del año en curso la Ley 472 de 1998 sobre protección de los derechos colectivos, dando paso, así sea con injustificado retardo, a la consolidación de lo que la doctrina jurídica en Colombia denomina "trípode del garantismo constitucional", sobre el cual, dada su importancia, vigencia y actualidad (puesto que no es tema exclusivo de juristas), bien vale la pena hacer algunas breves reflexiones desde el punto de vista del binomio inescindible "comunidad-empresa". Como que una primera "pata" la conforma la acción de tutela (Art. 86 de la C.P. y Decretos 2591 y 306 de 1991); una segunda, la acción de cumplimiento (Art. 87 de la C.P. y Ley 393 de 1997); y una tercera, las acciones *Class action, en el sistema jurídico anglosajón populares y de grupo (Art. 88 de la C.P. y Ley 472 de 1998, objeto de este comentario).

Previous studies have led to the development of allochimeric class I MHC proteins as agents that effectively induce donor-specific transplantation tolerance in a rat system with or without additional immunosuppression. Within the α1-helical region of RT1.Au, an epitope that conferred immunologic tolerance was discovered. Studies presented herein were designed to test our central hypothesis that allochimeric proteins onfer tolerance in a mouse model. To test this hypothesis, portal vein (PV) injection of wild-type H2Kd and H2Dd proteins were produced in a bacterial expression system and found to specifically prolong the survival of BALB/c (H2d) heart allografts in C57BL/10 (H2b) recipients. Although a single PV injection of 50 μg α1–α 3 H2Kd alone was ineffective, 50 μg α1 –α3 alone slightly prolonged BALB/c heart allograft survivals. In contrast, the combination of 25 μg α1–α 3 H2Kd and 25 μg α1–α 3 H2Dd proteins prolonged BALB/c graft survivals to 20.2 ± 6.4 days (p < 0.004). The effect was donor-specific, since a combination of 25 μg α1–α3 H2Kd and 25 μg α1–α3 H2Dd proteins failed to affect survivals of third-party C3H (H2k k) heart allografts, namely 9.0 ± 0.0 days in treated versus 7.8 ± 0.5 days in untreated hosts. Thus, the combination of two H2K d and H2Dd proteins is more effective in prolonging allograft survival than a single protein produced in a bacterial expression system. A single PV injection (day 0) of 25 μg α1–α 2 H2Kd and 25 μg α1–α 2 H2Dd proteins to C57BL/10 mice prolonged the survival of BALB/c heart allografts to 22.4 ± 4.5 days. Within a WF to ACI rat heart allograft system, a single PV injection of 20 μg 70–77 u-RT1.Aa induced specific tolerance of allografts. This therapy could be combined with CsA to induce transplantation tolerance. However, combination of 70–77u-RT1.Aa with CTLA4Ig, rapamycin, or AG-490 effectively blocked the induction of transplantation tolerance. Tolerance generated by allochimeric protein could be adoptively transferred to naive recipients. Intragraft cytokine mRNA levels showed a bias towards a Th2-type phenotype. Additionally, studies of cytokine signaling and activation of transcription factors revealed a requirement that these pathways remain available for signaling in order for transplantation tolerance to occur. These studies suggest that the generation of regulatory cells are required for the induction of transplantation tolerance through the use of allochimeric proteins. ^

This study considers the solution of a class of linear systems related with the fractional Poisson equation (FPE) (−∇2)α/2φ=g(x,y) with nonhomogeneous boundary conditions on a bounded domain. A numerical approximation to FPE is derived using a matrix representation of the Laplacian to generate a linear system of equations with its matrix A raised to the fractional power α/2. The solution of the linear system then requires the action of the matrix function f(A)=A−α/2 on a vector b. For large, sparse, and symmetric positive definite matrices, the Lanczos approximation generates f(A)b≈β0Vmf(Tm)e1. This method works well when both the analytic grade of A with respect to b and the residual for the linear system are sufficiently small. Memory constraints often require restarting the Lanczos decomposition; however this is not straightforward in the context of matrix function approximation. In this paper, we use the idea of thick-restart and adaptive preconditioning for solving linear systems to improve convergence of the Lanczos approximation. We give an error bound for the new method and illustrate its role in solving FPE. Numerical results are provided to gauge the performance of the proposed method relative to exact analytic solutions.

This study sought to establish and develop innovative instructional procedures, in which scaffolding can be expanded and applied, in order to enhance learning of English as a Foreign Language (EFL) writing skills in an effective hybrid learning community (a combination of face-to-face and online modes of learning) at the university where the researcher is working. Many educational experts still believe that technology has not been harnessed to its potential to meet the new online characteristics and trends. There is also an urgency to reconsider the pedagogical perspectives involved in the utilisation of online learning systems in general and the social interactions within online courses in particular that have been neglected to date. An action research design, conducted in two cycles within a duration of four months, was utilised throughout this study. It was intended not only to achieve a paradigm shift from transmission-absorption to socio-constructivist teaching/learning methodologies but also to inform practice in these technology-rich environments. Five major findings emerged from the study. First, the scaffolding theory has been extended. Two new scaffolding types (i.e., quasi-transcendental scaffolding and transcendental scafolding), two scaffolding aspects (i.e., receptive and productive) and some scaffolding actions (e.g., providing a stimulus, awareness, reminder, or remedy) for EFL writing skills in an effective hybrid learning community have been identified and elaborated on. Second, the EFL ‘Effective Writing’ students used the scaffolds implemented in a hybrid environment to enhance and enrich their learning of writing of English essays. The online activities, conducted after the F2F sessions most of the time, gave students greater opportunities to both reinforce and expand the knowledge they had acquired in the F2F mode. Third, a variety of teaching techniques, different online tasks and discussion topics utilised in the two modes bolstered the students’ interests and engagement in their knowledge construction of how to compose English-language essays. Fourth, through the scaffolded activities, the students learned how to scaffold themselves and thus became independent learners in their future endeavours of constructing knowledge. Fifth, the scaffolding-to-scaffold activities provided the students with knowledge on how to effectively engage in transcendental scaffolding actions and facilitate the learning of English writing skills by less able peers within the learning community. Thus, the findings of this current study extended earlier understandings of scaffolding in an EFL hybrid learning environment and will contribute to the advancement of future ICT-mediated courses in terms of their scaffolding pedagogical aspects.

In a study of socioeconomically disadvantaged children's acquisition of school literacies, a university research team investigated how a group of teachers negotiated critical literacies and explored notions of social power with elementary children in a suburban school located in an area of high poverty. Here we focus on a grade 2/3 classroom where the teacher and children became involved in a local urban renewal project and on how in the process the children wrote about place and power. Using the students' concerns about their neighborhood, the teacher engaged her class in a critical literacy project that not only involved a complex set of literate practices but also taught the children about power and the possibilities for local civic action. In particular, we discuss examples of children's drawing and writing about their neighborhoods and their lives. We explore how children's writing and drawing might be key elements in developing "critical literacies" in elementary school settings. We consider how such classroom writing can be a mediator of emotions, intellectual and academic learning, social practice, and political activism.
