Este es un estudio sobre la estrategia de guerra estadounidense en Medio Oriente basada en el uso sistemático de drones durante el periodo comprendido entre 2009 y 2013. Se busca explicar de qué manera puede considerarse el uso de este tipo de armamento como una práctica basada en la proyección de poder sin mayor vulnerabilidad. Los casos de Pakistán y Yemen son abordados, ya que evidencian las características de las operaciones selectivas por las que ha abogado el Presidente Obama. El estudio se inscribe dentro del realismo ofensivo, haciendo también referencia a sus limitaciones explicativas. Empero, se afirma que las dinámicas y consecuencias de la utilización de drones son intrínsecas a la necesidad estadounidense de combatir actores no estatales mediante prácticas que garanticen su seguridad y pretensiones hegemónicas a pesar de las implicaciones políticas , legales y sociales en las que puede incurrir.

Esta investigación se centra en la Fédération Internationale de Football Association (FIFA) como organización política. Intenta responder dos interrogantes primordiales: 1) ¿cómo la FIFA ha constituido el poder que tiene actualmente y, así, hacerse del monopolio indiscutido del fútbol? Y 2) ¿cómo ha cambiado en el tiempo la política interna de FIFA y su vínculo con la política internacional? Para lograr esto, se realiza un estudio histórico, basado principalmente en documentos, que intenta caracterizar y analizar los cambios de la organización en el tiempo. Se enfatizan las últimas dos presidencias de FIFA, de João Havelange y Joseph Blatter, como casos de estudio.

La autora revisa la contribución de Alfredo Pareja a la memoria del país, a través de su libro La hoguera bárbara. Escrito en 1944, trae a la luz pública un tema eludido o marginado en años previos, reconstruyendo los escenarios que antecedieron a la masacre de Eloy Alfaro y otros liberales, asi mismo presenta claves para la comprensión de los eventos que estuvieron detrás de esos crímenes que marcaron la historia del país. El presente ensayo analiza tres momentos de la memoria social para indagar si fue posible olvidar estos hechos. Primero, revisa la percepción del pueblo y la versión oficial de la masacre de 1912, se recuerda que, en 1919, el fiscal en el juicio para identificar a autores, cómplices y encubridores, determinó en forma concluyente la responsabilidad del Estado en la misma, no obstante, los crímenes quedaron en la impunidad. El segundo momento es el de culto a Alfaro a través de la celebración de su obra pública, en los años 20 y 30, la memoria social sobre la masacre parece distendida. Finalmente, en los años 40, se publican obras sobre Alfaro, por el centenario de su nacimiento -entre ellas La hoguera bárbara-, presentándolo como héroe liberal y mártir del pueblo.

This plea for changes in the way epidemiology is practiced presumes a progressive spirit among many readers, sharing a desire and in a position to serve humanity. The criteria used to begin this study of our role in the development of epidemiology is not simply a matter of technocratic formulae, but is based, rather on a committed point of view about the human dimension in the development of epidemiology. The aim is to generate propositions that will eliminate processes that destroy and threaten human life, promoting, instead, supportive measures and processes to protect society, the family and the individual.

Estados Unidos es sin duda uno de los actores más importantes en el actual contexto internacional, ya que no solo cuenta con la fuerza militar más poderosa y tecnificada del mundo, sino que además tiene una influencia política determinante; tanto que no se po dría hablar del actual sistema internacional sin nom brarlo reiteradamente. Uno de los puntos más polémicos de la política exterior estadounidense es la Estrategia de Seguridad Nacional –promulgada por George W. Bush un año después de los ataques del 11 de septiembre de 2001–, que transforma el panorama de las relaciones internacionales, al iniciar una nueva era bélica en la que la fuerza militar se impone a la razón. El concepto de «guerra anticipada» (preempt war, en inglés), que se aplica como eje articulador de esta nueva era, tiene como primeras evidencias del cambio de postura de Estados Unidos en su política exterior, a las guerras de Afganistán e Iraq, pues, como el autor lo demuestra –para responder la pregunta central de su investigación: ¿en qué consiste la gue rra anticipada y cómo este concepto se convirtió en eje central de la política de defensa estadou nidense en la era de Bush?–, en estas se em plea la anticipación como fórmula para la se guridad, convir tiendo a la guerra en el me jor mecanismo de defensa. En este libro también se explica la verdadera significación entre acciones preventivas y acciones anticipadas, y las connotaciones par ticulares que estas tienen en su aplicación. Temas con trascendentales implicaciones globales y regionales, y que no han sido suficiente mente analizados desde la óptica de América Latina.

This paper identifies the indicators of energy efficiency assessment in residential building in China through a wide literature review. Indicators are derived from three main sources: 1) The existing building assessment methods; 2)The existing Chinese standards and technology codes in building energy efficiency; 3)Academia research. As a result, we proposed an indicator list by refining the indicators in the above sources. Identified indicators are weighted by the group analytic hierarchy process (AHP) method. Group AHP method is implemented following key steps: Step 1: Experienced experts are selected to form a group; Step 2: A survey is implemented to collect the individual judgments on the importance of indicators in the group; Step 3: Members’ judgments are synthesized to the group judgments; Step 4: Indicators are weighted by AHP on the group judgments; Step 5: Investigation of consistency estimation shows that the consistency of the judgment matrix is accepted. We believe that the weighted indicators in this paper will provide important references to building energy efficiency assessment.

Retributivists believe that punishment can be deserved, and that deserved punishment is intrinsically good. They also believe that certain crimes deserve certain quantities of punishment. On the plausible assumption that the overall amount of any given punishment is a function of its severity and duration, we might think that retributivists (qua retributivists) would be indifferent as to whether a punishment were long and light or short and sharp, provided the offender gets the overall amount of punishment he deserves. In this paper I argue against this, showing that retributivists should actually prefer shorter and more severe punishments to longer, gentler options. I show this by focusing on, and developing a series of interpretations of, the retributivist claim that not punishing the guilty is bad, focussing on the relationship between that badness and time. I then show that each interpretation leads to a preference for shorter over longer punishment.

Despite strong prospective epidemiology and mechanistic evidence for the benefits of certain micronutrients in preventing CVD, neutral and negative outcomes from secondary intervention trials have undermined the efficacy of supplemental nutrition in preventing CVD. In contrast, evidence for the positive impact of specific diets in CVD prevention, such as the Dietary Approaches to Stop Hypertension (DASH) diet, has focused attention on the potential benefits of whole diets and specific dietary patterns. These patterns have been scored on the basis of current guidelines for the prevention of CVD, to provide a quantitative evaluation of the relationship between diet and disease. Using this approach, large prospective studies have reported reductions in CVD risk ranging from 10 to 60% in groups whose diets can be variously classified as 'Healthy', 'Prudent', Mediterranean' or 'DASH compliant'. Evaluation of the relationship between dietary score and risk biomarkers has also been informative with respect to underlying mechanisms. However, although this analysis may appear to validate whole-diet approaches to disease prevention, it must be remembered that the classification of dietary scores is based on current understanding of diet-disease relationships, which may be incomplete or erroneous. Of particular concern is the limited number of high-quality intervention studies of whole diets, which include disease endpoints as the primary outcome. The aims of this review are to highlight the limitations of dietary guidelines based on nutrient-specific data, and the persuasive evidence for the benefits of whole dietary patterns on CVD risk. It also makes a plea for more randomised controlled trials, which are designed to support food and whole dietary-based approaches for preventing CVD.

Eating attitudes are defined as beliefs. thoughts, feelings and behaviors towards food. Bulimia nervosa (BN) is ail eating disorder, in which the eating, attitudes are Seriously disturbed. Studies that evaluated nutritional aspects of BN focus mainly oil food intake, dietary restriction and binge eating. while the follow-up Studies evaluate mainly clinical symptoms. The objective of this study was to evaluate eating attitudes of patients with BN. during and after cognitive-behavioral intervention. Thirty nine (39) BN female patients received cognitive behavioral treatment with a Multidisciplinary team and had eating attitudes assessed by a questionnaire developed for this research. Frequencies of the attitudes assessed were compared at baseline. after 12 weeks and 24 weeks of treatment. After treatment, patients had less distorted beliefs about food, less guilty after eating ""forbidden"" foods and they felt more tranquil while caring outside home. Other negative behaviors, as dietary restriction, the desire of not cat, being angry when feeling hungry and using the food to relive stress. persisted. Eating attitudes of patients with BN are hard to be changed in a short-term. More attention to this disease`s component and new approaches to treatment are needed in order to have a better recovery.

Court delays are consistently criticised as being inimical to social welfare. However, the theoretical basis for this assertion is not well established in the law and economics literature. As a first step, very little is known about the impact of court delay on the defendant's optimal plea decision. If the defendant is rational in the sense of inter temporally optimising, court delay may increase or decrease the probability of a trial depending on the defendant's bail status. Some empirical support for this theoretical proposition is found using data on plea behaviour for a selection of cases heard in NSW Australia.

There have been concerns for some time about whether breaches of duty that cause a worker's death are appropriately dealt with under occupational health and safety legislation, or whether criminal prosecution is warranted in those cases involving recklessness or gross negligence. Defaulting employers are rarely prosecuted under existing criminal laws and there are serious doctrinal barriers to finding a corporation guilty of mens rea offences.
The Australian Capital Territory leads the way in Australia with the recent introduction of new criminal offences of industrial manslaughter for corporations and their senior officers. These laws rely on concepts of corporate liability based on organisational responsibility and corporate culture in the model Criminal Code Act 1995 (Cth) , thus avoiding the limitations of the identification doctrine. Other active Australian jurisdictions, whilst initially open to the notion of industrial manslaughter laws, have preferred to make changes to existing OHS laws to deal with the problem of workplace fatalities.
Whilst it has its limitations, and applies only in Australia's smallest jurisdiction, the Australian Capital Territory legislation reflects a commitment to treating workplace deaths with the seriousness they deserve, and making it easier to prosecute corporations whose operations are conducted recklessly or with gross negligence.

This article discusses the lack of integration between criminal sanctions and employment deprivations (in the form of being dismissed from employment or disqualified from working in certain industries). Offenders who are employed in certain industries, especially the professions, often suffer a far greater net punishment upon being found guilty of a criminal offence than other offenders, thereby violating the principle of proportionality and the (related) principle of equality in the impact of sanctions. The reason that such a situation has developed is because criminal sanctions and employment deprivations have evolved from different streams of jurisprudence. This article argues that sentencers should impose a ‘net’ sanction for a criminal offence, thereby merging these streams of jurisprudence. This would require courts to be vested with the power to suspend or disqualify people from being employed in certain occupations. The legal analysis in this article focuses on case and statutory law in Australia, however, the same broad principles apply in all common law jurisdictions, including the UK. Hence, the reform proposals suggested in this article are relevant throughout the common law world.

The Paragraph 6 solution arrived on 30th August 2003 to facilitate export of drugs to the countries which were not able to manufacture said drugs shows the total marginalization of developing countries in international treaty negotiations. A simple proposal by developing counties to use Article 30 of the TRIPS Agreement for such manufacture and export to non-manufacturing countries in order to avoid expensive litigations with the pharmaceutical multinationals took an ugly turn where not only the said proposal was totally rejected but export was added as one of the patenting rights in the TRIPS Agreement with payment of remuneration to patent holders. This introduction of export as one of the patenting rights was surrounded by a thicket of rules on the plea that such products would be diverted to ensure that the needing countries never acquire the requisite drugs. This article analyses the events leading to the establishment of the TRIPS Agreement, the elimination of developing countries from such negotiations through the use of suitably placed officials in the negotiating forums, the role of CEOs of the multinationals and the business NGOs such as International Intellectual Property Alliance and IPC (Intellectual Property Committee), epistemic community consisting of individuals such as Jacques Gorlin and Eric Smith and the subsequent development leading to the finalization of Para 6 Solution, which was an exact replication of events during the TRIPS negotiations. The analysis suggests that developing countries do not have any say in international negotiations and their agreements to such negotiations are essentially to legitimize their colonized existence.
