The increasing international political, public and scientific engagement in matters of environmental sustainability and development has produced a rapidly expanding body of environmental law and policy. The advent of international protocols, directives, and multilateral agreements has occurred concomitantly with the harmonisation of widespread environmental regimes of governance and enforcement within numerous domestic settings. This has created an unprecedented need for environmental legal apparatuses to manage, regulate and adjudicate legislation seeking to protect, sustain and develop global natural habitats. The evolving literature in green criminology continues to explore these developments within discourses of power, harm and justice. Such critiques have emphasised the role of dedicated environmental courts to address environmental crimes and injustices. In this article, we examine the important role of specialist courts in responding to environmental crime, with specific reference to the State of Queensland. We offer a critique of existing processes and practices for the adjudication of environmental crime and propose new jurisdictional and procedural approaches for enhancing justice. We conclude that specialist environmental courts endowed with broad civil and criminal jurisdiction are an integral part of an effective response to environmental crime.

Goodbye Brigadoon examines the shifting role media production plays in the economic and cultural strategies of global cities in small market nations, specifically Glasgow, Scotland. In particular, this project focuses on the formation of a digital media village along the banks of the River Clyde to argue the site constitutes a logical component to Glasgow’s ongoing transformation into a cosmopolitan center. Yet, as the regional government’s economic strategies and policy directives work to transform the abandoned waterfront into a center of cultural activity, this project also underscores the contradictory cultural dynamics to emerge from media production’s new role in the post-industrial city. At its core, the media hub reveals a regional government more interested in the technology used to deliver “national” stories than the manner of the stories themselves or the cultural practices responsible for creating them. Indeed, Goodbye Brigadoon is most interested in how media professionals based at the emergent cluster negotiate a sense of cultural identity and creative license against the institutional constraints, policy matters, and commercial logic they also must navigate in their workaday rituals. Ultimately, the conclusions offered in this project argue for a more complicated conception of the global-local location where these professionals work. Glasgow’s digital media village, in other words, is much more than an innocuous site of competitive advantage, urban regeneration, and job growth. It is best understood as a site of intense social struggle and unequal power relations where local mediamakers often find the site’s impetus for multiplatform media production an institutionally enforced false promise at odds with the realities of creative labor in the city.

The effects of mentally disabling conditions on legal capacity are escalating, particularly given the ageing Australian demographic. Wills, enduring powers of attorney, and advance health directives are coming to the fore as a means of ensuring that the wishes of people with regard to their property, finances and health care needs are respected should they become legally incapable of making their own decisions. Assessing when a person has lost legal capacity in this context is an ever-increasing concern facing society as a whole but, in particular, the legal and medical professionals conducting the assessments. Empirical and doctrinal research has been undertaken which canvassed legal and medical opinions about the relationship between members of these professions when assessing legal capacity. This research supports the hypothesis that tensions exist when assessing capacity, especially testamentary capacity. One source of tension is the effect of conflicting evidence about the loss of legal capacity given by legal and medical professionals in court, which raises questions such as: which evidence is, and should be, preferred; and who should be responsible? The exploration of these issues will be conducted with reference to the empirical data collected, and a review of the relevant Australian case law.

This research examined the function of Queensland Health's Root Cause Analysis (RCA) to improve patient safety through an investigation of patient harm events where permanent harm and preventable death, Severity Assessment Code 1, were the outcome of healthcare. Unedited and highly legislated RCAs from across Queensland Health public hospitals from 2009, 2010 and 2011 comprised the data. A document analysis revealed the RCAs opposed organisational policy and dominant theoretical directives. If we accept the prevailing assumption that patient harm is a systemic issue, then the RCA is failing to address harm events in healthcare.

This study seeks to answer the question of what the language of administrative press releases is like, and how and why it has changed over the past few decades. The theoretical basis of the study is provided by critical text analysis, supplemented with, e.g., the metafunction theory of Systemic Functional Grammar, the theory of poetic function, and Finnish research into syntax. The data includes 83 press releases by the City of Helsinki Public Works Department, 14 of which were written between 1979 and 1980 (old press releases), and 69 of which were written between 1998 and 1999 (new press releases). The analysis focuses on the linguistic characteristics of the releases, their changes and variation, their relation to other texts and the extra linguistic context, as well as their genre. The core research method is linguistic text analysis. It is supplemented with an analysis of the communicative environment, based on the authors' interviews and written documents. The results can be applied to the improvement of texts produced by the authorities and even by other organizations. The linguistic analysis focuses on features that transform the texts in the data making them guiding, detailed, and poetic. The releases guide the residents of the city using modal verbal expressions and performative verbs that enable the mass media to publish the guiding expressions on their own behalf as such. The guiding is more persuasive in the new press releases than in the old ones, and the new ones also include imperative clauses and verbless directives that construct direct interaction. The language of the releases is made concrete and structurally detailed by, e.g., concrete vocabulary, proper nouns and terms, as well as definitions, adverbials and comparisons, which are used specifically to present places and administrative organizations in detail. The rhetorical features in the releases include alliteration and metaphors, which are found in the new releases especially in the titles. The emphasized features are used to draw the readers' attention and to highlight the core contents of the texts. The new releases also include words that are colloquial in style, making the communicative situations less official. Structurally, the releases have changed from being letter-like to a more newsflash-like format. The changes in the releases can be explained by the development towards more professional communications and the more market-oriented ideology adopted in the communicative environment. Nitrogen (N) is one of the main inputs in cereal cultivation and as more than half of the arable land in Finland is used for cereal production, N has contributed substantially to agricultural pollution through fertilizer leaching and runoff. Based on this global phenomenon, the European Community has launched several directives to reduce agricultural emissions to the environment. Trough such measures, and by using economic incentives, it is expected that northern European agricultural practices will, in the future, include reduced N fertilizer application rates. Reduced use of N fertilizer is likely to decrease both production costs and pollution, but could also result in reduced yields and quality if crops experience temporary N deficiency. Therefore, more efficient N use in cereal production, to minimize pollution risks and maximize farmer income, represents a current challenge for agronomic research in the northern growing areas. The main objective of this study was to determine the differences in nitrogen use efficiency (NUE) among spring cereals grown in Finland. Additional aims were to characterize the multiple roles of NUE by analysing the extent of variation in NUE and its component traits among different cultivars, and to understand how other physiological traits, especially radiation use efficiency (RUE) and light interception, affect and interact with the main components of NUE and contribute to differences among cultivars. This study included cultivars of barley (Hordeum vulgare L.), oat (Avena sativa L.) and wheat (Triticum aestivum L.). Field experiments were conducted between 2001 and 2004 at Jokioinen, in Finland. To determine differences in NUE among cultivars and gauge the achievements of plant breeding in NUE, 17-18 cultivars of each of the three cereal species released between 1909 and 2002 were studied. Responses to nitrogen of landraces, old cultivars and modern cultivars of each cereal species were evaluated under two N regimes (0 and 90 kg N ha-1). Results of the study revealed that modern wheat, oat and barley cultivars had similar NUE values under Finnish growing conditions and only results from a wider range of cultivars indicated that wheat cultivars could have lower NUE than the other species. There was a clear relationship between nitrogen uptake efficiency (UPE) and NUE in all species whereas nitrogen utilization efficiency (UTE) had a strong positive relationship with NUE only for oat. UTE was clearly lower in wheat than in other species. Other traits related to N translocation indicated that wheat also had a lower harvest index, nitrogen harvest index and nitrogen remobilisation efficiency and therefore its N translocation efficiency was confirmed to be very low. On the basis of these results there appears to be potential and also a need for improvement in NUE. These results may help understand the underlying physiological differences in NUE and could help to identify alternative production options, such as the different roles that species can play in crop rotations designed to meet the demands of modern agricultural practices.

Extreme vibration has been reported for small, high speed craft in the maritime sector, with performance and health threatening effects on boat operators and crew. Musculoskeletal injuries are an enduring problem for high speed craft passengers. Spinal or joint injuries and neurological disorders may occur from repetitive pounding over rough water, continued vibration and single impact events. The risk from whole body vibration (WBV) induced through the small vessels mainly depends on time spent on the craft, which can’t be changed in a military scenario; as well as the number of shocks and jolts, and their magnitude and frequency. In the European Union for example, physical agents directives require all employers to control exposure to a number of physical agents including noise and vibration. The EC Vibration Directive 2002/44/EC then sets out regulations for the control of health and safety risks from the exposure of workers to hand arm vibration (HAV) and WBV in the workplace. Australia has exposure standards relating to WBV, AS 2670.1-2001 – Evaluation of human exposure to whole body vibration. This standard is identical to the ISO 2631-1:1997, Mechanical vibration and shock – Evaluation of human exposure to whole-body vibration. Currently, none of the jurisdictions in Australia have specific regulations for vibration exposures in workplaces. However vibration is mentioned to varying degrees in their general regulations, codes of practice and guidance material. WBV on high speed craft is normally caused by “continuous 'hammering' from short steep seas or wind against tide conditions. Shock on High Speed Craft is usually caused by random impacts. Military organisations need the knowledge to make informed decisions regarding their marine operations, compliance with legislation and potentially harmful health effects, and develop and implement appropriate counter-measures. Marine case studies in the UK such as published MAIB (Marine Accident Investigation Branch) reports show injuries that have occurred in operation, and subsequent MCA (Maritime Coastguard Agency) guidance is provided (MGN 436 (M+F), WHOLE-BODY VIBRATION: Guidance on Mitigating Against the Effects of Shocks and Impacts on Small Vessels. MCA, 2011). This paper proposes a research framework to study the origin, impact and pathways for prevention of WBV in small, high speed craft in a maritime environment.

This thesis examines posting of workers within the free movement of services in the European Union. The emphasis is on the case law of the European Court of Justice and in the role it has played in the liberalisation of the service sector in respect of posting of workers. The case law is examined from two different viewpoints: firstly, that of employment law and secondly, immigration law. The aim is to find out how active a role the Court has taken with regard these two fields of law and what are the implications of the Court’s judgments for the regulation on a national level. The first part of the thesis provides a general review of the Community law principles governing the freedom to provide services in the EU. The second part presents the Posted Workers’ Directive and the case law of the European Court of Justice before and after the enactment of the Directive from the viewpoint of employment law. Special attention is paid to a recent judgment in which the Court has taken a restrictive position with regard to a trade union’s right to take collective action against a service provider established in another Member State. The third part of the thesis concentrates, firstly, on the legal status of non-EU nationals lawfully resident in the EU. Secondly, it looks into the question of how the Court’s case law has affected the possibilities to use non-EU nationals as posted workers within the freedom to provide services. The final chapter includes a critical analysis of the Court’s case law on posted workers. The judgments of the European Court of Justice are the principal source of law for this thesis. In the primary legislation the focus is on Articles 49 EC and 50 EC that lay down the rules concerning the free movement of services. Within the secondary legislation, the present work principally concentrates on the Posted Workers’ Directive. It also examines proposals of the European Commission and directives that have been adopted in the field of immigration. The conclusions of the case study are twofold: while in the field of employment law, the European Court of Justice has based its judgments on a very literal interpretation of the Posted Workers’ Directive, in the field of immigration its conclusions have been much more innovative. In both fields of regulation the Court’s judgments have far-reaching implications for the rules concerning posting of workers leaving very little discretion for the Member States’ authorities.

The research reported in this paper documents the use of Web2.0 applications with six Western Australian schools that are considered to be regional and/or remote. With a population of two million people within an area of 2,525,500 square kilometres Western Australia has a number of towns that are classified as regional and remote. Each of the three education systems have set up telecommunications networks to improve learning opportunities for students and administrative services for staff through a virtual private network (VPN) with access from anywhere, anytime and ultimately reduce the feeling of professional and social dislocation experienced by many teachers and students in the isolated communities. By using Web2.0 applications including video conferencing there are enormous opportunities to close the digital divide within the broad directives of the Networking the Nation plan. The Networking the Nation plan aims to connect all Australians regardless of where they are hence closing the digital divide between city and regional living. Email and Internet facilities have greatly improved in rural, regional and remote areas supporting every day school use of the Internet. This study highlights the possibilities and issues for advanced telecommunications usage of Web2.0 applications discussing the research undertaken with these schools. Economic success, and a commitment to the social benefits of inclusive training opportunities are important goals for public vocational education and training (VET). Currently, in Australia, VET policy is a shared responsibility between the Commonwealth and the States and Territories. Priorities for investment are juggled between: a) improving efficiency and responsiveness; and b) providing societal prosperity. Amid recent VET educational reforms and policy directives the authors of this paper undertook a pilot study examining language, literacy and numeracy support and inclusive teaching and learning practices in a Diploma of Nursing course. The data highlighted implications arising from new market driven education reforms. This article reports on identified factors that influenced inclusive learning opportunities, noticeably associated with two recent policy developments: the release of the FSK Foundation Skills Training Package (IBSA 2014); and the Queensland's Higher Skills Program Policy 2014-15.

The need for mutual recognition of accurate measurement results made by competent laboratories has been very widely accepted at the international level e.g., at the World Trade Organization. A partial solution to the problem was made by the International Committee for Weights and Measures (CIPM) in setting up the Mutual Recognition Arrangement (CIPM MRA), which was signed by National Metrology Institutes (NMI) around the world. The core idea of the CIPM MRA is to have global arrangements for the mutual acceptance of the calibration certificates of National Metrology Institutes. The CIPM MRA covers all the fields of science and technology for which NMIs have their national standards. The infrastructure for the metrology of the gaseous compounds carbon monoxide (CO), nitrogen monoxide (NO), nitrogen dioxide (NO2), sulphur dioxide (SO2) and ozone (O3) has been constructed at the national level at the Finnish Meteorological Institute (FMI). The calibration laboratory at the FMI was constructed for providing calibration services for air quality measurements and to fulfil the requirements of a metrology laboratory. The laboratory successfully participated, with good results, in the first comparison project, which was aimed at defining the state of the art in the preparation and analysis of the gas standards used by European metrology institutes and calibration laboratories in the field of air quality. To confirm the competence of the laboratory, the international external surveillance study was conducted at the laboratory. Based on the evidence, the Centre for Metrology and Accreditation (MIKES) designated the calibration laboratory at the Finnish Meteorological Institute (FMI) as a National Standard Laboratory in the field of air quality. With this designation, the MIKES-FMI Standards Laboratory became a member of CIPM MRA, and Finland was brought into the internationally-accepted forum in the field of gas metrology. The concept of ‘once measured - everywhere accepted’ is the leading theme of the CIPM MRA. The calibration service of the MIKES-FMI Standards Laboratory realizes the SI traceability system for the gas components, and is constructed to enable it to meet the requirements of the European air quality directives. In addition, all the relevant uncertainty sources that influence the measurement results have been evaluated, and the uncertainty budgets for the measurement results have been created.

The use of animals in scientific experiments tends to arouse strong emotional reactions among the general public, the most essential concern being the pain and suffering they cause. It is felt that suffering inflicted on other beings, including animals, is not morally acceptable. Is the function of a researcher who uses animals morally acceptable and beneficial for humans and animals? May such a researcher him/herself decide what animal experiments he/she can perform or should some outsider have the right to decide what kind of experiments a researcher can or cannot perform? The research material comprises the legislation of Finland and that of some member and non-member states of the European Union, together with European Union directives and pertinent preparatory parliamentary documents. The author has likewise studied the vast literature on animal rights, both pro and contra writings and opinions. The opinions of philosophers on the moral and legal rights of animals are markedly conflicting. Some strongly support the existence of rights, while others totally refute such an opinion, claiming that the question is only of the moral principles of man himself which imply that animals must be treated in a human manner. Speaking of animal rights only tends to muddle ideas on the one hand in philosophical considerations and in legal analyses on the other. The development of legislation in Finland and some other member states of the European Union has in principle been similar. In Finland, the positive laws on animal experiments nowadays comply with the EU directive 86/609/EEC. However, there are marked differences between member states in respect of the way they have in practice implemented the principles of the EU directive. No essential alterations have in practice been discernible in the actual performance of animal experiments during the decades when legislation has been developed in different countries. Self-regulation within the scientific community has been markedly more effectual than legislative procedures. Legal regulation has nevertheless clearly influenced the quality of breeding and life conditions of experimental laboratory animals, cages for example being nowadays larger than hitherto. EU parliament and council have now accepted in September 2010 a new directive on animal experiments which must be implemented in the national legislations by January 1, 2013.

This paper presents a decentralized/peer-to-peer architecture-based parallel version of the vector evaluated particle swarm optimization (VEPSO) algorithm for multi-objective design optimization of laminated composite plates using message passing interface (MPI). The design optimization of laminated composite plates being a combinatorially explosive constrained non-linear optimization problem (CNOP), with many design variables and a vast solution space, warrants the use of non-parametric and heuristic optimization algorithms like PSO. Optimization requires minimizing both the weight and cost of these composite plates, simultaneously, which renders the problem multi-objective. Hence VEPSO, a multi-objective variant of the PSO algorithm, is used. Despite the use of such a heuristic, the application problem, being computationally intensive, suffers from long execution times due to sequential computation. Hence, a parallel version of the PSO algorithm for the problem has been developed to run on several nodes of an IBM P720 cluster. The proposed parallel algorithm, using MPI's collective communication directives, establishes a peer-to-peer relationship between the constituent parallel processes, deviating from the more common master-slave approach, in achieving reduction of computation time by factor of up to 10. Finally we show the effectiveness of the proposed parallel algorithm by comparing it with a serial implementation of VEPSO and a parallel implementation of the vector evaluated genetic algorithm (VEGA) for the same design problem. Con el objetivo de caracterizar agronómicamente dos genotipos de quequisque (Xanthosoma sp. (L.) Schott) cultivares Masaya y Nueva Guinea, se estableció un ensayo comparativo para evaluar su comportamiento morfológico, fenológico, de rendimiento y la incidencia de enfermedades (bacterianas y virales), en condiciones edafoclimáticas del REGEN-UNA Managua. El ensayo se estableció utilizando el esquema del diseño de bloques completos al azar (BCA), con 4 bloques y 2 tratamientos por bloque. La parcela experimental midió 12 m de largo por 4 m de ancho, con una densidad de 100 plantas por parcela, para un total de 800 plantas en el ensayo, sembradas a una distancia de 0.6 m entre planta y 0.8 m entre surco. 20 plantas ubicadas en los dos surcos centrales representaron la parcela útil, El ANDEVA realizado indican que los cultivares no presentaron diferencias estadísticas significativas entre ellas en las variables morfológicas. Los componentes de rendimiento no mostraron diferencias estadísticas significativas, sin embargo, el cultivar Nueva Guinea presentó siempre los mayores valores. Se reporta incidencia de bacteria Xanthomona campestris pv dieffenbachiae; el cultivar Nueva Guinea presentó 25.5% y el cultivar Masaya 18.5 %. El efecto de la bacteria se manifestó en una reducción del rendimiento en 25.85% para el cultivar Nueva Guinea y un 72. 13% en el cultivar Masaya. Se realizó el primer test de ELISA con el objetivo corroborar que los síntomas presentes en las plantas correspondían con la presencia efectiva del virus. Se encontró que 89 % de las plantas del cultivar Nueva Guinea y un 95.35% del cultivar Masaya estaban infectadas. Se realizaron 4 conteos visuales de la presencia del virus. No se encontró tendencia a disminuir o aumentar el porcentaje de plantas infectadas con el aumento de los días después de la siembra. El clon Masaya reportó un máximo 26.8% de plantas con síntomas y el clon Nueva Guinea un 25.9% a los 120 días ambos. La segunda prueba de ELISA a muestras tomadas al azar de hojas de la plantas de ambos dones reportó que el cultivar Masaya tenía un 97.5% de sus plantas infectadas y el cultivar Nueva Guinea 100 %.

El objetivo del presente estudio fue el determinar el rendimiento y adaptabilidad de tres cultivares clonales de quequisque Masaya (MY), Nueva Guinea (NG) y Apalí (AP), en la comunidad de La Poma, Masaya establecidas en época de postrera. El ensayo se estableció siguiendo arreglo del diseño de bloque completos al azar, unifactorial, con tres tratamientos y tres bloques. La parcela experimental estuvo conformada de 4 surcos de 13 m y l m de separación entre ellos, para un área de 52 m2 En cada surco se establecieron 22 plantas y una separación de 0. 6 m entre las mismas, para un total de 88 plantas por parcela, 264 por bloque y 792 totales en el ensayo. La parcela útil la conformaron los 2 surcos centrales sin incluir las primeras 5 plantas, para un total de 20 plantas evaluadas. El área del bloque fue de 156 m y el área total del ensayo de 468 m . Las variables evaluadas fueron: las morfológicas (altura de planta en cm, número de hojas, grosor del seudotallo en cm2, área foliar en cm2 y número de hijos), los componentes del rendimiento (peso promedio por cormelo en g, peso promedio de cormelos por planta en g, dimensión de cormelo en cm2 y número de cormelos); los eventos morfológicos (velocidad de brotación y ahijamiento, momento de cosecha), incidencia de enfermedades virales, fungosas y bacterianas y el efecto del DMV sobre el rendimiento. El análisis de varianza realizado a las variables morfológicas indica que: los 3 genotipos presentaron valores estadísticamente similares en las variables altura de planta, grosor del seudotallo, número de hojas y área foliar al menos en las 6 primeras evaluaciones, únicamente en variable número de hijos el clon NG obtuvo resultados estadísticamente superiores a los otros dones en estudio. El ANDEVA de los datos de los componentes del rendimiento señala que no hubo diferencias estadísticas entre los cultivares en cuanto a peso de los cormelos por planta: NG (75.26 qq/mz), AP (53,67 qq/mz) y MY (64.98 qq/mz)y dimensiones del cormelo; sin embargo, el número de cormelos por planta las plantas NG reportaron valores promedios superiores estadísticamente a los reportados por el clon MY (2.94) y AP (3. 28). El peso promedio de los cormos fue superior estadísticamente en el don MY (79.16 g) con relación a los reportados por NG (58.35g) y AP (79. 16 g). Se realizó un primer test de ELISA a las muestras de hojas de plantas que presentaban los síntomas, se encontró un 96 % de incidencia del DMV en las muestras . Considerando el total de plantas por cultivar en el ensayo, la mayor incidencia la presentó el clon NG con 47 %. Tres conteos visuales posteriores indican que los valores de plantas que presentan los síntomas. varían en cada fecha de evaluación encontrándose el cv. Apalí con los mayores valores de infección. Los conteos visuales de los síntomas de la bacteria Xanthomona campestris (Pammel) Dowson registran los mayores valores al cultivar AP con valores de 6 %, seguido del cultivar NG con 3.33% y MY con 1.66% a los 150 dds y un leve incremento a los 210 dds de 8. 33% para el AP y 5 % para los cultivares NG y MY. Los conteos visuales de los síntomas de Collectrotichum Kloesporioides (Penz) indican que los valores de reportados a los 150 dds redujeron a los 210 dds en todos los genotipos. En el caso del cultivar NG de 13.33 % en la primera fecha a 5% en la segunda, de 10 a 3.33% en el cultivar AP, y de 13.33 a 6.66% en el caso del clon MY.
