Este trabalho apresenta uma análise crítica à forma de se abordar casos jurídicos e proferir decisões judiciais denominada abordagem judicial pragmática, disseminada pelo magistrado e professor norte-americano Richard A. Posner. O objetivo é explicitar suas principais características e contornos, bem como sua repulsa pela teorização abstrata e pelos debates e argumentos morais na decisão judicial. A partir disso, pretende-se refutar parte dessa abordagem pragmática, por meio de argumentos levantados por filósofos morais e profissionais do direito a saber: Ronald Dworkin, Charles Fried, Anthony Kronman, John T. Noonan Jr e Martha C. Nussbaum - em defesa de uma abordagem que prega a inevitável utilização do raciocínio teórico, assim como a argumentação e reflexão moral na resolução de casos difíceis relacionados ao direito. Também será destacado como a repulsa pragmática pela teoria moral e abstrata é incompatível com a conjuntura justeórica contemporânea e como a análise de alguns casos difíceis expõe a falibilidade, ainda que parcial, desse estilo de abordagem pregado por Posner.

Imaginary-distance beam propagation method under the perfectly matched layer boundary condition is applied to judge single-mode behaviour of optical waveguides, for the first time to our knowledge. A new kind of silicon-on-insulator-based rib structures with half-circle cross-section is presented. The single-mode behaviour of this kind of waveguide with radius 2mum is investigated by this method. It is single-mode when the slab height is not smaller than the radius.

Artykuł koncentruje się na etycznym aspekcie „Familiaris Consortio”, zakładając równocześnie bogatą problematykę pastoralną. Pytanie etyczne, które pojawiało się wraz z ukazaniem się tego dokumentu wiązało się z nastrojami wahania i oczekiwania w wyniku ujawnienia się silnej opozycji wobec nauki zawartej w encyklice „Humanae Vitae” Pawła VI. Adhortacja nie podejmuje bezpośredniej polemiki z przeciwnikami nauki Kościoła, lecz przedstawia pozytywny wykład całościowej nauki na temat powołania małżeństwa i rodziny. Powołanie stanowi w tym dokumencie podstawową kategorię teologiczno-moralną, wyjaśniającą i uzasadniającą istotne wymogi moralne małżeństwa i rodziny i przenoszącą życie ludzkie na poziom świętości. Powołanie ma swe źródło w Boskim planie zbawienia i objawia się wraz z dokonaniem dzieła zbawienia w Jezusie Chrystusie. Tajemnica powołania uobecnia się w dziejach ludzkości jako ukryta a zarazem objawiona w misterium Chrystusa i Kościoła. Powołanie rzuca istotne światło na stworzenie mężczyzny i kobiety czyli stworzenie rodziny opartej na fundamencie małżeństwa. Odtąd prawda antropologiczna posiada wymiar sakramentalny. Powołanie przenikając wewnętrznie rzeczywistość stworzoną, umieszcza w samej głębi bytu „nie dające się stłumić wezwanie: rodzino, stań się tym, czym jesteś” (FC 17). Bóg Stwórca i Odkupiciel powierzył człowiekowi – mężczyźnie i kobiecie- zadanie budowania rodziny mocą tej samej Miłości, przez którą istnieje świat i człowiek, oraz tej samej Miłości, którą Objawił Syn Boży na Krzyżu, ustanawiając nowy porządek stworzenia. Odtąd prawda życia ludzkiego i prawda miłości musi być odczytywana wyłącznie w świetle tajemnicy Paschalnej. To wezwanie płynące z głębi sakramentu odzywa się mocą łaski w sercu małżeństwa, w sercu męża i żony, którzy są wezwani do miłowania się tą samą Miłością, która płynie z Misterium Krzyża. Ta koncepcja powołania, wypływająca z sakramentalnego charakteru chrześcijańskiego istnienia stanowi klucz do rozstrzygania szczegółowych pytań mogących się pojawić w kontekście życia małżeńskiego. Wizja przedstawiona przez „Familiaris Consortio” jest jednorodna i charyzmatyczna, jest teologiczna i antropologiczna zarazem, dotyczy bowiem człowieka jako człowieka, a nie tylko „pewnych jednostek” ludzkich uwikłanych w sidła małżeńskie. W „Familiaris Consortio” jest jedna norma małżeńska i jedna norma rodzicielska: to jest zawsze ta sama Miłość, która z Serca Boga poprzez sakrament przenika do serca małżonków. Dlatego miłość małżeńska jest miłością rodzicielską, czyli odpowiedzialną za świętość tajemnicy zrodzenia, to jest równocześnie za świętość Boga – Stwórcy i za godność człowieka powoływanego na świat. Zarówno miłość małżeńska jak miłość rodzicielska, nie mogą istnieć bez czystości małżeńskiej. Tu leży prawdopodobnie główna przyczyna powodująca opór wobec nauki „Humanae Vitae”. „Familiaris Consortio” odrzuca wszelką manipulację antykoncepcyjna, podkreślając sprzeczność postawy antykoncepcyjnej nie tylko z prawem Bożym, ale i z istotą człowieczeństwa. Zawiera się to w twierdzeniu, które głosi, że pomiędzy prawidłowym życiem małżeńskim a antykoncepcją zachodzi nie tylko różnica moralna, lecz także antropologiczna (FC 32). Jest to surowy osąd tej praktyki, ale prawdziwy: ci, którzy stosują antykoncepcję, staczają się na poziom poniżej-ludzki.

Using a classic grounded theory methodology (CGT), this study explores the phenomenon of moral shielding within mental health multidisciplinary teams (MDTS). The study was located within three catchment areas engaged in acute mental health service practice. The main concern identified was the maintenance of a sense of personal integrity during situational binds. Through theoretical sampling thirty two practitioners, including; doctors, nurses, social workers, occupational therapists, counsellors and psychologists, where interviewed face to face. In addition, emergent concepts were identified through observation of MDTs in clinical and research practice. Following a classic grounded theory methodology, data collection and analysis occurred simultaneously. A constant comparative approach was adopted and resulted in the immergence of three sub- core categories; moral abdication, moral hinting and pseudo-compliance. Moral abdication seeks to re-position within an event in order to avoid or deflect the initial obligation to act, it is a strategy used to remove or reduce moral ownership. Moral gauging represents the monitoring of an event with the goal of judging the congruence of personal principles and commitments with that of other practitioners. This strategy is enacted in a bid to seek allies for the support of a given moral position. Pseudo-compliance represents behaviour that hides desired principles and commitments in order to shield them from challenge. This strategy portrays agreement with the dominant position within the MDT, whilst holding a contrary position. It seeks to preserve a reservoir of emotional energy required to maintain a sense of personal integrity. Practitioners who were successful in enacting moral shielding were found to not experience significant emotional distress associated with the phenomenon of moral distress; suggesting that these practitioners had found mechanisms to manage situational binds that threatened their sense of personal integrity.

The medical professionalism movement, bolstered by many influential medical organizations and institutions, has in the last decade produced a number of conceptual definitions of professionalism and a number of concrete proposals for its measurement and teaching. These projects, however laudable, are misguided when they treat professionalism as a unitary descriptive concept rather than as a contested and therefore primarily evaluative one; when they conceive professionalism as a domain of medical practice separable in principle from other domains; and when they treat professionalism as, in principle, a specifiable goal or product of sufficiently well designed educational curricula. The logic of professionalism-as-product corresponds to the logic of techne (art or practical skill) in Aristotle's Nicomachean Ethics. Aristotle provides a cogent argument, however, that the moral excellences denoted by "professionalism" cannot be "produced" or even prespecified in the concrete; rather, they must be acquired through long practice under the careful concrete guidance of teachers who themselves embody these moral excellences. Phronesis (practical wisdom) rather than techne must therefore be the guiding logic of educational initiatives in medical professional formation, with particular emphasis on close mentorship and on the moral character both of students and of those who teach them.

Do people sometimes seek to atone for their transgressions by harming themselves physically? The current results suggest that they do. People who wrote about a past guilt-inducing event inflicted more intense electric shocks on themselves than did those who wrote about feeling sad or about a neutral event. Moreover, the stronger the shocks that guilty participants administered to themselves, the more their feelings of guilt were alleviated. We discuss how this method of atonement relates to other methods examined in previous research.

Hannah Arendt's theory of political judgment has been an ongoing perplexity among scholars who have written on her. As a result, her theory of judgment is often treated as a suggestive but unfinished aspect of her thought. Drawing on a wider array of sources than is commonly utilized, I argue that her theory of political judgment was in fact the heart of her work. Arendt's project, in other words, centered around reestablishing the possibility of political judgment in a modern world that historically has progressively undermined it. In the dissertation, I systematically develop an account of Arendt's fundamentally political and non-sovereign notion of judgment. We discover that individual judgment is not arbitrary, and that even in the complex circumstances of the modern world there are valid structures of judgment which can be developed and dependably relied upon. The result of this work articulates a theory of practical reason which is highly compelling: it provides orientation for human agency which does not rob it of its free and spontaneous character; shows how we can improve and cultivate our political judgment; and points the way toward the profoundly intersubjective form of political philosophy Arendt ultimately hoped to develop.

OBJECTIVE: To compare the performance of formal prognostic instruments vs subjective clinical judgment with regards to predicting functional outcome in patients with spontaneous intracerebral hemorrhage (ICH). METHODS: This prospective observational study enrolled 121 ICH patients hospitalized at 5 US tertiary care centers. Within 24 hours of each patient's admission to the hospital, one physician and one nurse on each patient's clinical team were each asked to predict the patient's modified Rankin Scale (mRS) score at 3 months and to indicate whether he or she would recommend comfort measures. The admission ICH score and FUNC score, 2 prognostic scales selected for their common use in neurologic practice, were calculated for each patient. Spearman rank correlation coefficients (r) with respect to patients' actual 3-month mRS for the physician and nursing predictions were compared against the same correlation coefficients for the ICH score and FUNC score. RESULTS: The absolute value of the correlation coefficient for physician predictions with respect to actual outcome (0.75) was higher than that of either the ICH score (0.62, p = 0.057) or the FUNC score (0.56, p = 0.01). The nursing predictions of outcome (r = 0.72) also trended towards an accuracy advantage over the ICH score (p = 0.09) and FUNC score (p = 0.03). In an analysis that excluded patients for whom comfort care was recommended, the 65 available attending physician predictions retained greater accuracy (r = 0.73) than either the ICH score (r = 0.50, p = 0.02) or the FUNC score (r = 0.42, p = 0.004). CONCLUSIONS: Early subjective clinical judgment of physicians correlates more closely with 3-month outcome after ICH than prognostic scales.

La conferencia aborda la enseñanza de la estadística, destacando tres modelos específicos del área: la guía GAISE, el ciclo investigativo PPDAC, y el ambiente para el aprendizaje del razonamiento estadístico SRLE. Además, se centra en el desarrollo del pensamiento estadístico según la jerarquía cognitiva de alfabetización estadística, razonamiento y pensamiento estadístico.
