O trabalho estuda a reclamação como instrumento de controle de precedentes do Supremo Tribunal Federal e do Superior Tribunal de Justiça. O estudo se inicia com a análise do desenvolvimento do instituto desde sua origem correicional, passando por sua constitucionalização até sua previsão no novo Código de Processo Civil, que generaliza seu cabimento como meio de controle da eficácia vinculante dos precedentes. Em seguida, passamos à análise do sistema brasileiro de respeito aos precedentes, fazendo uma breve comparação com países do common law, e concluímos que, no Brasil, o efeito vinculante, assim entendida a força que torna obrigatória a observância da norma extraível das decisões judiciais, só existe se houver previsão expressa na Constituição ou na lei. Também constatamos que o sistema adotou a reclamação a ser ajuizada diretamente perante o STF e o STJ como instrumento processual de controle da observância dessa força vinculante. Verificamos que, além de valorizar a segurança jurídica, a isonomia e a justiça das decisões, a adoção de um sistema de respeito a precedentes no Brasil tem como confessado objetivo a otimização do serviço judiciário e a redução dos processos pendentes nos tribunais superiores. Todavia, a utilização da reclamação como meio de controle da eficácia vinculante dos precedentes vai de encontro àqueles objetivos, pois reatomiza os litígios sem que isso signifique maior respeito à obrigatoriedade dos precedentes.

A presente Tese analisa o incidente de resolução de demandas repetitivas. Trata-se de uma nova técnica de julgamento dos denominados processos de massa, instituída pelo Novo Código de Processo Civil. Inicialmente, procurou-se demonstrar o caminho trilhado pelo legislador brasileiro, por meio de sucessivas reformas ao Código de Processo Civil, no sentido de valorizar e tornar estável os precedentes dos Tribunais, em especial das Cortes de Superposição, chegando-se ao ápice de modificar, inclusive, a Constituição do Brasil, para esse fim. Também foi destacada a importância da uniformização de jurisprudência, que de certa maneira precedeu o novel instituto. Na sequência, apontou-se alguns aspectos relevantes, de ordem processual, do incidente, bem como os seus pressupostos de cabimento. Avaliou-se, ainda, um dos mais importantes efeitos que decorrem da admissibilidade do incidente de resolução de demandas repetitivas, no sentido de suspender os demais processos que veiculem idêntica tese jurídica e, também, como se defendeu ao longo do estudo, que guardem similitude de ordem fática. Ademais, especificou-se o procedimento de julgamento, fulcrado, principalmente, em uma notável ampliação do contraditório, que dá margem, inclusive, a que o acórdão prolatado nessa sede possa ser impugnado, via recurso especial e/ou extraordinário. Por fim, encerra-se com a análise do precedente resultante do incidente de resolução de demandas repetitivas. Explicita-se os seus efeitos, inclusive com a possibilidade de aplicação para o futuro, tendo em vista a objetivação do julgamento, voltado à definição de uma tese jurídica. No entanto, e aqui está a Tese defendida, a questão jurídica, ainda que julgada de modo abstrato, justamente para produzir efeitos mais amplos (aqui denominados expansivos), deve estar necessariamente atrelada às questões de fato que a envolvem.

O presente estudo é resultado da observação de que, em que pese o incremento do ajuizamento de ações coletivas na Justiça do Trabalho, por meio de ações civis públicas, ainda há outras ações coletivas, destinadas à defesa de direitos metaindividuais, que não vêm recebendo o mesmo tratamento. Em especial, as ações cuja pretensão é a tutela dos atos da Administração Pública, que, no contexto do Estado Democrático de Direito, deve conduzir-se em prol do bem comum e, ainda, da garantia dos direitos sociais reconhecidos constitucionalmente. Analisa-se o cabimento dessa tutela pela via do Judiciário Trabalhista, nas situações em que os fatos constantes nas causas de pedir das respectivas ações sejam atinentes a direitos relacionados ao trabalho. Isso porque, na ocorrência de pontos de interseção entre o ato administrativo e as relações de trabalho, o ramo do Judiciário constitucionalmente vocacionado a analisá-los é o Trabalhista, já que o interesse em questão não configura mero ato administrativo, mas, além disso, revela o modo como o agente estatal compreende e orienta a sua conduta, gerando a valorização ou a desvalorização de direitos trabalhistas consagrados pela Constituição Federal. Com base nesse panorama acerca do papel do Estado brasileiro contemporâneo no que diz respeito à garantia de direitos sociais e do papel do Poder Judiciário no que tange à efetivação desses direitos, bem como procedendo ao exame da natureza desses direitos, que requerem novas posturas dos operadores do direito, este trabalho se propõe a afastar concepções antigas relacionadas a argumentos de suposta violação à separação de poderes e de indevida interferência em políticas públicas. Com isso, considerando que o Poder Judiciário tem no processo seu locus de manifestação, abordam-se as principais características do processo coletivo, visando à sua diferenciação em relação ao processo individual, em face da natureza dos direitos que compõem o seu objeto. Com o foco no fortalecimento do Judiciário Trabalhista e aperfeiçoamento do Estado Democrático de Direito, ingressa-se na seara das ações populares e de improbidade administrativa, refinando-se a aplicabilidade delas a atos praticados pela Administração Pública que repercutem na esfera trabalhista. Adota-se como premissa a nova conformação dos limites da competência da Justiça do Trabalho que não mais se restringe a lides de natureza individual ou coletiva entre trabalhadores e seus tomadores de serviço, conformação essa introduzida pela Emenda Constitucional no 45/2004 para defender-se que a consecução do bem comum, levada a efeito com a observância aos princípios regentes da Administração, desafia uma nova visão, especializada no valor social do trabalho, inclusive no que se refere à qualidade dos serviços públicos. As questões apontadas possibilitam concluir sobre a necessidade de se instituir concretamente os conteúdos axiológicos e não meramente patrimoniais que compõem o patrimônio público social, em especial o valor social do trabalho, preservando-o ou restituindo-o à coletividade, por meio de ações populares e de improbidade administrativa ajuizadas perante a Justiça do Trabalho. A pesquisa mostra que se alarga a garantia ao cidadão no que tange ao uso dos valores e recursos públicos para a promoção do bem comum e a evolução da coletividade.

A região de Caçapava do Sul, no Estado do Rio Grande do Sul, compreende, principalmente, a quadrícula de mesmo nome e abrange cerca de 11.000 Km². A referida região é caracterizada pela ocorrência de um batólito granítico (Granito Caçapava) com afloramento de 25 x 10 Km, orientado no sentido N-S, e sobre o qual assenta-se a cidade supracitada. O Granito Caçapava é circundado por um cinturão de metamorfitos pertencentes à Formação Vacacaí, Grupo Porongos (Pré-Cambriano Superior) (RIBEIRO et alii, 1966). Dentre os metamorfitos situa-se um corpo de rochas carbonatadas de aspecto lenticular, com contatos nítidos, interprenetrado po apófises graníticas e com afloramento de aproximadamente 17 Km². Foram estudadas amostras deste corpo de rochas por meio de microscopia, microssonda eletrônica, difratometria e espectometria de raios X e análise química por via úmida, com o objetivo de identificar e caracterizar os minerais carbonáticos e silicáticos. Por meio de técnicas de coloração, foi possível a distinção de dolomita (Do), calcita (Cc) e calcita ferrífera (Ccf). As análises modal e química indicaram predominância de carbonatos sobre silicatos, estando estes últimos relacionados mais às bandas da rocha. Os minerais silicáticos detectados foram: talco, tremolita, diopsídio, forsterita, clorita e flogopita. Em menores quantidades aparecem titanita, apatita e quartzo, sendo comum, também, a serpentina oriunda de alteração da forsterita. Lançados em mapa, os minerais índices mostraram a existência de um zoneamento metamórfico com rochas pertencentes à Fácies Piroxênio Hornfels, próximo ao contato, e de rochas da Fácies Albita-Epídoto Hornfels, em porções mais distantes, evidenciando assim, metamorfismo térmico. Com base em diagramas T-\'X GRAUS\'C \'O IND.2\' para o sistema CaO-MgO-Si \'O IND.2\'-\'CO IND.2\'-\'H IND. 2\'O, foi analisado o metamorfismo destas rochas e estimadas as temperaturas máximas da ordem de \'560 GRAUS\'C, compatíveis com as temperaturas magmáticas do Granito Caçapava. A conclusão final advinda com os estudos ora realizados, sobre essas rochas carbonáticas, aponta no sentido de se tratarem de MÁRMORES DOLOMÍTICOS IMPUROS DE CONTATO, gerados durante o Ciclo Brasiliano (680 a 500 m.a.).

Fifty-seven white mica clasts were separated from five samples taken from near the bases of turbidites ranging in age from early Albian to middle Eocene. Twenty two (39%) of the micas have ages between 260 and 340 Ma and five (9%) have older ages (~400-600 Ma). The former age range is characteristic of the North American Alleghenian orogeny and the Iberian Variscan orogeny. The latter range is characteristic of the North American Acadian orogeny and older basement rocks in the Grand Banks and Newfoundland areas. Both age ranges are present in the middle Eocene sample, but only the younger range occurs in the middle Albian sample. This difference could be a sampling artifact. If this is not the case, then the most likely explanation is that the Acadian-aged micas within the Meguma Zone underlying the Grand Banks were totally reset by Alleghenian reactivation of the zone, a feature which occurs extensively in Nova Scotia. The addition of Acadian-aged micas in the middle Eocene sample may reflect a change in sediment provenance as drainage systems unrelated to rift topography developed. With the exception of one clast dated at 186 Ma, the 12 other micas obtained from the upper Paleocene sample yielded ages between 55 and 74 Ma, with 7 falling within ±2 m.y. of the 57-Ma age of the sample indicated by the biostratigraphic age-depth plot for Site 1276. This, together with the volcaniclastic content of the sample, indicates an input from near-contemporaneous volcanism. The nearest known occurrences of near-contemporaneous late Paleocene volcanism that could have produced white micas are in Greenland and Portugal, some 2000 and 1500 km distant, respectively, from Site 1276 during the Paleocene. However, ages of volcanism in these areas indicate that they could probably not be sources of micas younger than 60 m.y., which suggests some as-yet unknown volcanic source in the North Atlantic area. Accumulation in the Grand Banks area of airborne-transported volcaniclastic material from eruptions of slightly different ages, followed by a single resedimentation event, could account for the spread of dates obtained from the sample. White micas from the lowermost Albian sample show a spread of ages between 37 and 284 Ma that is completely different from the age distribution pattern of the middle Albian and middle Eocene samples. The sample location is between, and at least 25 m above and below, two igneous sills dated at 98 and 105 Ma. The sills have narrow thermal aureoles and ages older than the youngest detrital micas in the sample. It is unlikely, therefore, that the spread of mica ages in the sample is due to partial resetting of ages caused by thermal effects associated with the intrusion of the sills. The resetting may have been associated with a longer lived thermal event.

The Iberian Pyrite Belt (IPB), which forms part of the Variscan orogenic massif, is renowned for the magnitude and extent of its massive sulfide mineralization. The stratigraphic record of the IPB consists of Upper Palaeozoic sedimentary and igneous rocks. In ascending order, these comprise the thick Phyllite-Quartzite Group attributed to the Middle and Upper Devonian and characterized by shales and quartzites with conglomeratic and carbonate intercalations towards the top; the appreciably thinner Volcano-Sedimentary Complex, a heterogeneous uppermost Devonian-Mississippian unit embodying diverse volcanic, subvolcanic, and sedimentary rocks that host the massive sulfide deposits; and the shaly and sandy, turbiditic Culm Group (Carboniferous). This entire succession was folded and faulted during the Asturian phase of the Variscan Orogeny that gave rise to a thin-skinned type structure. The present study constitutes a detailed blostratigraphic investigation of palynologically productive samples representative of the Phyllite-Quartzite Group and the basal (anoxic) portion of the Volcano-Sedimentary Complex. These were collected from surface and mine exposures variously located in the Spanish part of the IPB; out of 282 samples processed, 117 proved to be productive palynologically. The aim of this project is to provide comprehensive palynostratigraphic data applicable to precise dating and correlation of the IPB's stratigraphic succession (i.e., of the two sampled lithostratigraphic units), which has hitherto been investigated biostratigraphically on a relatively localized basis. The results are incorporated in two successive parts. The first of these, i. e., the present paper, focuses on the systematic analysis of the terrestrial (miospore) component of the palynological assemblages. The second part, devoted to the marine, organic-walled microphytoplankton (acritarchs and prasinophytes), will evaluate the stratigraphic significance of the IPB palynofloras and their application to elucidating the geological history of the region. In the systematic-descriptive section, which occupies the bulk of this paper, 55 species of trilete miospores are described and are allocated among 34 genera, two of which (Cristicavatispora and Epigruspora) are newly instituted herein. The majority of the species are either positively identifiable or closely affiliable with previously named species. The nine newly established species are as follows: Camptozonotriletes confertus, Indotriradites diversispinosus, Cristicavatispora dispersa (type species), Epigruspora regularis (type species), Ancyrospora? implicata, Endosporites tuberosus, Rugospora explicata, Spelaeotriletes plicatus, and Teichertospora iberica.

Mudrocks and carbonates of the Isa superbasin in the Lawn Hill platform in northern Australia host major base metal sulfide mineralization, including the giant strata-bound Century Zn-Pb deposit. Mineral paragenesis, stable isotope, and K-Ar dating studies demonstrate that long-lived structures such as the Termite Range fault acted as hot fluid conduits several times during the Paleoproterozoic and Mesoproterozoic in response to major tectonic events. Illite and chlorite crystallinity studies suggest the southern part of the platform has experienced higher temperatures (up to 300 degrees C) than similar stratigraphic horizons in the north. The irregular downhole variation of illite crystallinity values provides further information oil the thermal regime in the basin and shows that clay formation was controlled not only by temperature increase with depth but also by high water/rock ratios along relatively permeable zones. K-Ar dating of illite, in combination with other data, may indicate three major thermal events in the central and northern Lawn Hill platform Lit 1500, 1440 to 1400, and 1250 to 1150 Ma. This study did not detect the earlier Century base metal mineralizing event at 1575 Ma. 1500 Ma ages are recorded only in the south and correspond to the age of the Late Isan orogeny and deposition of the Lower Roper superbasin. They may reflect exhumation of a provenance region. The 1440 to 1300 Ma ages are related to fault reactivation and a thermal pulse at similar to 1440 to 1400 Ma possibly accompanied by fluid flow, with subsequent enhanced cooling possibly due to thermal relaxation or further crustal exhumation. The youngest thermal and/or fluid-flow event at 1250 to 1150 Ma is recorded mainly to the cast of the Tern-lite Range fault and may be related to the assembly of the Rodinian supercontinent. Fluids in equilibrium with illite that formed over a range of temperatures, at different times in different parts of the platform. have relatively uniform oxygen isotope compositions and more variable hydrogen isotope compositions (delta O-18 = 3.5-9.7 parts per thousand V-SMOW; delta D = -94 to -36 parts per thousand V-SMOW). The extent of the 180 enrichment and the variably depleted hydrogen isotope compositions suggest the illite interacted with deep-basin hypersaline brines that were composed of evaporated seawater and/or highly evolved meteoric water. Siderite is the most abundant iron-rich gangue phase in the Century Zn-Pb deposit, which is surrounded by all extensive ferroan carbonate alteration halo. Modeling suggests that the ore siderite formed at temperatures of 120 degrees to 150 degrees C, whereas siderite and ankerite in the alteration halo formed at temperatures of 150 degrees to 180 degrees C. The calculated isotopic compositions of the fluids are consistent with O-18-rich basinal brines and mixed inorganic and organic carbon Sources (6180 = 3-10 parts per thousand V-SMOW, delta C-13 = -7 to -3 parts per thousand V-PDB). in the northeast Lawn Hill platform carbonate-rich rocks preserve marine to early diagenetic carbon and oxygen isotope compositions, whereas ferroan carbonate cements in siltstones and shales in the Desert Creek borehole are O-18 and C-13 depleted relative to the sedimentary carbonates. The good agreement between temperature estimates from illite crystallinity and organic reflectance (160 degrees-270 degrees C) and inverse correlation with carbonate delta O-18 values indicates that organic maturation and carbonate precipitation in the northeast Lawn Hill platform resulted from interaction with the 1250 to 1150 Ma fluids. The calculated isotopic compositions of the fluid are consistent with evolved basinal brine (delta O-18 = 5.1-9.4 parts per thousand V-SMOW; delta C-13 = -13.2 to -3.7 parts per thousand V-PDB) that contained a variable organic carbon component from the oxidation and/or hydrolysis of organic matter in the host sequence. The occurrence of extensive O-18- and C-13-depleted ankerite and siderite alteration in Desert Creek is related to the high temperature of the 1250 to 1150 Ma fluid-flow event in the northeast Lawn Hill platform, in contrast to the lower temperature fluids associated with the earlier Century Zn-Pb deposit in the central Lawn Hill platform.

The stratiform Century Zn-Pb deposit and the discordant Zn-Pb lode deposits of the Burketown mineral field, northern Australia, host ore and gangue minerals with primary fluid inclusions that have not been affected by the Isan orogeny, thus providing a unique opportunity to investigate the nature of the ore-forming brines. All of the deposits are hosted in shales and siltstones belonging to the Isa superbasin and comprise sphalerite, pyrite, carbonate, quartz, galena, minor chalcopyrite, and minor illite. According to Pb model ages, the main ore stage of mineralization at Century formed at I575 Ma, some 20 m.y. after deposition of the host shale sequence. Microthermometry on undeformed, primary fluid inclusions hosted in porous sphalerite shows that the Zn at Century was transported to the deposit by a homogeneous, Ca2+- and Na+-bearing brine with a salinity of 21.6 wt percent NaCl equiv. delta D-fluid of the fluid inclusion water ranges from -89 to -83 per mil, consistent with a basinal brine that evolved from meteoric water. Fluid inclusion homogenization temperatures range between 74 degrees and 125 degrees C, which are lower than the 120 degrees to 160 degrees C range calculated from vitrinite reflectance and illite crystallinity data from the deposit. This discrepancy indicates that mineralization likely formed at 50 to 85 Mpa, corresponding to a depth of 1,900 to 3,100 m. Transgressive galena-sphalerite veins that cut stratiform mineralization at Century and breccia-filled quartz-dolomite-sphalerite-galena veins in the discordant Zn-Pb lodes have Pb model ages between 1575 and 1485 Ma. Raman spectroscopy and microthermometry reveal that the primary fluid inclusions in these veins contain Ca2+, Na+. but they have lower salinities between 23 and 10 wt percent NaCl equiv and higher delta D-fluid values ranging from -89 to -61 per mil than fluid inclusions in porous sphalerite from Century. Fluid inclusion water from sphalerite in one of the lode deposits has delta O-18(fluid) values of 1.6 and 2.4 per mil, indistinguishable from delta O-18(fluid) values between -0.3 to +7.4 per mil calculated from the isotopic composition of coexisting quartz, dolomite, and illite. The trend toward lower salinities and higher delta D-fluid values relative to the earlier mineralizing fluids is attributed to mixing between the fluid that formed Century and a seawater-derived fluid from a different source. Based on seismic data from the Lawn Hill platform and paragenetic and geochemical results from the Leichhardt River fault trough to the south, diagenetic aquifers in the Underlying Calvert superbasin appear to have been the most likely sources for the fluids that formed Century and the discordant lode deposits. Paragenetically late sphalerite and calcite cut sphalerite, quartz, and dolomite in the lode deposits and contain Na+-dominated fluid inclusions with much lower salinities than their older counterparts. The isotopic composition of calcite also indicates delta O-18(fluid) from 3.3 to 10.7 per mil, which is larger than the range obtained from synmineralization minerals, supporting the idea that a unique fluid source was involved. The absolute timing of this event is unclear, but a plethora of Pb model, K-Ar, and Ar-40/Ar-39 ages between 1440 and 1300 Ma indicate that a significant volume of fluid was mobilized at this time. The deposition of the Roper superbasin from ca. 1492 +/- 4 Ma suggests that these late veins formed from fluids that may have been derived from aquifers in overlying sediments of the Roper superbasin. Clear, buck, and drusy quartz in veins unrelated to any form of Pb-Zn mineralization record the last major fluid event in the Burketown mineral field and form distinct outcrops and ridges in the district. Fluid inclusions in these veins indicate formation from a low-salinity, 300 degrees +/- 80 degrees C fluid. Temperatures approaching 300 degrees C recorded in organic matter adjacent to faults and at sequence boundaries correspond to K-Ar ages spanning 1300 to 1100 Ma, which coincides with regional hydrothermal activity in the northern Lawn Hill platform and the emplacement of the Lakeview Dolerite at the time of assemblage of the Rodinia supercontinent.

The objective of this study was to characterize the structural-geophysical expression of the Transbrasiliano Lineament (TBL) in the east-central portion of the Parnaíba Basin. The TBL corresponds to a major Neoproterozoic NE-trending shear zone related to the Brasiliano orogenic cycle, with dextral strike-slip kinematics, underlying (but also laterally exposed in the NE and SW basin edges) the sedimentary section of the Parnaíba Basin. In this study, the interpretation of gravity and magnetic anomaly maps is consistent with the TBL kinematics, the signature of the geophysical anomalies corresponding to the high (plastic behaviour) and subsequent declining temperature (ductile to brittle behaviour) stages during Brasiliano and late Brasiliano times. The pattern of residual gravity anomalies is compatible with an S-C dextral pair shaping the geological bodies of an heterogeneous basement, such as slices of gneisses and granulites (positive anomalies), granitic and low-medium grade metasedimentary rocks (negative anomalies). Such anomalies curvilinear trends, ranging from NNE (interpreted as S surfaces) to NE (C surfaces), correspond to flattening surfaces (S), while the NE rectilinear trend must represent a C band. The narrower magnetic anomalies also display NNE to NE (S surfaces) trends and should correspond to similar (although narrower and more discontinuous) sources in the equivalent anomaly patterns. Pre-Silurian pull-apart style grabens may contribute to the NE negative gravimetric anomalies, although this interpretation demands control by seismic data analysis. On the other hand, the curvilinear anomalies associated to contractional trends are incompatible with their interpretation as pre-Silurian graben, in both maps. In the (reduced to the pole) magnetic anomalies map, most of these are again associated to low-temperature shear zones (C planes) and faults, juxtaposing distinct blocks in terms of magnetic properties, or eventually filled with basic bodies. It is also possible that some isolated magnetic anomalies correspond to igneous bodies of late-Brasiliano or Mesozoic age. The basement late discontinuities pattern can be interpreted in analogy to the Riedel fractures model, with steep dipping surfaces and a sub-horizontal movement section. This study also explored 2D gravity modeling controlled by the interpretation of a dip seismic line as regards to the Transbrasiliano Lineament. The rock section equivalent to the Jaibaras Group occupying a graben structure (as identified in the seismic line) corresponds to a discrete negative anomaly superimposed to a gravimetric high, once again indicating a stronger influence of older crystalline basement rocks as gravimetric sources, mainly reflecting the heterogeneities and anisotropies generated at high temperature conditions and their subsequent cooling along the TBL, during the Brasiliano cycle.
