Analyze the problem of sexual violence suffered by children and adolescents in the city of Natal / Rio Grande do Norte (RN), attended by the Programa Sentinela, a service aimed at combating sexual violence children and teenagers who serves on the council of Natal. Thus aims to review the implementation of the Programa Sentinela in Natal / RN, in the period 2001 to 2006, verifying that the program has contributed to the access of children and adolescents who are victims of abuse and sexual exploitation to fundamental rights under the Statute Children and adolescents (ECA) and the Local Plan and the National gainst Infanto-Youth Sexual Violence. It has a theoretical and methodological approach quantitative and qualitative, covering the issue of sexual violence against children and adolescents, as one of the expressions of economic relationships, gender, race and culture that make up the material and symbolic structure of society. It methodological procedure: review of literature on the subject and conducting interviews with professionals and families of children and adolescent victims of sexual violence. Investigate as the unit of analysis the Sentinel Program. The analysis on the governmental actions of this period on this social problem points to the continuity and little change in the care of victims of sexual violence: despite maintain features and palliative assistencialistas, favoring the "Network of Sexual Tourism", go through some innovations in terms of securing rights from the ECA, which is the need for transparency and democratization in the management of government policies. In research undertaken, Brazil will only be combating this type of crime when each of the social actors are actually doing their share, down taboos, facing corruption and strengthening a system of guarantee of rights, which target children and adolescents are unprotected, and often ignored by Brazilian society

This work deals with the problematic of the determinations that contribute to become the adolescents involved with law. Thus, in this research, the social exclusion is apprehended as one of the most important determining to understand this problematic, once we defend that it is part of the trajectory of this adolescent's life since its birth as a punishment that starts before they becoming envolved in act's that break the law. It is still questioned the discussion of the reduction of the penal age, viewed aa a proposal that will contribute to perpetuate the repression. The objectives of the research were: analyze the problematic of adolescents in conflict with law, where social exclusion is seen here as a main category. The research also aims to understand the situation towards social exclusion and that this public is undertaken in the state of Rio Grande do Norte, more specifically in Natal. This is dane through analysis of the profile of adolescents that are submitted to the treatment at Centro Integrate de Atendimento ao Adolescente Acusado de Ato Infracional - CIAD in 2005. This is dane on arder to identify of the State's and society's actions towards this issue, how it has prevailed in analyzing if there is punishing or social protection. The research also contributed with discussion towards the non penal reduction of for underage minors. The approach realized if of qualiquantitative nature. The research was realized with 190 male adolescent subjects, age ranging from 12 to 21 that were interns at CIAD in the year of 2005. The research shows that their fundamental rights (education, health, amongst others) are disrespected on a daily basis by the State. The State prioritizes economic issues, making social inequality more profound. The main argument is that this problematic has its main oring in the social exclusion and it is imposed to the adolescents as a punishment before thes have been involved with the law going on top of the social protection. When the adolescent goes from being the victim to executioner, the Statute of Children and Adolescents is questioned by many sectors that defend the reduction of penal minority as a solution to reduce the country's violence. Thus, it was aimed here to discuss arguments that point to non exclusion, discrimination and repression. It is proposed that the State should assume children and adolescents as a priority, implementing what the statute establishes as well as assures related to the fruition of denied rights as a way to prevent their future involvement with violence

At 6.4%, the unemployment rate for the Latin American and Caribbean region overall was the lowest for the past few decades, down from 6.7% in 2011. This is significant, in view of the difficult employment situation prevailing in other world regions. Labour market indicators improved despite modest growth of just 3.0% in the region’s economy. Even with sharply rising labour market participation, the number of urban unemployed fell by around 400,000, on the back of relatively strong job creation. Nevertheless, around 15 million are still jobless in the region. Other highlights of 2012 labour market performance were that the gender gaps in labour market participation, unemployment and employment narrowed, albeit slightly; formal employment increased; the hourly underemployment rate declined; and average wages rose. This rendering was obviously not homogenous across the region. Labour market indicators worsened again in the Caribbean countries, for example, reflecting the sluggish performance of their economies. The sustainability of recent labour market progress is also a cause for concern. Most of the new jobs in the region were created as part of a self-perpetuating cycle in which new jobs and higher real wages (and greater access to credit) have boosted household purchasing power and so pushed up domestic demand. Much of this demand is for non-tradable goods and services (and imports), which has stimulated expansion of the tertiary sector and hence its demand for labour, and many of the new jobs have therefore arisen in these sectors of the economy. This dynamic certainly has positive implications in terms of labour and distribution, but the concern is whether it is sustainable in a context of still relatively low investment (even after some recent gains) which is, moreover, not structured in a manner conducive to diversifying production. Doubt hangs over the future growth of production capacity in the region, given the enormous challenges facing the region in terms of innovation, education quality, infrastructure and productivity. As vigorous job creation has driven progress in reducing unemployment, attention has turned once again to the characteristics of that employment. Awareness exists in the region that economic growth is essential, but not in itself sufficient to generate more and better jobs. For some time, ILO has been drawing attention to the fact that it is not enough to create any sort of employment. The concept of decent work, as proposed by ILO, emphasized the need for quality jobs which enshrine respect for fundamental rights at work. The United Nations General Assembly endorsed this notion and incorporated it into the targets set in the framework of the Millennium Development Goals. This eighth issue of the ECLAC/ILO publication “The employment situation in Latin America and the Caribbean” examines how the concept of decent work has evolved in the region, progress in measuring it and the challenges involved in building a system of decent work indicators, 14 years after the concept was first proposed. Although the concept of decent work has been accompanied since the outset by the challenge of measurement, its first objective was to generate a discussion on the best achievable labour practices in each country. Accordingly, rather than defining a universal threshold of what could be considered decent work —regarding which developed countries might have almost reached the target before starting, while poor countries could be left hopelessly behind— ILO called upon the countries to define their own criteria and measurements for promoting decent work policies. As a result, there is no shared set of variables for measuring decent work applicable to all countries. The suggestion is, instead, that countries move forward with measuring decent work on the basis of their own priorities, using the information they have available now and in the future. However, this strategy of progressing according to the data available in each country tends to complicate statistical comparison between them. So, once the countries have developed their respective systems of decent work indicators, it will be also be important to work towards harmonizing them. ECLAC and ILO are available to provide technical support to this end. With respect to 2013, there is cautious optimism regarding the performance of the region’s labour markets. If projections of a slight uptick —to 3.5%— in the region’s economic growth in 2013 are borne out, labour indicators should continue to gradually improve. This will bring new increases in real wages and a slight drop of up to 0.2 percentage points in the region’s unemployment rate, reflecting a fresh rise in the regional employment rate and slower growth in labour market participation.

Esta dissertação analisa o conceito de pessoa com deficiência disposto na legislação nacional e internacional, perquirindo quem são os integrantes desse grupo vulnerável que possuem o direito às vagas reservadas ao mercado de trabalho, previsto na Constituição Federal de 1988 e nas Leis nº 8.112/90 e 8.213/91. Trata-se de uma pesquisa com enfoque na aplicação das ações afirmativas, especificamente o sistema de cotas, destinado à inclusão social das pessoas com deficiência. Verifica-se a existência de uma polêmica questão referente à relativa indeterminação de quem são os destinatários dessa medida. Assim, trazemos para o debate o conjunto normativo de leis, decretos e tratados internacionais que buscaram definir as pessoas com deficiência, entre os quais destacamos o Decreto nº 3.298/99 e a Convenção sobre os Direitos das Pessoas com Deficiência da ONU. Mas também analisamos as principais referências teóricas relacionadas ao universo da deficiência, ocasião na qual exploramos a evolução dos direitos humanos e fundamentais desse grupo, passando pelos principais paradigmas e reivindicações dos movimentos sociais, conhecendo assim quais são os alicerces de tais direitos e de que forma exigem o tratamento igualitário. Procuramos esclarecer e desfazer o imbróglio conceitual que se estabeleceu no sistema jurídico brasileiro ao longo dos últimos 25 anos, por meio da difusão das informações acima citadas. Visamos com isso possibilitar que as ações afirmativas cumpram certos requisitos de validade, entre os quais o dever de justiça e eficiência na redistribuição dos recursos fundamentais. Destacamos que o dever de inclusão social, bem como o sucesso das ações afirmativas, estão subordinados ao maior conhecimento sobre os direitos desse grupo, tanto por parte dos operadores do direito, como dos demais profissionais de outras áreas do saber, os quais devem trabalhar em conjunto para identificar quais fatos relevantes no contexto social tornam esse indivíduos vulnerabilizados e justificam a proteção estatal por meio do sistema de cotas.

O presente trabalho realiza a análise dos processos de urbanização, cuja característica marcante é a segregação econômica, social e espacial da população de baixa renda, perceptível pelo fenômeno de periferização urbana vivenciado por este segmento social. Sem vias de acesso formal à terra urbana, a população de baixa renda residente em centros urbanos promove a ocupação irregular de áreas desprovidas ou carentes de infraestrutura e serviços urbanos, as quais, em geral, não são requisitadas pelo mercado imobiliário formal. A forma de apropriação desigual dos espaços territoriais é fruto do modo de apropriação do modo capitalista. Nesse contexto de desigualdade, exclusão, segregação se insere a questão da ocupação irregular nas margens de cursos d’água situadas no meio urbano, áreas estas especialmente protegidas pela legislação ambiental, tema que nos remete ao foco principal da dissertação: o estudo da possibilidade de implementação de ações de regularização fundiária sustentável em ocupações de interesse social, consolidadas em áreas urbanas situadas às margens de cursos d’água, analisada como instrumento de combate ao processo de segregação socioespacial vivenciado pela população de baixa renda em decorrência do processo de produção capitalista dos espaços urbanos. Para tanto, a partir da análise de casos concretos utiliza-se as ações de regularização como instrumento para a consecução do direito às cidades sustentáveis, albergado no ordenamento jurídico brasileiro na Lei nº10.257/2001, afirmando-o como um direito fundamental, a partir da teoria do jusfilósofo Ronald Dworkin. A problemática que a dissertação revela reside no aparente conflito ante a necessidade de atendimento dos direitos fundamentais das populações residentes destas ocupações e o dever de manutenção do meio ambiente ecologicamente equilibrado, cuja solução é pautada pelo sopesamento de princípios, e valores neles incutidos, com fundamento no conceito de direito como integridade, também desenvolvido por Ronald Dworkin.

O presente trabalho tem por objetivo realizar abordagem teórica sobre o instituto da jurisdição na efetivação judicial do direito à saúde. Para tanto abordará a influência do princípio democrático e do valor justiça na construção de um conceito contemporâneo de processo e delimitação de seus fins. Partindo do pressuposto que a Constituição eleva a dignidade da pessoa humana ao patamar de princípio fundamental da República, concluir-se-á pelo direito à saúde como essencial para uma existência digna. A seguir, reconhecida a dupla dimensão do direito à saúde – formal e material – concluir-se-á pela sua justiciabilidade. Realizar-se-á uma abordagem sobre a influência dos princípios constitucionais de justiça na construção de um conceito moderno de jurisdição, reconhecendo à jurisdição o dever de aplicar a lei na dimensão dos direitos fundamentais, fazendo sempre o resgate dos valores substanciais neles contidos. Destacando a essencialidade do contraditório para a concretização da promessa constitucional de acesso à justiça, realizar-se-á uma análise dos aspectos processuais da efetivação judicial do direito à saúde.
