Há mais crimes hoje nos complexos de favelas do Alemão e da Penha, na zona norte do Rio, que antes da ocupação das comunidades pelas forças de segurança, em novembro de 2010. Nos seis primeiros meses deste ano, o total de ocorrências registradas, 6.188, foi 30,1% maior que no primeiro semestre de 2010: tiveram alta crimes como tentativa de homicídio (250%), lesão corporal dolosa (81,8%) e estupro (66,7%). Só este ano, cinco PMs das Unidades de Polícia Pacificadora (UPPs) do Alemão e da Penha morreram em confrontos com traficantes - o maior número de baixas de militares desde a criação do projeto, em 2007. O comandante das UPPs, coronel Frederico Caldas, classificou o último mês de março como “o momento mais crítico desde o início das UPPs”. Em um só mês, três PMs morreram no Alemão e na Penha, entre eles o subcomandante da UPP da Vila Cruzeiro, tenente Leidson Acácio Alves Silva, de 27 anos. Na madrugada desta segunda, criminosos dispararam contra uma viatura da UPP do Parque Proletário, na Penha. Os PMs revidaram e houve tiroteio, mas não houve feridos ou presos, de acordo com a polícia. Nas últimas semanas, as trocas de tiros têm sido frequentes. Em julho, o teleférico do Alemão chegou a ficar cinco dias fechado, deixando 12 mil pessoas diariamente sem o transporte. Escolas públicas também não puderam abrir e, em um só dia, mais de 10 mil crianças e adolescentes ficaram sem estudar.

A partir da redemocratização, as Forças Armadas passaram a assumir de forma cada vez mais frequente atividades estranhas à sua função precípua de defesa externa. Esse estudo pretendeu analisar o caso da Marinha do Brasil, e avaliar o impacto, para a Força, da assunção de funções subsidiárias. Para isso, foram coletados dados sobre a parcela de recursos provisionados à Marinha, para o financiamento de tais atividades, e sobre o quantitativo de pessoal e meios da Força Naval reservados ao cumprimento dessas missões. Os dados orçamentários foram levantados através de consulta ao Sistema do Plano Diretor, sistema informatizado específico da Marinha do Brasil. Os dados estatísticos foram extraídos do Anuário Estatístico da Marinha 2013/2014; do Memento nº 68 do Ministério da Defesa; junto às Organizações Militares da Marinha; em pesquisas realizadas nos sites da intranet e em publicações da Força Naval. Os resultados evidenciam que houve um crescimento considerável dos recursos destinados ao financiamento das atividades subsidiárias, ao longo do período 2001-2014, mais evidente a partir do governo Luís Inácio Lula da Silva e perpassando o mandato de Dilma Rousseff. Apesar disso, eles somam apenas 2% dos valores destinados à Força Naval em 2014, fatia que revela-se modesta diante da mobilização de pessoal e meios operativos necessários ao cumprimento dessas funções. Concluiu-se que o exercício de funções domésticas gera impactos negativos no aprestamento da Força, além de comprometer a qualidade da democracia, ao incentivar a ampliação da atuação militar no universo civil.

This work presents a reflection on possibilities and boundaries of consolidation and expansion of human settlements characterized as traditional communities that are located within protected areas, using as study reference the State Sustainable Development Reserve Ponta do Tubarão, at Rio Grande do Norte state. The main topics highlight the conflict between the right to housing and the prevalence of fundamental rights of traditional populations, opposed to the diffuse right to environment, according to the regulatory framework of the Brazilian Urban and Environmental Policies. At the same time that these settlements, historically built, are substantiated by the principles of recognition of rights to traditional populations, they are in a condition of complexity to the resolution of conflicts in its urban dimension and lead to an impairment of natural sites. This work questions how the instruments of land use and occupation are defined and relate to environmental planning, especially considering that the settlements are located in Permanent Preservation Areas (APP). It aims to further the discussion of the urban dimension in settlements, characterizing its formation and growth process, to identify the gaps and convergences between the Urban and Environmental Policy, under the foundations of a socio-environmental approach. The results spotlights the conflicts between occupation and natural areas, inferring that the definition of Urban Policies instruments and its integration with Environmental Policies instruments account for essential and priority actions to the achievement to the rights to a sustainable city, as determined in the Cities Statute and environmental protection goals, defined for the Conservation Units

This work was developed in the research line: "The habitus of study: builder of a new reality in the basic education of metropolitan area Natal" which is being developed with the support of CAPES by the Centre for Education. Acts, especially the problem of academic performance of students in basic education of the public in the Metropolitan Region of Natal (RMN). Thus, the aim of this paper is to construct a typology of students in the 9th year of basic education, attending the public schools (state or municipal) of MRN, 2009, and assess, according to these profiles, what personal characteristics student and their families: economic, social and cultural capital as well as teaching practices create environments capable of favoring a good educational development as measured by the performance obtained in the assessments in mathematics and English language. The data used were provided through the microdata Brazil Exam 2009 held by INEP. We used the methods Grade of Membership (GoM) for construction of profiles relevance of students according to the characteristics already mentioned. With these profiles was verified, which were effectively generating good performance in school curriculum components evaluated. The findings indicate that students belonging to the profile considered good environment, able to achieve better school performance both in Portuguese as in Mathematics, compared to the extreme profiles and adverse deficit

Brazilian law passes through a crisis of effectiveness commonly attributed to the extravagance of fundamental rights and public shortage. However, public finances are not dogmatically structured to solve the conflicts around the limitations of public spending. There are ethical conditioning factors, like morality, proportionality and impartiality, however, these principles act separately, while the problem of public shortage is holistic. Also, the subjectivity of politics discretionary in the definition of public spending, which is supported in an indeterminate concept of public interest, needs material orientation about the destination of public funds, making it vulnerable to ideological manipulation, resulting in real process of catching rights. Not even the judicial activism (such as influx of constitutionalism) is shown legally appropriate. The Reserve of Possible, also presents basic ethical failure. Understanding the formation of public shortage is therefore essential for understanding the crisis of effectiveness of state responsibilities, given the significant expansion of the state duty of protection, which does not find legal technique of defense of the established interests. The premise of argument, then, part of the possibility of deducting minimal model ethical of desire to spend (public interest) according to objective parameters of the normative system. Public spending has always been treated disdainfully by the Brazilian doctrine, according to the legal character accessory assigned to the monetary cost. Nonetheless, it is the meeting point between economics and law, or is in the marrow of the problem of public shortage. Expensive Subjects to modernity, as the effectiveness of fundamental rights, pass necessarily an ethical legal system of public spending. From the ethical principles deducted from the planning, only the democratic principle guides the public spending through the approval of public spending in the complex budget process. In other words, there is an ethical distancing of economic reality in relation to state responsibilities. From the dogmatic belief of insufficiency, public spending is evaluated ethically, according to the foundations of modern constitutionalism, in search of possible of the financial reserve, certain that the ethics of public economy is a sine qua non condition for legal ethics.

With a focus on the need for effectiveness of fundamental rights of persons with disabilities, this dissertation held a scientific research to analyze the degree of implementation of reservation of positions and public jobs to people with disabilities in the Brazilian State, because the 1988 Federal Constitution expressly determined such a reservation in your article 37, VIII. Highlight that this subject is enough evidence, given the large number of open public competition in recent years in Brazil, as well as recent proposals to grant equal rights to blacks (Bill nº 6,738/2013). In addition, the wording the constitutional device comes fomenting heated discussions on the subject, which are flowing on the doors of the judiciary and are spicy because such protection Microsystem vulnerable group has several gaps in the regulation of this policy. However, the research produced, unlike other related theme, does not address the problem of inefficiency in its constitutional theory, that is, abstractly, but also focuses on a specific analysis of this ineffectiveness within Brazilian society, so that research based on a bibliographical analysis, plus a study case law, at the national level, as well as in field research, while case study, focusing on the technique of the analysis of everyday life, because it was believed that the degree of realization of the constitutional norm debated is not yet a satisfactory degree of effectiveness.
