Seeking better understanding of the relationship between criminal law and surveillance demands investigating the evolving nature of sovereignty in an era of transnational digital information flows. While territorial boundaries determine the limits of police investigative and surveillance powers under the criminal law, several recent United States (US) examples demonstrate how new forms of extraterritorial surveillance that enable police to access online communications by foreign citizens and digital information stored in offshore locations are authorized by US courts. This discussion outlines how the processes of mutual legal assistance that ordinarily govern the search, seizure and transfer of digital evidence from one jurisdiction to another are increasingly considered to undermine police efficiency, even though they protect the due process rights afforded to crime suspects under established principles of sovereignty (Palmer and Warren 2013).

Knowledge, Spirit, Law is a de facto phenomenology of scholarship in the age of neoliberal capitalism. The eleven essays (plus Appendices) in Book 1: Radical Scholarship cover topics and circle themes related to the problems and crises specific to neoliberal academia, while proposing creative paths around the various obstructions. The obstructions include metrics-obsessed academia, circular and incestuous peer review, digitalization of research as stalking horse for text- and data-mining, and violation by global corporate fiat of Intellectual Property and the Moral Rights of Authors. These issues, while addressed obliquely in the main text, definitively inform the various proscriptive aspects of the essays and, via the Introduction and Appendices, underscore the necessity of developing new-old means to no obvious end in the production of knowledge — that is to say, a return to forms of non-instrumentalized intellectual inquiry. To be developed in two concurrent volumes, Knowledge, Spirit, Law will serve as a “moving and/or shifting anthology” of new forms of expression in humanistic studies. Book 2: The Anti-Capitalist Sublime will be published in Autumn 2016.

El derecho internacional, como el derecho administrativo de cada Estado, se encuentra vinculado a la finalidad universal del derecho. No obstante, la influencia de la comunidad internacional en los asuntos jurídicos de los Estados está generando, con el auge de la globalización, mecanismos o instrumentos que de forma no impositiva pero sí persuasiva, vienen delimitando las competencias estatales. Estos instrumentos ejercen la función de ordenar los ámbitos de validez de dichas competencias jurídicas y administrativas internas, a través de formas declaratorias de carácter internacional, mediante normas jurídicas blandas denominadas soft law. El amplio y variado uso del soft law en temas como los derechos humanos y el medio ambiente plantea una dificultad para la teoría tradicional de fuentes, inspirada en la voluntad de los Estados, los cuales se constituyen a partir de su soberanía estatal (hard law). Esto sugiere una dicotomía jurídica, en donde el soft law se contrasta con las reglas legales que definen obligaciones específicas de hard law, es decir, “son normas o principios más abiertos o generales en su contenido y significado, comprendiéndose como suaves. En tal caso, el Soft Law plantea una apertura a la internacionalización y democratización del derecho administrativo. La creciente adopción de instrumentos de soft law de influencia internacional o global permite la participación de actores no estatales, tales como las organizaciones no gubernamentales (ONG), y de carácter civil en la construcción de políticas e instrumentos que en ocasiones adquieren más legitimidad que las leyes creadas para atender tales asuntos.

The Queensland University of Technology (QUT) University Academic Board approved a new QUT Assessment Policy in September 2003, which requires a criterion-referenced approach as opposed to a norm-referenced approach to assessment across the university(QUT,MOPP,2003). In 2004, the QUT Law School embarked upon a process of awareness raising about criterion-referenced assessment amongst staff and from 2004 – 2005 staggered the implementation of criterion-referenced assessment in all first year core undergraduate law units. This paper will briefly discuss the benefits and potential pitfalls of criterion referenced assessment and the context for implementing it in the first year law program, report on student’s feedback on the introduction of criterion referenced assessment and the strategies adopted in 2005 to engage students more fully in criterion referenced assessment processes to enhance their learning outcomes.
