A presente pesquisa dispõe sobre a efetividade do Sistema Interamericano de Direitos Humanos com relação aos casos brasileiros e a situação geral de violação de Direitos Humanos no Brasil. O estudo parte da exposição de uma concepção e fundamentação dos Direitos Humanos, para posteriormente analisar a consolidação de sua proteção internacional com o surgimento dos sistemas de promoção e de garantia dos Direitos Humanos, em âmbito global e regional, destacando em seguida o Sistema Interamericano de Proteção aos Direitos Humanos, em que se faz uma análise dos seus principais órgãos: Corte e Comissão Interamericanas. No estudo sobre a Comissão Interamericana, ao discorrer sobre funcionamento, requisitos para o ingresso e trâmite das petições individuais, apresenta-se os casos brasileiros em curso na Comissão, identificados a partir da análise dos seus relatórios anuais, disponíveis no seu endereço eletrônico. Com isso, traça-se um perfil dos casos enviados á Comissão Interamericana, ressaltando que, em regra, não esgotam os recursos judiciais internos, o que corresponde a um requisito processual para o ingresso de petições individuais. Logo, estas são enviadas com fundamento nas vias excepcionais, mormente a exceção da demora injustificada em tutelar jurisdicionalmente os casos de violações ocorridos no Brasil, o que faz do Sistema Interamericano não um órgão coadjuvante ou complementar. De modo a auferir a efetividade do Sistema Interamericano para a promoção e a garantia dos Direitos Humanos no Brasil, apresenta-se o monitoramento que a Comissão realiza desde 1997, quando estabeleceu ao governo brasileiro suas Recomendações sobre a situação geral de violação de Direitos Humanos, a partir da missão in loco que fez no país em 1995; e com a análise dos casos brasileiros em tramitação na Comissão Interamericana, identifica-se também quais denúncias geraram Recomendações ao Brasil e a relação destas com políticas públicas, inovações e alterações legislativas ocorridas internamente

1792, Madri. After years of inactivity, the Spanish Inquisition is born again with the mission of containing the laic winds that blow from the revolutionary France. Inês Bilbatúa, a rich merchant’s daugther, is victim of the inquisitorial machinery which tortures and violates her, through one of their abetters, the Dominican monk Lorenzo. Before being arrested, the young lady had served as model for the painter Francisco of Goya, who had also portrayed the monk Lorenzo. The Aragonese painter’s figure serves as narrative conductor of a history that narrates the young Inês’ via crucis and, at the same time, it recreates the historical scenery of the Napoleonic invasion (1808), through a basic element, the painting. Our work intends to analyze the relationships among movie, painting and history present in “Goya’s ghosts” (2006), of the Czech director Milos Forman (1932) - whose script was adapted to a homonymous book in 2007 -, a movie that is based on the artistic production of Francisco of Goya y Lucientes (1746 -1828), official painter of Carlos’ IV (1788 -1808) court and the most lucid columnist of his time, that knew how to capture in his works the religious fanaticism, the populist fervour, the governor’s hypocrisy and the horror and the violence of the war.

The yellow-billed magpie is a little smaller than the American or black-billed magpie, but the difference in size is very slight. The birds look exactly alike, except one has a black beak and the other has a yellow bill and a bit of yellow skin back of the eye.There are concentrated populations in the Los Banos area, Gustine area, and along the course of the Merced River comprising about 19,100 acres. They are occasionally seen in other areas of the County, but only infrequently observed in the southwestern portion of the County. The heaviest populations are in walnut orchards, dairy farms, almond orchards, turkey ranches and areas adjacent to river bottoms.The yellow-billed magpie may represent a dying ancient race. Since scientific interest has been directed toward its habits and distribution, its range has become more restricted. There are reports that 50 or 60 years ago it was common in many places close to the Coast, where the observer would now look for it in vain. It inhabits only the interior of California west of the Sierra Nevada, chiefly in the Sacramento and San Joaquin Valleys. It haunts stock ranches, because food to its liking is usually plentiful in such places. When cattle and sheep are butchered the refuse attracts magpies. They gather about any dead animal. They feed on grasshoppers, worms and grubs, and of course always look for a reasonable supply of eggs.

[ES]Al amparo del tío paterno, que llamó a los sobrinos a la corte y supo servirse de sus influencias para situarlos convenientemente, los Iriarte constituyeron un importante núcleo intelectual y político en la España del siglo XVIII. A pesar de su singularidad, la formidable ascensión del clan familiar no ha sido suficientemente explicada, a pesar de que en ella se concitan de manera ejemplar las particulares circunstancias que orientaron las relaciones entre políticos y literatos en la España del absolutismo borbónico.

My research tells about the origins of Rome. I think that Rome became a civil community under king Tullus Hostilius who transformed a federation of villages in a city. Perhaps he retook a project of his grandfather, Hostus Hostilius. I think also that the tradition on the early Rome was elaborated by Servius Tullius’ court and his motivations must be researched in the relations between this king and Tarquin’s dynasty. Finally I formulated some particular theories on the comitia centuriata and their evolution and on the international politic of Servius Tullius.

Life is full of uncertainties. Legal rules should have a clear intention, motivation and purpose in order to diminish daily uncertainties. However, practice shows that their consequences are complex and hard to predict. For instance, tort law has the general objectives of deterring future negligent behavior and compensating the victims of someone else's negligence. Achieving these goals are particularly difficult in medical malpractice cases. To start with, when patients search for medical care they are typically sick in the first place. In case harm materializes during the treatment, it might be very hard to assess if it was due to substandard medical care or to the patient's poor health conditions. Moreover, the practice of medicine has a positive externality on the society, meaning that the design of legal rules is crucial: for instance, it should not result in physicians avoiding practicing their activity just because they are afraid of being sued even when they acted according to the standard level of care. The empirical literature on medical malpractice has been developing substantially in the past two decades, with the American case being the most studied one. Evidence from civil law tradition countries is more difficult to find. The aim of this thesis is to contribute to the empirical literature on medical malpractice, using two civil law countries as a case-study: Spain and Italy. The goal of this thesis is to investigate, in the first place, some of the consequences of having two separate sub-systems (administrative and civil) coexisting within the same legal system, which is common in civil law tradition countries with a public national health system (such as Spain, France and Portugal). When this holds, different procedures might apply depending on the type of hospital where the injury took place (essentially whether it is a public hospital or a private hospital). Therefore, a patient injured in a public hospital should file a claim in administrative courts while a patient suffering an identical medical accident should file a claim in civil courts. A natural question that the reader might pose is why should both administrative and civil courts decide medical malpractice cases? Moreover, can this specialization of courts influence how judges decide medical malpractice cases? In the past few years, there was a general concern with patient safety, which is currently on the agenda of several national governments. Some initiatives have been taken at the international level, with the aim of preventing harm to patients during treatment and care. A negligently injured patient might present a claim against the health care provider with the aim of being compensated for the economic loss and for pain and suffering. In several European countries, health care is mainly provided by a public national health system, which means that if a patient harmed in a public hospital succeeds in a claim against the hospital, public expenditures increase because the State takes part in the litigation process. This poses a problem in a context of increasing national health expenditures and public debt. In Italy, with the aim of increasing patient safety, some regions implemented a monitoring system on medical malpractice claims. However, if properly implemented, this reform shall also allow for a reduction in medical malpractice insurance costs. This thesis is organized as follows. Chapter 1 provides a review of the empirical literature on medical malpractice, where studies on outcomes and merit of claims, costs and defensive medicine are presented. Chapter 2 presents an empirical analysis of medical malpractice claims arriving to the Spanish Supreme Court. The focus is on reversal rates for civil and administrative decisions. Administrative decisions appealed by the plaintiff have the highest reversal rates. The results show a bias in lower administrative courts, which tend to focus on the State side. We provide a detailed explanation for these results, which can rely on the organization of administrative judges career. Chapter 3 assesses predictors of compensation in medical malpractice cases appealed to the Spanish Supreme Court and investigates the amount of damages attributed to patients. The results show horizontal equity between administrative and civil decisions (controlling for observable case characteristics) and vertical inequity (patients suffering more severe injuries tend to receive higher payouts). In order to execute these analyses, a database of medical malpractice decisions appealed to the Administrative and Civil Chambers of the Spanish Supreme Court from 2006 until 2009 (designated by the Spanish Supreme Court Medical Malpractice Dataset (SSCMMD)) has been created. A description of how the SSCMMD was built and of the Spanish legal system is presented as well. Chapter 4 includes an empirical investigation of the effect of a monitoring system for medical malpractice claims on insurance premiums. In Italy, some regions adopted this policy in different years, while others did not. The study uses data on insurance premiums from Italian public hospitals for the years 2001-2008. This is a significant difference as most of the studies use the insurance company as unit of analysis. Although insurance premiums have risen from 2001 to 2008, the increase was lower for regions adopting a monitoring system for medical claims. Possible implications of this system are also provided. Finally, Chapter 5 discusses the main findings, describes possible future research and concludes.
