This second edition contains many new questions covering recent developments in the field of landlord and tenant law including Bruton v London and Quadrant Housing Trust, Hemmingway Securities Ltd v Dunraven Ltd, British Telecommunications plc v Sun Life Assurance Society plc and Graysim Holdings Ltd v P&O Property Holdings Ltd. New topics covered also include the Landlord and Tenant (Covenant) Act 1995, the Contracts (Rights of Third Parties) Act 1999 and the Agricultural Tenancies Act 1995. In addition the authors have made substantial revisions to existing questions in order to bring them in line with recent case law and statutory provisions, which include the Housing Act 1996 and the Unfair Terms in Consumer Contracts Regulations 1999. Analyses cases involving the construction of perpetually renewable leases (PRLs) under the Law of Property Act 1922 s.145 and Sch.15, and the findings of a study into whether the relevant provisions should be repealed. Reviews the problems arising where courts have allowed a perpetually renewable term to be created, the need for an express covenant for renewal and the scope for a human rights challenge to PRLs. Small Arms and Light Weapons (SALW) proliferation was undertaken by the Non-Governmental Organizations (NGOs) as the next important issue in international relations after the success of the International Campaign to Ban Landmines (ICBL). This dissertation focuses on the reasons why the issue of SALW resulted in an Action Program rather than an international convention. Thus, this result was considered as unsuccessful by the advocates of regulating the illicit trade in SALW. The study provides a social movement theoretical approach, using framing, political opportunity and network analysis to explain why the advocates of regulating the illicit trade in SALW did no succeed in their goals. The UN is taken as the arena in which NGOs, States and International Governmental Organizations (IGOs) discussed the illicit trade in SALW. ^ The findings of the study indicate that the political opportunity for the issue of SALW was not ideal. The network of NGOs, States and IGOs was not strong. The NGOs advocating regulation of SALW were divided over the approach of the issue and were part of different coalitions with differing objectives. Despite initial widespread interest among States, only a couple of States were fully committed to the issue till the end. The regional IGOs approached the issue based on their regional priorities and were less interested in an international covenant. The advocates of regulating illicit trade in SALW attempted to frame SALW as a humanitarian issue rather than as a security issue. Thus they were not able to use frame alignment to convince states to treat SALW as a humanitarian issue. In conclusion it can be said that all three items, framing, political opportunity and the network, play a role in the lack of success of advocates for regulating the illicit trade in SALW. ^

Supersession is the theory of one idea supplanting the other. In both Christianity and Islam, this idea is commonplace. In Christianity, the message of Jesus creates a New Covenant for both Jews and Gentiles, while in Islam, the revelation of Muhammad restores the original religion that God intended from the beginning. Christianity and Islam both supersede Judaism in very similar ways. In regards to the use of Abraham in particular, each religion inherits him by appealing to Jewish scripture or their oral tradition, using him to prove their truth claims, and claiming that their religion is originally the religion of Abraham.

The question of how far and in what way to extend protection to witnesses in trials has manifested itself in institutions as diverse as the European Court of Human Rights (ECHR), the Committee of the International Covenant on Civil and Political Rights (ICCPR), the ad hoc criminal tribunals (International Criminal Tribunal for the former Yugoslavia, International Criminal Tribunal for Rwanda, the Special Court for Sierra Leone), and most recently the International Criminal Court (ICC). This is not surprising; as David Lusty has pointed out in his seminal analysis of the use of anonymous accusers, the question has arisen in almost every legal deliberative body for the past two thousand years.

Public Lightning is an important part of municipality’s nighttime landscape. Lighting can be used to enhance public safety and security while improving the aesthetic appeal of the surrounding properties but with the current global financial crisis, such lighting systems must also be sustainable. Most climate policy efforts focus on the state and international level, however national governments won’t be able to meet their international commitments without local action. In Portugal, the Public Lighting is responsible for 3% of energy consumption. The problem is that the trend is to increase (about 4-5% per year) which represents very high costs for the municipal authorities. In terms of numbers are analyzed in this thesis 45 of 278 existent in Continental Portugal what represents only 16,2 % of the counties. This where the local authorities in Portugal that had a Sustainable Energy Action Plan (SEAP) that had been accepted and made available in the Covenant of Mayors website until the end of year 2013. It is important that the Covenant of Mayors will increase the local authorities awareness for energy efficiency and especially to public lighting because there is still a long way to go in terms of energy consumption reduction. In future works it would be interesting to see the payback of the EolGreen post in a real scenario due to lack of energy consumption from the grid it would allow to have a pretty high initial investment even with the maintenance that those technologies need.

O crescimento exponencial da população mundial que assentou essencialmente na utilização de combustíveis fósseis e o facto de aproximadamente ¾ da população mundial viver em cidades, criou uma situação insustentável de emissões de CO2 para a atmosfera. No sentido de minimizar e tentar reverter este comportamento a União Europeia criou o programa Pacto dos Autarcas, que visa o comprometimento de um território em reduzir as suas emissões de CO2 em, pelo menos, 20% até 2020, através do chamado Plano de Ação. O presente trabalho pretende desenvolver um possível Plano de Ação para a Sustentabilidade Energética para o município de Vale de Cambra. Da realização da matriz energética para este município foi inventariado o consumo de 47.154 tep e respectivas emissões de CO2 associada de 108.084 toneladas, para o ano de referência 2012. Face ao estudo compreendido entre 2002 e 2012 são previstos consumos e emissões na ordem de 54.327 tep e 123.059 toneladas de CO2 respetivamente até 2020 caso não sejam tomadas medidas para inverter essa tendência. Baseado na interpretação da matriz energética criada, propõe-se um conjunto de ações nas áreas da indústria, mobilidade, edifícios, energias renováveis, eficiência energética, governabilização e ainda sensibilização/formação para obter uma redução de 20% das emissões e consumo em 2020, passando para 98.447 toneladas de CO2 emitidas e 43.462 tep respetivamente. Conclui-se que o planeamento energético de um território é de elevada importância porque permite articular vários aspectos, conseguindo aumentar a protecção do ambiente (com a redução de emissões de gases efeito de estufa) e aumentando a eficiência energética do território, aumenta a sua competitividade económica e consequentemente maior oportunidade de investimentos externos, criando mais oportunidades de emprego e bem-estar social.

We study the changes in the consumers’ and producers’ surplus associated with acquisition deals where there is a non-competition covenant that forbids the seller from re-entering the market over a given time period. We find that these cquisition deals can lead to significant negative (positive) changes in the producers’ consumers’) surplus, which decrease significantly with the time period of the covenant. We also show that the effect of the time period of the covenant on the welfare change can be positive or negative. It depends largely on the market conditions, such as the profit uncertainty and growth rate.

Resumen Los sistemas de indicadores en materia de derechos económicos, sociales y culturales han tenido un vertiginoso avance en los últimos tiempos en el seno de la Organización de las Naciones Unidas. La justiciabilidad de los derechos citados ha presentado sendos problemas debido a que el artículo segundo del Pacto Internacional de Derechos Económicos, Sociales y Culturales establece que depende de aspectos tales como los recursos disponibles del Estado, la progresividad en la implementación de políticas, entre otros. Por lo tanto, no se le han asignado a tales derechos, un carácter exigible y esta situación ha provocado que su vigencia sea limitada. Precisamente, este ensayo pretende demostrar cómo se ha revertido esta concepción y a través de los sistemas de indicadores desarrollados para diferentes derechos humanos se pueden obtener prestaciones mínimas, que deben cumplir los Estados, para satisfacer las demandas de alcance general.Palabras clave: derechos económicos, sociales y culturales, Organización de las Naciones Unidas, justiciabilidad, progresividad, indicadores de resultado, modelo de indicadores, desarrollo humano.AbstractIndicator systems in terms of economic, social and cultural rights have had a rapid development lately within the United Nations Organization. The justiciability of these rights has presented problems, mainly because of the second article of the International Covenant on Economic, Social and Cultural Rights states that it depends on aspects such as available resources of the State, the progressivity in the implementation of policies, etc. Therefore, these rights have not been given a mandatory character, and this has led to their limited effect. ResumenEl presente artículo pretende establecer al menos, cuatro problemáticas que inciden o afectan la plenitud de los derechos económicos, sociales y culturales como derechos humanos de disfrute general. Las problemáticas por analizar consisten en la implementación; derecho mínimo exigible; justiciabilidad y decisiones políticas de los Estados, y en consecuencia en cada una de estas variables se examinará en que medida inciden en el desarrollo pleno de los citados derechos. Se establece como idea central del ensayo, que tales derechos presentan problemas que empiezan desde su limitada concepción normativa (art. 2 Pacto Internacional Derechos Económicos, Sociales y Culturales), hasta los factores cotidianos que igualmente limitan su alcance extensivo. ResumenEste trabajo pretende abordar desde un enfoque deductivo, el fenómeno del relativismo cultural. Es así como se parten de las premisas teóricas y conceptuales de lo que se entiende por este tipo de relativismo, su contraste con los derechos humanos de alcance universal, hasta llegar a su implementación a través de diferentes normas internacionales. Se analizarán las principales fuentes, consistentes en tratados, conferencias y declaraciones, en las que se visualiza la tutela y defensa del relativismo cultural. Finalmente, se reflexionará en torno a la efectividad de la salvaguarda de esta modalidad de relativismo y las particularidades propias de cada una de las fuentes jurídicas y políticas invocadas.
