Purpose – The purpose of this paper is to provide a critical assessment of legal and regulatory impediments to effective governance of public-private partnerships (PPPs) in Kazakhstan. Design/methodology/approach – The qualitative study develops propositions from the PPP literature and then tests them against findings from in-depth interviews. Interviewees have been selected by a purposeful sampling from PPP projects in Kazakhstan as well as from national and regional PPP centres. Findings – The identified barriers to effective PPP management include irregularities in the PPP legal framework, such as lack of legal definition of a PPP and controversy with the government guarantee’s legal status for its long-term payments to partnerships; bureaucratic tariff setting for partnership services; non-existent opportunity for private asset ownership; and excessive government regulation of PPP workers’ wage rates. Practical implications – The partners’ opposing perspectives on a number of PPP issues show that management needs to identify and carefully reconcile stakeholder values in a partnership in order to achieve more effective PPP governance. Practitioners, particularly those in the public agencies, have to be concerned with ways to reduce the government overregulation of the private operators, which is likely to result in greater PPP flexibility in management and, ultimately, higher efficiency in delivering the public services. Originality/value – By elucidating multiple examples of overregulation and PPPs’ inefficiency, the paper demonstrates that the government dominance in PPP management is conceptually inappropriate. Instead, the government should adopt the concept of co-production and manage its relations with the private sector partner in a collaborative fashion.

This paper discusses how global financial institutions are using big data analytics within their compliance operations. A lot of previous research has focused on the strategic implications of big data, but not much research has considered how such tools are entwined with regulatory breaches and investigations in financial services. Our work covers two in-depth qualitative case studies, each addressing a distinct type of analytics. The first case focuses on analytics which manage everyday compliance breaches and so are expected by managers. The second case focuses on analytics which facilitate investigation and litigation where serious unexpected breaches may have occurred. In doing so, the study focuses on the micro/data to understand how these tools are influencing operational risks and practices. The paper draws from two bodies of literature, the social studies of information systems and finance to guide our analysis and practitioner recommendations. The cases illustrate how technologies are implicated in multijurisdictional challenges and regulatory conflicts at each end of the operational risk spectrum. We find that compliance analytics are both shaping and reporting regulatory matters yet often firms may have difficulties in recruiting individuals with relevant but diverse skill sets. The cases also underscore the increasing need for financial organizations to adopt robust information governance policies and processes to ease future remediation efforts.

Based on a large dataset from eight Asian economies, we test the impact of post-crisis regulatory reforms on the performance of depository institutions in countries at different levels of financial development. We allow for technological heterogeneity and estimate a set of country-level stochastic cost frontiers followed by a deterministic bootstrapped meta-frontier to evaluate cost efficiency and cost technology. Our results support the view that liberalization policies have a positive impact on bank performance, while the reverse is true for prudential regulation policies. The removal of activities restrictions, bank privatization and foreign bank entry have a positive and significant impact on technological progress and cost efficiency. In contrast, prudential policies, which aim to protect the banking sector from excessive risk-taking, tend to adversely affect banks cost efficiency but not cost technology.

In this article, the prevailing official view of supervision as a regulatory instrument is examined as it applies to the social services sector in Sweden. The study is based on a comparison of the views expressed on the design of supervision as a regulatory instrument by two government commissions, the Supervision Commission and the Commission on Supervision within the Social Services (UTIS), and on the positions taken by the Government regarding the definitions of the concept of supervision proposed by these commissions. The view of supervision as a regulatory instrument expressed in these policy documents is analysed with the help of a theoretical framework describing the components, their functions and the governance characteristics of control systems. In the framework separate interrelated characteristics of the components are identified and summarized into two models of control systems. The analysis shows that supervision in the Swedish social services sector can be described in terms of both a disciplinary and non-disciplinary system. By its system theoretical basis and the identification of interrelated characteristics the study contributes to a broadened understanding of the construction and functions of supervision as a regulatory instrument and of how supervision within the Swedish social sector is meant to be designed.

Government websites offer great benefits to citizens and governments. Such benefits, however,cannot be realized if websites are unusable. This study investigates usability of government websites in Uganda.Using the feature investigation method, the study evaluated four Ugandan government websites according tothree perspectives. Results show that websites are partially usable in the design layout and navigationperspectives but are rather weak in stating legal policies. Evaluation results provide the Ugandan governmentwith a clear picture of what needs to be improved according to international website design standards. Moreover,the parsimonious evaluation framework proposed in the research is useful for any country that wants to do aquick and easy evaluation of their government websites.

We construct and simulate a theoretical model in order to explain particular historical experiences in which inflation acceleration apparently helped to spur a period of economic growth. Government financed expenditures affect positively the produtivity growth in this model so that the distortionary effect of inflation tax is compensated by the productive effect of public expenditures. We show that for some interval of money creation rates there is an equilibrium where money is valued and where steady state physica1 capital grows with inflation. It is a1so shown that zero inflation and growth maximization are never the optimal policies.

In this paper, we show that when the government is able to transfer wealth between generations, regressive policies are no longer optimal. The optimal educational policy can be decentralized through appropriate Pigouvian taxes and credit provision, is not regressive, and provides equality of opportunities in education (in the sense of irrelevance of parental income for the amount of education). Moreover, in the presence of default, the optimal policy can be implemented through income-contingent payments.

Nos últimos anos, a indústria elétrica brasileira passou, basicamente, por duas reestruturações setoriais, implantadas segundo políticas e ideologias divergentes, mas que convergiram para o mesmo objetivo final: a busca por investimentos privados para dar suporte à expansão do sistema. Esse é o grande desafio do novo modelo institucional de 2004, que surge em um ambiente conturbado, de forte percepção de riscos e incertezas. A própria instabilidade regulatória é a grande responsável pelo recuo e ponderação na hora de investir. Contudo, a pergunta que se faz na presente pesquisa objetiva identificar os fatores motivadores da nova reestruturação setorial. Só assim, pode-se correlacionar os fatos do passado com a recente reforma, identificando possíveis deficiências e fatores críticos de sucesso. Para tanto, o presente estudo recorreu à literatura existente, assim como a entrevistas semi-estruturadas com especialistas do setor elétrico brasileiro. Os dados foram analisados qualitativamente, por meio de categorias estabelecidas a posteriori, buscando-se aceitar ou refutar suposições. As evidências sugerem que, apesar de a nova reforma institucional ter realizado avanços, ao introduzir mecanismos absorvidos, principalmente, a partir das experiências regulatórias dos últimos anos, dificuldades ainda permanecem e devem ser enfrentadas, especialmente no que tange à mitigação dos riscos ambientais e regulatórios, este último, percebido com maior intensidade a partir de 2004. Sendo assim, cabe ao governo federal, representado pelo Ministério de Minas e Energia (MME), conseguir atrair investimentos e proporcionar estabilidade regulatória, a fim de afastar o “fantasma” do racionamento.

Os processos e as instituições regulatórias são assuntos prioritários da agenda governamental, por tratarem-se de assunto dinâmico que envolve uma mudança na cultura administrativa do país. Um dos grandes desafios das agências reguladoras brasileiras tem sido desempenhar suas funções de forma autônoma e imparcial com o objetivo de promover confiança e transparência ao mercado e à sociedade. Este estudo buscou realizar uma análise do conteúdo e das repercussões das mudanças ora em curso no Brasil, em especial daquelas contidas na proposta enviada pelo governo federal brasileiro ao Congresso Nacional dispondo sobre a nova Lei Geral das Agências reguladoras (Projeto de Lei 3337/2004), com o fito de promover mudanças no modelo de organização institucional e funcionamento desses entes regulatórios. Com esse fim, de início, foram descritos os fundamentos teóricos da regulação, com a apresentação do processo de criação das agências reguladoras federais brasileiras e suas características determinantes. Após a fundamentação, foram detalhados os pontos principais do Projeto de Lei 3337/2004, e seu substitutivo, elaborado pelo Deputado Leonardo Picciani. O próximo capítulo, Governança Regulatória, apresentou as políticas de reforma regulatória, seus desafios no Brasil, e delineou o Programa de Fortalecimento da Capacidade Institucional para Gestão em Regulação (PRO-REG). O estudo deu prosseguimento à análise por meio da apresentação das boas práticas à qualidade regulatória, enfatizando a importância da participação social no processo regulatório, e também da abordagem da experiência internacional. Item complementar para a compreensão e visão geral do estudo, a supervisão regulatória foi também conceituada e justificada, seguida pela abordagem da criação da Unidade de Supervisão Central e da experiência internacional. Por último, em análise final do tema, apoiada por grande pesquisa bibliográfica e documental, e por entrevistas concedidas pelos ocupantes dos dois maiores cargos da Superintendência de Abastecimento da Agência Nacional do Petróleo, Gás Natural e Biocombustíveis, procurou-se mostrar a imprescindibilidade do desenvolvimento e implementação de uma estratégia de qualidade regulatória que permita uma abordagem consistente.

The questlon of the crowding-out of private !nvestment by public expenditure, public investment in particular , ln the Brazilian economy has been discussed more in ideological terrns than on empirical grounds. The present paper tries to avoid the limitation of previous studies by estlmatlng an equation for private investment whlch makes it possible to evaluate the effect of economic policies on prlvate investment. The private lnvestment equation was deduced modifylng the optimal flexible accelerator medel (OFAM) incorporating some channels through which public expendlture influences privateinvestment. The OFAM consists in adding adjustment costs to the neoclassical theory of investrnent. The investment fuction deduced is quite general and has the following explanatory variables: relative prices (user cost of capitaljimput prices ratios), real interest rates, real product, public expenditures and lagged private stock of capital. The model was estimated for private manufacturing industry data. The procedure adopted in estimating the model was to begin with a model as general as possible and apply restrictions to the model ' s parameters and test their statistical significance. A complete diagnostic testing was also made in order to test the stability of estirnated equations. This procedure avoids ' the shortcomings of estimating a model with a apriori restrictions on its parameters , which may lead to model misspecification. The main findings of the present study were: the increase in public expenditure, at least in the long run, has in general a positive expectation effect on private investment greater than its crowding-out effect on priva te investment owing to the simultaneous rise in interst rates; a change in economlc policy, such as that one of Geisel administration, may have an important effect on private lnvestment; and reI ative prices are relevant in determining the leveI of desired stock of capital and private investrnent.

o objeto da presente pesquisa é evidenciar o padrão de Estado Regulador brasileiro, sua complexidade e o modelo adotado, em parte, na década de 90, para a sua implementação, notadamente com a criação de algumas autarquias especiais dotadas de autonomia funcional diferenciada em relação ao Poder Público central. Examinando os motivos e a forma adotada para a estruturação dessas entidades reguladoras, no bojo de uma tentativa de reformar a organização administrativa, sob a forma gerencial, pretende-se analisar se esse caminho deve ser trilhado, ainda que em parte, para outros setores. A análise envolve a possível redefinição da divisão de tarefas e competências entre "entidades de Governo" e entes públicos cuja missão requer continuidade ("órgãos de Estado"), especialmente, nos casos de alternância do poder. Pretende-se contribuir para a estruturação de entidades vocacionadas para o desenvolvimento de políticas de Estado.

A corporate firm may influence policies in its favor by transferring money to political candidates. However, empirical studies which document evidence about the return on campaign donations are rare (Großer, Reuben and Tymula, 2013). In this paper we estimate the net expected return of a campaign donation in eight Brazilian states using a Regression Discontinuity Design (RDD) to separate the return of winning and losing state deputy candidates in the electoral coalition in 2006. Our results show that that the net return is quite high (i.e., the investment of donor firms is almost 2% of the net expected return), and is larger among traditional electoral parties than any other parties, on average. Looking at the heterogeneity of local executive and legislative levels, we find that net returns are higher when donor firms finance deputies within a governor’s electoral coalition than deputies outside this coalition.

Esta tese é composta por três ensaios sobre testes empíricos de curvas de Phillips, curvas IS e a interação entre as políticas fiscal e monetária. O primeiro ensaio ("Curvas de Phillips: um Teste Abrangente") testa curvas de Phillips usando uma especificação autoregressiva de defasagem distribuída (ADL) que abrange a curva de Phillips Aceleracionista (APC), a curva de Phillips Novo Keynesiana (NKPC), a curva de Phillips Híbrida (HPC) e a curva de Phillips de Informação Rígida (SIPC). Utilizamos dados dos Estados Unidos (1985Q1--2007Q4) e do Brasil (1996Q1--2012Q2), usando o hiato do produto e alternativamente o custo marginal real como medida de pressão inflacionária. A evidência empírica rejeita as restrições decorrentes da NKPC, da HPC e da SIPC, mas não rejeita aquelas da APC. O segundo ensaio ("Curvas IS: um Teste Abrangente") testa curvas IS usando uma especificação ADL que abrange a curva IS Keynesiana tradicional (KISC), a curva IS Novo Keynesiana (NKISC) e a curva IS Híbrida (HISC). Utilizamos dados dos Estados Unidos (1985Q1--2007Q4) e do Brasil (1996Q1--2012Q2). A evidência empírica rejeita as restrições decorrentes da NKISC e da HISC, mas não rejeita aquelas da KISC. O terceiro ensaio ("Os Efeitos da Política Fiscal e suas Interações com a Política Monetária") analisa os efeitos de choques na política fiscal sobre a dinâmica da economia e a interação entre as políticas fiscal e monetária usando modelos SVARs. Testamos a Teoria Fiscal do Nível de Preços para o Brasil analisando a resposta do passivo do setor público a choques no superávit primário. Para a identificação híbrida, encontramos que não é possível distinguir empiricamente entre os regimes Ricardiano (Dominância Monetária) e não-Ricardiano (Dominância Fiscal). Entretanto, utilizando a identificação de restrições de sinais, existe evidência que o governo seguiu um regime Ricardiano (Dominância Monetária) de janeiro de 2000 a junho de 2008.

The research topic of this paper is focused on the analysis of how trade associations perceive lobbying in Brussels and in Brasília. The analysis will be centered on business associations located in Brasília and Brussels as the two core centers of decision-making and as an attraction for the lobbying practice. The underlying principles behind the comparison between Brussels and Brasilia are two. Firstof all because the European Union and Brazil have maintained diplomatic relations since 1960. Through these relations they have built up close historical, cultural, economic and political ties. Their bilateral political relations culminated in 2007 with the establishment of a Strategic Partnership (EEAS website,n.d.). Over the years, Brazil has become a key interlocutor for the EU and it is the most important market for the EU in Latin America (European Commission, 2007). Taking into account the relations between EU and Brazil, this research could contribute to the reciprocal knowledge about the perception of lobby in the respective systems and the importance of the non-market strategy when conducting business. Second both EU and Brazilian systems have a multi-level governance structure: 28 Member States in the EU and 26 Member States in Brazil; in both systems there are three main institutions targeted by lobbying practice. The objective is to compare how differences in the institutional environments affect the perception and practice of lobbying, where institutions are defined as ‘‘regulative, normative, and cognitive structures and activities that provide stability and meaning to social behavior’’ (Peng et al., 2009). Brussels, the self-proclaimed "Capital of Europe”, is the headquarters of the European Union and has one of the highest concentrations of political power in the world. Four of the seven Institutions of the European Union are based in Brussels: the European Parliament, the European Council, the Council and the European Commission (EU website, n.d.). As the power of the EU institutions has grown, Brussels has become a magnet for lobbyists, with the latest estimates ranging from between 15,000 and 30,000 professionals representing companies, industry sectors, farmers, civil society groups, unions etc. (Burson Marsteller, 2013). Brasília is the capital of Brazil and the seat of government of the Federal District and the three branches of the federal government of Brazilian legislative, executive and judiciary. The 4 city also hosts 124 foreign embassies. The presence of the formal representations of companies and trade associations in Brasília is very limited, but the governmental interests remain there and the professionals dealing with government affairs commute there. In the European Union, Brussels has established a Transparency Register that allows the interactions between the European institutions and citizen’s associations, NGOs, businesses, trade and professional organizations, trade unions and think tanks. The register provides citizens with a direct and single access to information about who is engaged in This process is important for the quality of democracy, and for its capacity to deliver adequate policies, matching activities aimed at influencing the EU decision-making process, which interests are being pursued and what level of resources are invested in these activities (Celgene, n.d). It offers a single code of conduct, binding all organizations and self-employed individuals who accept to “play by the rules” in full respect of ethical principles (EC website, n.d). A complaints and sanctions mechanism ensures the enforcement of the rules and addresses suspected breaches of the code. In Brazil, there is no specific legislation regulating lobbying. The National Congress is currently discussing dozens of bills that address regulation of lobbying and the action of interest groups (De Aragão, 2012), but none of them has been enacted for the moment. This work will focus on class lobbying (Oliveira, 2004), which refers to the performance of the federation of national labour or industrial unions, like CNI (National Industry Confederation) in Brazil and the European Banking Federation (EBF) in Brussels. Their performance aims to influence the Executive and Legislative branches in order to defend the interests of their affiliates. When representing unions and federations, class entities cover a wide range of different and, more often than not, conflicting interests. That is why they are limited to defending the consensual and majority interest of their affiliates (Oliveira, 2004). The basic assumption of this work is that institutions matter (Peng et al, 2009) and that the trade associations and their affiliates, when doing business, have to take into account the institutional and regulatory framework where they do business.

As recentes discussões sobre a regulação financeira tendem a caracterizar como meramente circunstanciais as medidas adotadas nesta frente. Neste trabalho, o tema é abordado como uma forma de organização social, conceito fundamental para cumprir o objetivo de relacionar a regulação financeira brasileira à renda dos indivíduos e identificar às bases nas quais as incursões regulatórias têm se desenvolvido e em quais conceitos elas estão pautadas.
