O modo como a violência sexual contra crianças e adolescentes é tratada na contemporaneidade, principalmente pelo Sistema de Garantia de Direitos (SGD), revela uma atuação repressiva e punitiva inerente ao direito penal brasileiro. Esse viés com ênfase na punição produz certo saber sobre o tema, desenhando um modus operandi similar dentro de cada ente do SGD que atua em 3 eixos: promoção, defesa e controle. A partir dessa lógica, foi realizada uma pesquisa de mestrado junto ao Programa de Pós-Graduação em Psicologia Social da Universidade do Estado do Rio de Janeiro. A pesquisa teve como objetivo compreender, por meio de análise documental de 3 processos concluídos de crianças que supostamente sofreram violência sexual, como foi a atuação do SGD desde a denúncia do caso até a sentença proferida pelo juiz. O foco principal foi a compreensão dos atores sobre seu papel nesses casos de violência sexual contra crianças; suas decisões e os conceitos utilizados nos autos, e, por fim, que argumentos propiciaram a decisão e a sentença. Percorrendo a legislação específica para a Infância e Juventude pode-se compreender como as questões dos direitos foram sendo incorporados às questões da infância, sobretudo nos últimos vinte anos. Na realidade, a pesquisa revela que a ênfase nos princípios do direito penal toma a cena em sentido contrário dos cuidados necessários no atendimento a um sujeito em desenvolvimento e de sua família, colocando repetidamente a mãe no lugar de negligente. E o abuso, considerado no início dos processos como procedente, acaba desaparecendo no final.

Esta pesquisa teve a pretensão de discutir e propor pistas para uma nova abordagem metodológica, direcionada aos profissionais que trabalham com o tema do abuso sexual intrafamiliar e em relações próximas, por meio de uma torção dos Processos Circulares sob a inspiração da Teoria Ator-rede, no sentido de ampliação e renovação dos modos de intervenção do Sistema de Garantia dos Direitos da Criança e do Adolescente. Apesar da relevância do tema, percebeu-se que o abuso sexual de crianças e adolescentes ainda é tabu em nossa sociedade, tratado de forma privada e sem diálogo intersetorial, mesmo dentro das estruturas institucionais. A delicadeza do tema deve-se à conjunção dos temas sexo, criança, família e violência. É uma temática que clama por novos e complementares aportes teóricos e metodológicos, após a constatação que nem o sistema penal, nem o de garantia de direitos têm respostas que se pautem na atenção, no cuidado e em uma escuta da criança que propicie que ela trabalhe seus sofrimentos, dúvidas e sentimentos variados como sujeito de direitos. O tema busca trazer novas possibilidades para o trabalho com os profissionais, operadores do direito ou atores do Sistema de Garantia dos Direitos da Criança e Adolescente, criando espaço reflexivo para que possam ser redesenhadas e as questões afetas clareadas. A metodologia de trabalho proposta foi executada com um grupo de profissionais da área, apontando para a possibilidade de seu exercício com famílias envolvidas com situações de abuso sexual

This paper describes the incidence of maltreatment histories in a community sample of mothers of one-year old infants in Northern Ireland. The occurrence of five subsets of childhood maltreatment is examined: emotional abuse, emotional neglect, physical abuse, physical neglect and sexual abuse. Of the 201 women who completed the Childhood Trauma Questionnaire (CTQ), 70 mothers (35%) reported experiencing one or more types of maltreatment during childhood. Forty-eight mothers (24%) gave a history of being emotionally abused, 43 (21%) of emotional neglect, 27 (13%) of physical abuse, 20 (10%) of sexual abuse, and 19 (10%) of physical neglect. Physical abuse was the only type of maltreatment which showed an association with maternal socio-economic status, with higher incidence reported amongst Occupational Classes 4 and 5 (lower supervisory and technical occupations and semi-routine and routine groups). More than half of those with a history of abuse experienced more than one type of maltreatment (42 mothers or 60% of those reporting maltreatment). Differences in rates of incidence to more recent studies on younger adults are discussed, as well as implications for prevention and intervention.

Although our society has put in place various forms of legislation to protect children's rights, many children are still subject to various forms of maltreatment such as sexual, physical or emotional abuse and/or physical or emotional neglect. All of these can have serious detrimental effects on the victims. Previous literature in this area has tended to focus on sexual abuse. In contrast, this paper provides an overview of all the different types of maltreatment in terms of characteristics of victims, the range of consequences, mediating factors and types of interventions that may be offered.

Over the past few decades, children and young people who have sexually harmed others have attracted increasing attention from researchers and policy makers. Although it is known that they form a small, but significant group, there are difficulties in gaining a clear indication of incidence since much of the existing research has involved small and heterogeneous samples, many of which were not UK-based and lack of control groups for comparison. Furthermore, many incidents of sexual abuse are likely to go unreported. The nature, extent and significant negative consequences of harmful sexual behaviour for the victims and perpetrators, make this an important issue for policy development and research investigation. Overall, research and knowledge in this important area are still accumulating and much remains to be confirmed. Although recent decades have seen a movement towards greater understanding of the issue of harmful sex behaviour, a gap remains. The purpose of the project was to help address this gap in knowledge.

This study ascertained the extent to which abuse and neglect are identified and recorded by mental health services. A comprehensive audit of 250 randomly selected files from four community mental health centres in Auckland, New Zealand was conducted, using similar methodology to that of a 1997 audit in the same city so as to permit comparisons. Significant increases, compared to the 1997 audit, were found in the rates of child sexual and physical abuse, and adulthood sexual assault (but not adulthood physical assault) identified in the files. Identification of physical and emotional neglect, however, was poor. Male service users were asked less often than females; and male staff enquired less often than female staff. People with a diagnosis indicative of psychosis, such as ‘schizophrenia’, tended to be asked less often and had significantly lower rates of abuse/neglect identified. Despite the overall improvement, mental health services are still missing significant amounts of childhood and adulthood adversities, especially neglect. All services need clear policies that all service users be asked about both abuse and neglect, whatever their gender or diagnosis, and that staff receive training that address the barriers to asking and to responding therapeutically to disclosures.

RESUMO: As mulheres presas encontram-se num sistema essencialmente dirigido por e concebido para homens. As mulheres que entram na prisão geralmente vêm de ambientes marginalizados e desfavorecidos e muitas vezes têm histórias de violência e abuso físico e sexual. As mulheres presas são um grupo particularmente vulnerável, uma vez que dentro do sistema prisional as suas necessidades de saúde e higiene são muitas vezes negligenciadas. O primeiro passo para o desenvolvimento de programas e práticas sensíveis ao género é compreender as características das mulheres delinquentes e definir fatores de vida específicos que contribuem para a formação do comportamento criminoso de mulheres. Em junho de 2012 foi realizada uma investigação na única prisão feminina da Geórgia, para estudar as necessidades mentais e psicossociais das mulheres presas. O objetivo da pesquisa foi o desenvolvimento de programas de apoio pertinentes para a reabilitação, ressocialização e reintegração, e a elaboração de recomendações práticas para a gestão das prisões. Foi desenvolvido um instrumento de pesquisa (inquérito) com uma fundamentação conceptual baseada em quatro principais teorias: Teoria dos Caminhos (Pathways Theory), teoria do desenvolvimento psicológico da mulher (Theory of Women’s Psychological Development), Trauma e Teorias da Dependência (Trauma and Addiction Theories). Foram inquiridas 120 mulheres presas. Os resultados deste estudo mostram que muitas das necessidades das mulheres presas são diferentes das dos homens e requerem estratégias adaptadas às suas características e situações psicossociais específicas. A maioria das mulheres encarceradas é jovem, enérgica, pode trabalhar, tem profissão e família. As presas sofrem de problemas psicológicos e muitas vezes são rejeitadas pelas suas famílias. Uma parte substancial das mulheres presas tem múltiplos problemas de saúde física e mental. A maioria delas tem filhos e sofre com o facto das crianças estarem a crescer longe da mãe. Com base nos resultados desta investigação é possível elaborar um contexto promotor do planeamento e desenvolvimento de serviços com um enfoque de género na prisão. Na perspetiva de longo prazo, o conhecimento das necessidades básicas e a introdução de programas e serviços com necessidades específicas pertinentes irá beneficiar as presas e as suas famílias, e melhorar a eficácia do sistema de justiça criminal.----------ABSTRACT: Female inmates find themselves in a system essentially run by men for men. Women who enter prison usually come from marginalized and disadvantaged backgrounds and are often characterized by histories of violence, physical and sexual abuse. Female prisoners constitute an especially vulnerable group given their specific health and hygienic needs within the system are often neglected. The first step in developing gender-sensitive program and practice is to understand female offenders’ characteristics and the specific life factors that shape women’s patterns of offending. In June 2012 a research was carried out in the Georgian only female prison facility to assess the mental and psychosocial needs of women prisoners, aiming to develop effective support programs for their rehabilitation, re-socialization and reintegration, as well as to elaborate new recommendations concerning prison management. A survey instrument (questionnaire) was developed within a theoretical framework based on four fundamental theories: Pathways Theory, Theory of Women’s Psychological Development and Trauma and Addiction Theories. Sample size was defined to be 120 surveyed persons. The study showed that needs of incarcerated women were different from those of men, thus requiring approaches tailored to their specific psychosocial characteristics and situations. The basic population of imprisoned women consisted of young, energetic, working-age females, most often with a professional qualification. Female prisoners suffered from psychological problems and are were more likely to be rejected by their families. Most of them had children and suffered that the children were growing without mothers. A substantial proportion of women offenders had multiple physical and mental health problems. Based on the study findings a conceptual framework can be elaborated towards planning and developing gender-sensitive services in prison. In the long-term perspective, acknowledgement of baseline needs and introduction of the relevant needs-specific programs and services may benefit women prisoners as well as their families, improving the effectiveness of the criminal justice system.

Le présent mémoire cherche à déterminer s’il existe des facteurs qui conduisent aux aveux chez les agresseurs sexuels durant un interrogatoire. Dans ce but, notre étude est basée sur 183 dossiers d’agression sexuelle traités par le Service de police de la Ville de Montréal. Les 137 participants qui ont fait une ou deux victimes (un dossier par victime) étaient âgés de 15 à 71 ans au moment du crime, et sont majoritairement francophones, caucasien et sans emploi. Toutes les variables sélectionnées ont été divisées en trois catégories : les caractéristiques de l’agresseur, les caractéristiques du crime et les caractéristiques contextuelles de l’interrogatoire. Les agresseurs sexuels qui ont avoué leur crime avaient les caractéristiques suivantes : caucasien, célibataire, n’ayant pas utilisé la menace ni causé de blessures, la victime était un garçon ou une femme adulte. Il n’y avait, contre eux, ni preuves matérielles ou biologiques, ni présence de sperme sur la victime, et il n’y a pas eu de séance d’identification. De plus, ils ont subi plusieurs interrogatoires, souvent dans un bureau privé en présence d’un seul interrogateur, qui n’est pas l’enquêteur principal, mais ils ont écrit et signé leur déclaration. Ces résultats devraient aider les policiers à cibler les facteurs les plus favorables aux aveux tout en montrant qu’il s’agit généralement d’un ensemble de facteurs qui conduisent les agresseurs sexuels aux aveux lors d’un interrogatoire.

Cette thèse a pour objectif principal d’explorer les contributions de l’attachement et du tempérament sur la quantité d’informations dévoilées par les enfants victimes d’agression sexuelle. Les auditions de 25 enfants âgés de trois à sept ans ont été codifiées sur le plan du type de questions et du nombre de détails. Le tempérament de l’enfant a été évalué par un questionnaire rempli par le parent. Les représentations d’attachement et les habiletés verbales ont été évaluées par l’entremise de tâches auprès de sous-échantillons d’enfants. Pour répondre à la question de recherche principale, le questionnaire de tempérament TABC-r a d’abord été traduit en français puis validé auprès de 231 parents issus de la population générale, ce qui a constitué un objectif secondaire de la thèse. Les résultats indiquent que le TABC-r version canadienne-française présente des propriétés psychométriques adéquates et similaires à la version originale. La structure factorielle, la cohérence interne, la fidélité inter-juge, la stabilité temporelle et la validité divergente sont très satisfaisantes. La validité convergente est soutenue par des relations attendues avec les problèmes de comportements et les relations familiales, mis à part des liens non retrouvés avec les habiletés cognitives. Ces résultats, les limites de l’étude et les pistes de recherche futures sont discutés. Les résultats obtenus concernant l’audition indiquent que les enfants victimes d’agression sexuelle présentant un attachement plus sécurisé et moins évitant rapportent davantage de détails en moyenne aux questions proposant un choix. Les associations modérées, quoique non significatives, entre le manque de persistance à la tâche et la quantité moyenne de détails aux questions proposant un choix, et entre l’attachement sécurisé et évitant et la quantité moyenne d’informations rapportées globalement sont décrites compte tenu de la petite taille de l’échantillon. Lorsqu’ils sont considérés simultanément, la sécurité d’attachement et le manque de persistance à la tâche contribuent potentiellement de façon complémentaire à expliquer une part de variance du nombre moyen de détails aux questions de reconnaissance lorsque l’âge est contrôlé, mais seul l’apport de la sécurité d’attachement est significatif. Ces résultats, les limites de l’étude, les pistes de recherches futures et les implications pour la conduite d’auditions sont discutés.

Objective: There were two aims to this study: first to examine whether emotional abuse and neglect are significant predictors of psychological and somatic symptoms, and lifetime trauma exposure in women presenting to a primary care practice, and second to examine the strength of these relationships after controlling for the effects of other types of childhood abuse and trauma. Method: Two-hundred and five women completed the Childhood Trauma Questionnaire (Bernstein et al., 1994), Trauma History Questionnaire (Green, 1996), the Symptom Checklist-revised (Derogatis, 1997), and the Revised Civilian Mississippi Scale for posttraumatic stress disorder (Norris & Perilla, 1996) when presenting to their primary care physician for a visit. Hierarchical multiple regression analyses were conducted to examine unique contributions of emotional abuse and neglect variables on symptom measures while controlling for childhood sexual and physical abuse and lifetime trauma exposure. Results: A history of emotional abuse and neglect was associated with increased anxiety, depression, posttraumatic stress and physical symptoms, as well as lifetime trauma exposure. Physical and sexual abuse and lifetime trauma were also significant predictors of physical and psychological symptoms. Hierarchical multiple regressions demonstrated that emotional abuse and neglect predicted symptomatology in these women even when controlling for other types of abuse and lifetime trauma exposure. Conclusions: Long-standing behavioral consequences may arise as a result of childhood emotional abuse and neglect, specifically, poorer emotional and physical functioning, and vulnerability to further trauma exposure. Objective. Numerous studies have reported elevated levels of overgeneral autobiographical memory among depressed patients and also among those previously exposed to a traumatic event. No previous study has examined their joint association with overgeneral memory in a community sample, nor examined whether the associations are with both juvenile- and adult-onset depression. Methods. The current study examined the relative importance of exposure to childhood abuse and neglect in overgeneral memory of women with and without a history of major depressive disorder (MDD). Autobiographical memory test together with standardized interviews of childhood experiences and MDD were assessed in a risk-stratified community sample of 103 women aged 25–37. Results. Overgenerality in memory was associated with recalled childhood sexual abuse (CSA) but not other adversities. A history of CSA was predictive of overgeneral memory bias even in the absence of MDD. Our analyses indicated no significant association between a history of MDD and overgeneral memory in women who reported no CSA. However, overgeneral memory was increased in women who reported CSA and MDD with a significant difference found in relation to positive cues, the highest scores being seen among those with adult rather than juvenile-onset depression. Conclusions. The findings highlight the significance of CSA in predicting overgeneral memory, differential response in relation to positive and negative cue memories, and point to a specific role in the development of depression for overgeneral memory following CSA.

This study presents the issue of sexual violence against children and adolescents in the city of Natal RN from a critical approach over the work carried out at the Delegacia Especializada em Defesa da Criança e Adolescente DCA, with the perspective towards guaranteeing their rights. It is constituted of an analysis under a theoretical-methodological focus, both quantitative and qualitative, taking as a premise the sexual violence against children and adolescents in its social, legal, historical, cultural and economical dimensions that are behind this issue. The established course between knowledge and methodology involved: a conceptual analysis of the sexual violence, a research in the official records of the Public Power, the application of questionnaires with the coordinators of social projects and programmes, the accomplishment of interviews with key institutional actors and mothers of victimized children and adolescents, besides the analysis of quantitative indicators from the data made available by the DCA. The research took place within the Delegacia Especializada em Defesa da Criança e Adolescente, and also took for reference the information from institutions that develop actions directed towards children and adolescents victims of sexual abuse. Through this study, the strategies and the contradictions existing in the struggle against sexual violence towards children and adolescents implemented by the Public Power were learnt, the need for a greater articulation was identified to guarantee their rights and it also allowed for the tracing of a panorama of the sexual violence against children and adolescents in the period from 2001 to 2004 in the city of Natal-RN

Objective: In this study, we compared the frequency and intensity of childhood traumas in alcohol- or other drug-dependent patients, in patients with depression, and in a control group without psychiatric diagnoses. Methods: The study had a retrospective design of a clinical sample of men and women from the groups listed above. They were evaluated by the same standardized instrument: the Childhood Trauma Questionnaire.. Results: A higher frequency and intensity of emotional, physical, and sexual abuse were found in alcohol- and other drug-dependent patients than in patients with depression, who, in turn, presented significantly higher proportions than the control group. In all of the cases, the frequency was higher among women than men. Conclusion: Because of the high frequency and intensity of childhood traumas among alcohol- or other drug-dependent patients and depressed patients, the assessment of problems due to childhood traumas among these patients is essential to a better understanding of the etiology of those disorders and to their treatment. © 2010 Elsevier Ltd.
