Posterior ao Tratado de Madrid (1750), o governo do Marquês de Pombal (1750-1777) implanta o projeto moderno nacional de caráter imperial nas colônias portuguesas. O Tratado de Madrid reconhecia a situação real na América Latina e encaminhou o trabalho das comissões de limites. O capitão-geral, na época do Estado do Grão-Pará e Maranhão, Francisco Xavier Mendonça Furtado foi ator decisivo do projeto político e militar, segurando a região à coroa portuguesa, e executava o projeto pombalino contra os jesuítas ("Estado de Deus") e as condições agrestes da região. A partir dos traços que o empreendimento político e ideológico deixou, o nosso estudo compara três vozes: as cartas do Governador Francisco Xavier de Mendonça Furtado, a obra do escritor paraense Dalcídio Jurandir e a trilogia romanesca de Alfred Döblin, a fim de analisar como as incursões ideológica e estética configuram a mediação entre a realidade histórica e a representação nas narrativas de ficção. Essa comparação se realiza no contexto de uma região que liberou as mais altas e fecundas fantasias da historia cultural da humanidade (as Amazonas, El Dorado, o tesouro do Rei Salomão e o boom da borracha), a fim de traçar as fantasmagorias diante das ruínas da realidade, confrontar o imaginário coletivo e a ficcionalização individual.

This study deals with the protection of social rights in Europe and aims to outline the position currently held by these rights in the EU law. The first two chapters provide an overview of the regulatory framework in which the social rights lie, through the reorganisation of international sources. In particular the international instruments of protection of social rights are taken into account, both at the universal level, due to the activity of the United Nations Organisation and of its specialized agency, the International Labour Organization, and at a regional level, related to the activity of the Council of Europe. Finally an analysis of sources concludes with the reconstruction of the stages of the recognition of social rights in the EU. The second chapter describes the path followed by social rights in the EU: it examines the founding Treaties and subsequent amendments, the Charter of Fundamental Social Rights of Workers of 1989 and, in particularly, the Charter of Fundamental Rights of the European Union, the legal status of which was recently treated as the primary law by the Treaty of Lisbon signed in December 2007. The third chapter is, then, focused on the analysis of the substantive aspects of the recognition of the rights made by the EU: it provides a framework of the content and scope of the rights accepted in the Community law by the Charter of Fundamental Rights, which is an important contribution to the location of the social rights among the fundamental and indivisible rights of the person. In the last section of the work, attention is focused on the two profiles of effectiveness and justiciability of social rights, in order to understand the practical implications of the gradual creation of a system of protection of these rights at Community level. Under the first profile, the discussion is focused on the effectiveness in the general context of the mechanisms of implementation of the “second generation” rights, with particular attention to the new instruments and actors of social Europe and the effect of the procedures of soft law. Second part of chapter four, finally, deals with the judicial protection of rights in question. The limits of the jurisprudence of the European Union Court of Justice are more obvious exactly in the field of social rights, due to the gap between social rights and other fundamental rights. While, in fact, the Community Court ensures the maximum level of protection to human rights and fundamental freedoms, social rights are often degraded into mere aspirations of EU institutions and its Member States. That is, the sources in the social field (European Social Charter and Community Charter) represent only the base for interpretation and application of social provisions of secondary legislation, unlike the ECHR, which is considered by the Court part of Community law. Moreover, the Court of Justice is in the middle of the difficult comparison between social values and market rules, of which it considers the need to make a balance: despite hesitancy to recognise the juridical character of social rights, the need of protection of social interests has justified, indeed, certain restrictions to the free movement of goods, freedom to provide services or to Community competition law. The road towards the recognition and the full protection of social rights in the European Union law appears, however, still long and hard, as shown by the recent judgments Laval and Viking, in which the Community court, while enhancing the Nice Charter, has not given priority to fundamental social rights, giving them the role of limits (proportionate and justified) of economic freedoms.

Le ragioni della delocalizzazione sono molteplici e di differente natura. Si delocalizza, in primo luogo, per ragioni di stampo economico, finanziario eccetera, ma questa spinta naturale alla delocalizzazione è controbilanciata, sul piano strettamente tributario, dall’esigenza di preservare il gettito e da quella di controllare la genuinità della delocalizzazione medesima. E’ dunque sul rapporto tra “spinte delocalizzative” dell’impresa, da un lato, ed esigenze “conservative” del gettito pubblico, dall’altro, che si intende incentrare il presente lavoro. Ciò alla luce del fatto che gli strumenti messi in campo dallo Stato al fine di contrastare la delocalizzazione (più o meno) artificiosa delle attività economiche devono fare i conti con i principi comunitari introdotti con il Trattato di Roma e tratteggiati negli anni dalla giurisprudenza della Corte di Giustizia. In quest’ottica, la disciplina delle CFC costituisce un ottimo punto di partenza per guardare ai fenomeni di produzione transnazionale della ricchezza e agli schemi di ordine normativo preposti alla tassazione di codesta ricchezza. Ed infatti, le norme sulle CFC non fanno altro che omogeneizzare un sistema che, altrimenti, sarebbe lasciato alla libera iniziativa degli uffici fiscali. Tale “normalizzazione”, peraltro, giustifica le esigenze di apertura che sono incanalate nella disciplina degli interpelli disapplicativi. Con specifico riferimento alla normativa CFC, assumono particolare rilievo la libertà di stabilimento ed il principio di proporzionalità anche nella prospettiva del divieto di abuso del diritto. L’analisi dunque verterà sulla normativa CFC italiana con l’intento di comprendere se codesta normativa, nelle sue diverse sfaccettature, possa determinare situazioni di contrasto con i principi comunitari. Ciò anche alla luce delle recenti modifiche introdotte dal legislatore con il d.l. 78/2009 in un quadro normativo sempre più orientato a combattere le delocalizzazioni meramente fittizie.

Questa ricerca intende esaminare l'impatto della circolazione transfrontaliera dei servizi sul bilanciamento tra regole di mercato e politiche sociali. L'analisi di questa tensione costituisce il punto di partenza per una riflessione più ampia che si propone di comprendere come la conciliazione tra solidarietà e competitività e, più generalmente, tra esigenze di protezione sociale degli Stati membri e tradizionali competenze comunitarie nell'ambito del mercato comune, possa operare nel settore dei servizi. Un mercato comune dei servizi in costante espansione in senso transfrontaliero ha indubbiamente effetti non trascurabili sul piano sociale ed in particolare sul diritto del lavoro consolidatosi nelle tradizioni costituzionali degli Stati membri. La necessità di conciliare solidarietà e competitività alla base del concetto di economia sociale ed il rinnovato accento sulla dimensione sociale dell'Unione accolto nel Trattato di Lisbona dovrebbero promuovere una convivenza armoniosa tra un'integrazione europea di carattere principalmente economico ed i residui spazi di intervento statale a tutela dei mercati nazionali del lavoro. Prima di analizzare cause ed effetti di tale potenziale conflitto nell'ambito del mercato europeo dei servizi risulta necessario fornire un panorama del quadro normativo applicabile agli operatori economici che intendano fornire a titolo temporaneo una prestazione in uno Stato membro diverso da quello di stabilimento. Nell'ambito di tale disamina, dedicata alle fonti conflittuali del diritto europeo applicabili ai prestatori di servizi, individueremo le condizioni che devono rispettare gli operatori per esercitare un'attività in uno Stato membro diverso da quello di origine (Parte I). Potremo quindi illustrare come l'esercizio delle libertà comunitarie di circolazione da parte delle imprese europee abbia fatto emergere le contraddizioni ed i limiti del funzionamento del mercato comune rispetto alla fruizione dei diritti sociali da parte dei lavoratori locali e distaccati (Parte II).

There has been much commentary about the re-ordering of the relations between nation state government, geographical territory, and populations in the advanced liberal democracies. This is seen as a product of: increasing demographic and cultural diversity due to legal and illegal migration; economic, cultural, and political global interdependence; footloose mobility of capital and the outsourcing of jobs to poorer countries; the growing power of international corporations and financial markets; and the growth of supra-national bodies like the European Union and The North Atlantic Free Trade Association, the World Trade Organisation, and (debatably), the UN. These developments are held to be associated with the gradual demise of the model of the increasingly secular nation state first crystallised by the Treaty of Westphalia in 1648. This conception provided a mutual, guarantee of states’ jurisdiction over territory and populations through their legitimated attempts to monopolise the use of force. Though, the relations between these states have always been asymmetrical and often challenged (Hunter 1998).

Obwohl der Ursprung der europäischen Einigungsgeschichte im wirtschaftlichen Bereich lag, hatte die Integration von Beginn an auch politischen Charakter. Schon die römischen Verträge enthielten Ansätze einer Konstitutionalisierung und auch die Bezeichnung der Verträge als Verfassung wurde seit den 60er-Jahren unter Rechtswissenschaftlern immer gebräuchlicher, auch wenn dies stets umstritten war. Unabhängig vom Streit über den Verfassungsbegriff hat die von den Verträgen gebildete Rechtsordnung jedenfalls inhaltlich Verfassungscharakter. Sie enthält Regelungen, die man gemeinhin mit einer Staatsverfassung verbindet. Die europäische Integration war stets von verfassungsrechtlichen Idealen getragen, weshalb man die Mitgliedstaaten auch als eine Verfassungsrechtsgemeinschaft bezeichnen kann. Bedeutende Weiterentwicklungen erfuhr der Konstitutionalisierungsprozess mit der Konventsmethode und der Erarbeitung der Grundrechte-Charta. Fortgesetzt wurde dieser Prozess mit dem Entwurf über den Verfassungsvertrag für Europa. Da in ihm typische Gehalte einer Verfassung verkörpert sind, verdient er durchaus auch diese Bezeichnung. Auf seiner Basis sollte ein schlanker, übersichtlicher und verständlicher Verfassungstext geschaffen werden, der die Reform und Integration Europas weiter führt und ein Instrument der Identitätsstiftung sein kann.

In October 1930, violent action of the Polish security forces against the Ukrainian population in Eastern Galicia resulted in an international campaign for the Ukrainians in Poland. Its central claim was the condemnation of these incidents as a violation of the Minorities Treaty of the League of Nations. The article focuses on the involved British extra-parliamentary groups and their international federations as well as leftist intellectuals, socialist parties and the Labour and Socialist International. In most cases, the commitment of the activists was motivated by the desire to expose a humanitarian scandal while the implementation of minority rights played a minor role. When it turned out that the first reports had presented an exaggerated version of the events, they shifted their focus to the Polish opposition whose persecution started in November 1930.

Construidas por viajeros norteamericanos que llegan a Puerto Rico para registrar el cambio de dominación y el rostro isleño, las imágenes verbales e iconográficas seleccionadas exhiben los poderes de una mirada imperial que justifica el programa expansionista y colonizador, subrayando los relieves de una tierra dominable, dispuesta a entregarse al nuevo amo.

Submarine canyon systems provide a heterogeneous habitat for deep-sea benthos in terms of topography, hydrography, and the quality and quantity of organic matter present. Enhanced meiofauna densities as found in organically enriched canyon sediments suggest that nematodes, as the dominant metazoan meiobenthic taxon, may play an important role in the benthic food web of these sediments. Very little is known about the natural diets and trophic biology of deep-sea nematodes, but enrichment experiments can shed light on nematode feeding selectivity and trophic position. An in-situ pulse-chase experiment (Feedex) was performed in the Nazaré Canyon on the Portuguese margin in summer 2007 to study nematode feeding behaviour. 13C-labelled diatoms and bacteria were added to sediment cores which were then sampled over a 14-day period. There was differential uptake by the nematode community of the food sources provided, indicating selective feeding processes. 13C isotope results revealed that selective feeding was less pronounced at the surface, compared to the sediment subsurface. This was supported by a higher trophic diversity in surface sediments compared to the subsurface, implying that more food items may be used by the nematode community at the sediment surface. Predatory and scavenging nematodes contributed relatively more to biomass than other feeding types and can be seen as key contributors to the nematode food web at the canyon site. Non-selective deposit feeding nematodes were the dominant trophic group in terms of abundance and contributed substantially to total nematode biomass. The high levels of 'fresh' (bioavailable) organic matter input and moderate hydrodynamic disturbance of the canyon environment lead to a more complex trophic structure in canyon nematode communities than that found on the open continental slope, and favours predator/scavengers and non-selective deposit feeders.
