La question de la propriété de l’information est reformulée en tenant compte de la problématique de l’espionnage économique, pratique déloyale ayant pour objet prioritaire l’accès à l’information privée d’un concurrent. L’atteinte aux intérêts légitimes d’un concurrent résulte du seul transfert de connaissance et peut donc être théoriquement indépendante d’une éventuelle contrefaçon ou d’un acte de parasitisme. C’est dans la perspective de cet accès illégitime à la seule information d’un concurrent qu’est ici envisagée la propriété de l’information per se. À l’heure actuelle, l’existence d’une telle propriété de l’information n’est pas démontrée en droit, l’information n’étant qu’une « chose » et non un « bien ». Mais, en reconnaissant que l’information peut être volée indépendamment de tout support, le droit pénal semble admettre indirectement cette propriété. De même, une jurisprudence ancienne relative à la concurrence déloyale protège celui qui ne peut se prévaloir d’un droit privatif, ce qui implique une « réservation » juridique de l’information, forme de « quasi-propriété ». Cela tend à démontrer que la propriété de l’information est juridiquement concevable. Cependant, les débats doctrinaux se sont rarement orientés vers la question de la réparation, essentielle en matière d’espionnage économique. Dans cette perspective, la reconnaissance d’une propriété de l’information est en réalité très limitée compte tenu du préjudice pouvant résulter de la perte d’exclusivité de l’information, préjudice pouvant être bien supérieur à la valeur de l’information elle-même. Plutôt que de reconnaître un droit de propriété sur l’information, la solution serait peut-être d’accorder à l’entreprise un droit subjectif à la protection de ses informations confidentielles, droit protégeant civilement contre la seule appréhension illégitime de telles informations.

A administração da educação pública sergipana se tem submetido as determinações do contexto histórico-estrutural do estado, as quais têm reduzido as escolas públicas a meros espaços de manobras político-partidárias. As direções das instituições escolares são ocupadas, via de regra, por pessoas arbitrariamente indicadas pelo Estado, que estão deixando fluir até a clientela a ideologia da classe dominante. Na hegemonia em curso, seu papel tem sido o de reforço à evasão e seletividade da escola pública e o de controlador da distribuição do saber elaborado junto as crianças oriundas das camadas populares. E nesse sentido não se verifica qualquer diferença a partir da habilitação desses administradores. Considerada a escola pública numa perspectiva progressista e dada a insatisfação geral registrada, sobretudo nas escolas estaduais da capital e municipais do interior do estado, sugere-se dentre outras medidas, que todo o processo de formação do educador enfatize sua possibilidade como organizador de propostas pedagógicas coletivas, vinculadas ao movimento de democratização da sociedade. Isto desde as licenciaturas, às escolas normais e programas especiais de preparação do professor leigo, portanto extrapolando o âmbito das discussões sobre uma habilitação do Curso de Pedagogia. Também se propõe a união de forças da sociedade civil e a deflagração de um amplo processo de discussão na sociedade, a ser desenvolvido por etapas (municipal, micro-regional e estadual) tendo em vista a definição de diretrizes para uma política educacional em Sergipe. A mediação que se espera do organizador da escola é o exercício de uma administração de um direito civil básico de todo e cada cidadão sergipano: o domínio competente do saber social acumulado; essa prática ensejará ao diretor de escolas evoluir da postura de intelectual tradicional para a de intelectual progressista.

In Israel religious belonging remains a central category of citizenship. Laws concerning reproductive technologies such as the surrogacy law from 1996 are strongly informed by Orthodox rabbis’ kinship concepts (Kahn 2000, Shalev 1998, Weisberg 2005). A set of regulations secures that heterosexual Jewish couples bring into being children who are unequivocally Jewish themselves. The Israeli surrogacy law can therefore be understood as part of a policy seeking to reproduce the boundaries of the Jewish-Israeli collective. Same-sex couples do not fit this narrow definition of family and have no access to surrogacy in Israel. Yet gay couples maintain that parenthood is a universal civil right and bypass their exclusion through surrogacy arrangements abroad. The proposed paper follows these couples to Mumbai, which has become a popular destination for surrogacy in recent years. After their children’s birth the couples spend three to five weeks in India. In this time they not only take on their new tasks as fathers. They are also occupied with the bureaucracy of disconnecting the children from India and turning them into Israeli citizens. The paper elaborates on the bureaucratic processes and the hurdles same-sex couples encounter when seeking recognition of their parenthood and citizenship for their children. It unveils the intricacies and ramifications of Israel’s contradicting surrogacy policy of enforcing narrow definitions of family inside the country and simultaneously outsourcing problematic cases.

This paper aims at shedding light on an obscure point in Kant's theory of the state. It discusses whether Kant's rational theory of the state recognises the fact that certain exceptional social situations, such as the extreme poverty of some parts of the population, could request institutional state support in order to guarantee the attainment of a minimum threshold of civil independence. It has three aims: 1) to show that Kant's Doctrine of Right can offer solutions for the complex relation between economics and politics in our present time; 2) to demonstrate the claim that Kant embraces a pragmatic standpoint when he tackles the social concerns of the state, and so to refute the idea that he argues for an abstract conception of politics; and 3) to suggest that a non-paternalistic theory of rights is not necessarily incompatible with the basic tenets of a welfare state.
