Wśród niematerialnych potrzeb ludzkich do najważniejszych, z punktu widzenia polityki społecznej, należy potrzeba bezpieczeństwa. Stąd takim istotnym problemem jest gwarantowanie obywatelom poczucia bezpieczeństwa socjalnego. Choć z jednej strony, rozwój gospodarczy przynosi za sobą wzrost zamożności społeczeństwa, a co za tym idzie, wzrost poczucia bezpieczeństwa socjalnego, z drugiej strony w społeczeństwie nadal występują osoby i grupy, które, z różnych powodów, nie korzystają z owoców owego postępu. Dotyczy to zwłaszcza tych, którzy maja ograniczony dostęp do podstawowych dóbr i usług powszechnie przysługujących. Ta kategoria osób – to osoby wykluczone, czy też marginalizowane społecznie. Dla wykluczenia społecznego najbardziej charakterystyczne są trzy cechy: niski poziom uczestnictwa w życiu społecznym, długotrwałość i niedobrowolność takiej sytuacji, ograniczenie możliwości korzystania z podstawowych praw obywatelskich. Kwestia wykluczenia społecznego od niedawna została uznana przez Unię Europejską za jeden z podstawowych problemów społecznych. Stąd ogłoszenie roku 2010 Europejskim Rokiem Walki z Ubóstwem i Wykluczeniem Społecznym i podjęcie konkretnych działań w celu ograniczenia tych zjawisk. Daje to nadzieję, że tak w Unii Europejskiej, jak i w Polsce uda się zmniejszyć ilościowe rozmiary wykluczenia społecznego.

It is difficult, even excruciating, to imagine the staggering descent from high optimism to despondency experienced by many African Americans who lived between emancipation and the dawn of the twentieth century. For historians living in the post–civil rights era, recapturing the scale, velocity, and brutality of that dramatic fall has been hampered by two conceptual problems. The first of these, undergirded by prominent trends in the formerly “new” social history, is a widely shared enthusiasm for illuminating those hidden corners of daily life where men and women on the receiving end of Jim Crow continued to wield a degree of control. “Agency” has been the buzzword for a generation of scholarship that emphasizes the staying power and persistence of black Southerners in the face of relentless assaults on their social and economic status, their civil rights, and even, at times, their collective existence. This is, in many ways, an understandable reaction to an earlier consensus that relegated black historical initiative to the margins of a national fable cleansed of unseemly violence and sharp social conflict, but it can also be problematic.

Is equality valuable? This question dominates many discussions of social justice, which tend to center on whether certain forms of distributive equality are valuable, such as the equal distribution of primary social goods. But these discussions often neglect what is known as social or relational equality. Social equality suggests that equality is foremost about relationships and interactions between people, rather than being primarily about distribution.

A number of philosophers have written about the significance of social equality, and it has also played an important role in real-life egalitarian movements, such as feminism and civil rights movements. However, as it has been relatively neglected in comparison to the debates about distributive equality, it requires much more theoretical attention. This volume brings together a collection of ten original essays which present new analyses of social and relational equality in philosophy and political theory. The essays analyze the nature of social equality, as well as its relationship to justice and politics.

Readership: The book is primarily aimed at professionals in the field - philosophers (especially in moral, social and political philosophy) and political theorists. It is also aimed at the academic library market. The assumption that US policy toward Africa was characterized by continuity during the cold war has recently been challenged by scholars who argue that President John F. Kennedy embarked on an African policy that was distinct from his predecessors. This may be true for black Africa, but Kennedy’s support for African nationalism did not extend to South Africa. This article reveals that Kennedy’s cold war priorities ensured continuity in US policy toward the apartheid state and, in some cases, additional cooperation as cold war crises increased the perceived importance of South Africa as an ideological and strategic ally and bastion against communism on a rapidly changing continent. This article also explores the role South Africa’s apartheid government played in this cold war alliance. The ruling National Party recognized its importance to US foreign policy goals and used this to stave off serious American criticism of its racial policies, deflect attention in the United Nations, and ensure continued economic and military cooperation with the United States.

For persons with disabilities, the activities that able-bodied people take for granted can be major, often insurmountable challenges. Attempting to enter a restaurant for lunch with friends can result in lengthy and adversarial litigation if the facility is not accessible to a person with a disability or other mobility impairment. This litigation would be initiated after the individual was effectively refused service; a refusal based on hislher personal physical characteristics. If a shopping mall is not equipped with "access amenities", then the disabled person may be excluded from shopping there and thus exercising consumer freedom. If workplaces are not equipped to accommodate the access needs of persons with disabilities, then those people are effectively barred from gainful employment there. If a municipal goveniment building is inaccessible to disabled persons, then they may be excluded from participating in council meetings. These are all activities that the majority of the population enjoys as a matter of course, in that they represent the functions of a free citizen in a free society. If a person is excluded from such activities because of some personal characteristic, then that person is subjected to differential or discr~minatory treatment. The guarantees provided in Canadian feden! and provincial rights legislation, are such that people are not to be discriminated againsL Where buildings and facilities othen\iise open to the public are not accessible for persens with disabilities, then those people are being discriminated against. To challenge these discriminatory practices, individuals initiate complaints through the administrative justice system. To address the extent to which this is a problem, many sources were consulted. Constitutional lawyers, tribunal members, advocates for the disabled and land use planners were interviewed. Case law and legislation were reviewed. Literature on citizenship theory, dispute resolution and dispute avoidance was compiled and assessed. And, the field of land use planning was analyzed (drawing on the WTiter's educational and experiential background) as a possible alternative method for effecting systemic access for persons with disabilities. The conclusion of this study is that there does exist a proactive method for assuring access, a method that can apply the systemic remedy needed to deal with this problem. The current method, which is an adversarial and piecemeal complaint process, has proven ineffective in remedying this discrimination problem~ Failure to provide an appropriate remedy means that persons with disabilities will not enjoy the degree of citizen status enjoyed by the able-bodied. This is the current circumstance, and since equity is the aim of rights legislation, and since such legislative and administrative frameworks have failed in that purpose, then an alternative method is necessary. An alternative model is the one in which land use planning is based. It has conflict avoidance and conflict minimization as underpinnings. And, most importantly, land use planning is already a proyen method of combatting discrimination.

People with intellectual disabilities (ID) are more likely to be victims of abuse and human rights violations than people without ID. The 3Rs: Rights, Respect, and Responsibility project has developed and is testing a human rights training program for adults with ID. The current project was conducted to make recommendations to adapt the 3Rs rights training program to be used with youth with ID and their families. An interpretive phenomenological framework was employed to investigate youth with ID, parents', and siblings' perceptions of the i r experiences with choice making, an enactment of rights, in the family context. Thematic analysis of interviews revealed that, consistent with previous research, family members consider family values, conventions, and family members' well being when making decisions. A training program should promote a consideration of expanded opportunities for youth with ID to make choices and should be flexible to address individual families' cultures, needs, and desires.

Le législateur a introduit, à la fin des années 1980, une institution permettant à tout individu majeur et apte de confier, advenant son inaptitude, son bien-être, la gestion de ses biens et, de façon générale, sa protection à une personne en qui il a confiance. Cette institution s’appelle le mandat donné en prévision de l’inaptitude du mandant. Toutefois, les besoins du mandant ne peuvent être déterminés avec précision avant la survenance de son inaptitude. Cette situation a amené une certaine doctrine, en vue d’assurer la sauvegarde de l’autonomie résiduelle du mandant, à invoquer en matière de mandat de protection les principes gouvernant les régimes de protection. Malheureusement, en l’absence de disposition expresse à cet effet, il semble que cette voie ne puisse être adoptée. En conséquence, le présent mémoire tente de démontrer que les principes énoncés à la Charte des droits et libertés de la personne et les fondements du régime contractuel prévu au Code civil du Québec permettent d’assurer la protection du mandant dans le respect de ses intérêts et de ses attentes légitimes. Cette approche concilie également le respect de l’autonomie résiduelle du mandant, de ses volontés et de son besoin de protection et assure l’efficacité de l’institution.

Comment comprendre la volonté d'appartenir à la nation américaine des Afro-Américains en dépit d'une mémoire faite d'humiliation et d'une accumulation de revers? À plusieurs reprises durant l'histoire américaine, des élites ont proposé à la communauté noire des solutions dites « radicales » qui remettent en question le paradigme dominant de l'intégration à la nation américaine. Ce mémoire tente d'identifier les raisons qui expliquent pourquoi, au cours du mouvement pour les droits civiques, les Noirs font le choix de l'intégration défendu par Martin Luther King et rejettent le séparatisme défendu par Malcolm X. La spécificité du mémoire réside dans l'utilisation de la littérature sur la formation des nations qui me permet d'étudier le choix des Afro-Américains. La nation est vue comme le produit d'une construction qui fait interagir les élites et les masses. J'étudie « par le haut » la façon dont les entrepreneurs ethniques, King et Malcolm X, redéfinissent l'américanité. J'étudie également « par le bas » comment les masses reçoivent les discours de ces élites. Ma première hypothèse se consacre à la formation de l'alliance stratégique entre King et l'exécutif américain qui permet à King de définir l'agenda législatif et d'appuyer son discours sur les gains qu'il réalise. La deuxième hypothèse se penche sur la structure des opportunités s'offrant aux Afro-Américains qui orientent le choix qu'ils font.

La Seconde Guerre mondiale était riche en possibilités d’avancement pour la population noire. Les leaders afro-américains, conscients du caractère favorable du contexte, mirent sur pied de nouvelles stratégies afin d’optimiser les gains afro-américains. L’économie de guerre favorisa les migrations internes vers les centres industriels du Nord et de l’Ouest. Les migrants noirs s’extirpaient donc du carcan contraignant du Sud où ils étaient régulièrement privés de leur droit de vote. Les leaders noirs brandirent alors un nouvel outil pour faire pression sur les deux principaux partis politiques fédéraux : le nouveau poids électoral afro-américain. La période fut aussi marquée par une hausse de l’activisme noir. Celui-ci se voyait légitimé par les idéaux de liberté et de démocratie prétendument défendus par les États-Unis. Finalement, le plein-emploi permit l’essor du statut économique noir et les leaders afro-américains tentèrent d’exploiter cette conjoncture particulière afin d’en faire bénéficier leur communauté à long terme.

Boston lawyer William P. Homans Jr. devoted his fifty-year career to the defense of the poor and downtrodden, the protection of our most basic civil liberties, and the abolition of the death penalty. Descendant of two of Boston's oldest and most prominent families, and combat veteran of both the British and American Navies during World War II, Homans became unlikely guru to the 1960s generation of radical lawyers and antiwar activists. He was on the defense team in the 1968 conspiracy trial of Dr. Benjamin Spock and four other leading opponents of the Vietnam War accused of aiding and abetting resistance to the military draft, and represented Dr. Kenneth Edelin in the 1975 manslaughter prosecution arising out of a lawful abortion performed after Roe v. Wade. The narrative contrasts Bill Homans' storied legal career with a troubled personal life in a balanced but unvarnished manner, testifying to the strength of the human spirit when committed to the pursuit of the common good. About the author: Mark S. Brodin is Professor of Law at Boston College Law School and the author of numerous books and law journal articles in the areas of civil and criminal procedure, evidence, litigation, and employment discrimination. A graduate of Columbia College (1969) and Columbia Law School (1972), he served as law clerk to United States District Judge Joseph L. Tauro and staff attorney with the Lawyers' Committee for Civil Rights in Boston. He has also practiced for brief periods as a public defender in Boston and a prosecutor in Norfolk County.

NGOs werden von einem idealtypischen, perfektionistischen, Homogenität vermittelnden Schleier umgeben, der es schwer macht, die eigentlichen definitorischen Strukturen des NGO-Begriffs zu erfassen. In meiner Dissertation konnte ich dieses in der allgemeinen Öffentlichkeit vorherrschende Image beiseite schieben und erlangte somit einen Blick auf die eigentlichen Strukturen der NGOs. Im weiteren Verlauf versuchte ich die Verortung der NGOs in der Gesellschaft zu lokalisieren. Dies stellte sich sowohl im theoretischen als auch im empirischen Teil, in dem ich Interviews ausgewertet habe, die ich zuvor mit Experten verschiedenster deutscher und brasilianischer NGOs durchführte, als äußerst schwieriges Unterfangen dar. Dies lag zum einem daran, dass abseits der von der UN 1996 aufgestellten NGO-Kriterien keine allgemeingültigen, obligatorisch normativen NGO Definitionen existieren und zum anderen, dass die NGOs und deren Arbeitsfelder so heterogen sind, dass es nahezu unmöglich ist, Definitionskriterien aufzustellen, die allen NGOs gerecht werden könnten. NGOs erbringen einen wichtigen Beitrag zur Interessenvertretung sowie zum Zusammenschluss von Benachteiligten, damit diese ihre (Bürger-) Rechte wahrnehmen und gemeinsam Veränderungen bewirken können. Anhand von Kompetenzaufbau, Ermittlung der Ursachen der Ausgrenzung und deren Beseitigung wird versucht, die Veränderungen aktiv zu gestalten. NGOs fördern somit die Selbstorganisation und bündeln die Belange der Betroffenen. Festzuhalten ist, dass die NGOs ein immens wichtiges Element in der Zivilgesellschaft darstellen. Sie sind Ausdruck des politischen, sozialen und solidarischen Wollens von Menschen, die an der Gemeinschaft teilhaben, ihre Rechte geltend machen und den Istzustand des Systems nicht mehr einfach ohne Gegenwehr hinnehmen wollen. Das zivilgesellschaftliche Engagement ist, so zeigt die wachsende Bedeutung von NGOs, ungebrochen stark. Aber es ist aufgrund seiner großen Vielfalt weder begrifflich noch organisatorisch auf einen einzigen Nenner zu bringen. Das ist offenbar die Stärke eines zivilgesellschaftlichen Engagements, das die Schwächen eines gesellschaftlichen Systems aufnimmt: Staat und Markt sind nicht die einzigen Akteure, von denen gesellschaftlicher Wandel und sozialer Friede zugleich begünstigt werden können.

Esta monografía pretende revisar la incidencia de las redes sociales, tanto tradicionales como virtuales, en el proceso de construcción del movimiento "la Ola Verde" en las elecciones presidenciales de 2010. Este movimiento se constituyó en un fenómeno político y social efímero que en pocos meses logró competir contra maquinarias políticas ya consolidadas pero que no logró la victoria electoral anhelada. Este trabajo de grado está estructurado en tres secciones las cuales nacieron a partir de una caracterización de tres etapas que atravesó la Ola Verde, estos son: la génesis, el crecimiento y el declive del movimiento. De igual manera, la presente monografía analiza el rol de las emociones en las redes sociales tradicionales y en las redes sociales virtuales (Facebook y Twitter).
