In The Global Model of Constitutional Rights Kai Möller claims that the proportionality test is underlain by an expansive moral right to autonomy. This putative right protects everything that advances one’s self-conception. It may of course be limited when balanced against other considerations such as the rights of others. But it always creates a duty on the state to justify the limitation. Möller further contends that the practice of proportionality can best be understood as protecting the right to autonomy. This review article summarizes the main tenets of Möller’s theory and criticizes them on two counts. First, it disputes the existence of a general right to autonomy; such a right places an unacceptably heavy burden on others. Second, it argues that we do not need to invoke a right to autonomy to explain and justify the main features of the practice of proportionality. Like other constitutional doctrines, proportionality is defensible, if it is grounded in pragmatic –mainly epistemic and institutional- considerations about how to increase overall rights compliance. These considerations are independent of any substantive theory of rights.

The transition parameter is based on the electron characteristics close to the Earth's dayside magnetopause, but reveals systematic ordering of other, independent, data such as the ion flow, density and temperature and the rientation and strength of the magnetic field. Potentially, therefore, it is a very useful tool for resolving ambiguities in a sequence of satellite data caused by the effects of structure and motion of the boundary; however, its application has been limited because there has been no clear understanding of how it works. We present an analysis of data from the AMPTE-UKS satellite which shows that the transition parameter orders magnetopause data because magnetic reconnection generates newly-opened field lines which coat the boundary: a direct relationship is found with the time elapsed since the boundary-layer field line was opened. A simple model is used to reproduce this behaviour.

This article investigates the notion of transculturality and applies it to four modernist authors of the 20th century: Edith Södergran, Elias Canetti, Henry Parland and Marguerite Duras. The concept of transculturality is used to reach a better – or at least different – understanding of the selected writers and their respective body of work.

The present study aims at making a theoretically reflection about the reconstruction process of democracy that can be observed in the country since the opening political process, which took place with the Geisel´s government in 1974, passing through the first civil president, in 1985, the Constitution process, in 1986, and finally the Constitution promulgation in 1988. It interests to this study analyses the premise that the 1988 Constitution inaugurates the moment in which democracy starts to be reconstructed in the country, and that this reconstruction is made in such a brand new way, once it included the possibility of participation of the civil society in the deliberation of the public politics, what became possible with the creation of new spaces of a gestion shared by the three executive powers: federal; states; municipalities, and with the civil society, in the councils created in those spheres. In this way, this work wishes to focus the opening process to the civil society participation, wich became possible with the creation of the city councils of public politics. It´s about investigating the form in wich the relations set up in these hibrid spaces could be considered democratic, inclusive and promoters of effective participation, checking up tendencies, giving emphasis to regularities and some specifities encountered in the forms of participation, which have been observed in those councils. In order to comprehend the democratic process in construction in the country, the analysis of the relations established by the civil society and the local executive power in the obligatory municipal councils is taken as object of study, passing by the tensions wich evolves institutions and political practices, permeated by the local political culture.
