Moffitt’s dual typology of ‘life-course persistent’ and ‘adolescence limited’ offending has received extensive empirical attention, but the extent to which the antisocial behaviour of adolescence limited offenders is constrained to adolescence is relatively under-examined.Using data from the Australian Mater University Study of Pregnancy and its Outcomes, we explore Moffitt’s concept of snares, or those factors that may lead to an adolescent persisting in antisocial behaviour such as drug addiction, educational failure, and contact with the justice system. The Mater University Study of Pregnancy and its Outcomes is a longitudinal study of mother–child dyads from the pre-natal stage to 21 years of age. Findings show that one-third of individuals identified as having an adolescent onset of antisocial behaviour persisted with this antisocial behaviour as young adults. This continuity can, in part, be explained by snares and the research suggests that reducing exposure to snares may lead to less antisocial behaviour in adulthood.

How litigious are Australians? Although quantitative studies have comprehensively debunked the fear of an Australian civil justice system in crisis, the literature has yet to address the qualitative public policy question of whether Australians are under- or over-using the legal system to resolve their disputes. On one view, expressed by the insurance industry, the mass media and prominent members of the judiciary, Australia is moving towards an American-style hyper-litigiousness. By contrast, Australian popular culture paints the typical Australian as culturally averse to formal rights assertion. This article explores the comparative law literature on litigiousness in two jurisdictions that have attracted significant scholarly attention — the United States and Japan. More specifically, it seeks to draw lessons from this literature for both understanding litigiousness in modern Australia and framing future research projects on the issue.

Two types of welfare states are compared in this article. Differences in procedural rights for young unemployed at the level of service delivery are analyzed. In Australia, rights are regulated through a rigid procedural justice system. The young unemployed within the social assistance system in Sweden encounter staff with high discretionary powers, which makes the legal status weak for the unemployed but, on the other hand, the system is more flexible. Despite the differences, there is striking convergence in how the young unemployed describe how discretionary power among street-level staff affects their procedural rights. This result can be understood as a result of similar professional norms, work customs and occupational cultures of street-level staff, and that there is a basic logic of conditionality in all developed welfare states where procedural rights are tightly coupled with responsibilities.

Queer criminological work is at the forefront of critical academic criminology, responding to the exclusion of queer communities from criminology, and the injustices that they experience through the criminal justice system. This volume draws together both theoretical and empirical contributions that develop the growing scholarship being produced at the intersection of 'queer' and 'criminology'. Reflecting the diversity of research that is undertaken at this intersection, the contributions to this volume offer a deeper theoretical and conceptual development of this field alongside empirical research that illustrates the continued relevance and urgency of such scholarship. The contributions consider what it means to be queering criminology in the current political, social, and criminological climate, and chart directions along which this field might develop in order to ensure that greater social and criminal justice for LGBTIQ communities is achieved.

As part of the 2014 amendments to the Youth Justice Act 1992 (Qld) the previous Queensland government introduced a new breach of bail offence and a reverse onus provision in relation to the new offence. Also included in the raft of amendments was a provision removing the internationally accepted principle that, in relation to young offenders, detention should be used as ‘a last resort’. This article argues that these changes are likely to increase the entrenchment of young people within the criminal justice system.

This report examines publically-available research literature from North America, Australia and New Zealand on the effectiveness of measures that aim to reduce non-violent offending by Indigenous people. It identifies culturally safe and relevant principles for the design and implementation of measures that have been found to be promising in terms of reducing this category of offending. These principles are important for policy-makers and practitioners to understand, given that many Indigenous people come into contact with the criminal justice system in relation to non-violent offences such as public order and driving offences. The principles set out in the report include: incorporating Indigenous culture, family and community into treatment programs; combining Indigenous approaches with effective Western treatment models such as Cognitive Behavioural Therapy; and addressing the substance abuse, trauma, and historical and social context often associated with offending by Indigenous people. In addition to promoting these principles, the report provides an overview of Indigenous people’s contact with the criminal justice system in relation to non-violent crimes, as well as a discussion of specific programs that have been used with this group of offenders.

DNA evidence has made a significant contribution to criminal investigations in Australia and around the world since it was widely adopted in the 1990s (Gans & Urbas 2002). The direct matching of DNA profiles, such as comparing one obtained from a crime scene with one obtained from a suspect or database, remains a widely used technique in criminal investigations. A range of new DNA profiling techniques continues to be developed and applied in criminal investigations around the world (Smith & Urbas 2012). This paper is the third in a series by the Australian Institute of Criminology (AIC) on DNA evidence. The first, published in 1990 when the technology was in its relative infancy, outlined the scientific background for DNA evidence, considered early issues such as scientific reliability and privacy and described its application in early criminal cases (Easteal & Easteal 1990). The second, published in 2002, expanded on the scientific background and discussed a significant number of Australian cases in a 12-year period, illustrating issues that had arisen in investigations, at trial and in the use of DNA in the review of convictions and acquittals (Gans & Urbas 2002). There have been some significant developments in the science and technology behind DNA evidence in the 13 years since 2002 that have important implications for law enforcement and the legal system. These are discussed through a review of relevant legal cases and the latest empirical evidence. This paper is structured in three sections. The first examines the scientific techniques and how they have been applied in police investigations, drawing on a number of recent cases to illustrate them. The second considers empirical research evaluating DNA evidence and databases and the impact DNA has on investigative and court outcomes. The final section discusses significant cases that establish legal precedent relating to DNA evidence in criminal trials where significant issues have arisen or new techniques have been applied that have not yet been widely discussed in the literature. The paper concludes by reflecting on implications for policy and practice.

Drink driving is a leading cause of criminal justice system contact for Indigenous Australians. National and state strategies recommend Indigenous road safety initiatives are warranted. However, there is sparse evidence to inform drink driving-related preventive and treatment measures. Using quantitative and qualitative methods, the study examines the profile of Queensland’s Indigenous drink drivers using court convictions and identifies the contributing psycho-social, cultural and contextual factors through qualitative interviews.

ABORIGINAL people in urbanised Australia experience violence on a daily basis. This violence ranges from the psychological (the covert hostility of the corner shop, the denial of the Aboriginality of fair-skinned or urban Blacks) through to the physical brutality of the criminal justice system. For Aboriginal women and children this daily violence is not only public but also has a private, B1ack-on-B1ack dimension. The Aboriginal home may be some refuge from the slights of white Australia but this is cold comfort to women for whom being 'flogged up' by their partners is so ordinary an event as to be unremarkable.

This doctoral thesis explores the development of drug markets and drug related crime in Finland since the mid 1990s, as well as public control measures aimed at solving problems related to drug crime. The research further examines the criminal career of persons having committed drug crime, as well as their socio-economic background. The period since the mid 1990s is, on the one hand, characterized by increasing use of drugs and increasingly severe drug problems. On the other hand, this period is also characterized by intensified drug control. Also criminality associated with drugs has increased and become more severe. During this period the prevention of drug problems became a focal issue for authorities, and resources were increased for activities geared towards fighting drugs. Along with this development, Finnish drug policy has been balancing between therapeutic activities and control. A focal point in this thesis is the question how society addresses drug problems, as well as how this differs from efforts to solve other problems. Why are criminal means so readily used when dealing with drug problems; why have the police received an extended mandate to use coercive force; and why has the field for imposing administrative sanctions been extended? How has the extension of drug control affected general thinking in criminal policy? The subject matter in this thesis is approached in a criminological and criminal policy perspective. The thesis is made up of four research articles and a Summary Article. In the Summary Article the studies were placed into the Finnish research context of drug criminality and drug control as well as criminal policy. Furthermore, the author has assessed his own research location as a drug control researcher. Applying the notion of risk, an analysis was made of threats posed by drugs to society. Theoretical perspectives were also brought to the fore on how society may regulate drug problems and threats associated with them. Based on research literature and administrative documents, an analysis was made of the relation between drug related social and health policy and criminal justice control. An account was also made of the development of drug control in Finland since the mid 1990s. There has been a strong increase in control by the criminal justice system since the mid 1990s. Penalties have been made more stringent, more efficient means have been developed to trace the financial gain from the offence, opportunities for money laundering have been prevented and the police has obtained ample new powers of inquiry. New administrative measures have been directed towards drug users, such as introducing drug tests in working life, checking the applicants criminal record for certain jobs, as well as the threat of losing one s driving licence in cases where a physician has established drug addiction. In the 1990s the prevention of drug crimes and their disclosure were made part of the police s control activities nationwide. This could clearly be seen in increased criminal statistics. There are humiliating elements associated with the police s drug control that should be eliminated for the benefit of everybody. Furthermore, the criminal control is directed towards persons in a weak socio-economic position. A drug verdict may set off a marginalization process that may be very difficult to halt. Drug control is selective and generates repressive practises. The special status accorded drug problems is also revealed in the way in which the treatment of drug addicts has developed.

O processo histórico dialético é acompanhado não apenas da transformação do conteúdo normativo das leis, mas da transformação da própria forma legal em si. Conforme a organização da produção vai se desenvolvendo nas relações sociais mais complexas, as categorias do Direito também se tornam mais complexas, cada vez mais autônomas e definidas. O capitalismo é um movimento, que, como tal, se parar, não consegue se sustentar. Se todas as pessoas ficarem em casa, paradas, sem consumir, o sistema entra em colapso, pois a mercadoria precisa circular. Igualmente, o sistema penal precisa produzir normas punitivas para se manter, ainda que a circulação delas aconteça com base apenas em seu valor simbólico. a produção de normas penais reproduz a lógica da produção de mercadorias, a qual, por meio do fetichismo, segrega o valor-de-uso do valor, possibilitando que leis sejam criadas independentemente de serem úteis, mas apenas para circularem e reforçarem a estrutura punitiva. A compreensão da cisão entre valor e utilidade é fundamental para esclarecer o fetichismo da norma penal, que se manifesta por meio da expansão da criminalização e do agravamento das penas. Por mais que se tenha clara a ineficácia da produção de leis punitivas para resolver problemas sociais, a criação de novos tipos penais está ancorada em seu valor, separado de sua utilidade concreta.

A presente tese tem por objetivo central investigar a legitimidade da adoção do monitoramento eletrônico como sanção autônoma no sistema de justiça penal brasileiro. Para tanto, parte-se da perspectiva do controle social formal no contexto das sociedades tecnológicas e de riscos, no qual a prisão e o monitoramento estão inseridos, e traça-se um paralelo entre as sanções penais adotadas ao longo do desenvolvimento do Direito Penal e a evolução da sociedade. Enfocando o instituto do monitoramento eletrônico de presos, a tese aborda seu conceito, origens, espécies, evolução tecnológica, finalidades, modelos e aspectos constitucionais, tanto no Brasil, como em outros países. A partir de uma análise crítica de seu tratamento normativo, a nível federal e estadual, formulam-se proposições com o objetivo de preservar os direitos individuais dos monitorados, garantindo-se a idoneidade do sistema de monitoramento eletrônico como espécie de sanção penal, em harmonia com as finalidades preventiva e retributiva da pena, mas sem se descurar da sua potencialidade como instrumento de redução da superpopulação carcerária brasileira.

Trata do indulto, modalidade coletiva da graça, procurando estabelecer seus limites e finalidades no âmbito do Estado moderno. Após a delimitação do tema, distinguindo-se a graça das demais modalidades de clemência estatal, e justificação das escolhas terminológicas, passa-se à evolução histórica do instituto e, em seguida, à sucinta exposição sobre a configuração atual nos ordenamentos estrangeiros. Identifica-se, não obstante a concretização da graça na maioria das Constituições modernas, uma tendência de restrição do âmbito de aplicação do instituto, tanto por parte da doutrina quanto pela jurisprudência e produção legislativa. As restrições são impostas com base na suposta necessidade de adequação da graça, cuja origem remete às prerrogativas monárquicas típicas do Estado absolutista, aos princípios fundamentais do Estado Democrático de Direito, especialmente os princípios da separação de poderes e da igualdade. Adentrando o núcleo do trabalho, procura-se estabelecer a relação entre indulto e os princípios do Estado Democrático de Direito, de forma que sejam identificados limites ao exercício da atribuição, com fulcro no texto constitucional. Afere-se, assim, a legitimidade da restrição do indulto a hipóteses caracterizadas pela excepcionalidade e irrepetibilidade, baseada em alegada relação de contradição entre a atribuição de indultar do Poder Executivo e o princípio da separação de poderes, o princípio da igualdade e os eventos regulares do mecanismo sancionatório. Delimitadas as possibilidades de exercício legítimo da atribuição, busca-se, então, fixar os parâmetros que devem pautar o conteúdo dos atos de indulto, com base nas teorias da pena. Adota-se, para tanto, a teoria preventiva positiva, procurando-se identificar hipóteses em que a execução da pena aplicada não contribuiria para a realização de suas finalidades, para elaborar, a partir disso, casos de cabimento do exercício do indulto.

Neste trabalho pretendemos demonstrar que a utilização da impunidade como suposto motivador criminal - seja como conceito, seja como conteúdo -, é equivocada na medida em que aquela não passa de um defeito funcional advindo do descompasso entre o programa criminalizador primário e a criminalização secundária, ainda que intermediada pela criminalização terciária (midiática). A consequência dessa paralaxe seria a migração léxica não só do verbete impunidade para o verbete impunização, senão a consideração de que essa não passa de um apontar de dedo político, útil ao sistema penal que, descaradamente, utiliza-se daquela desafinação para manter ou aumentar o seu poder punitivo. Para tanto, utilizamo-nos do método indiciário, haja vista não nos ser possível decifrar todas as causas e consequências que envolvem o discurso da impunidade criminógena, embora isso não nos tenha impedido de concluir que a seletividade inerente ao sistema penal, equivocadamente nomeada de impunidade, serve, em última medida, quando bem utilizada, como corretivo da voracidade do poder punitivo. Corretivo que, todavia, para exercer todo seu poder curativo, não pode continuar se valendo da própria seletividade, senão de uma redução do próprio poder punitivo.
