We develop a theory of public versus private ownership based on value diversion by managers. Government is assumed to face stronger institutional constraints than has been assumed in previous literature. The model which emerges from these assumptions is fexible and has wide application. We provide amapping between the qualitative characteristics of an asset, its main use - including public goods characteristics, and spillovers toother assets values - and the optimal ownership and management regime. The model is applied to single and multiple related assets. We address questions such as; when is it optimal to have one of a pair ofr elated assets public and the other private; when is joint management desirable; and when should a public asset be managed by the owner of a related private asset? We show that while private ownership can be judged optimal in some cases solely on the basis of qualitative information, the optimality of any other ownership and management regimes relies on quantitative analysis. Our results reveal the situations in which policy makers will have difficulty in determining the opimal regime.

State ownership of publicly-traded corporations remains pervasive around the world, and has been increasing in recent years. Existing literature focuses on the implications of government ownership for corporate governance and performance at the firm level. This Article, by contrast, explores the different but equally important question of whether the presence of the state as a shareholder can impose negative externalities on the corporate law regime available to the private sector. Drawing from historical experiments with government ownership in the United States, Brazil, China, and Europe, this study shows that the conflict of interest stemming from the state’s dual role as a shareholder and regulator can influence the content of corporate laws to the detriment of outside investor protection and efficiency. It thus addresses a gap in the literature on the political economy of corporate governance by incorporating the political role of the state as shareholder as another mechanism to explain the relationship between corporate ownership structures and legal investor protection. Finally, this Article explores the promise of different institutional arrangements to constrain the impact of the state’s interests as a shareholder on the corporate governance environment, and concludes by offering several policy recommendations.

We construct a model in which a first mover decides on its location before it knows the identity of the second mover; joint location results in a negative extemality. Contracts are inherently incomplete since the first mover's initial decision cannot be specified. We analyze several kinds of rights, including damages, injunctions, and rights to exclude (arising from covenants or land ownership). There are cases in which allocating any of these basic rights to the first mover-i.e., first-party rights-is dominated by second-party rights, and cases in which the reverse is true. A Coasian result (efficiency regardless of the rights allocation) only holds under a limited set of conditions. As corollaries of a theorem ranking the basic rights regimes, a number of results emerge contradicting conventional wisdom, including the relative inefficiency of concentrated land ownership and the relevance of the generator's identity. We conclude with a mechanism and a new rights regime that each yield the first best in all cases.

Os conflitos de uso são determinados pelas ocupações inadequadas do solo, como é o caso de ocupação do solo dentro de áreas de preservação permanente. O presente trabalho teve como objetivos determinar as classes de uso do solo e se há conflitos dentro de áreas de preservação permanente ao longo da rede de drenagem da microbacia do Ribeirão Água Fria, município de Bofete (SP). Situa-se geograficamente entre as coordenadas: 48°09'30 a 48°18'30 de longitude WGr., 22°58'30 a 23°04'30 de latitude sul com uma área de 15.242,84 ha. O mapa de uso do solo foi elaborado por meio da interpretação diretamente na tela do computador de imagem digital de satélite. Nos dados orbitais, a área de estudo está inserida no quadrante A, da imagem TM/Landsat-5, órbita 220, ponto 76, passagem de 8/09/2007. O Sistema de Informação Geográfica empregado foi o Cartalinx. As áreas de conflito da microbacia foram obtidas a partir do cruzamento entre os mapas de uso do solo e de APPs. Os resultados permitiram concluir que mais da metade da área (51,09%) está ocupada por pastagens, reflexo de solos arenosos e de baixa fertilidade. Constatou-se, ainda, que apesar de quase metade da microbacia estar coberta com algum tipo de vegetação (48,78% de mata natural/reflorestamento), possui aproximadamente um terço das áreas de preservação permanente utilizadas inadequadamente por pastagens (88,15%), reflorestamento (10,42%) e solo exposto (1,43%), totalizando 343,07 ha de áreas conflitantes em um total de 993,26 ha de APPs.

The proposal and implementation of parceling real estate into smaller lots in Brazil is done according to legal and technical formalities. However, these instruments have proved inefficient in reducing the resulting environmental impacts. The ambiguities of the federal, state and municipal laws and regulations have limited the effectiveness of the actions of urban administrators. Law 10257/2001 emerged as an alternative to overcome these difficulties, proposing the adoption of neighborhood impact studies as an instrument to evaluate new proposals of urban occupation for purposes of environmental licensing. Thus, the purpose of this law is to provide the foundations for municipal public authorities to establish criteria for the assessment, mitigation and compensation of impacts resulting from new occupations. However, the very vagueness of the generic nature of this federal law and its incorrect application in the municipal sphere has posed the greatest obstacles to the good use of this instrument of urban environmental management. These deficiencies are classified herein in the categories of philosophical, technical and operational problems. The problems of a philosophical nature lead to technical difficulties, which in turn trigger operational deficiencies. Through the geotechnology's use, the aim of this study was to characterize the urban occupation interference and occurrence of floods in the upstream area of watershed from the stream Wenzel (Rio Claro-SP/Brazil). Urbanized watersheds are composed of a variety of features and the development of cartographic material allowed the analysis of the evolution of land used for 1958 and 2006 scenarios. The thematic maps were generated using software Spring 4.3.3, wherein it got the separation of matters from vegetation cover and other intra urban features. Procedures of digital processes and classification of surface cover allowed quantifying the occupied area by each coverage type: woody vegetation, grass, grass with bare soil, bare soil, building, asphaltic sheets and exposed soil. Quantification of the different covers' occupied areas allowed relating the parameter Curve Number (Soil Conservation Service) as efficient methodology for runoff values estimative. The results indicate vegetation cover's reduction, intensive surface's sealing and suppression of water bodies. These factors imply changes of hydrological dynamics of the source, increasing flow and transfer of larger volumes of water and flood peaks to downstream sectors. The use of geotechnology allowed analyzing the evolution of urbanization and it permits also to infer about trends for future or inadequate occupancy to hydrological and environmental point of view. © 2013 IEEE.

Uma das áreas mais promissoras para o estudo das sociedades pré-colombianas complexas na bacia do rio Amazonas é a área do baixo curso dos rios Tapajós, Trombetas e Nhamundá. Há relatos escritos sobre os Konduri e os Tapajós, apresentando informações sobre a sua organização social regional, padrões de comércio, a abundância de alimentos, e o mundo material. Assim, evidências arqueológicas – sítios imensos, solos antrópicos, e belos artefatos – podem ser contrastadas com a informação escrita. Estes ricos depósitos culturais estão desaparecendo a um ritmo alarmante, à medida em que os centros urbanos crescem e se expande a agricultura na região. Apesar desta situação, pouca pesquisa arqueológica tem sido realizada na área, especialmente quando se trata de investigar os antigos padrões de assentamento e redes de trocas. Nos últimos anos, temos realizado pesquisas na bacia do baixo rio Tapajós. O registro arqueológico indica que a cerâmica mostrando forte semelhança estilística forte com a encontrada no grande sítio central está espalhada por pelo menos 90 quilômetros ao sul da presente cidade de Santarém. Este artigo apresenta os resultados de uma pesquisa regional realizada nas proximidades de Santarém, no planalto de Belterra e Alter do Chão, oferecendo uma análise preliminar do sistema de assentamentos na região.

This study aims to analyze the thermal comfort in urban areas for different land uses. The ENVImet microclimatic model has been used for urban boundary layer simulation, providing the following thermal comfort indexes: PMV (Predicted Mean Vote) and PPD (Predicted Percentage of Dissatisfaction). The chosen area covers the central area in the city of Ourinhos, located in southeastern Brazilian city, with subtropical climate. Four simulations were accomplished: an area with real buildings and vegetation on site, a “grassy” area where buildings have been replaced by grass in the central area, another grassy area, known as “grass/tree”, with additional trees in, and a final area called “Park” also grassy, where trees were added all over the area. The structures which showed thermal comfort within the ISO 7730 standards were the grassy area with no trees at 9 a.m., and a paved area, as well as the park area at 3 p.m. Other situations have presented values of PMV and PPD off the limits required by the rules; they were very close to those values. The only point that presented a far cry from the comfort required was the spot in the asphalt at 9 a.m. The other situations showed PMV and PPD values not far from the limits of comfort. Only the point on the asphalt showed values far from the limit of comfort at 9 a.m.

White Rock Lake reservoir in Dallas, Texas contains a 150-cm sediment record of silty clay that documents land-use changes since its construction in 1912. Pollen analysis corroborates historical evidence that between 1912 and 1950 the watershed was primarily agricultural. Land disturbance by plowing coupled with strong and variable spring precipitation caused large amounts of sediment to enter the lake during this period. Diatoms were not preserved at this time probably because of low productivity compared to diatom dissolution by warm, alkaline water prior to burial in the sediments. After 1956, the watershed became progressively urbanized. Erosion decreased, land stabilized, and pollen of riparian trees increased as the lake water became somewhat less turbid. By 1986 the sediment record indicates that diatom productivity had increased beyond rates of diatom destruction. Neither increased nutrients nor reduced pesticides can account for increased diatom productivity, but grain size studies imply that before 1986 diatoms were light limited by high levels of turbidity. This study documents how reservoirs may relate to land-use practices and how watershed management could extend reservoir life and improve water quality.
