Managing public sector projects in Malaysia is a unique challenge. This is because of the ethical issues involved during the project procurement process. These ethical issues need attention because they will have an impact on the quality, cost and time of the project itself. The ethical issues here include conflict of interest, bid shopping, collusive tendering, bid cutting, corruption and the payment game. In 2006, 17.3% of 417 Malaysian government contract projects were considered sick due to contractors' performances that failed to conduct the project according to the project plan. Some of the sick projects from these statistics are due to the ethical issues involved. These construction projects have low quality due to the selection of the contractors, done unethically due to personal relationships instead of professional qualifications. That is why it is important to govern the project procurement processes to ensure the accountability and transparency of the decision making process to ensure that these ethical issues can be avoided. Extensive research has been conducted on the ethical issues in the tendering process or the award phase of project management. There is a lack of studies looking at the role of clients, including the government client, in relation to unethical practice in project procurement in the public sector. It is important to understand that ethical issues not only involve the contractors and suppliers but also the clients. Even though there are codes of ethics in the public sectors, ethical issues still arise. Therefore, this research develops a project governance framework (PGEDM) for ethical decision making in the Malaysian public sectors. This framework combines the ethical decision making process together with the project governance principals in guiding the public sectors with ethical decision making in project procurement. A triangulation of questionnaire survey and Delphi study was employed in this research to collect required qualitative and quantitative data. A questionnaire survey was conducted among the public officials (the practitioners) who are currently working in the procurement area in the Malaysian public sectors, in identifying the ethical behaviours and factors influencing further ethical behaviour to occur. A Delphi study was also conducted with the assistance of a panel of experts consisting of practitioners that have expertise in the area of project governance and project procurement as well as academician, which further considered the relationship and the influence of the criteria and indicators of ethical decision making (EDM) and project governance (project criteria, organisational culture, contract award criteria, individual criteria, client's requirements, government procedures and professional ethics). Through the identification and integration of the factors and EDM criteria as well as the project governance criteria and EDM steps for ethical issues, a PGEDM framework was developed to promote, and drive consistent decision outcome in project procurement in the public sector. The framework contributes significantly to ethical decision making in the project procurement process. These findings not only give benefit to the people involved in project procurement but also to the public officials in guiding them to be more accountable in handling ethical issues in the future and to have a more transparent decision making process.

This article aims to discuss the notion of moral progress in the theory of recognition. It argues that Axel Honneth's program offers sophisticated theoretical guidance to observe and critically interpret emancipatory projects in contemporary politics based on ideas of individuality and social inclusiveness. Using a case study – the investigation, through frame analysis, of transformations in the portrayal of people with impairment as well as in public discourses on the issue of disability in major Brazilian news media from 1960 to 2008 – this article addresses three controversies: the notion of progress as a directional process; the problem of moral disagreement and conflict of interest in struggles for recognition; and the processes of social learning. By articulating empirically based arguments and Honneth's normative discussions, this study concludes that one can talk about moral progress without losing sight of value pluralism and conflict of interest.

Legacies of the Global Financial Crisis and major domestic corporate collapses – such as HIH Insurance Pty Ltd and One.Tel Ltd (telecommunications) – have significantly changed Australia‟s financial regulatory landscape. Legal requirements for auditors have attracted particular attention as have practice standards more broadly around disclosure and conflict of interest. Conversely, although successful detection and prosecution of breaches may rest in significant part on forensic accounting activities, Australia‟s practitioners in this field have no minimum training or qualifications standards other than the baseline requirements mandated by the country‟s three professional accounting bodies. For those unaffiliated with these organizations, no professional oversight exists. In Australia, growth in the forensic accounting industry has been in direct response to public demand for expertise in a broad range of fraud, forensic and business analytics areas in order to improve the corporate governance practices of Australian organizations. During the 1990s, Australian forensic accounting firms expanded and diversified into a number of different areas going well beyond just the examination of financial documents and involvement in financial litigation disputes. “Big 4” accounting firms such as PriceWaterhouseCoopers, KPMG, Deloitte and Ernst and Young formed independent forensic accounting or forensic services units; a number of mid-tier and „boutique‟ forensic accounting firms similarly expanded into forensic investigative, analytical and advisory services. By 2008, 800 forensic accountants were registered with the country‟s largest specialist forensic accounting group, the Forensic Accounting Special Interest Group (FASIG) of the ICAA1. Currently, obtaining more precise figures on numbers of forensic accounting practitioners is problematic: professional accounting bodies either do not keep a register or have ceased registering their forensic accounting members; lack of formal recognition, admission or certification processes complicate identification of candidates; and diversity of the skills sets the industry requires has meant the influx of non-accounting based specialists.

A presente tese tem por objetivo tratar do conflito de interesses na sociedade de economia mista. Referida sociedade tem na sua base constitutiva o conflito como elemento inerente. Por possuir capital público e privado, não é fácil solucionar facilmente os problemas que se apresentam no decorrer de sua existência frente à possibilidade de que o detentor do poder de controle pode decidir em prol do interesse público. E é visando limitar a má utilização do interesse público como resposta à tomada de decisões por parte do acionista controlador que se propõe uma mudança de paradigma. Para tanto, propõe-se analisar o papel do Estado empresário na atual conjuntura de limitação de intervenção do Estado na economia. Também é abordada a forma com que o poder Executivo vem intervindo no mercado, de forma a limitar a livre iniciativa e, por vezes, até mesmo eivada de certa inconstitucionalidade. No entanto, para evitar que haja afronta à Constituição no que diz respeito à exploração de atividade econômica por parte do Estado sem que sejam observados os limites constitucionais impostos, apresenta-se o meta-interesse como meio de solução. Sendo o meta-interesse o interesse da própria companhia, e considerando que o interesse público que fundamenta a autorização para a criação da sociedade de economia mista se extingue com a criação da referida companhia, tem-se que as normas que devem reger as sociedades de economia mista são as normas de direito privado. Com o meta-interesse o Estado passa a intervir na seara privada em igualdade de condições com as demais companhias, não podendo mais se valer de sua posição de acionista majoritário para tomar decisões que conflitem com o interesse da companhia e que privilegiem o interesse público secundário ou até mesmo o interesse político do Estado em detrimento do interesse social e dos acionistas minoritários. Dessa forma, o meta-interesse tem por finalidade colocar fim aos conflitos em relação à aplicação das normas jurídicas e as indefinições da própria natureza da sociedade de economia mista.

A administração pública apresenta vários problemas, que vão desde a ausência de avaliações quanto aos aspectos de eficiência, eficácia e efetividade na utilização de recursos e das políticas públicas adotadas, até a prática perversa da corrupção em suas diversas formas. Grande parte destes problemas decorre da falta de mecanismos de controle e acompanhamento para saber se as ações promovidas pelos gestores públicos estão de acordo com os objetivos da sociedade. Os problemas que decorrem desta relação de conflito de interesses entre aqueles que delegam a administração de suas organizações e aqueles que recebem esta delegação e administram, são chamados de problemas da relação entre principal e agente. No setor público pode-se considerar que agente é o gestor público (recebe a delegação e administra) e principal é o cidadão ou a própria sociedade (que delega). Estes conceitos têm origem na teoria da agência. Esta teoria é um dos fundamentos da governança, seja no setor privado ou no setor público. E a governança adota princípios como a transparência e a accountability para propor práticas de controle e acompanhamento da administração, a fim de evitar os problemas da relação agente e principal. Deste modo, a presente pesquisa tem por objetivo avaliar se os relatórios de gestão do Poder Executivo municipal são aderentes aos princípios e padrões de boas práticas de governança para o setor público acerca da transparência e da accountability na utilização dos recursos, bem como dos resultados gerados em decorrência das políticas públicas adotadas. Para tanto, a metodologia utilizada neste trabalho foi a seguinte: através da pesquisa bibliográfica, identificou-se na literatura quais os princípios e padrões de boas práticas de governança para a administração pública, e criou-se um quadro-síntese para servir de base para avaliação dos relatórios de gestão quanto aos aspectos de transparência e accountability; através da pesquisa documental foram selecionados os relatórios de gestão da Prefeitura da Cidade do Rio de Janeiro a serem analisados, que foi a cidade escolhida para realização da pesquisa pela proximidade com o autor e pela disponibilização de diversos documentos em seu sítio eletrônico; a seguir, pela análise de conteúdo, fez-se a avaliação dos documentos utilizando-se o quadrosíntese produzido. Os resultados da pesquisa demonstraram que os relatórios de gestão analisados possuem pouca aderência aos princípios e padrões de boa governança, evidenciando-se uma aderência de apenas 37,71% em relação aos elementos estabelecidos no quadro-síntese. Assim, apontou claramente para o fato de que há pouca transparência nos relatórios de gestão, fato este que prejudica a accountability na administração pública.

O presente estudo analisa a importância da fase pré-processual, compreendida entre o momento em que surge o conflito de interesses no âmbito da sociedade e aquele em que é deflagrada a ação cível. Desenvolve-se o estudo de institutos do direito comparado, que incutem a noção de elevada utilidade da regulação da conduta pré-processual das partes e advogados como os pre-action protocols e a disclousure do direito inglês e a similar desta no direito estadunidense, a discovery o que evidencia que é a preparação adequada da demanda que permite a superação dos filtros legítimos à propositura de ações. Verifica-se que há procedimentos prévios, preparatórios à ação judicial na legislação vigente, que passam quase despercebidos da doutrina tradicional.A apuração da existência de filtros legítimos à propositura da ação, induz a conclusão de que efetivamente que existe um ônus jurídico de preparação da demanda na fase pré-processual, cuja não observância prejudica o acesso à justiça compreendido o acesso à justiça sob a perspectiva de uma tutela jurídica efetiva, que seja resultado de um processo garantístico além dessa omissão acarretar consequências desfavoráveis para a parte, que vão desde a demora na prestação jurisdicional até a inviabilização da tutela jurisdicional. O magistrado deve exercer um juízo sobre a superação ou não destes filtros pela parte que propõe a demanda, verificando se a mesma é ou não admissível, podendo o processo formar-se e desenvolver-se validamente: este é o juízo de admissibilidade da demanda cível que examina a conduta pré-processual das partes e se o ônus de preparação adequada da demanda foi desempenhado.

Um dos temas mais estudados na área de finanças corporativas é a determinação de fatores que influenciem o valor de mercado das companhias. Outro tema, também bastante comum, é a relação entre proprietários e agentes. Ambas as questões se entrelaçam porque, em tese, agentes podem orientar suas decisões em benefício próprio, contrariando os interesses dos proprietários, o que, em última análise, impactaria negativamente no valor das empresas. No Brasil, face às características próprias de controle e propriedade das companhias, o conflito de interesses passa a englobar também as relações entre controladores e minoritários. Uma rápida análise da literatura existente irá constatar que são muitas as variáveis consideradas. A tentativa de tratá-las num único modelo esbarra nas correlações muito elevadas que as referidas variáveis possuem entre si. Este estudo pretendeu lançar um novo olhar sobre o problema, utilizando Análise Fatorial para contornar estas dificuldades. Partindo de uma amostra com 114 empresas, foi possível identificar dois fatores aos quais se relacionam as nove variáveis consideradas no trabalho. Os fatores, nomeados Negociabilidade e Governança Corporativa, respondem por mais de 2/3 da variabilidade dos dados. As coordenadas dos fatores, divididas em altas e baixas, combinadas em pares, permitiu a caracterização de quatro quadrantes, pelos quais as empresas se distribuem. Através da utilização de teste não paramétrico de diferenças de médias, foi possível rejeitar a hipótese nula de igualdade do valor médio de mercado das empresas entre os quatro quadrantes. Os resultados encontrados são explicados pelos valores assumidos pelas variáveis para as empresas de cada quadrante.

BACKGROUND: In a 1994 Ninth Circuit decision on the remand of Daubert v. Merrell Dow Pharmaceuticals, Inc., Judge Alex Kosinski wrote that science done for the purpose of litigation should be subject to more stringent standards of admissibility than other science. OBJECTIVES: We analyze this proposition by considering litigation-generated science as a subset of science involving conflict of interest. DISCUSSION: Judge Kosinski's formulation suggests there may be reasons to treat science involving conflict of interest differently but raises questions about whether litigation-generated science should be singled out. In particular we discuss the similar problems raised by strategically motivated science done in anticipation of possible future litigation or otherwise designed to benefit the sponsor and ask what special treatment, if any, should be given to science undertaken to support existing or potential future litigation. CONCLUSION: The problems with litigation-generated science are not special. On the contrary, they are very general and apply to much or most science that is relevant and reliable in the courtroom setting.

BACKGROUND: Professionalism has been an important tenet of medical education, yet defining it is a challenge. Perceptions of professional behavior may vary by individual, medical specialty, demographic group and institution. Understanding these differences should help institutions better clarify professionalism expectations and provide standards with which to evaluate resident behavior. METHODS: Duke University Hospital and Vidant Medical Center/East Carolina University surveyed entering PGY1 residents. Residents were queried on two issues: their perception of the professionalism of 46 specific behaviors related to training and patient care; and their own participation in those specified behaviors. The study reports data analyses for gender and institution based upon survey results in 2009 and 2010. The study received approval by the Institutional Review Boards of both institutions. RESULTS: 76% (375) of 495 PGY1 residents surveyed in 2009 and 2010 responded. A majority of responders rated all 46 specified behaviors as unprofessional, and a majority had either observed or participated in each behavior. For all 46 behaviors, a greater percentage of women rated the behaviors as unprofessional. Men were more likely than women to have participated in behaviors. There were several significant differences in both the perceptions of specified behaviors and in self-reported observation of and/or involvement in those behaviors between institutions.Respondents indicated the most important professionalism issues relevant to medical practice include: respect for colleagues/patients, relationships with pharmaceutical companies, balancing home/work life, and admitting mistakes. They reported that professionalism can best be assessed by peers, patients, observation of non-medical work and timeliness/detail of paperwork. CONCLUSION: Defining professionalism in measurable terms is a challenge yet critical in order for it to be taught and assessed. Recognition of the differences by gender and institution should allow for tailored teaching and assessment of professionalism so that it is most meaningful. A shared understanding of what constitutes professional behavior is an important first step.

Lasioglossum malachurum, a bee species common across much of Europe, is obligately eusocial across its range but exhibits clear geographic variation in demography and social behaviour. This variation suggests that social interactions between queens and workers, opportunities for worker oviposition, and patterns of relatedness among nest mates may vary considerably, both within and among regions. In this study, we used three microsatellite loci with 12–18 alleles each to examine the sociogenetic structure of colonies from a population at Agios Nikolaos Monemvasias in southern Greece. These analyses reveal that the majority of colonies exhibit classical eusocial colony structure in which a single queen mated to a single male monopolizes oviposition. Nevertheless, we also detect low rates of multiqueen nest founding, occasional caste switching by worker-destined females, and worker oviposition of both gyne and male-producing eggs in the final brood. Previous evidence that the majority of workers show some ovarian development and a minority (17%) have at least one large oocyte contrasts with the observation that only 2–3% of gynes and males (the so-called reproductive brood) are produced by workers. An evaluation of the parameters of Hamilton's Rule suggests that queens benefit greatly from the help provided by workers but that workers achieve greater fitness by provisioning and laying their own eggs rather than by tending to the queen's eggs. This conflict of interest between the queen and her workers suggests that the discrepancy between potential and achieved worker oviposition is due to queen interference. Comparison of relatedness and maternity patterns in the Agios Nikolaos Monemvasias population with those from a northern population near Tübingen, Germany, points to a north–south cline of increasingly effective queen control of worker behaviour.

In this paper we report an empirical study of the photographic portrayal of family members at home. Adopting a social psychological approach and focusing oil intergenerational power dynamics, our research explores the use of domestic photo displays in family representation. Parents and their teenagers from eight families in the south of England were interviewed at home about their interpretations of both stored and displayed photos within the home. Discussions centred on particular photographs found by the participants to portray self and family in different ways. The findings show that public displays of digital photos are still curated by mothers of the households, but with more difficulty and less control all with analogue photos. In addition, teenagers both contribute and comply with this curation within the home, whilst at the same time developing additional ways of presenting their families and themselves online that are 'unsupervised' by the curator. We highlight the conflict of interest that is at play within teen and parent practices and consider the challenges that this presents for supporting the representation of family through the design of photo display technology. Canadians appear to hold the activities of those in government and in big business in low esteem. Media reports of several high-profile political and corporate instances of unethical conduct have reinforced the public's concern for the status of ethical conduct and honesty in government and in big business. The response by public and private sector managers to unethical conduct by employees is largely in the form of 'ethical rules' which both sectors agree provide a measure of certainty as to the ethical conduct expected from employees. Since research on ethics in the public and private sectors is limited and since ethics is a topic of increasing concern to both sectors, this thesis provides data that could assist managers in dealing with the issue of ethical conduct within their respective organizations. The purpose of this thesis is to compare the state of ethical conduct within public and private sector organizations in Canada. This is accomplished through a description and analysis of the approaches taken by the public and private sectors as well as the four professions of law, engineering, accountancy and medicine. Ethical conduct within the public sector focuses on the ethical behaviour of public servants rather than elected officials. The underlying intent of this thesis is to discover if contemporary ethical problems are similar in the public and iv private sectors with respect to the four ethical areas of conflict of interest, political activity, problem public comment and confidentiality. The comparative data on both public and private sector ethics are assessed and similarities and differences are identified. One major finding emerges from this study. Codes of ethics in both the public and private sectors are perceived by management to play an important role in the prevention of unethical conduct. A procedure for developing a code of ethics is presented along with recommendations as to the administration of a code of ethics. Finally, recommendations are made as to the role of education in ethics.

RÉSUMÉ FRANÇAIS Ce mémoire fait l’étude du régime de prévention et de sanction des conflits possibles entre les intérêts de la municipalité d’une part et de ceux de ses élus de l’autre. L’objet de recherche est abordé selon une approche historique et éthique basée sur le régime juridique actuel. Le mémoire est divisé en 3 chapitres : (1) la notion de conflit d’intérêts ; (2) le cadre juridique à la base du régime de sanction des conflits d’intérêts et (3) celui sur le régime de prévention des conflits d’intérêts dans le domaine municipal. Le chapitre préliminaire situe l’objet de recherche à l’intérieur des grandes tendances de la recherche juridique sur la question et présente un cadre de réflexion sur la notion de conflit d’intérêts. L’examen des conflits d’intérêts repose avant tout sur un questionnement et sur un jugement de nature subjective : ce qui a été considéré comme un conflit d’intérêts autrefois ne l’est pas nécessairement de nos jours et ce, en dépit du fait que le cadre juridique évolue aussi dans le temps. On ne peut donc pas dégager avec exactitude et pour toujours ce qui constitue un conflit d’intérêts de ce qui n’en constitue pas un. Le chapitre premier est divisé en 4 sections. On y traite notamment de la règle relative à l’interdiction pour un élu municipal de contracter avec la municipalité. On y démontre que l’origine de cette règle remonte aux premières lois municipales du XIXe siècle et que cette dernière a subi assez peu de modifications au fil des ans. La troisième section porte sur les cas de malversation, d’abus de confiance et les autres inconduites prohibées par la Loi sur les élections et référendums dans les municipalités (L.R.Q. c. E-2.2). Une quatrième section sur les accusations criminelles d’abus de confiance et de corruption vient clore le premier chapitre. Chacune de ces sections est abordée notamment en faisant l’historique des dispositions législatives en cause ainsi qu’en faisant certains parallèles avec la législation des autres provinces canadiennes. Le chapitre 2 sur le régime de prévention des conflits d’intérêts est divisé en 4 parties. La première section porte sur l’obligation pour un élu de déclarer annuellement ses intérêts pécuniaires. Cette obligation n’est pas unique au Québec puisqu’elle est présente dans quelques législations provinciales canadiennes. La deuxième section porte sur l’obligation pour cet élu de dénoncer verbalement son intérêt dans une question abordée par le conseil municipal réuni en séance ou en comité. Là encore, l’origine de cette approche préventive est fort ancienne et a longtemps été considéré comme le seul moyen de dénoncer son intérêt sans subir les sanctions prévues par la loi. Une troisième section s’intéresse au cadre juridique entourant les soumissions publiques et qui vise à éliminer toute situation possible de favoritisme ou de patronage. Une quatrième section aborde la question des codes d’éthique et de leur utilité ainsi que les développements récents sur cette question avec le dépôt en 2009 du rapport du Groupe de travail sur l’éthique dans le milieu municipal. Une conclusion vient clore le mémoire en présentant une synthèse de l’étude assortie de commentaires personnels sur les conclusions du Groupe de travail précité.
