Mineral exploration programmes around the world use data from remote sensing, geophysics and direct sampling. On a regional scale, the combination of airborne geophysics and ground-based geochemical sampling can aid geological mapping and economic minerals exploration. The fact that airborne geophysical and traditional soil-sampling data are generated at different spatial resolutions means that they are not immediately comparable due to their different sampling density. Several geostatistical techniques, including indicator cokriging and collocated cokriging, can be used to integrate different types of data into a geostatistical model. With increasing numbers of variables the inference of the cross-covariance model required for cokriging can be demanding in terms of effort and computational time. In this paper a Gaussian-based Bayesian updating approach is applied to integrate airborne radiometric data and ground-sampled geochemical soil data to maximise information generated from the soil survey, to enable more accurate geological interpretation for the exploration and development of natural resources. The Bayesian updating technique decomposes the collocated estimate into a production of two models: prior and likelihood models. The prior model is built from primary information and the likelihood model is built from secondary information. The prior model is then updated with the likelihood model to build the final model. The approach allows multiple secondary variables to be simultaneously integrated into the mapping of the primary variable. The Bayesian updating approach is demonstrated using a case study from Northern Ireland where the history of mineral prospecting for precious and base metals dates from the 18th century. Vein-hosted, strata-bound and volcanogenic occurrences of mineralisation are found. The geostatistical technique was used to improve the resolution of soil geochemistry, collected one sample per 2 km2, by integrating more closely measured airborne geophysical data from the GSNI Tellus Survey, measured over a footprint of 65 x 200 m. The directly measured geochemistry data were considered as primary data in the Bayesian approach and the airborne radiometric data were used as secondary data. The approach produced more detailed updated maps and in particular maximized information on mapped estimates of zinc, copper and lead. Greater delineation of an elongated northwest/southeast trending zone in the updated maps strengthened the potential to investigate stratabound base metal deposits.

This article assesses the effect that leveraging civilian defense force militias has on the dynamics of violence in civil war. We argue that the delegation of security and combat roles to local civilians shifts the primary targets of insurgent violence toward civilians, in an attempt to deter future defections, and re-establish control over the local population. This argument is assessed through an analysis of the Sunni Awakening and ancillary Sons of Iraq paramilitary program. The results suggest that at least in the Al-Anbar province of Iraq, the utilization of the civilian population in counterinsurgent roles had significant implications for the targets of insurgent violence.

We present new Herschel photometric and spectroscopic observations of Supernova 1987A, carried out in 2012. Our dedicated photometric measurements provide new 70 mu m data and improved imaging quality at 100 and 160 mu m compared to previous observations in 2010. Our Herschel spectra show only weak CO line emission, and provide an upper limit for the 63 mu m [O-I] line flux, eliminating the possibility that line contaminations distort the previously estimated dustmass. The far-infrared spectral energy distribution (SED) is well fitted by thermal emission from cold dust. The newly measured 70 mu m flux constrains the dust temperature, limiting it to nearly a single temperature. The far-infrared emission can be fitted by 0.5 +/- 0.1M(circle dot) of amorphous carbon, about a factor of two larger than the current nucleosynthetic mass prediction for carbon. The observation of SiO molecules at early and late phases suggests that silicates may also have formed and we could fit the SED with a combination of 0.3M(circle dot) of amorphous carbon and 0.5M(circle dot) of silicates, totalling 0.8M(circle dot) of dust. Our analysis thus supports the presence of a large dust reservoir in the ejecta of SN 1987A. The inferred dust mass suggests that supernovae can be an important source of dust in the interstellar medium, from local to high-redshift galaxies.

This article examines how civilian defense militias shape violence during civil war. We define civilian defense forces as a sedentary and defensive form of pro-government militia that incumbents often use to harness the participation of civilians during a counterinsurgency campaign. We argue that civilian defense forces reduce the problem of insurgent identification. This leads to a reduction in state violence against civilians. However, we also claim that these actors undermine civilian support for insurgents, which leads to an increase in rebel violence against civilians and overall intensification of conflict. A statistical analysis of government and rebel violence against civilians from 1981 to 2005, and a qualitative assessment of a civilian defense force operating in Iraq from 2005 to 2009, offer strong support for our theoretical claims. These findings provide further insight into pro-government militias and their effects on violence. They also have wider ethical implications for the use of civilian collaborators during civil war.

A biostratigrafia de dinoflagelados, do Jurássico da Bacia Algarvia e do Afloramento Mesozoico da Carrapateira, foi efetuada com base no estudo palinológico de 482 amostras, provenientes de quinze sucessões margo-calcárias da sub-bacia ocidental, sub-bacia oriental e de duas sondagens offshore da Bacia Algarvia, e da Baía das Três Angras no Afloramento Mesozoico da Carrapateira. As amostras recolhidas do Jurássico Inferior revelaram-se pobres em palinomorfos devido, principalmente, à natureza dolomítica destas sucessões carbonatadas. Os resíduos orgânicos das amostras pertencentes ao Jurássico Médio e Superior são, geralmente, abundantes e possuem palinomorfos bem preservados. Foram identificadas 57 espécies de quistos de dinoflagelados, 5 espécies de esporos, 9 espécies de pólenes, 1 género de acritarcas e 1 género de algas. Os novos dados palinostratigráficos, com base em quistos de dinoflagelados, são consistentes com as Cronozonas de amonites descritas para estas sucessões. As palinofloras de dinoflagelados revelam afinidades com a província do Tétis. Na Bacia Algarvia não foi registada a presença das principais formas marcadoras das biozonas do NW da Europa e as associações recuperadas revelaram-se significativamente menos diversas do que associações contemporâneas conhecidas noutros locais. Este facto estará relacionado com fatores paleogeográficos e com as condições restritas que prevaleceram na Bacia Algarvia durante o Jurássico. A partir da análise de palinofácies verificou-se a existência de uma grande similaridade entre os ambientes deposicionais em todas as sucessões analisadas, verificando-se a existência de uma variação entre ambientes de plataforma proximal a intermédia, sempre com forte influência continental. Os perfis quimiostratigráficos,de δ13C e δ18O, obtidos da análise de rocha total, das sucessões carbonatadas do Bajociano superior - Kimmeridgiano inferior, mostram uma tendência geral semelhante às curvas δ13C e δ18O globais para este intervalo, no domínio tetisiano. Excursões negativas de δ13C foram observadas em Benaçoitão e na Baía das Três Angras. No entanto, estes terão sido eventos locais, que não têm relação com a curva global δ13C, tendo sido interpretados como o resultado da entrada de grande quantidade de 12C para a bacia, cuja origem pode estar associada à degradação e oxidação da matéria orgânica e/ou meteorização das áreas continentais em consequência de variações do nível do mar.

This article reconsiders the House of Lords decision in Rees v. Darlington Memorial Hospital NHS Trust (2003) and the decision to award a conventional award of £15,000 in all cases of failed sterilisation resulting in the birth of an unwanted child. In so doing, it briefly recites the history of the Wrongful Conception action and the unique facts of Rees. It then goes on the consider the implications of two fundamental aspects of the judgment. Firstly, it looks at the 'conventional award' itself and considers the reasoning behind the award and the effect that it has on our understanding of (particularly women's) reproductive autonomy. Secondly, it analyses the rather 'unique' judgment of Lord Scott and his decision to evaluate these cases using the possessory analogy of an unwanted foal; particular focus is given to the notion of parental 'choice' in these cases and whether mitigation (i.e. abortion or adoption) can ever be considered "reasonable".

In R v McNally, gender deception is found capable of leading to the vitiation of consent to sexual intercourse and, in so doing, places restriction on the freedom of transgendered individuals in favour of cisgendered freedom. This paper seeks to challenge the standing of this decision by adopting a combined methodological approach between Deleuzian post-structuralism and Gewirthian legal idealism. In so doing, we attempt to show that the combination offers a novel and productive approach to contentious decisions, such as that in McNally. Our approach brings together post-structuralist corporeality which conceives of the body as material and productive, and Gewirth’s ‘agent’ to conceptualise the legal body as an entity which can, and should, shape judicial reasoning. It does this by employing the criterion of categorically necessary freedom on institutionalised practical reasoning. These ‘bodies of agents’ can be conceived as the underpinning and justificatory basis for the authority of the law subject to the morally rational Principle of Generic Consistency. This egalitarian condition precedent requires individualisation and the ability to accept self-differentiation in order to return to a status, which can be validly described as “law”. Ultimately, we argue that this theoretical combination responds to a call to problematise the connection made between gender discourse and judicial reasoning, whilst offering the opportunity to further our conceptions of law and broaden the theoretical armoury with which to challenge judicial reasoning in McNally. That is, a ‘good faith’ attempt to further and guarantee transgender freedoms.

The law regulating the availability of abortion is problematic both legally and morally. It is dogmatic in its requirements of women and doctors and ignorant of would-be fathers. Practically, its usage is liberal - with s1(1)(a) Abortion Act 1967 treated as a ‘catch all’ ground - it allows abortion on demand. Yet this is not reflected in the ‘law’. Against this outdated legislation I propose a model of autonomy which seeks to tether our moral concerns with a new legal approach to abortion. I do so by maintaining that a legal conception of autonomy is derivable from the categorical imperative resulting from Gewirth’s argument to the Principle of Generic Consistency: Act in accordance with the generic rights of your recipients as well as of yourself. This model of Gewirthian Rational Autonomy, I suggest, provides a guide for both public and private notions of autonomy and how our autonomous interests can be balanced across social structures in order to legitimately empower choice. I claim, ultimately, that relevant rights in the context of abortion are derivable from this model.

As medical technology has advanced, so too have our attitudes towards the level of control we can or should expect to have over our procreative capacities. This creates a multidimensional problem for the law and family planning services in terms of access to services – whether to avoid conception or terminate a pregnancy – and the negligent provision of these services. These developments go to the heart of our perception of autonomy. Unsurprisingly, these matters also raise a moral dilemma for the law. Distinctively, discourse in this area is dominated by assertions of subjective moral value; in relation to life, to personal choice and to notions of the archetypal family. Against this, I stress that a model of objective morality can answer these challenging questions and resolve the inherent problems of legal regulation. Therefore, I argue that notions of autonomy must be based on a rational, action-based understanding of what it means to be a ‘moral agent’. I claim that from this we might support a legal standard, based on objective rational morality, which can frame our constitutional norms and our conception of justice in these contentious areas. This paper claims that the current regulation of abortion is outdated and requires radical reform. It proposes a scheme that would shift the choice towards the mother (and the father), remove the unnecessarily broad disability ground and involve doctors having a role of counsel (rather than gatekeeper).

The paper concerns the moral status of persons for the purposes of rights-holding and duty-bearing. Developing from Gewirth’s argument to the Principle of Generic Consistency (PGC) and Beyleveld et al.’s Principle of Precautionary Reasoning, I argue in favour of a capacity-based assessment of the task competencies required for choice-rights and certain duties (within the Hohfeldian analytic). Unlike other, traditional, theories of rights, I claim that precautionary reasoning as to agentic status holds the base justification for rights-holding. If this is the basis for generic legal rights, then the contingent argument must be used to explain communities of rights. Much in the same way as two ‘normal’ adult agents may not have equal rights to be an aeroplane pilot, not all adults hold the same task competencies in relation to the exercise of the generic rights to freedom derived from the PGC. In this paper, I set out to consider the rights held by children, persons suffering from mental illness and generic ‘full’ agents. In mapping the developing ‘portfolio’ of rights and duties that a person carries during their life we might better understand the legal relations of those who do not ostensibly fulfil the criteria of ‘full’ agent.

To identify common variants influencing body mass index (BMI), we analyzed genome-wide association data from 16,876 individuals of European descent. After previously reported variants in FTO, the strongest association signal (rs17782313, P = 2.9 x 10(-6)) mapped 188 kb downstream of MC4R (melanocortin-4 receptor), mutations of which are the leading cause of monogenic severe childhood-onset obesity. We confirmed the BMI association in 60,352 adults (per-allele effect = 0.05 Z-score units; P = 2.8 x 10(-15)) and 5,988 children aged 7-11 (0.13 Z-score units; P = 1.5 x 10(-8)). In case-control analyses (n = 10,583), the odds for severe childhood obesity reached 1.30 (P = 8.0 x 10(-11)). Furthermore, we observed overtransmission of the risk allele to obese offspring in 660 families (P (pedigree disequilibrium test average; PDT-avg) = 2.4 x 10(-4)). The SNP location and patterns of phenotypic associations are consistent with effects mediated through altered MC4R function. Our findings establish that common variants near MC4R influence fat mass, weight and obesity risk at the population level and reinforce the need for large-scale data integration to identify variants influencing continuous biomedical traits.

The fonds includes sixty two items of correspondence between Benjamin Woodruff Price, aka Woodruff, Ben or Uncle, and various family members, both immediate and distant cousins. Also included is business correspondence related to Price’s activities as a watchmaker and/or jeweler. Benjamin Woodruff Price was born in Thorold Township ca. 1831, the son of Joseph Price and Mary Smith. B.W. Price married Ella or Ellen McGlashan (1851-1906) ca. 1868. Price died between 1891 and 1901, his burial location is unknown at present. A watchmaker and jeweler, Price lived most of his life in Fonthill, Ont. He also included auctioneer, undertaker and photographer as some of his other professional activities. His siblings included David Smith Price (wife Isabella Ann), John Smith Price (wife Elizabeth Jane), and sisters Susan Page (husband Edward Rice Page), Jerusha Price, Mary Price and Martha W. Stone (husband Dudley Ward Stone). John Smith Price died 18 April 1860, leaving no descendents. It is likely that G.W. Stone was a nephew to B.W. Price, the son of his sister Martha W. Stone and her husband Dudley Ward Stone. Susan Page was a sister of Benjamin Woodruff Price. She was married to Edward Rice Page and they had at least two children, Joseph and Clayton. At the time of this correspondence they lived in Suspension Bridge, NY, now part of Niagara Falls, New York. Edward Rice Page’s occupation was listed as saloon keeper. The Price family appears to have had a very large extended family. This information was gleaned from the contents of letters of Maggie Tisdale, daughter of Ephraim and Hannah (Price) Tisdale, P.A. or Ann Morgan, [may also be Phebe Ann] of Newark, NY? and Marietta House of Bayham Township. DeWitt Higgins of Suspension Bridge, NY aka Niagara Falls, NY was an auctioneer, specialized in buying jewellery, watches, clocks, from individuals and reselling his product to others like B.W. Price.

Le pouvoir de détenir une personne à des fins d'enquête n'est pas une technique d'investigation nouvelle et tire son origine du droit anglais. Mais cette méthode d'enquête, qui consiste à restreindre temporairement la liberté de mouvement d'une personne que l'on soupçonne pour des motifs raisonnables d'être impliquée dans une activité criminelle, ne fut reconnue officiellement au Canada qu'en juillet 2004 suite au jugement rendu par la Cour suprême dans l'affaire R. c. Mann. Au moment d'écrire ces lignes, cette stratégie d'enquête policière ne fait toujours pas l'objet d'une réglementation spécifique au Code criminel. L'approbation de cette technique d'enquête, en l'absence de toute forme de législation, ne s'est pas faite sans critiques de la part des auteurs et des commentateurs judiciaires qui y voient une intrusion dans un champ de compétences normalement réservé au Parlement. L'arrêt Mann laisse également en suspens une question cruciale qui se rapporte directement aux droits constitutionnels des citoyens faisant l'objet d'une détention semblable: il s'agit du droit d'avoir recours sans délai à l'assistance d'un avocat. Le présent travail se veut donc une étude approfondie du concept de la détention à des fins d'enquête en droit criminel canadien et de son impact sur les droits constitutionnels dont bénéficient les citoyens de notre pays. Pour accomplir cette tâche, l'auteur propose une analyse de la question en trois chapitres distincts. Dans le premier chapitre, l'auteur se penche sur le rôle et les fonctions dévolus aux agents de la paix qui exécutent leur mission à l'intérieur d'une société libre et démocratique comme celle qui prévaut au Canada. Cette étude permettra au lecteur de mieux connaître les principaux acteurs qui assurent le maintien de l'ordre sur le territoire québécois, les crimes qu'ils sont le plus souvent appelés à combattre ainsi que les méthodes d'enquête qu'ils emploient pour les réprimer. Le deuxième chapitre est entièrement dédié au concept de la détention à des fins d'enquête en droit criminel canadien. En plus de l'arrêt R. c. Mann qui fera l'objet d'une étude détaillée, plusieurs autres sujets en lien avec cette notion seront abordés. Des thèmes tels que la notion de «détention» au sens des articles 9 et 10b) de la Charte canadienne des droits et libertés, la différence entre la détention à des fins d'enquête et l'arrestation, les motifs pouvant légalement justifier une intervention policière de même que les limites et l'entendue de la détention d'une personne pour fins d'enquête, seront aussi analysés. Au troisième chapitre, l'auteur se consacre à la question du droit d'avoir recours sans délai à l'assistance d'un avocat (et d'être informé de ce droit) ainsi que du droit de garder le silence dans des circonstances permettant aux agents de la paix de détenir une personne à des fins d'enquête. Faisant l'analogie avec d'autres jugements rendus par nos tribunaux, l'auteur suggère quelques pistes de solutions susceptibles de combler les lacunes qui auront été préalablement identifiées dans les arrêts Mann et Clayton.
