Through the justice principles –equality, time, status, need, efficiency and worth– developed by Jon Elster, we show in this article how fair trade certification for producers is legitimatised by stakeholders. Based on a field investigation with coffee growers in Peru, Ecuador and Bolivia and with fair trade organisations in the North (Max Havelaar/FLO, Andines and Artisans du Monde), the analysis firstly reviews just certification according to the impersonal criteria of “mechanical” justice, such as equality, time and efficiency. The second section looks at more individualised criteria such as the status, need and worth of the beneficiaries. Finally, it determines in what way fair trade is really a mixed bag, one which calls upon different principles of justice to justify what it is out to accomplish. The main result of the analysis is that fair certification granted to producer organisations is not being distributed according to a unique system of justice based on just one criterion. On the contrary, fair trade is a complex and hybrid bag that uses different components from each distribution procedure.

The Brazilian Amazon is one of the world’s largest tropical forests. It supplies more than 80 % of Brazil’s timber production and makes this nation the second largest producer of tropical wood. The forestry sector is of major importance in terms of economic production and employment creation. However, the Brazilian Amazon is also known for its high deforestation rate and for its rather unsustainably managed timber resources, a fact which puts in the balance the long-term future of the forestry sector in the region. Since the mid- 1990s, with strong support from World Wildlife Fund (WWF), the number of tropical forests certified by the Forest Stewardship Council (FSC) has significantly increased. This is especially true for projects sponsored by large scale companies. The number of community- based forest management projects has also increased. Certification of community-based forest enterprises (CFEs) was initially a goal for the sponsors and community members. Certification is viewed as a way to reach alternative timber markets. In Brazil, the state of Acre has the highest concentration of CFEs certified by FSC. Most of them have been implemented with the support of environmental NGOs and public funds. Environmental NGOs strongly defend the advantages of certification for communities; however, in reality, this option is not that advantageous. Despite all the efforts, the number of participants in each project remains low. Why is this occurring? In this paper, we analyze the underlying motives of a few individual’s participation in CFEs certification projects. We aim to present and discuss some factors that shape the success of CFEs and their later certification. The results are based on surveys conducted in two certified CFEs in the state of Acre.

Certains mouvements sociaux transnationaux (MSTN) militent pour le respect des normes sociales et environnementales en particulier dans les pays à bas salaires. Ils développent pour cela de nouveaux instruments, des labels et des codes de conduites. Ces mouvements sociaux transnationaux cherchent au travers ces derniers à renforcer la régulation sociale, environnementale et sa démocratisation au plan international. Mais la privatisation de la vérification des normes sociales et environnementales nuit à l’indépendance économique des auditeurs. Ainsi, ce mode de régulation s’avère contraire à leur objectif à long terme : une régulation sociale encadrée par des pouvoirs publics démocratisés.

Le sujet sur lequel porte la présente étude est inspiré de la problématique à la base du développement du commerce électronique : la confiance. En effet, l’accroissement exponentiel du nombre d’internautes et des sites Web commerciaux pose un sérieux problème à ce niveau. Ces sites présentent au public une information et des services divers, mais peu vérifiables. Ainsi, le principal obstacle au développement du commerce électronique avec les particuliers est le manque de confiance qu’inspirent les lieux visités. En effet, comment savoir si l’entreprise existe, quelles sont ses politiques concernant la sécurité ou la gestion des renseignements personnels, etc. La vérification et la certification des sites apparaissent comme une solution de plus en plus attrayante et utilisée pour ajouter cet élément de confiance. Déjà, de nombreux sceaux de qualité sont apparus sur les sites commerciaux. Certains sceaux portent sur la confidentialité tandis que d’autres ciblent la protection des consommateurs. La certification peut provenir de la compagnie même, d’un tiers certificateur ou d’un organisme public. Ces éléments constituent des balises et repères importants pour le consommateur sur Internet. Toutefois, les incidences légales sont multiples et certains concepts demeurent flous. Pour apporter une réponse à ces questions, nous définirons le concept de certification des sites Web et ses enjeux dont plus particulièrement la problématique de la confiance des consommateurs. Les différents objets de la certification seront analysés, tant au niveau de l’entité, du contenu du site que de la dimension transactionnelle de celui-ci. Les processus possibles et les impacts de la certification occupent la seconde partie du travail. Il s’agit d’examiner successivement les étapes menant à la certification, soit l’établissement des standards, de l’évaluation de l’entité et de la certification elle-même. L’analyse des impacts de la certification, tant sur le plan de la portée, de la responsabilité légale et des effets sur la concurrence de la certification constitue quant à eux, l’aboutissement de la recherche, soit de savoir quel est l’impact juridique d’un tel mécanisme. Le but de la recherche est de permettre au lecteur de mieux cerner ce phénomène de l’utilisation de la certification sur Internet avec ses avantages et ses limites. Certes, cet outil peut s’avérer très utile pour bâtir la confiance des consommateurs, promouvoir l’essor du commerce électronique et constituer une forme d’autoréglementation. Toutefois, mal utilisé ou mal encadré, il peut engendrer l’effet inverse et détruire cette confiance si fragile à construire dans un environnement dématérialisé.

Nowadays there is a growing environmental concern and the business communities have slowly started recognising environmental protection and sustainable utilization of natural resources into their marketing strategies. This paper discusses the various Ecolabeling and Certification Systems developed world over to regulate and introduce Fair Trade in Ornamental Fish Industry. Ecolabeling and green certification are considered as part of these strategies implemented partly out of compulsion from the National and International Regulatory Bodies and Environmental Movements. All the major markets of ornamental fishes like European Union, USA and Japan have started putting restrictions on the trade to impose ecolabeling as a non tariff barrier like the one imposed on seafood and aqua cultured products. A review was done on the available Ecolabeling and Green Certification Schemes available at local, national and international levels for fisheries including aquaculture and ornamental fish trade and to examine the success and constraints faced by these schemes during its implementation. The primary downside of certification is the multiplicity of ecolabels and cost incurred by applicants for certification, costs which may in turn be passed on to consumers. The studies reveal serious inadequacies in a number of ecolabels and cast doubt on their overall contribution to effective fisheries management and sustainability. The paper also discusses the inititive taken in India to develop guidelines for Green Certification of Fresh water ornamental fishes.

The Indian ornamental fish industry is divided into two-the domestic market and the export market. 90% of the freshwater ornamental fish exported from India are wild caught indigenous species. The study formed the criteria and indicators assessing the sustainability of wild caught ornamental fish exported from India. These indicators were then analyzed for their interactions, connections, linkages and relationships using cognitive mapping. The work is first of its kind in the ornamental fisheries

The organic agricultural sector of Uganda is among the most developed in Africa in terms of its professional institutional network and high growth rates of number of certified farmers and land area. Smallholder farmers are certified organic through contract production for export companies using a group certification scheme (internal control system - ICS). The ICS is a viable and well-accepted tool to certify small-scale producers in developing countries all over the world. Difficulties in certification are still stated to be among the main constraints for Uganda’s organic sector development. Therefore, this paper reports a qualitative case study comprising 34 expert interviews in two organic fresh-produce export companies in central Uganda, aiming to explore the challenges which underlie organic certification with ICS. The study shows that farmers cannot be labelled as ‘organic by default’ but deliberately engage in organic production as a marketing strategy. The small quantities purchased by the organic companies lead to a difficult marketing situation for the farmers, causing production and infiltration risks on the farm level. These risks require increased control that challenges the companies organizationally. The risks and control needs are a reason to involve farmers in ICS procedures and innovatively adapt the ICS by means of a bypass around formal perspective restrictions. The paper discusses different perspectives on risks, risk control and certification.

Desde el ámbito académico el auge de la Gestión de la Calidad (GC) ha sido analizado extensamente a través de numerosos estudios de carácter empírico. Una parte importante de estos estudios han tratado de analizar cuáles han sido los principales efectos de la implantación de estos modelos sobre los resultados o el desempeño (performance) empresarial. Hay que señalar que la mayor parte de dichos estudios son de tipo cuantitativo, basados en la utilización de encuestas dirigidas a los directivos de las empresas que han participado en el proceso de implantación. Ahora bien, el análisis de los efectos de la GC realizado de esta forma, cuenta, a nuestro entender, con una posible debilidad y distorsión metodológica al tomar sólo como base las opiniones de los directivos de las empresas involucradas en el proceso de implantación sobre los efectos del propio proceso y los resultados pueden tener cierto sesgo, tal y como ha sido subrayado por diversos investigadores (ver, por ejemplo, Wayhan et al, 2002 y Heras et al, 2002). Por estos motivos, en el estudio que aquí presentamos hemos considerado necesario utilizar una metodología que tenga en cuenta la opinión de expertos de diversa índole que tienen distintas funciones en la implantación de modelos de GC, de forma que se pueda obtener una información de interés para contrastarla y triangularizarla con la obtenida en estudios empíricos previos llevados a cabo con la metodología tradicional
