The decision in QCOAL Pty Ltd v Cliffs Australia Coal Pty Ltd [2010] QSC 479 involved an examination of a number of issues relating to the assessment of costs under the Legal Profession Act 2007 (Qld). The decision highlights a range of issues which, in slightly different circumstances, may have deprived the successful party of the right to recover costs by reference to the costs agreement.

Childbirth and the development of acute trauma symptoms : incidence and contributing factors

Background: Little is known about the relationship between women's birthing experiences and the development of trauma symptoms. This study aimed to determine the incidence of acute trauma symptoms and posttraumatic stress disorder in women as a result of their labor and birth experiences, and to identify factors that contributed to the women's psychological distress. Method: Using a prospective, longitudinal design, women in their last trimester of pregnancy were recruited from four public hospital antenatal clinics. Telephone interviews with 499 participants were conducted at 4 to 6 weeks postpartum to explore the medical and midwifery management of the birth, perceptions of intrapartum care, and the presence of trauma symptoms. Results: One in three women (33%) identified a traumatic birthing event and reported the presence of at least three trauma symptoms. Twenty-eight women (5.6%) met DSM-IV criteria for acute posttraumatic stress disorder. Antenatal variables did not contribute to the development of acute or chronic trauma symptoms. The level of obstetric intervention experienced during childbirth (β= 0.351, p < 0.0001)and the perception of inadequate intrapartum care (β= 0.319, p < 0.0001) during labor were consistently associated with the development of acute trauma symptoms. Conclusions: Posttraumatic stress disorder after childbirth is a poorly recognized phenomenon. Women who experienced both a high level of obstetric intervention and dissatisfaction with their intrapartum care were more likely to develop trauma symptoms than women who received a high level of obstetric intervention or women who perceived their care to be inadequate. These findings should prompt a serious review of intrusive obstetric intervention during labor and delivery, and the care provided to birthing women.

Detection of rain in acoustic recordings of the environment

Environmental monitoring has become increasingly important due to the significant impact of human activities and climate change on biodiversity. Environmental sound sources such as rain and insect vocalizations are a rich and underexploited source of information in environmental audio recordings. This paper is concerned with the classification of rain within acoustic sensor re-cordings. We present the novel application of a set of features for classifying environmental acoustics: acoustic entropy, the acoustic complexity index, spectral cover, and background noise. In order to improve the performance of the rain classification system we automatically classify segments of environmental recordings into the classes of heavy rain or non-rain. A decision tree classifier is experientially compared with other classifiers. The experimental results show that our system is effective in classifying segments of environmental audio recordings with an accuracy of 93% for the binary classification of heavy rain/non-rain.

A kinematic analysis of the hand function

Background The evaluation of the hand function is an essential element within the clinical practice. The usual assessments are focus on the ability to perform activities of daily life. The inclusion of instruments to measure kinematic variables provides a new approach to the assessment. Inertial sensors adapted to the hand could be used as a complementary instrument to the traditional assessment. Material: clinimetric assessment (Upper Limb Functional Index, Quick Dash), antrophometric variables (eight and weight), dynamometry (palm preasure) was taken. Functional analysis was made with Acceleglove system for the right hand and computer system. The glove has six acceleration sensor, one on each finger and another one on the reverse palm. Method Analytic, transversal approach. Ten healthy subject made six task on evaluation table (tripod pinch, lateral pinch and tip pinch, extension grip, spherical grip and power grip). Each task was made and measure three times, the second one was analyze for the results section. A Matlab script was created for the analysis of each movement and detection phase based on module vector. Results The module acceleration vector offers useful information of the hand function. The data analysis obtained during the performance of functional gestures allows to identify five different phases within the movement, three static phase and tow dynamic, each module vector was allied to one task. Conclusion Module vector variables could be used for the analysis of the different task made by the hand. Inertial sensor could be use as a complement for the traditional assessment system.

Interaction of carbon monoxide with transition metal surfaces

XPS studies of the interaction of carbon monoxide with surfaces of Fe, Co and Ni indicate that at 300 K, the disproportionation reaction is prominent up to exposures of 103 L giving rise to high surface concentrations of carbon. At higher exposures and higher temperatures, dissociation of carbon monoxide accompanied by the formation of surface oxide layers becomes more prominent. In the case of copper, disproportionation is prominent up to 104 L even at 500 K followed by dissociation at higher exposures. These results are also supported by Auger spectroscopic studies.

A lifespan perspective on leadership

In this chapter, we present a lifespan model of leadership that outlines how leader and follower age as well as age-related changes in leader traits and characteristics, leader behaviors, and follower attribution and identification processes may influence leadership effectiveness. First, we describe how leader traits and characteristics change with age and how these developmental changes may impact on leader behaviors and, subsequently, leadership effectiveness. Specifically, we discuss age-related changes in leaders’ task competence, interpersonal attributes, and motivation to lead. We particularly focus on how generativity – a set of interconnected motives pertaining to establishing and guiding future generations – may emerge as an important concern among older leaders. Second, we review theoretical approaches that help explain how and why leader age and age-related traits and characteristics, follower age, as well as leader-follower age differences may influence follower attribution and identification processes. Third, we outline a number of boundary conditions of the effects proposed by our lifespan model of leadership, including leader-follower relationship duration, situational characteristics, as well as the cultural, social, and historical context. We conclude the chapter by discussing our model’s implications for future research and organizational practice.

Mulheres opinam sobre o aborto. Narrador descreve dados da Organização das Nações Unidas - ONU, segundo os quais no Brasil são feitos 10% dos abortos do mundo . Aparecida Shumaher, do Conselho Nacional de Defesa da Mulher, diz que o aborto é questão de responsabilidade ética da mulher, cabendo a ela decidir. Dom Antonio C. de Queiroz, Secretário Geral da Conferência Nacional dos Bispos do Brasil (CNBB), afirma que a igreja é radicalmente contra o aborto. Leonor Nunes de Paiva, da OAB-RJ, defende que a mulher deve ter o direito de interromper a gestação. Diz também que a OAB-RJ entende o aborto como assunto para a legislação ordinária. Deputados da Assembleia Nacional Constituinte (ANC) consideram que o aborto não é matéria constitucional. José Paulo Bisol (PMDB-RS) afirma que o aborto deve ser tratado no Código Penal, não na Constituição. Reunião da Mesa da Constituinte discute como será a votação do substitutivo da Sistematização no Plenário geral. Já existem propostas do Centrão e da Mesa. De acordo com o Senador Mauro Benevides (PMDB-CE), presidente em exercício da Assembleia Nacional Constituinte (ANC), a Mesa se encaminhará para a apresentação de outro substitutivo. Sessão solene conclui os trabalhos da Comissão de Sistematização dando por encerrada a votação do substitutivo, este encaminhado à Mesa da ANC. O Deputado Bernardo Cabral (PMDB-AM), faz considerações sobre os trabalhos da Comissão de Sistematização. O Senador Affonso Arinos (PFL-RJ) repete a frase de Benjamin Franklin: "Por haver vivido muito, fui levado a mudar de opinião várias vezes em assuntos importantes, assim aceito este projeto" e conclui declarando aceitar o projeto. O Deputado Amaury Muller (PDT-RS) afirma que embora os Constituintes façam um balanço positivo dos assuntos que foram tratados na Sistematização, reconhecendo seu trabalho, mantém-se a fé e a esperança de que os Constituintes no Plenário possam traduzir com fidelidade os compromissos que assumiram com a sociedade brasileira durante a campanha eleitoral. O Senador Mario Covas (PMDB-SP), a Deputada Sandra Martins Cavalcanti (PFL-RJ) e o Deputado Arnaldo Faria de Sá (PTB-SP) consideram que no Plenário alguns dos pontos do substitutivo serão reformados, enriquecendo o texto. Influence of aniline on Daphnia magna Straus [Translation from: Trudy Saratov.Otdeleniya GosNIORKh 13 102-104, 1975]

Experiments were carried out by the method of direct effect of the tested substance on increase of biomass (1,2). Daphnia magna was cultured under laboratory conditions.The author concludes that concentrations of aniline from 5000 to 0.1 mg/1 appear acutely lethal. The disturbance of feeding, reproduction, the disorganization of the nervous system, speak of the toxicity of the substance.
