In 2009, Vladimir Putin, the then Russian prime minister, gave impetus to the establishment of closer relations within what was then a still narrow group of three countries: Russia, Kazakhstan and Belarus. Russia was determined in embarking on the implementation of the principles of the Customs Union among these three states and, since 2012, within the Common Economic Space as well. This process of integration is intended to bring about the introduction of ‘four freedoms’ in this area: the free movement of goods, services, capital and labour. From Moscow’s point of view, building up such integration structures is especially necessary in order to counteract the economic expansion of the European Union and China. It also feels it is important to take measures against the loosening of the bonds between the CIS countries and Russia. At the same time, close co-operation is expected to guarantee for Russia that the strong politico-economic influences in this area will be maintained. Despite the numerous limitations of the integration process, such as the small number of the participating states or limited progress in implementing the CES, this is still the most advanced integration programme in the region seen since the collapse of the USSR. Progress in putting the rules of the Customs Union into practice can be seen as a success for Moscow. In turn, the formation of the CES is still at an early stage, and it is difficult to determine at this point to what extent the three countries will harmonise their markets.

This study examines the legal and political implications of the forthcoming end of the transitional period for the measures in the fields of police and judicial cooperation in criminal matters, as set out in Protocol 36 to the EU Treaties. This Protocol limits some of the most far-reaching innovations introduced by the Treaty of Lisbon over EU cooperation on Justice and Home Affairs for a period of five years after the entry into force of the Treaty of Lisbon (until 1 December 2014), and provides the UK with special ‘opt out/opt-in’ possibilities. The study focuses on the meaning of the transitional period for the wider European Criminal Justice area. The most far-reaching change emerging from the end of this transition will be the expansion of the European Commission and Luxembourg Court of Justice scrutiny powers over Member States’ implementation of EU criminal justice law. The possibility offered by Protocol 36 for the UK to opt out and opt back in to pre-Lisbon Treaty instruments poses serious challenges to a common EU area of justice by further institutionalising ‘over-flexible’ participation in criminal justice instruments. The study argues that in light of Article 82 TFEU the rights of the defence are now inextricably linked to the coherency and effective operation of the principle of mutual recognition of criminal decisions, and calls the European Parliament to request the UK to opt in EU Directives on suspects procedural rights as condition for the UK to ‘opt back in’ measures like the European Arrest Warrant.

Este estudo teve como objetivo caracterizar as concepções e práticas de avaliação de professores portugueses de Ciências Físico-Químicas do ensino básico e conhecer como estes integram a avaliação nas suas aulas no contexto de uma reorganização curricular. Realizaram-se três estudos de caso, em que participaram professores com menos de três anos de serviço. A recolha de dados consistiu na observação naturalista de aulas, entrevistas semiestruturadas e documentos fornecidos pelos participantes. Os resultados evidenciam duas concepções de avaliação das aprendizagens: avaliação da aprendizagem e avaliação para a aprendizagem. Um dos participantes evidencia uma concepção de avaliação da aprendizagem, valorizando uma avaliação de natureza sumativa. Os professores com uma concepção sobre avaliação para a aprendizagem promovem uma avaliação orientada para a melhoria das aprendizagens, valorizando o carácter formativo da avaliação. Relativamente às práticas avaliativas dos três participantes, verificou-se que os critérios de avaliação não são explicitados aos alunos, o feedback é pouco frequente e os alunos têm um papel reduzido no processo de avaliação. Todos os professores demonstram dificuldades na avaliação das competências atitudinais e processuais, sendo que, apenas um dos participantes elabora registos de observação para avaliar estas competências. Os testes constituem o principal instrumento de avaliação nas aulas dos professores participantes neste estudo, o que é coerente com uma concepção de ensino e aprendizagem ainda, marcadamente tradicional.
