The importance of the banks and financial markets relies on the fact that they promote economic efficiency by allocating savings efficiently to profitable investment opportunities.An efficient banking system is a key determinant for the financial stability.The theory of market failure forms the basis for understanding financial regulation.Following the detrimental economic and financial consequences in theaftermath of the crisis, academics and policymakers started to focus their attention on the construction of an appropriate regulatory and supervisory framework of the banking sector. This dissertation aims at understanding the impact of regulations and supervision on banks’ performance focusing on two emerging market economies, Turkey and Russia. It aims at examining the way in which regulations matter for financial stability and banking performance from a law & economics perspective. A review of the theory of banking regulation, particularly as applied to emerging economies, shows that the efficiency of certain solutions regarding banking regulation is open to debate. Therefore, in the context of emerging countries, whether a certain approach is efficient or not will be presented as an empirical question to which this dissertation will try to find an answer.

After the 2008 financial crisis, the financial innovation product Credit-Default-Swap (CDS) was widely blamed as the main cause of this crisis. CDS is one type of over-the-counter (OTC) traded derivatives. Before the crisis, the trading of CDS was very popular among the financial institutions. But meanwhile, excessive speculative CDSs transactions in a legal environment of scant regulation accumulated huge risks in the financial system. This dissertation is divided into three parts. In Part I, we discussed the primers of the CDSs and its market development, then we analyzed in detail the roles CDSs had played in this crisis based on economic studies. It is advanced that CDSs not just promoted the eruption of the crisis in 2007 but also exacerbated it in 2008. In part II, we asked ourselves what are the legal origins of this crisis in relation with CDSs, as we believe that financial instruments could only function, positive or negative, under certain legal institutional environment. After an in-depth inquiry, we observed that at least three traditional legal doctrines were eroded or circumvented by OTC derivatives. It is argued that the malfunction of these doctrines, on the one hand, facilitated the proliferation of speculative CDSs transactions; on the other hand, eroded the original risk-control legal mechanism. Therefore, the 2008 crisis could escalate rapidly into a global financial tsunami, which was out of control of the regulators. In Part III, we focused on the European Union’s regulatory reform towards the OTC derivatives market. In specific, EU introduced mandatory central counterparty clearing obligation for qualified OTC derivatives, and requires that all OTC derivatives shall be reported to a trade repository. It is observable that EU’s approach in re-regulating the derivatives market is different with the traditional administrative regulation, but aiming at constructing a new market infrastructure for OTC derivatives.

En el Noroeste de México el incremento en la productividad agrícola entre los años de 1940 y 1970, fue debido a la expansión de las tierras de cultivo, el uso de fertilizantes y semillas mejoradas, la mecanización, la mayor disponibilidad de créditos, a los sistemas de irrigación y el mejoramiento de las carreteras. Así como la importante intervención del Estado mexicano al implementar políticas de inversión con el apoyo de agencias internacionales de desarrollo, y otorgar facilidades de crédito para el desarrollo de la agricultura a través de la creación de bancos agrícolas oficiales y las facilidades para la constitución de bancos privados comerciales.Después de la desarticulación de la banca en México debido a la revolución, se avanzó con pasos firmes en la reestructuración del sistema bancario con la creación de una nueva legislación bancaria, la fundación del Banco de México y la Comisión Nacional Bancaria en 1924; Banco Nacional de Crédito Agrícola (1926), el Banco Nacional de Crédito Ejidal (1935), el Banco Nacional de Comercio Exterior (1937) y el Banco Nacional Agropecuario (1965), que dieron apoyo financiero a los pequeños agricultores y ejidatarios. Los principales agricultores de Sinaloa y Sonora en colaboración con el gobierno federal a través de la Comisión Monetaria y el Banco de México fundaron el Banco de Sinaloa y el Banco Agrícola Sonorense en 1933. Explicar el impacto que tuvieron estas instituciones financieras en el crédito agrícola de Sinaloa y Sonora será el objetivo central de este trabajo.

This study shows that many bad loans now burdening Taiwan's financial institutions are interrelated with the society's democratization which started in the late 1980s. Democratization made the local factions and business groups more independent from the Kuomintang government. They acquired more political influence than under the authoritarian regime. These changes induced them to manage their owned financial institutions more arbitrarily and to intervene more frequently in the state-affiliated financial institutions. Moreover they interfered in financial reform and compelled the government to allow many more new banks than it had originally planned. As a result the financial system became more competitive and the qualities of loans deteriorated. Some local factions and business groups exacerbated the situation by establishing banks in order to funnel funds to themselves, sometimes illegally. Thus many bad loans were created as the side effect of democratization.

本稿では初めに、イスラーム銀行に関する内外の研究状況について俯瞰し、その後でイスラーム銀行が設立される基にある「利子(リバー)の禁止」について述べ、そして歴史上のイスラーム金融について述べた。続いて、1970年代以降のイスラーム銀行の発展について整理した。そこでは、ダール・アル・マール・アル・イスラーミー・グループやアル・バラカ・グループなどのイスラーム銀行グループにも言及しながらイスラーム銀行の発展について述べ、また、中東や南アジア、東南アジアの主要国における状況やアフリカやヨーロッパなどへの拡大についてもまとめた。後半では、イスラーム銀行・イスラーム金融がどのような問題を抱えているかという点について、サウジアラビアを例として既存の金融体制との矛盾の問題を検討し、続いて、実際の金融活動ではムラーバハ金融やその類似手法が多く用いられていることやマレーシアでは非イスラーム教徒の中国系住民がイスラーム銀行の顧客の過半数を占めていることを示しながら、イスラーム金融でも実際には「高利回り」への志向が強まっているなど、イスラーム金融抱えている根本的な問題についても検討した。

This paper will document financial aspects of transactions, and trade credit supply behavior with FDI among small and medium-sized enterprises(SMEs) based on two original surveys, conducted in four cities in China in 2003. The survey was designed to capture the nature of inter-firm transactions, trade credit and other financial conditions. Literature on FDI mainly refers to technology transfer, employment or investment. This paper focuses on the role and significance of FDI in the supply of trade credit due to its trade credit enforcement technology. Yanagawa, Ito and Watanabe [2006] developed a model which indicates that when a seller has higher enforcement technology or a buyer has richer liquidity, both trade credit and transaction volume will be increased. In this paper, we confirmed that FDI and G contributed to the provision of trade credit and had a positive external effect on trade credit enforcement towards China’s economy. (1) Sales towards FDI customers have the power to increase the trade credit ratio,even when controlling other factors such as choice of payment instrument, competitiveness, and expost default management. This implies that FDI does provide trade credit, not only because it has superior liquidity, but because it is also superior in terms of enforcement of trade credit repayment.(2) Cash constraints of the buyer influence the decisions concerning trade credit provided by the seller, as a model in Yanagawa, et al. [2006] predicted, and this implies that strategic default is a serious concern among SMEs in China. (3) Spillover effect exists in payment enforcement technology in transactions with FDI customers.

Compared to the size of the microfinance market, the number of Microfinance Institutions that are professionally ran like commercial banks is still scarce, and even more scarce are the MFI listed in public stock exchanges. This document focuses on four listed MFIs and reviews its business model and funding sources. The document also analyses the market price evolution of the listed shares and investigates whether investors are assigning a premium to the MFIs compared with its respective market indices. In recent years international investors are increasing the focus on the social consequences of their investments along with its financial returns. The microfinance sector, considered as an asset class is a relatively young concept but the microfinance industry is experiencing a tremendous growth and has a high potential for the future. Today most social responsible investments in microfinance are performed through loans or fixed income structured finance vehicles. The possibilities to invest in the equity tranche of the industry are still scarce since the number of listed microfinance institutions is reduced and the private equity investments are limited and difficult to reach for the majority of investors. In this document we present a study on the characteristics of the MFIs and we try to shed some light on this subsector of the equity assets universe that may become important in the coming future. En la situación actual, en la que la inestabilidad económica es un hecho, se plantea analizar y estudiar el estado de las entidades financieras. El estudio a realizar se circunscribe únicamente al ámbito nacional, debido a la idiosincrasia de los bancos. Para conocer el entorno en el que se mueven los bancos nacionales, se analiza en primer lugar el estado financiero de los países más relevantes a nivel internacional, para posteriormente estudiar la situación económica de España, especialmente en el sector bancario. Se pretende establecer el marco en el que se mueve dicho sector, para poder tener toda la información necesaria para entender no sólo los problemas que afectan a estas entidades, sino también para ver que es necesario un cambio para que estas organizaciones puedan evolucionar y desarrollarse. Una vez detallado el entorno en el que se tienen que mover los bancos, se detallan los principales motivos por los que han perdido credibilidad de cara a los clientes y a los organismos internacionales responsables de velar por la correcta ejecución de las operaciones bancarias, conforme a unas normativas ya establecidas. Se han mencionado algunos ejemplos significativos y con gran repercusión social. No se entra a detallar cada uno de los casos, el objetivo es mostrar que este tipo de actuaciones no sólo perjudican a la propia entidad sino que repercuten en todo el ámbito financiero nacional. Al profundizar en los motivos que han llevado a los bancos a la situación que sufren actualmente, se ve que mantener el mismo método de trabajo no es sostenible a largo plazo; por ello, se plantea un cambio en su estrategia, en concreto un cambio en el modelo de cultura organizacional. Se toma como modelo el empleado en otras empresas, principalmente orientales, por su carácter innovador y por estar más alineadas con las nuevas necesidades y requerimientos de los clientes actualmente. La evolución de las tecnologías ha supuesto un cambio disruptivo en la forma de hacer negocios: algo que debe adoptar la banca para poder, no sólo competir, sino sobrevivir. El cambio de modelo estratégico ha de iniciarse en la Alta Dirección, para propagarse posteriormente al resto de la organización. Al tratarse de un cambio de gran envergadura, su completa implantación llevará años, por lo que es imprescindible realizar un seguimiento y una revisión continua del mismo. Finalmente se comentan las ventajas que el banco conseguirá con este cambio. Éstas abarcan la recuperación de la confianza de los clientes, pasando por una modernización (necesaria en cualquier caso), para completarse con un incremento de los beneficios económicos, que no deja de ser uno de los motores de los bancos. ---ABSTRACT---Nowadays, the economic instability is a fact, so in this project we have studied and analysed the status of financial institutions. This study is limited to the national environment, due to the idiosyncrasy of the banks. In order to understand the environment in which national banks moved, firstly it has been analysed the financial status of the most relevant countries internationally, to study later the economic status of Spain, especially in the banking sector. The aim is to establish a framework in which the sector moves, to have at the end all the necessary information to understand, not only the issues that are affecting to this entities, but also to realize that a change is necessary for their progress and develop. Once detailed the environment in which the banks have to move, it is detailed the main reasons that have lead them to lose credibility with customers, and with international agencies responsible for ensuring the correct execution of banking operations. These operations must be done under established regulations. It has been mentioned some significant examples of mistakes that have had a social impact. It has not been detailed each outrageous, the objective is to show that this kind of actions not only hurt the institution itself, but also affect the entire national financial sector. Into the reasons that have led banks to the actual situation, it can be seen that keeping the same method of working is not sustainable in the long term; therefore, a change of strategy is proposed, more specifically a change in the model of organizational culture. The reference model has been one used by other companies, mainly eastern companies, due to its innovation and its capability to be aligned with the changing needs and requirements of customers nowadays. The evolution of technology has been a disruptive change in the way of doing business: something to be taken by the bank, not only to compete but also to survive. The strategic model change must start with the compromise of CEO’s, and later must be spread to the rest of the organization. It is a major change, so its full implementation will take years, so, it is basic to carry out continuous reviews. Finally, the advantages that the bank will get with this change are discussed. These advantages include recovery of customer confidence, through modernization (something needed anyway), to be enriched by an increase in economic benefits, the engine of the banks.

Esta investigación se centra en determinar los grupos estratégicos (GE) de la industria bancaria venezolana y su influencia sobre el desempeño en el sector, así como su relación con la cobertura y la exclusión geográfica, durante el período 2008-2010. El test M de Box demostró que hubo inestabilidad financiera durante este lapso de tiempo, por ello se evaluó el comportamiento de los GE en cada año de estudio. La muestra se constituyó para el año 2008 por 58 entidades financieras, en el año 2009 por 52 entidades bancarias y para el período 2010 por sólo 39 instituciones. Antes de la aplicación del análisis cluster a las variables de alcance de la estrategia y recursos comprometidos, se realizó un análisis de componentes principales para determinar la relación entre estas variables y detectar valores atípicos; mientras que para distinguir las estrategias que caracterizaron a los grupos se siguió el procedimiento de uso común propuesto por Amel y Rhoades (1988), y se reforzó con la realización de las pruebas de contraste de medias o medianas ANOVA, Scheffé, Kruskal-Wallis y U de Mann-Whitney. Se empleó el paquete estadístico SPSS (versión 15.0) y el software de sistema de información geográfica Arcgis (versión 9.2) para lograr el objetivo propuesto. Los resultados indican que: 1) Al aplicar un procedimiento estadístico es posible detectar gradaciones en la implementación o evasión de las estrategias o del compromiso de recursos por parte de los GE, 2) En momentos de inestabilidad financiera los bancos cambian de estrategia y por tanto de GE, con el fin de obtener un buen desempeño, o al menos sobrevivir, 3) Sólo hubo evidencia parcial de la validez predictiva de los grupos estratégicos, 4) Al menos en Venezuela, los GE bancarios tienden a adoptar una estrategia de cobertura geográfica acorde con su estrategia financiera y, además que, los GE difieren en el nivel de Responsabilidad Social Empresarial en la lucha contra la exclusión financiera geográfica. ABSTRACT This research focuses on identifying strategic groups (SG) of the Venezuelan banking industry and its influence on the performance in the sector and its relationship with geographical coverage and exclusion, during the period 2008-2010. Box M test showed that there was financial instability during this period, so the behavior of SG in each year of study was evaluated. The sample was established for 2008 by 58 financial institutions, in 2009 by 52 banks and for the period 2010 to only 39 institutions. Before applying the cluster analysis variables scope of the strategy and committed resources, principal component analysis was performed to determine the relationship between these variables and outliers; while distinguishing strategies that characterized the group proposed by Amel and Rhoades (1988) commonly used procedure was followed and reinforced by the performance of tests contrast mean or median ANOVA, Scheffé, Kruskal-Wallis and Mann-Whitney. SPSS (version 15.0) and software Arcgis geographic information system (version 9.2) was used to achieve the objective. The results indicate that: 1) By applying a statistical procedure can detect gradations in implementation or avoidance strategies or resource commitment by SG, 2) In times of financial instability banks change their strategy and therefore SG, in order to get a good performance, or at least survive, 3) There was only partial evidence for the predictive validity of strategic groups, 4) At least in Venezuela, banking SG tend to adopt a strategy of geographical coverage according to their financial strategy and also that the SG differ in the level of corporate social responsibility in the fight against financial exclusion Geographic.

O objetivo deste estudo consistiu-se em analisar os fatores influentes no comportamento de compra industrial, na situação de decisão de crédito bancário em pequenas empresas. Para tanto, foram entregues questionários a doze empresas da indústria gráfica, selecionadas pelo número de empregados (de 20 a 100 - pequenas indústrias, segundo o critério do IBGE), localizadas no Distrito Federal e associadas ao sindicato da categoria. De acordo com resultados obtidos por meio do levantamento de campo, as conclusões desta pesquisa puderam ser exploradas tendo-se como base três pontos principais: a) os resultados relativos aos fatores influentes no comportamento do consumidor industrial, tais como os referentes a importância da localização geográfica do fornecedor, dos seus recursos tecnológicos e da redução, pelos compradores, dos riscos percebidos nas decisões de compras, dentre outros que mostraram-se condizentes com as pressuposições do modelo de comportamento do mercado industrial adotado; b) a discussão relativa à situação de decisão de crédito bancário, baseado na literatura pesquisada. De acordo com os resultados, puderam-se detalhar os aspectos relativos aos atributos dos bancos e do crédito, destacando-se, dentre outros, a importância da imagem da instituição financeira, da qualidade do gerente de contas e do custo dos empréstimos e financiamentos; c) as especificidades da pequena empresa, que puderam ser visualizadas nos resultados da pesquisa de campo como, por exemplo, a estratégia intuitiva e pouco formalizada, a situação extra-organizacional incontrolável e a racionalidade político-econômico-familiar do pequeno empresário.

As cooperativas de crédito são instituições financeiras que têm como finalidade principal a prestação de serviços bancários e de intermediação financeira voltando-se para a geração de benefícios ao cooperado, através de benefícios econômicos encontrados sob a forma cooperativada. Considerando o objetivo destas organizações, o presente trabalho teve por objetivo avaliar a eficiência das mesmas considerando duas vertentes: 1) a atividade de intermediação financeira; e 2) a atividade de prestação de serviços bancários, a partir de variáveis contábeis. A técnica utilizada para a avaliação da eficiência foi a Análise Envoltória de Dados e foram analisados os determinantes da eficiência por meio de regressões do tipo Tobit. A amostra é composta por 315 cooperativas singulares listadas na base de dados do Banco Central do Brasil e foram utilizados os dados dos balancetes anuais e semestrais (soma dos semestres para as contas de resultado de cada ano) apresentados para período de 2007 a 2014. Os resultados indicaram baixa eficiência das cooperativas na prestação de serviços bancários, com 73% da amostra apresentando ineficiência ao longo de todos os anos do período em análise. Na atividade de intermediação financeira 20 cooperativas foram eficientes ao longo do período completo, com as demais apresentando graus de ineficiência abaixo de 16% em todos os anos. Quanto aos determinantes da eficiência, verificou-se como principais fatores na atividade de intermediação financeira a Imobilização, a Insolvência, o Descasamento Passivo e as Despesas Administrativas, enquanto na atividade de prestação de serviços os principais determinantes foram a Captação por Floating e as Despesas Administrativas. Os resultados da eficiência na intermediação financeira indicaram baixos graus de ineficiência, enquanto os altos graus de ineficiência na prestação de serviços bancários alertaram para a pouca importância dada ao fornecimentos destes serviços e para a importância de se utilizar dois modelos distintos para a avaliação da eficiência em cooperativas de crédito, dado o comportamento desvinculado entre as duas atividades avaliadas.

This study attempts to develop performance indicators for the financial markets based on the findings in an earlier Factor Markets Working Paper (No. 33, “Agricultural credit market institutions: A comparison of selected European countries”) and on FADN (Farm Accountancy Data Network) data. Two indicators were developed. One measured the long-term economic sustainability of agricultural firms since the financial characteristics of the firms were perceived as important factors when rejecting a loan applicant. If the indicator works, it should show that a low value in this indicator is related to the performance in the financial markets. The second indicator was the loan-to-value (LTV), or debt-to-asset ratio, the reasoning behind this indicator is that low values can point to credit constraints, and in WP 33 we saw that the interviewed experts expected LTVs to be much higher than what is actually the case. We find that the first indicator can’t be used to measure the performance of the financial institutions, since we can’t show any relationship between the indicator and activities in the financial markets. However, the indicator is valuable for its measurement of the long-term financial sustainability of the agricultural sector, or of the firms. The loan-to-value indicator does imply that most countries would have room to increase the credit.
