Direito à intimidade do empregado e o poder de direção do empregador: abrangência e limites

A pesquisa desenvolve-se no âmbito das relações de emprego, e trata dos limites e da abrangência do direito à intimidade e à vida privada do empregado, e do poder de direção do empregador. Aquele na qualidade de direito fundamental, garantido pela Constituição Brasileira a todos os cidadãos, e este como mecanismo indispensável para o desenvolvimento das atividades de gestão no âmbito de um contrato de trabalho, como por exemplo, contratar, fiscalizar, estipular regulamentos, punir, dentre outros. O primeiro possui fundamento no art. 5º, X da Constituição Federal de 1988 – CF/88, e o segundo, no art. 2º da Consolidação das Leis do Trabalho – CLT. O assunto é relevante, principalmente pela constatação de limites ao poder de direção do empregador, impostos pelo dever de respeito aos direitos fundamentais do empregado. De outra sorte, este também encontra limitações na existência desses direitos no exercício de sua atividade laboral em razão do caráter subordinativo inerente ao contrato de trabalho. O presente estudo perfaz a análise de princípios e de fundamentos dos direitos em questão, apresentando ao final possíveis diretrizes na composição dos conflitos referentes ao tema proposto.

A independência do solo que habitamos: poder, autonomia e cultura política na construção do império brasileiro - Sergipe (1750-1831)

A Província de Sergipe ganhou autonomia em relação à Província da Bahia em 1820, por decisão de D. João VI, que então já havia transferido a Corte portuguesa para o Brasil. Dois anos depois o Brasil se tornava uma nação soberana, separando-se de Portugal. Esses dois acontecimentos, que guardam proximidade temporal e política, instigaram a historiadora Edna Maria Matos Antônio a estudar a presença da corte portuguesa no Brasil e os significados das transformações institucionais aplicadas pelo governo joanino às regiões distantes do Rio de Janeiro, então sede política da nação. A autora aborda as reformas econômicas e administrativas promovidas pelo estado metropolitano, iniciadas na fase pombalina em meados do século XVIII e continuadas com a chegada de D. João VI ao Rio de Janeiro. E avalia as distintas conseqüências de tais reformas para o desenvolvimento regional do Brasil, além da influência que teriam exercido sobre o movimento da independência brasileira. Tomando como referência a Revolução Pernambucana de 1817, que ao contestar a política joanina e exigir reformas recebeu adesão de parte das elites locais e desencadeou conflitos na relação com o poder monárquico, o livro analisa o processo de independência da capitania de Sergipe. A autonomia teria sido concedida em reconhecimento da Coroa à participação dos representantes do poder sergipano no combate à revolta de Pernambuco. A investigação desses fatos permitiu à autora expor a natureza desses conflitos e seus desdobramentos dentro da crise do colonialismo em terras brasileiras. O momento exigia que os grupos sociais e políticos da Colônia tomassem decisões sobre formatos políticos institucionais vistos como soluções para melhorar e modificar a realidade. Injustiça e poder segundo Noam Chomsky

Injustice and power according to Noam Chomsky. In the beginning of the Politics, Aristotle establishes the two lesser forms of sociability: the relationships between man and woman and between master and the slave. In this context, he observes that “Hellenes are natural masters of barbarians” and the reason is that Greeks know philosophy and barbarians still resort to violence (ARISTOTLE, Politics, 1252a.). Shortly after defines “just war” as a war that has a fair cause, that is, which is well justified by philosophy or a fair speech (ARISTOTLE, Politics, 1255a.). This scene briefly expresses the manner in which the USA understands their role in the contemporary world. Chomsky points out the political use of massive military force of his country and denounces how it articulates internally and externally. He affirms that politics is excessively submitted to “ideology”, to doxa, as opposed to natural sciences. His militancy, thus, only advocates freedom and unrestricted right to information. In Camelot, the Kennedy years (1993), for example, the MIT’s professor collects information from congressmen’s speeches and government officials and from secret documents made public and he explicits the methods and actions of the US government. Thereby he can conclude that the US has, for historical reasons, an internal posture that is advocate or contrary to what they imposes to other countries. Power and justice on the one hand, force and injustice on the other –according to their own political discourse.

Tecnologia e poder: uma análise dos cadernos de informática dos jornais Folha e Estado de São Paulo

O advento de uma nova ordem global mediada pelas tecnologias de informação e comunicação pode parecer, a um observador desatento, algo bom ou, no mínimo, neutro. No entanto, os valores decorrentes deste modelo organizacional estão intimamente ligados a interesses políticos, econômicos e ideológicos. Entender a complexidade dessa nova dinâmica em nossas vidas, sem cair nos extremismos da questão, é o desafio a que nos propomos. Para tanto, discutiremos no primeiro a relação entre tecnologia e sociedade desde o advento do alfabeto ocidental. No segundo capítulo apresentaremos os fundamentos da análise do discurso de linha francesa e, no terceiro capítulo, analisaremos os cadernos de informática do mês de agosto de dois grandes jornais impressos brasileiros – Folha e Estado de São Paulo - à luz das teorias da análise do discurso, buscando entender como a construção simbólica de nosso atual contexto se manifesta na forma discursiva do jornalismo

Avaliação da cobertura de formas de vida no estrato herbáceo e sua relação com a diversidade da regeneração natural de lenhosas em Mata Atlântica

A comunidade vegetal pode ser constituída por diversas formas de vida, envolvendo desde plantas vasculares a não vasculares, bem como uma ampla gama de grupos taxonômicos e funcionais. Sendo considerada parte integrante do ciclo de crescimento florestal associados às fases iniciais do estabelecimento e desenvolvimento deste ciclo. Espécies herbáceas e subarbustivas, uma guilda importante, mesmo dentro de formações florestais, possuem um grande poder de colonização e modificação da comunidade, com isso o estabelecimento de indivíduos de porte arbóreo pode ser restringido pelo aumento de biomassa dessas espécies, pois tais vegetais por encobrirem o solo podem inviabilizar o processo germinativo do banco de sementes, transitório ou permanente. Este estudo analisou a relação entre cobertura de Arecaceae, Samambaias, Poaceae e Bromeliaceae, e a densidade e diversidade da regeneração natural de lenhosas em um trecho de Floresta Ombrófila Densa situada no Parque Estadual Carlos Botelho. Formam inventariadas 120 parcelas contidas em 6 transectos. Cada transecto contou com 20 parcelas (1m X 1m), sendo que 10 delas estavam inseridas em locais onde ocorrem manchas de Calathea communis (Maranthaceae) e as outras 10 em locais desprovidos desta espécie. Os indivíduos regenerantes foram divididos em 3 classes de altura, a classe A compreendeu plântulas lenhosas de 10 a 15 cm, a classe B de 16 a 50 cm e a classe C envolveu jovens de 50 a 150 cm.. A quantificação da cobertura das diferentes guildas foi realizada em manchas com presença e ausência de Calathea communis, no interior das parcelas. Através de uma análise de variância, conclui-se que existe uma tendência da Calathea communis interferir na cobertura de todas as formas de vida estudadas. Significados e expectativas de crianças das camadas populares em relação à escolarização

Nowadays, we understand the childhood as a result of historical and social changes. This work aims to comprehend representations and expectations made by children from the popular classes in the initial years of Fundamentaql Education. We conducted a research with six students from a public school that attends children from urban popular layer's families. The research examines the meanings and representations of educational practices developed in the relationships established among teachers, students and families through their life stories. Among the results, we can say that the environment of differentiation in the school id perceived to the students because they introject teacher's representations about their performance. Scientific studies show that children crystallize a positive image of the shool when the speech and posture of the institution value and encourage learning. However, the students are challenged to produce better results in order to participate in extracurricular activities, which they are excluded todue indiscipline or learning difficulties. The mean of the schooling is highly influenced by the performance of students and also by the attitude of educators in the family and in the school. The theoretical review points out that when students have a good performance, the merit is attributed to stress and ease they have to acquire the learning contents. In other hand, struggling students or with a lag of content explains the academic problems stems from the lack of capacity and potential for acquisition of learning compatible with age, defining schooling as something necessary for training, but which is inaccessible in their life stories

A discursivização em Wall.E: sociedade, tecnologia e poder

This article consists in a discourse analysis of the feature film in animation Wall.e produced by Pixar in association to Disney in 2008. Pixar has been known to produce films that contain various discursive levels, making its products appealing not only for children, but also for adults. However, Wall-e proves to be a masterpiece in Pixar carrier, because it is the one which focuses on the analysis and critique of contemporary society associated with technological development. For this, the plot has as its starting point the question of sustainability and unbridled consumerism. But the film expands the debate, tracing the relationship between technology and humanity, discussing how one affects the other. The project therefore aims to show how the animation works such concepts and constructs his discourse. To this end, the work seeks to identify the signs that make up the discourse and draw the intertextuality between WALL.E and other works that also discuss the same elements such as Stanley Kubrick‟s 2001 - A Space Odyssey (1968)

Implicações sobre o trabalho coletivo, relações de poder na escola e valorização / desvalorização docente

As questões dessa pesquisa se delinearam a partir de uma outra, sobre a construção do Projeto Pedagógico (Dias e Tuppy, 2010), cujo levantamento preliminar aponta para os temas acima apontados, quais sejam: trabalho coletivo, relações de poder e mecanismos de valorização profissional no âmbito da instituição escolar, a que chamaremos de categorias de análise. O trabalho coletivo é o mecanismo vital para o êxito da vida escolar, e vê-se a necessidade de olhar quais os mecanismos dessa prática. As relações de poder na escola podem ser vistas de diversos ângulos, e será outro componente da pesquisa. A desvalorização e valorização docente que se vincula a ideologias, a visões da sociedade, e até as questões de gênero. No trabalho preliminar realizado no âmbito daquela pesquisa, por 10 pesquisadores, em 53 escolas de uma Rede Municipal de Ensino, tais categorias aparecem de forma recorrente nas discussões realizadas com os profissionais das diferentes escolas, apontando para o fato de que tais temas tem prevalência no cotidiano escolar, implicando a necessidade de um estudo mais acurado sobre eles. Nesse sentido, a presente pesquisa, buscará elementos que forneçam aporte teórico à parte das discussões que serão encaminhadas por aquele estudo. Recorreremos, assim, ao levantamento de trabalhos, cuja temática estabeleça relação com as categorias de análise aqui definidas. Com os objetivos de buscar aporte teórico para discussão do cotidiano escolar, levantar trabalhos científicos que tratem das seguintes temáticas: trabalho coletivo, relações de poder e mecanismos de valorização profissional no âmbito da instituição. Para elaboração deste trabalho será realizada uma pesquisa de natureza qualitativa, através de levantamento e análise bibliográfica, a fim de mapear e analisar a produção científica sobre os temas propostos. As estratégias governamentais frente à empregabilidade de jovens e adultos: investigando os meandros da relação educação e trabalho

This conclusion of course work aims to investigate the city of Limerick / SP, in order to question whether there are and what public policies developed by local, if there are training places for young people and targeting the job market or even partnerships between the city and local businesses seeking to supply the concrete conditions of preparation and targeting young people for the labor market. All changes in education accompanied the need to provide skilled labor to contribute to the country's economic development. The work is divided into several chapters. The first chapter is about the whole historical development of professional education in Brazil and new challenges. The second chapter discusses the reality of the world of work changes and their consequences, and the issue of working children and adolescents. The third chapter is about the difficulty of insertion of the poor youth in the current job market. The fourth chapter presents the city of Limerick to the needs of professional schools to meet the large number of trades and industries, which are currently listed by the educational institutions of the city and programs signed between the Municipal bodies and institutions such as SENAC (National Service of Commercial Learning) and Senai (National Service of Industrial Learning). The fifth chapter presents an interview with the CAMPL the city of Limerick, whose goal and give professional training to teens to get the first employee. Imagens de satélite na análise da relação entre queimadas, aerossóis atmosféricos e precipitação

The direct and indirect effects of atmospheric aerossols in the amazonic climate have been focus of many published. This work aims to analyze a possible relation among Burns, atmospheric aerossols and precipitation above South America. It uses the avaluable data from the satellites AQUA/TERRA and TRMM and the images furnished by NOAA and GOES. These analysis can provide some explanations about the effects of emission of aerosols by burns on the composition of atmosphere and cloud formation, mainly in Amazon. We use the Aerosol Optical Depth (AOD) from MODIS/TERRA-AQUA, burns index from CPTEC and rain rate from TRMM. The data we use were obtained from 2000 until 2012. The study is divided in two parts. In the first one, it was performed a quantitative analysis between number of burns and aerosols emission. It was identified a great variability in space and time of the AOD on South America. On the north, northeast and center-west, the AOD is significant during the winter period, with peak on August and September. The southeast is affected by aerosols from center-west due to the dynamical transport. In the second part, it was evaluated the relation between AOD and precipitation in a 13-year period. The statistical analysis shows up a negative correlation of 0.72 between August and October, on Legal Amazon. These result indicate an inverse relation between AOD and rain rate. The other months present not significant correlation. These results are in a good agreement with the literature, in which in-situ methods were applied or combined with satellites data. The increasing of aerosols concentration in the atmosphere are reinforced during drier years. It can affect the increasing process of water drops, decreasing the precipitation. Relação entre materiais dentários e o complexo dentino-pulpar

Despite the strong valorization of the esthetics and its relationship with restorative materials, the biological principles of any clinical procedure are extremely important to maintain the vitality of the dentin-pulp complex. Dentin and pulp tissue are susceptible to different kinds of irritants such as toxins from microorganisms, traumatic procedures of cavity preparation, as well as toxic components released by restorative materials applied in non recommended clinical situations. Initially, the pulp responds to irritation by starting an inflammatory reaction which involves outward movement of dentinal fluid and intratubular deposition of immunoglobulins, upregulation of odontoblast activities, presence of immune cells and their cytokines as well as local expression of neuropeptides and chemokines. After these initial events, the inflammation process can be resolved associated or not to sclerotic dentin formation and reactionary dentin deposition. If high intensity offensive stimuli are applied to the dentin-pulp complex, death of odontoblasts takes place and consequently pulp ageing or even partial necrosis of this tissue may occurs. Thereby, clinicians need to be aware about the physiological and pathological features of the dentin-pulp complex as well as the possible biological consequences of different clinical procedures. In this way, the dentists should be able to carry out minimally aggressive operative techniques and to select the more appropriate restorative materials for each specific clinical situation in order to obtain excellent clinical results associated to the maintenance of pulp vitality.
