El acceso a la propiedad legal de la tierra en la provincia de Buenos Aires es un tema de larga tradición en la historiografía argentina. Algunas de las primeras preguntas acerca del proceso de obtención de títulos sobre terrenos baldíos del estado durante el siglo XIX tuvieron respuestas en un marco general, explicaciones que se están profundizando y reforzando con estudios más focalizados espacialmente, de manera que la ocupación sin títulos tiene un lugar cada vez más importante en la historiografía. Sin duda estos avances deben mucho al crecimiento de los estudios locales desde mediados de la década de 1980, que ponen estas cuestiones en relación con el funcionamiento del mercado de factores y los aspectos socio-demográficos. Nos proponemos aquí realizar un estado de la cuestión acerca de este tema, dando cuenta de los avances realizados y las posibilidades que la historia local ofrece para desarrollar una nueva mirada sobre el mundo rural pampeano del siglo XIX

El Desarrollo Local Territorial es un proceso endógeno de construcción social que apunta a la generación de capacidades locales aprovechando los recursos territoriales para fortalecer el entramado socio-institucional y el sistema económico-productivo y movilizarlos para mejorar la calidad de vida de una comunidad. Un aspecto relevante, de cara al Desarrollo Local, es conocer la estructura y evolución de la población, el perfil del mercado de trabajo, así como los principales problemas de empleo en la zona en consideración. La Región de Cuyo, integrada históricamente por las provincias de Mendoza, San Juan y San Luis, presenta singularidades tanto en sus perfiles productivos como en su desarrollo económico. En particular, la Provincia de San Luis se caracteriza fuertemente por la aplicación de una sostenida política pública de reducción de los efectos de desempleo e inequidad que se manifestaron profundamente desde la devaluación de la moneda. En ese sentido, este trabajo -que continúa y actualiza la línea de un estudio previo relacionado con la Región Centro Ampliada, elaborado con datos provisorios del Censo 2010- pretende aportar al estudio del mercado laboral de la Región Cuyo y su relación con el desarrollo territorial, elaborando un diagnóstico de las provincias involucradas. Como fuente principal de información, se utiliza la Base de Microdatos de la eph, que releva y publica el indec, para el período comprendido entre 2003 y 2011 y datos definitivos del Censo Nacional de Población, Hogares y Viviendas 2010

El sistema administrativo y legal está en el origen de las transformaciones territoriales que ha sufrido el litoral. Como creación socio política, es reflejo, en cada momento histórico, de los hábitos, prioridades y objetivos sobre el territorio, siendo parte fundamental en la construcción del espacio social litoral y en la destrucción del sistema ecológico. Cuanto mayor es la presión económica sobre el territorio, más importante será la capacidad de las herramientas que desarrolla para establecer los límites de actuación de los diversos agentes, siendo determinante la definición del ámbito litoral (ITUR, 1987) y la distribución de competencias entre las distintas administraciones

To achieve sustainability in the area of transport we need to view the decision-making process as a whole and consider all the most important socio-economic and environmental aspects involved. Improvements in transport infrastructures have a positive impact on regional development and significant repercussions on the economy, as well as affecting a large number of ecological processes. This article presents a DSS to assess the territorial effects of new linear transport infrastructures based on the use of GIS. The TITIM ? Transport Infrastructure Territorial Impact Measurement ? GIS tool allows these effects to be calculated by evaluating the improvement in accessibility, loss of landscape connectivity, and the impact on other local territorial variables such as landscape quality, biodiversity and land-use quality. The TITIM GIS tool assesses these variables automatically, simply by entering the required inputs, and thus avoiding the manual reiteration and execution of these multiple processes. TITIM allows researchers to use their own GIS databases as inputs, in contrast with other tools that use official or predefined maps. The TITIM GIS-tool is tested by application to six HSR projects in the Spanish Strategic Transport and Infrastructure Plan 2005?2020 (PEIT). The tool creates all 65 possible combinations of these projects, which will be the real test scenarios. For each one, the tool calculates the accessibility improvement, the landscape connectivity loss, and the impact on the landscape, biodiversity and land-use quality. The results reveal which of the HSR projects causes the greatest benefit to the transport system, any potential synergies that exist, and help define a priority for implementing the infrastructures in the plan

La última década ha sido testigo de un auge en el número de estudios buscando esclarecer el modo en que los mecanismos fisiológicos facilitan las respuestas fenotípicas y conductuales a las condiciones ambientales bajo entornos naturales. Este reciente interés nació de la necesidad de trasladar las hipótesis y conclusiones generadas en el laboratorio a contextos más realistas, en donde los animales se ven expuestos a la influencia simultánea de múltiples factores y presiones selectivas. En este sentido, tanto los glucocorticoides como los carotenoides han venido recibiendo considerable interés, a razón de sus respectivos papeles como importantes mediadores fisiológicos de la homeostasis y procesos relacionados con la salud de los animales. No obstante, hasta la fecha, gran parte de las publicaciones relacionadas con el estudio de estos dos sistemas fisiológicos en aves silvestres han usado especies modelo de pequeño tamaño y corta vida (principalmente paseriformes), cuya ecología y vulnerabilidad ante los retos medioambientales difiere considerablemente de la de las aves de larga vida. En consecuencia, el objetivo de la presente tesis ha consistido en tratar de reducir esta brecha en el conocimiento mediante la aproximación a distintos aspectos de la ecofisiología de una rapaz salvaje, territorial, y extremadamente longeva (el milano negro, Milvus migrans)...

This work explores the idea of constitutional justice in Africa with a focus on constitutional interpretation in Ghana and Nigeria. The objective is to develop a theory of constitutional interpretation based upon a conception of law that allows the existing constitutions of Ghana and Nigeria to be construed by the courts as law in a manner that best serves the collective wellbeing of the people. The project involves an examination of both legal theory and substantive constitutional law. The theoretical argument will be applied to show how a proper understanding of the ideals of the rule of law and constitutionalism in Ghana and Nigeria necessitate the conclusion that socio-economic rights in those countries are constitutionally protected and judicially enforceable. The thesis argues that this conclusion follows from a general claim that constitutions should represent a ‘fundamental law’ and must be construed as an aspirational moral ideal for the common good of the people. The argument is essentially about the inherent character of ‘legality’ or the ‘rule of law.’ It weaves together ideas developed by Lon Fuller, Ronald Dworkin, T.R.S. Allan and David Dyzenhaus, as well as the strand of common law constitutionalism associated with Sir Edward Coke, to develop a moral sense of ‘law’ that transcends the confines of positive or explicit law while remaining inherently ‘legal’ as opposed to purely moral or political. What emerges is an unwritten fundamental law of reason located between pure morality or natural law on the one hand and strict, explicit, or positive law on the other. It is argued that this fundamental law is, or should be, the basis of constitutional interpretation, especially in transitional democracies like Ghana and Nigeria, and that it grounds constitutional protection for socio-economic rights. Equipped with this theory of law, courts in developing African countries like Ghana and Nigeria will be in a better position to contribute towards developing a real sense of constitutional justice for Africa.

This paper anticipates the 2012 revision of the European Insolvency Regulation, which is the sole Union legislation on the subject of cross border insolvency proceedings. The paper first describes the historical background of the Regulation. The salient point of the historical discussion is that the Regulation is the product of forty years of negotiation and arises from a historical context that is no longer applicable to current economic realities, i.e. it provides for liquidation, not reorganization, it doesn’t deal with cross border groups of companies, and it lacks an effective mechanism for transparency and creditor participation. The paper then reviews the unique hybrid jurisdictional system of concurrent universal and territorial proceedings that the Regulation imposes. It looks at this scheme from a practical viewpoint, i.e. what issues arise with concurrent proceedings in two states, involving the same assets, the same creditors, and the same company. The paper then focuses on a significant issue raised by the European Court of Justice in the Eurofoods case, i.e. the need to comply with fundamental due process principles that, while not articulated in the Regulation, lie at the core of Union law. Specifically, the paper considers the ramifications of the Court’s holding that “a Member State may refuse to recognize insolvency proceedings opened in another Member State where the decision to open the proceedings was taken in flagrant breach of the fundamental right to be heard.” In response to the Court’s direction, this paper proposes a package of due process rights, consisting principally of an accessible, efficient and useful insolvency database, the infrastructure of which already exists, but the content and use of which has not yet been developed. As part of a cohesive three part due process package, the paper also proposes the formation of cross border creditors' committees and the establishment of a European Insolvency Administrator. Finally, on the institutional level, this paper proposes that the revision of the Regulation and the development of the insolvency database not only need to be coordinated, but need to be conceptualized, managed and undertaken, not as the separate efforts of diverse institutions, but as a single, unified endeavor.

The primary focus of this dissertation is to determine the degree to which political, economic, and socio-cultural elites in Jamaica and Trinidad & Tobago influenced the development of the Caribbean Court of Justice's (CCJ) original jurisdiction. As members of the Caribbean Community (CARICOM), both states replaced their protectionist model with open regionalism at the end of the 1980s. Open regionalism was adopted to make CARICOM member states internationally competitive. Open regionalism was also expected to create a stable regional trade environment. To ensure a stable economic environment, a regional court with original jurisdiction was proposed. A six member Preparatory Committee on the Caribbean Court of Justice (PREPCOM), on which Jamaica and Trinidad & Tobago sat, was formed to draft the Agreement Establishing the Caribbean Court of Justice that would govern how the Court would interpret the Revised Treaty of Chaguaramas (RTC) and enforce judgments. ^ Through the use of qualitative research methods, namely elite interviews, document data, and text analysis, and a focus on three levels of analysis, that is, the international, regional, and domestic, three major conclusions are drawn. First, changes in the international economic environment caused Jamaica and Trinidad & Tobago to support the establishment of a regional court. Second, Jamaica had far greater influence on the final structure of the CCJ than Trinidad & Tobago. Third, it was found that in both states the political elite had the greatest influence on the development and structure of the CCJ. The economic elite followed by the socio-cultural elite were found to have a lesser impact. These findings are significant because they account for the impact of elites and elite behavior on institutions in a much-neglected category of states: the developing world.^

Le néolibéralisme, un terme qui désigne couramment la raison d’état contemporaine, est largement associé à un désinvestissement de l’État pour la cause sociale ainsi qu’à un discours de légitimation des disparités socio-économiques. Il s’agit, pour plusieurs, d’une idéologie qui ne considère pas la justice comme un idéal collectif à poursuivre. Un retour sur certains penseurs à qui l’on attribue la formulation des idées néolibérales permet toutefois de constater que la justice fut, au sein de leurs travaux, l’un des thèmes majeurs. L’objectif général de ce mémoire est donc de présenter la conception de la justice chez deux penseurs du néolibéralisme : le journaliste américain Walter Lippmann et l’économiste autrichien Friedrich A. von Hayek. Cette perspective comparée me permettra d’identifier ce que je nomme la «conception néolibérale» de la justice, conception qui s’articule à partir d’une compréhension singulière du marché. Dans le premier chapitre, je présente le problème central de la conception néolibérale de la justice, en abordant la posture épistémologique privilégiée par Hayek et Lippmann. Dans le deuxième chapitre, je présente certaines modalités de cette conception et soulève ses principales apories. Je soutiens aussi qu’une rupture survient entre Hayek et Lippmann autour de la notion de «responsabilité». Finalement, je compare la conception néolibérale de la justice avec la conception libertarienne présentée par Nozick. C’est à partir des critères de justice respectifs de chaque théorie que j’avance la distinction, au troisième chapitre, entre les deux conceptions pourtant similaires. Contrairement à une analyse courante qui fait du néolibéralisme un projet amoral, je soutiens que la reconnaissance de la dimension morale du discours néolibéral ouvre une fenêtre à partir de laquelle il devient possible de critiquer le projet sur des bases éthiques. C’est en identifiant la notion de justice à l’oeuvre dans le discours néolibéral contemporain et en l’inscrivant dans la tradition morale présentée dans le cadre de ce mémoire que nous sommes mieux à même de comprendre l’idéologie du néolibéralisme.

This article considers the opportunities of civilians to peacefully resist violent conflicts or civil wars. The argument developed here is based on a field-based research on the peace community San José de Apartadó in Colombia. The analytical and theoretical framework, which delimits the use of the term ‘resistance’ in this article, builds on the conceptual considerations of Hollander and Einwohner (2004) and on the theoretical concept of ‘rightful resistance’ developed by O’Brien (1996). Beginning with a conflict-analytical classification of the case study, we will describe the long-term socio-historical processes and the organizational experiences of the civilian population, which favoured the emergence of this resistance initiative. The analytical approach to the dimensions and aims of the resistance of this peace community leads to the differentiation of O`Brian’s concept of ‘rightful resistance’.

Este compendio de planificación comprende el área urbana del cantón Biblián como ambiente de actuación. Durante este proceso se establecieron diversas recomendaciones en cada capítulo para establecer una respuesta sencilla a las partes que requieren mayor urgencia, como el uso de ocupación del suelo, el equipamiento, la vialidad, y la formación de un conjunto normativo que permita la actuación municipal, en actividades de prevención, control y sanción. Todos estos vinculados también a otros aspectos destacándose la demografía, la delimitación territorial, el socio-económico, la infraestructura, la vivienda, el medio ambiente, etc. El documento final se ha desarrollado en seis fases generales.
