Objective Levodopa in presence of decarboxylase inhibitors is following two-compartment kinetics and its effect is typically modelled using sigmoid Emax models. Pharmacokinetic modelling of the absorption phase of oral distributions is problematic because of irregular gastric emptying. The purpose of this work was to identify and estimate a population pharmacokinetic- pharmacodynamic model for duodenal infusion of levodopa/carbidopa (Duodopa®) that can be used for in numero simulation of treatment strategies. Methods The modelling involved pooling data from two studies and fixing some parameters to values found in literature (Chan et al. J Pharmacokinet Pharmacodyn. 2005 Aug;32(3-4):307-31). The first study involved 12 patients on 3 occasions and is described in Nyholm et al. Clinical Neuropharmacology 2003:26:156-63. The second study, PEDAL, involved 3 patients on 2 occasions. A bolus dose (normal morning dose plus 50%) was given after a washout during night. Plasma samples and motor ratings (clinical assessment of motor function from video recordings on a treatment response scale between -3 and 3, where -3 represents severe parkinsonism and 3 represents severe dyskinesia.) were repeatedly collected until the clinical effect was back at baseline. At this point, the usual infusion rate was started and sampling continued for another two hours. Different structural absorption models and effect models were evaluated using the value of the objective function in the NONMEM package. Population mean parameter values, standard error of estimates (SE) and if possible, interindividual/interoccasion variability (IIV/IOV) were estimated. Results Our results indicate that Duodopa absorption can be modelled with an absorption compartment with an added bioavailability fraction and a lag time. The most successful effect model was of sigmoid Emax type with a steep Hill coefficient and an effect compartment delay. Estimated parameter values are presented in the table. Conclusions The absorption and effect models were reasonably successful in fitting observed data and can be used in simulation experiments.

The self, roles and the ongoing coordination of human action. Trying to see ‘society’ as neither prison nor puppet theatre In the article it is argued that structural North-American role-sociology may be integrated with theories emphasizing ‘society’ as ongoing processes (f. ex. Giddens’ theory of structuration). This is possible if the concept of role is defined as a recurrence oriented to the action of others standing out as a regularity in a societal process. But this definition makes it necessary to in a fundamental way understand what kind of social being the role-actor is. This is done with the help of Hans Joas’ theory of creativity and Merleau-Pontys concept of ‘flesh’ arguing that Meads concept of the ‘I’ maybe understood as an embodied self-asserting I, which at least in reflexive modernity has the creative power to split Meads ‘me’ into a self-voiced subject-me and an other voiced object-me. The embodied I communicating with the subject-me may be viewed as that role-actor which is something else than the role played. But this kind of role-actor is making for new troubles because it is hard to understand how this kind of self is creating self-coherence by using Meads concept of ‘the generalized other’. This trouble is handled by using Alain Touraines concept of the ‘subject’ and arguing that the generalized other is dissolving in de-modernized modernity. In split modernity self-coherence may instead be created by what in the article is called the generalized subject. This concept means a kind of communicative future based evaluation, which has its base in the ‘subject’ opposing the split powers of both the instrumentality of markets and of life-worlds trying to create ‘fundamentalistic’ self-identities. This kind of self is communicative because it also must respect the other as ‘subject’. It exists only in the battle against the forces of the market or a community. It never constructs an ideal city or a higher type of individual. It creates and protects a clearing that is constantly being invaded, to use the words of the old Frenchman himself. Asa kind of test-case it is by the way in the article shown how Becks concept of individualization may be understood in a deeply social and role-sociological way.

Este trabalho acadêmico é fruto da observação profissional cotidiana acerca da relação do Estado e de suas entidades de Direito Público com o particular. De modo algum propende a deslustrar teorias, opiniões e suporte jurídico favoráveis ao modelo diferenciado e casuisticamente pró-estatal vigente. Assim, na linha do eixo acadêmico-científico deste Mestrado, de caráter marcadamente profissional, buscou-se no campo do pluralismo de idéias descrever, num diapasão dialético, o contexto factual e jurídico-legal consoante os dois primeiros capítulos, para assim ensejar discussão e reflexão sobre matéria que se oferece relevante para a efetiva melhoria dos serviços jurisdicionais, submetendo-os, a seguir, a diretivas teóricas e, em particular, à compreensão contextual de nossa ordem constitucional. Partiu-se assim, de situações concretas vivenciadas no ambiente forense de uma unidade da Justiça Federal (2ª Vara da Justiça Federal de Petrópolis, da Seção Judiciária do Estado do Rio de Janeiro), sabidamente competente para as causas em que a União, entidades autárquicas ou empresa pública federal forem interessadas na condição de autoras, rés, assistentes ou opoentes1. O tema central do estudo são as prerrogativas processuais da Fazenda Pública. Vem de longe um conjunto de protetivo processual em seu favor. Para ficarmos no século XX, por exemplo, o art. 32 do Decreto-Lei nº 1.608, de 18 de setembro de 1939 (Código de Processo Civil) já explicitava: “Art. 32. Aos representantes da Fazenda Pública contar-se-ão em quádruplo os prazos para a contestação e em dobro para a interposição de recurso.” O Código de Processo Civil atual conforme destacado na parte descritiva do texto, cuidou de aperfeiçoar e ampliar esse suporte pró-fazendário, como exemplo, o dispositivo mais conhecido é, seguramente, o art. 188 do Código de Processo Civil. No entanto, a multiplicidade de avanços no seio da sociedade brasileira – basicamente nos planos político, constitucional, legal, social, econômico, cultural, global e tecnológico – trouxe como corolário o imperativo da otimização dos mecanismos voltados para o que denominamos no trabalho de acesso qualificado à Justiça. Esse conjunto de fatores, em realidade, acha-se forrado pelos princípios da igualdade e da isonomia que permeiam todo o arcabouço de conquistas asseguradas no corpo político-jurídico constitucional. Nas palavras do professor e atual Ministro do Supremo Tribunal Federal Luiz Fux2, a neutralidade, sobretudo do juiz, constitui fator impediente para o magistrado manter a igualdade das partes na relação jurídica processual. Claro, frise-se, tanto quanto possível, isto é, observando a lei que, ao eventualmente promover, pontualmente, certo grau distintivo, o faça comprometida com a efetiva correção de discrímen para assim encontrar e assegurar a igualdade. Deve fazêlo, na linha desse pensamento, de modo a impedir que o resultado da aplicação da norma não seja expressão da deficiência e do desmerecimento de uma das partes em juízo. Tudo considerado importa que o entendimento ora realçado não se destine apenas ao juiz, mas no caso, também ao legislador, fonte criadora da normatividade posta em evidência.

Economists have argued that regulation is the appropriate approach to maintain output in its economically efficient level in a natural monopoly, and that can be achieved by submitting these companies to regulatory agencies’ decisions. The autonomous agencies are, however, not free in an absolute sense, and it is important to ask what the priorities of the new administration are. One answer is that it is designed to give leeway and powers of discretion to unbiased professionals with expertise in their field. In practice, however, professional experts might often be politically motivated. The objective of this study is to investigate whether political nominations to the presidency of regulatory agencies, rather than technical appointments, affect the level of regulatory risk. In order to achieve this purpose, an event study was performed, where the regulatory risk in a political nomination will be compared to a technical nomination, in terms of abnormal return.

Esta dissertação estuda os países andinos Bolívia, Equador e Venezuela que recentemente, sob a liderança de Presidentes com forte respaldo popular e discurso de renovação política, aprovaram novas constituições. Todo o processo de elaboração das novas constituições nos três países foi realizado buscando-se o respaldo popular, com consultas para saber, no voto, se de fato Assembleias Constituintes deveriam ser convocadas até a posterior aprovação do texto final via plebiscito realizado nacionalmente. Para analisar de forma crítica o que ocorreu na Bolívia, no Equador e na Venezuela foi realizada uma revisão bibliográfica do conceito de constituição e poder constituinte, estudando-se também o processo de elaboração de constituições, conforme entendido pela literatura. A compreensão teórica aliada aos três casos práticos estudados no texto permitem identificar uma tendência de direcionamento da vontade popular para a implementação de projetos políticos dos líderes eleitos, que atuam para, com maior ou menor facilidade, conseguir controlar todas as instâncias políticas do país. E as novas Constituições, observar-se-á, são parte fundamental nesse projeto de poder.

Este trabalho aborda a atividade sancionadora da Administração Pública e a necessidade de apreciação da culpabilidade para aplicação da sanção administrativa. Procede-se a uma análise dos fundamentos e conteúdo do Poder Sancionador da Administração Pública, em especial à culpabilidade do agente como elemento da infração administrativa. Defende-se, como regra, a necessidade de apreciação do elemento subjetivo do agente para aplicação da sanção administrativa, sob a ótica constitucional, enquanto garantia do administrado e decorrência da dignidade da pessoa humana.

Uma das respostas dadas à expansão dos poderes do STF responsabiliza a Assembleia Constituinte pelos poderes dados ao tribunal. O objetivo desse trabalho é comprovar que o STF avoca para si competências nunca entregues pela constituinte, mesmo em matérias em que a omissão de outros poderes não pode ser alegada. Para isso estudamos o controle preventivo de emendas fazendo uma análise comparativa entre o seu desenho na Assembleia e as mudanças ocorridas ao longo da jurisprudência da Corte.

Este trabalho visa comparar, estatisticamente, o desempenho de duas estratégias de imunização de carteiras de renda fixa, que são recalibradas periodicamente. A primeira estratégia, duração, considera alterações no nível da estrutura a termo da taxa de juros brasileira, enquanto a abordagem alternativa tem como objetivo imunizar o portfólio contra oscilações em nível, inclinação e curvatura. Primeiro, estimamos a curva de juros a partir do modelo polinomial de Nelson & Siegel (1987) e Diebold & Li (2006). Segundo, imunizamos a carteira de renda fixa adotando o conceito de construção de hedge de Litterman & Scheinkman (1991), porém assumindo que as taxas de juros não são observadas. O portfólio imunizado pela estratégia alternativa apresenta empiricamente um desempenho estatisticamente superior ao procedimento de duração. Mostramos também que a frequência ótima de recalibragem é mensal na análise empírica.

Seriam as reformas tributárias condicionadas por fatores políticos? Verificando a escassez de trabalhos empíricos sobre o tema, elaboramos definição própria de reforma tributária e adotamos uma tipologia para esses fenômenos. Em seguida, compilamos a base de dados de reformas tributárias a partir das respostas aos formulários da pesquisa de campo IPES 2006, realizada pelo Banco Interamericano de Desenvolvimento, com apoio do Centro Interamericano de Administrações Tributárias (CIAT). Esses formulários foram preenchidos por funcionários especialistas dos ministérios de finanças latino-americanos, que reportaram reformas entre 1990 e 2004. Depois, construímos os índices de reformas tributárias, que foram utilizados como variáveis dependentes em nossos modelos. Os índices contribuem para o desenvolvimento de estudos quantitativos sobre reformas tributárias, portando flexibilidade para testar diversas hipóteses. Eles tornaram possível analisar separadamente os determinantes das reformas da tributação da renda e do consumo, das reformas gerais e direcionadas, das reformas tendentes a aumentar ou reduzir tributos. Nos testes, destacou-se a influência da lista fechada, indicando que a disciplina parlamentar é importante para aprovar reformas. Em menor número de especificações, foram também relevantes a magnitude distrital, o bicameralismo, o poder de decreto do presidente da república e seu ciclo eleitoral. Não captamos evidência de fatores políticos conjunturais, como a ideologia partidária e maioria do governo no parlamento. Do mesmo modo, a influência dos poderes presidenciais de agenda e veto não se confirmou. O domínio de um partido na coalizão de governo foi relevante somente quando vinculado à lista fechada nas eleições. Em geral, os resultados confirmam o impacto de fatores político-institucionais sobre reformas tributárias, não se observando o mesmo para fatores político-conjunturais. Além disso, foram observadas diferenças nos condicionantes políticos que definem reformas na tributação da renda e do consumo, direcionadas e gerais, expansivas e redutoras (incentivos). O estudo contribui para análise quantitativa dos condicionantes políticos das reformas tributárias na América Latina e fornece dados antes indisponíveis. Oferece evidência empírica, considerando diferentes tipos de reformas e de fatores políticos. O estudo conclui pela necessidade de incorporar as variáveis políticas nas análises que envolvam reformas tributárias, até então marcadas pelo domínio dos argumentos econômicos. Além disso, sugere que o aperfeiçoamento das instituições políticas é importante para melhorar as decisões de política tributária na América Latina.

Esse trabalho tenta analisar a atuação do Ministério do Trabalho através da articulação de seus ministros com outras áreas da burocracia estatal, durante o governo Castelo Branco, para, por um lado, reprimir e expurgar opiniões contrárias ao regime ditatorial e, por outro, promover uma nova política para os trabalhadores, o “novo trabalhismo”. O termo condensava a ideia da área econômica de ‘democratizar’ as oportunidades, ampliando as atribuições dos sindicatos, deslocando o seu foco das reivindicações salariais para o desenvolvimento, em associação com o governo, de projetos e programas de investimentos nos setores sociais de produtividade indireta. Para implementar a proposta, cada ministro teve que lidar com as pressões advindas do processo de alteração da política trabalhista e articular os seus interesses pessoais com as atribuições da pasta. Arnaldo Sussekind resistiu às demandas para o fim da estabilidade, alterou a Lei de Greve, permitiu o fracionamento do 13º salário e abriu espaço para a implantação da política salarial. Ao mesmo tempo promoveu uma massiva intervenção nos sindicatos, cujos processos permitem conhecer melhor o interior da burocracia estatal, perceber os argumentos utilizados para afastar as diretorias das entidades e questionar a tomada de decisões dentro do ministério sob o novo contexto social pós-golpe. Walter Peracchi Barcelos utilizou a pasta como trampolim político, propondo e executando ações repressivas que lhe garantiam vantagens políticas e negligenciando projetos da área econômica, como o Fundo de Garantia por Tempo de Serviço, que ameaçavam importantes conquistas dos trabalhadores. Por fim, Luiz Gonzaga do Nascimento e Silva reformulou o Banco Nacional da Habitação e unificou a previdência, ações que permitiram a transferência de atribuições e recursos do Estado para a iniciativa privada. A pesquisa, portanto, sustenta que o Ministério do Trabalho, após o golpe, perdeu poder político dentro do governo por permitir a transferência de suas atribuições para camadas da elite empresarial e para os militares, forçando os sindicatos a modificarem seus canais de diálogo e suas reivindicações para se adaptarem ao novo contexto.

Visceral leishmaniasis (VL) has a wide geographical distribution in tropical and subtropical areas of the planet, which is a protozoan parasite of the genus Leishmania. This pathogen is transmitted to the host through the sandflies bite, with its saliva, the immune response that leads to both. In the state of Rio Grande do Norte, 85% of the sand flies captured is Lutzomyia longipalpis, but the second most abundant, Lutzomyia evandroi, it deserves emphasis because its wide distribution and eclectic behavior. The exposure of people living in endemic areas for the insect vector VL greatly increases the chances of infection. This study aimed to evaluate aspects of the epidemiological profile of VL in endemic areas of human and nonendemic in the metropolitan area of Natal, as well as verify the abundance and seasonal fluctuations of sandflies species in two counties endemic for VL. Were collected in the municipalities of Nísia Floresta, Parnamirim, São Gonçalo do Amarante and Macaíba, of which groups of females were separated for further dissection of the salivary glands and identification of species. The blood samples used were from individuals of two Natal s districts where it has never been reported cases of VL and neighborhoods of Parnamirim applicants who present cases of VL. In the municipality of Nísia Floresta, the most abundant species was L. evandroi with 38.39%, followed by L. longipalpis with 36.22%, L. walkeri 19.67% L. lenti 3.81%, L. wellcomei 1.39% and L. whitmani 0.52%. Already in Parnamirim the proportions were L. walkeri with 73.15%, L. evandroi with 10.55%, L. wellcomei 7.63%, L. longipalpis 6.37%, L. whitmani 1.46%, L. sordellii 0.52%, L. intermedia 0.21 and L. shanonni 0.1%. In both municipalities was observed higher abundance of species distributed in the initial months of the year, as February and March. The study showed that no difference in exposure to the vector of VL among individuals from endemic and non endemic area for this disease. But there are differences in exposure between individuals of L. longipalpis and L. evandroi, confirming the great powers of the first vector. It was also characterized as predominant phenotype in the population of endemic areas who had negative serologic responses to antigens of Leishmania and result in negative Montenegro skin test (DTH), indicating that much of the population hasn t been bitten by infected insects

This scholarly work aims to investigate the feasibility and constitutionality of access to justice through the provision of full and free legal assistance by the Brazilian municipalities. Investigates the historical aspects of federalism in a global context, emphasizing the contributions left by American federalism. In the Brazilian context, emphasizing the importance of municipalities as federal entities and their outstanding characteristics, while addressing regional issues of federalism. Leanings to the more detailed analysis of the Brazilian municipalities, contextualizing its legal status, its independence and its constitutional powers. It is emphasized in the same way, the relevant transformations of Brazilian municipalities over the last twenty years of this Constitution of the Federative Republic of Brazil in 1988, especially the various constitutional amendments that affected the local autonomy and budgetary aspects, fiscal and skills, bringing significant changes to the municipalities. It is an approach to the concept of justice and deepening the studies on the fundamental right of access to justice in its various connotations. In this vein, it is a study on the legal advice provided in Brazil, especially the powers of the Public Defender of the States and Union, as well as the provision of such public service by Brazilian municipalities and its relevance to citizens in need. At this point, it deepens the relevance of the theme of this dissertation earning the implications of municipal performance in the provision of legal assistance provided to the needy, and the activity of the Municipal Attorney or legal counsel in conducting such a task and its implications for legal and procedural especially on the constitutionality or otherwise of the conduct of such public service, confronting the constitutional articles that are correlated with the subject. Within this context, evaluates the municipal legal assistance under the test of constitutionality, in particular the assistance given by the Executive, through the Municipal Attorney or specialized secretariats and that provided by the Legislature, although it only has the typical functions of legislating and control the municipal accounts, comes in a few municipalities in Brazil deploying sectors with the performance of legal services to the needy. At this point the thesis, one wonders if some important aspects of this activity such as political influence and patronage, very common in day-to-day municipal prosecutors and legal advisers, public employees or occupying commissioned positions within the municipal administrative structure in several municipalities throughout Brazil. Finally, there will be a conclusion as to the constitutionality of the service being done by presenting proposals and recommendations that may improve the municipal legal aid, allowing a constitutional backing to this important service is being provided in capital cities and municipalities throughout the length of Brazil

Taking as a starting point the Classic Federalism and theory of the development this Work intend to present some ideas linked about cooperation between federal entities and intergovernmental relations with the main focus the regulation by the Public Consortia aimed at administrative efficiency as a Constitutional Principle of Activity Administrative, against the current provisions of the Federal Constituition of 1988, and infraconstitutional legislation in order to provoke debate and criticism about the principle of cooperation adopted as a paradigm and the capabilities that the state has and what it is, in fact, an efficient management public. It is in the growth of the state, and not a decrease as a minimal state, which aims to discuss its role in promoting the collective interests, and it is therefore essential, as an institution able to intervene on citizens in the search for socially relevant results. Study Federalism and Development on the premise of public consortia and administrative efficiency requires study the course of history as the formation of the Brazilian State, in particular the fact that he is in joint effort between federal agencies - federal, state and municipal - in order to better review the relations established in this plan, in what concerns directly on the issue of division of powers, especially the common or competitors and the subject of the highest relevance for the implementation of an effective federal pact. Finally, the objective of this Work is not only particularize the institute of public consortia, it is intended to demonstrate the deviousness of the concept of efficiency and the division of powers of federal agencies and the constitutional contribution of the institute as a program that should be put in a tone of debate, adequacy of the practice and the law itself

The research aims to analyze the reasons and the unique role of prosecutors in the promotion of public policies. The opening lines deal with the evolution and expansion of the general theory of the fundamental rights in the international and national levels and that have led to the creation of a welfare state concerned with carrying out positive actions which aim at the community well-being. Thus, it is clear that, after the uneven development of the Brazilian democracy, the Constitution of 1988 not only has erected to a state socially responsible, but also built a system of guarantees which highlights the significant expansion of the Powers of the Public Ministry and has now taken an outstanding position in regard to collective rights, allowing, at the same time, its members to perform the syndication of state actions, particularly public policies, correcting the course of these administrative processes in the presence of poor management and inactivity of the public administrator when acting in defense of fundamental rights. This ministerial activism, even facing the obstacles and boundaries submitted to its pursuit, has shown an increase in actions that culminated, in the last ten years, in a significant number of judicial and extrajudicial measures that indicated the correction of public policies and actions in areas of health, education, housing and the environment. In this process of monitoring and doing, the important role of the other social characters is highlighted, especially the one of the citizen who is responsible for most of the complaints that start the initiatives of the Public Ministry and that can be deployed through a significant list of judicial and extrajudicial instruments, especially the important procedure that allows the hearing and participation of the involved in the implementation of public policies, enabling a collective even a consensual solution of the matter generated among the Public Administration. Given these initiatives, the ministerial activism has established itself as a movement of its own characteristics, aimed to guarantee the fundamental rights, especially when these are not targeted by state actions that should contribute to the achievement of the democratic state of law idealized by the Federal Constitution without any distortion of direction. The present work consists of studying to diffuse control of constitutionality in Brazil, with emphasis in a procedural alternative to the evolution of that model: the incident to challenge of unconstitutionality. Starting from the discussion about the new role of constitutional jurisdiction in peripheral countries and in the globalized society, without forgetting to face inevitable doubts about its legitimacy before other powers of the State, the Brazilian control of constitutionality is revealed, under a diffuse, non-dichotomical view, through a number of inconsistencies and misunderstandings, that compromise social peace, the credibility of democratic institutions and the supremacy of juridical security. In order to achieve the goal, the study in course discussed the main difficulties of the Brazilian mixed model of constitutionality control, as well as, directing its view to the incident of challenge of unconstitutionality, which the most adequate forms to assure its appropriateness, legitimacy, processing and decisory effects are. Is was essential, in this point of view, to establish the difference between the incident of challenge of unconstitutionality conceived in article of the Brazilian Federal Constitution and the incident of challenge of unconstitutionality such as it is known in the European models. The insertion of the incident of challenge of unconstitutionality based on European models in the Brazilian control system, without jeopardizing the North-American essence the Brazilian constitutional history presents since 1981, is the hypothesis that is presented as an improvement of constitutional protection
