Nel presente lavoro viene trattato il delicato tema dell’autotutela collettiva, nell’intersezione tra ipotesi di revisione nazionale e prospettive europee. Dapprima viene ricostruita l’evoluzione della valutazione del conflitto collettivo nell’ordinamento giuridico italiano ed effettuata una ricognizione delle diverse manifestazioni del conflitto collettivo ivi riscontrabili. Il tentativo è quello di superare i limiti di una trattazione ristretta allo sciopero e di verificare la perdurante validità della tradizionale nozione di sciopero, intesa esclusivamente come astensione collettiva dalle prestazioni di lavoro. In un secondo capitolo vengono esaminati i disegni di legge di riforma in materia di conflitto collettivo, presentati nel corso della XVI legislatura e le clausole, incidenti sulla medesima materia, rinvenibili nell’Accordo interconfederale del 28 giugno 2011 e negli accordi FIAT del 2010, relativi agli stabilimenti di Pomigliano D’Arco e Mirafiori. Alla luce di tali materiali, si riesaminano le tematiche della titolarità individuale del diritto di sciopero, delle clausole di tregua e delle procedure arbitrali e conciliative. Successivamente, viene esaminata la produzione legislativa e giurisprudenziale comunitaria in tema di conflitto collettivo. Il confronto con l’ordinamento nazionale consente di mettere criticamente in luce il diverso rapporto tra mercato e diritti d’azione collettiva e di rilevare che nell’ordinamento comunitario la giurisprudenza della Corte di giustizia abbia introdotto limiti eccessivi al dispiegarsi dei diritti sociali in esame. Da ultimo, vengono formulate alcune considerazioni conclusive. Criticamente viene rilevato come, in tempi di globalizzazione, non viene prestata sufficiente attenzione alla valorizzazione del conflitto collettivo, come motore dell’emancipazione e del progresso sociale.

L’elaborato esamina il tema del concorso e del conflitto tra contratti collettivi di diverso livello nel settore privato. Partendo da un’impostazione complessiva del fenomeno della contrattazione collettiva, oltre che da una riflessione sulla natura e sul ruolo della contrattazione integrativa, il lavoro si propone di individuare un criterio di risoluzione del conflitto. In una prima parte della ricerca sono stati individuati e studiati i modelli di rapporti tra livelli definiti negli accordi interconfederali e nei contratti di categoria. Nello studio della regolamentazione interna al sistema sindacale si è considerato la natura delle relative clausole. Queste ultime hanno valenza obbligatoria e, per tale motivo, non sono idonee a risolvere l’eventuale conflitto tra livelli contrattuali. Si è reso quindi necessario considerare i criteri esterni di risoluzione del conflitto elaborati dalla dottrina e della giurisprudenza. Tra i vari criteri elaborati, ci si è soffermati sul criterio di specialità, sulla sua natura e sulla sua funzione. Più nello specifico, si è ritenuto il principio di specialità un principio generale dell’ordinamento giuridico, applicabile anche al conflitto tra contratti di diverso livello. Alla luce del principio di specialità, si è ricostruito il rapporto tra livelli, anche in ipotesi di contrattazione separata e di negoziazione operante su rinvio legislativo. Infine, nell’ultimo capitolo si è esaminato l’art. 8 della L. 148/2011. Ci si è interrogati sulla compatibilità di tale norma con l’impostazione complessiva del tema del rapporto tra contratti di diverso livello e sui suoi riflessi sulla questione del conflitto.

Il lavoro di ricerca che si presenta è suddiviso in tre capitoli nei quali, da altrettanti punti di osservazione, è analizzato il tema della instabilità del lavoro. Nel primo capitolo, il candidato evidenzia le cause che hanno determinato il vorticoso aumento di utilizzo dei contratti di lavoro flessibili e, a tal proposito, da un prospettiva extra-nazionale, analizza le direttive europee e, i principi comuni e le guidelines che, nel percorso di sviluppo della strategia europea per l’occupazione, hanno posto la flexicurity come modello di mercato europeo tipico; dalla medesima prospettiva, prendendo spunto dai cambiamenti del mercato globale, si pone attenzione all’analisi economica del diritto del lavoro e, in particolare, alle conseguenze che le trasformazioni economiche generano sulla capacità di questa materia di tenere elevato il grado di sicurezza occupazionale connesso alla stipula dei contratti di lavoro. Il secondo capitolo è dedicato al ruolo svolto in Italia dai sindacati sul tema della flessibilità. In tal senso, l’autore evidenzia come la funzione “istituzionale” cui sono chiamate anche le organizzazioni dei lavoratori abbia caratterizzato le scelte di politica sindacale in materia di lavori temporanei; è così preso in esame il concetto di flessibilità “contrattata”, come già emerso in dottrina, e si teorizza la differenza tra rinvii “aperti” e rinvii “chiusi”, quali differenti forme di delega di potere normativo alle parti sociali in materia di flessibilità. Nel terzo ed ultimo capitolo l’autore tenta di evidenziare i vantaggi e le funzioni che derivano dall’utilizzo del contratto a termine, quale principale forma di impiego flessibile del nostro mercato del lavoro. Premessi tali benefici viene formulato un giudizio critico rispetto al grado di liberalizzazione che, con le ultime riforme, è stato ammesso per questo istituto sempre più strumento di arbitrio del datore di lavoro nella scelta della durata e delle condizioni di svolgimento della prestazione di lavoro.

The response of some Argentine workers to the 2001 crisis of neoliberalism gave rise to a movement of worker-recovered enterprises (empresas recuperadas por sus trabajadores or ERTs). The ERTs have emerged as former employees took over the control of generally fraudulently bankrupt factories and enterprises. The analysis of the ERT movement within the neoliberal global capitalist order will draw from William Robinson’s (2004) neo-Gramscian concept of hegemony. The theoretical framework of neo-Gramscian hegemony will be used in exposing the contradictions of capitalism on the global, national, organizational and individual scales and the effects they have on the ERT movement. The ERT movement has demonstrated strong level of resilience, despite the numerous economic, social, political and cultural challenges and limitations it faces as a consequence of the implementation of neoliberalism globally. ERTs have shown that through non-violent protests, democratic principles of management and social inclusion, it is possible to start constructing an alternative social order that is based on the cooperative principles of “honesty, openness, social responsibility and caring for others” (ICA 2007) as opposed to secrecy, exclusiveness, individualism and self-interestedness. In order to meet this “utopian” vision, it is essential to push the limits of the possible within the current social order and broaden the alliance to include the organized members of the working class, such as the members of trade unions, and the unorganized, such as the unemployed and underemployed. Though marginal in number and size, the members of ERTs have given rise to a model that is worth exploring in other countries and regions burdened by the contradictory workings of capitalism. Today, ERTs serve as living proofs that workers too are capable of successfully running businesses, not capitalists alone.

This was an exploratory study that aimed to gain a rough understanding of the possible ways of implementing community development. The study was carried out between October 1998 and August 1999 in Lupeni, in the Jiu Valley, which is a mining area facing major decline following the government's decision to restructure the mining industry. Against a background of the history of sociology and its insights into the development of the community concept and its theoretical, methodological and practical significance, an analysis was carried out on four levels relevant to the community development approach: social participation, citizens' level of dependency on the state, and membership and the sense of belonging to the local and national community. A needs analysis approach using questionnaires, in-depth interviews and the Delphi approach took into consideration all those actors who could play important roles in local development: local authorities, representatives of local organisations (schools, trade unions, local associations, churches), and local residents.

Rumiana Stoilova (Bulgaria). Social Policy Facing the Problems of Youth Employment. Ms. Stoilova is a researcher in the Institute of Sociology in Sofia and worked on this project from October 1996 to September 1998. This project involved collecting both statistical and empirical data on the state of youth employment in Bulgaria, which was then compared with similar data from other European countries. One significant aspect was the parallel investigation of employment and unemployment, which took as a premise the continuity of professional experience where unemployment is just a temporary condition caused by external and internal factors. These need to be studied and changed on a systematic basis so as to create a more favourable market situation and to improve individuals' resources for improving their market opportunities. A second important aspect of the project was an analysis of the various entities active on the labour market, including government and private institutions, associations of unemployed persons, of employers or of trade unions, all with their specific legal powers and interests, and of the problems in communication between these. The major trends in youth unemployment during the period studied include a high proportion of the registered unemployed who are not eligible for social assistance, a lengthening of the average period of unemployment, an increase in the percentage of people who are unemployed for the first time and an increasing percentage of these who are not eligible for assistance, particularly among newly registered young people. At the same time the percentage of those for who work has been found is rising and during the last three years an increasing number of the unemployed have started some independent economic activity. Regional differences are also considerable and in the case of the Haskovo region represent a danger of losing the youngest generation, with resulting negative demographic effects. One major weakness of the existing institutional structure is the large scale of the black labour market, with clear negative implications for the young people drawn into it. The role of non-governmental organisations in providing support and information for the unemployed is growing and the government has recently introduced special preferences for organisations offering jobs to unemployed persons. Social policy in the labour market has however been largely restricted to passive measures, mostly because of the risk that poverty poses to people continuously excluded from the labour market. Among the active measures taken, well over half are concerned with providing jobs for the unemployed and there are very limited programmes for providing or improving qualifications. The nature of youth employment in Bulgaria can be seen in the influence of sustained structures (generation) and institutions (family and school). Ms. Stoilova studied the situation of the modern generation through a series of profiles, mostly those of continuously unemployed and self-employed persons, but also distinguishing between students and the unemployed, and between high school and university students. The different categories of young people were studied in separate mini-studies and the survey was carried out in five town in order to gather objective and subjective information on the state of the labour market in the different regions. She conducted interviews with several hundred young people covering questions of family background, career plans, attitudes to the labour situation and government measures to deal with it, and such questions as independence, mobility, attitude to work, etc. The interviews with young people unemployed for a long period of time show the risk involved in starting work and its link with dynamics of economic development. Their approval of structural reforms, of the financial restrictions connected with the introduction of a currency board and the inevitability of unemployment was largely declarative. The findings indicate that the continuously unemployed need practical knowledge and skills to "translate" the macroeconomic realities in concrete alternatives of individual work and initiative. The unemployed experience their exclusion from the labour market not only as a professional problem but also as an existential threat, of poverty, forced mobility and dependence on their parents' generation. The exclusion from the market of goods and services means more than just exercising restraint in their consumption, as it places restrictions on their personal development. Ms. Stoilova suggests that more efficient ways of providing financial aid and mobilisation are needed to counteract the social disintegration and marginalisation of the continuously unemployed. In measuring the speed of reform, university students took both employment opportunities and the implementation of the meritocratic principle in employment into account. When offered a hypothetical choice between a well-paid job and work in one's own profession, 62% would prefer opt for the well-paid job and for working for a company that offered career opportunities rather than employment in a family or own company. While most see the information gained during their studies as useful and interesting, relatively few see their education as competitive on a wider level and many were pessimistic about employment opportunities based on their qualifications. Very similar attitudes were found among high school students, with differences being due rather to family and personal situations. The unemployed, on the other hand, placed greater emphasis on possibilities of gaining or improving qualifications on a job and for the opportunities it would offer for personal contacts. High school students tend to attribute more significance to opportunities for personal accomplishment. A significant difference that five times fewer high school students were willing to work for state-owned companies, and many fewer expected to find permanent employment or to find a job in the area where they lived, Within the family situation, actual support for children seems to be higher than the feelings of confidence expressed in interviews. The attitudes of the families towards past experience seems to be linked with their ability to cope with the difficulties of the present, with those families which show an optimistic and active attitude towards the future having a greater respect for parents experience and tolerance in communication between parents and children.

Through comparative analysis of the immigrant labor forces at work in iron mining in northern Minnesota, coal mining in Illinois, and steel milling in the Calumet region of Chicago and Gary, this paper addresses the forms of social distance separating and marginalizing new immigrants from American society and trade unionism that existed in 1914, the year that marked the end point of mass immigration from Eastern and Southern Europe. The “new immigration” was a labor migration that congregated its subjects overwhelmingly in what were called "unskilled" or "semi-skilled" forms of labor. Skilled work was largely, with certain variations, the preserve of "American" or old immigrant workers. This labor gulf separating new immigrants and American workers was hardened by a spatial separateness. New immigrants often lived in what have been called industrial villages—the mining town or location, the factory neighborhood— striking in their isolation and insularity from mainstream society. This separateness and insularity became a major preoccupation for corporate managers, Progressive reformers, and for American trade unions as new immigrants began to engage in major labor struggles leading up to 1914. But among the three industries, only the union of coal miners, the United Mine Workers, enjoyed success in organizing the new immigrants. In the steel mills and the iron mines, the unions were either rooted out or failed to gain a foothold at all. The explanation for these differences is to be found in the different forms of industrial development among the industries studied.

For Estonia and its people social work is one of the vitally important fields that had to be built up from almost nothing since independence was regained in 1991. During Soviet times social work and social workers did not receive the necessary attention. Severe social problems were denied and kept hidden since according to official communist ideology, life in the Soviet Union was the best in the world and getting better all the time. Social workers did not receive specialised education and their functions were to be carried out by the workers of trade unions and the party, by teachers and by the workers of the personnel departments. In the 1990s big changes, having also an effect on social life, took place in the development of Estonian society. Concepts such as social work and social worker were rediscovered in Estonia. There are certain prerequisites for the success of any activity (including social work). One of the most important ones is being a professional, a worker with thorough preparation. Social work as an occupation requires specialised academic education, which is based on theoretical knowledge and practical skills that have been acquired through theoretical knowledge. Specialised knowledge is a foundation for attaining a specialised qualification. However, at the same time one has to keep in mind that social work as an occupation is constantly changing, there is no absolute knowledge - everything is relative, dynamic and changing (Tamm, 1998). The changing nature of the activity requires reflection by a social worker, who also has to be able to evaluate his/her work and its basis and learn from experiences. Academic specialised education implies also the development of a new professional identity and higher levels of competence. This underlines the necessity of specialised education.

La presente investigación analiza el entramado de politicidad en un ámbito estatal de trabajo, a partir de la experiencia de los trabajadores del Hospital Provincial Neuquén Dr. Castro Rendón (HN) entre los años 2005 y 2013. Se propone un abordaje relacional que atienda a la configuración y redefinición de los escenarios de disputa, retomando la perspectiva de Norbert Elías. Se ha diseñado una estrategia metodológica cualitativa basada en la realización de observaciones participantes, entrevistas semi-estructuradas en profundidad y en el análisis de materiales gráficos. Se realizó un muestreo teórico de tipo no probabilístico, y las unidades de la muestra fueron seleccionadas de acuerdo a criterios relativos a la participación política y a las características de las labores hospitalarias. Los principales hallazgos de esta tesis refieren a la conceptualización de los ámbitos estatales de trabajo. Se los caracteriza como espacios donde se relacionan y se expresan múltiples grupos, resaltando los procesos socio-culturales que están implicados en las disputas políticas de los trabajadores. Se analizan la articulación entre demandas sectoriales y la disputa más general por la gestión de las políticas públicas, las regulaciones especiales que legislan el trabajo hospitalario, las distintas temporalidades de los conflictos, la vinculación con organizaciones externas, la jerarquización del espacio laboral, y la permeabilidad de lo estatal y lo no-estatal. Estos resultados permiten aportar de manera más general a las teorías sociológicas de la acción colectiva en lo que respecta a la utilización de las categorías de clase y a las identidades de los trabajadores

Este artículo centra su atención en el tipo de relaciones establecidas entre el gobierno radical de Amadeo Sabattini (1936-1939) y el movimiento obrero desde una perspectiva de análisis que correlaciona tres planos: el desarrollo de nuevas prácticas estatales marcadas por la conciliación y el arbitraje en los conflictos laborales, la expansión de las corrientes sindicales de izquierda y su unificación en una sola central obrera, y las respuestas que frente a ambos fenómenos ofreció el conservadorismo cordobés. En este último aspecto, se indaga especialmente en el papel desempeñado por el Partido Demócrata y por la Iglesia Católica

En este trabajo analizaremos el Semanario CGT en relación a su proyección como nexo comunicativo y organizacional de las propuestas sindicales y políticas que elaboró la conducción de la CGT de los Argentinos durante 1968 y 1969. Examinaremos las tensiones expresadas en la publicación entre el proyecto político que desde allí se buscó articular y las limitaciones que existieron para su realización, atendiendo a las expectativas políticas su conducción estructuradas en torno a las tradiciones y los postulados del sindicalismo combativo, como a los conflictos existentes entre las distintas tendencias del sindicalismo local por la conducción del movimiento obrero organizado

El trabajo reflexiona sobre la relación conflictos laborales-huelgas generales en el período 2002-2012 en Argentina a partir del debate Iñigo Carrera-Adrian Piva sobre la huelga general como indicador de los momentos de ascenso y descenso de la lucha de clases, y vinculando dicha relación con algunas discusiones entre las tesis económicas y políticas del conflicto laboral. Incluye una reconstrucción estadística de la conflictividad laboral con datos del Centro de Estudios Nueva Mayoría, Taller de Estudios Laborales y el Ministerio de Trabajo, Empleo y Seguridad Social. Finalmente, reconstruye las huelgas generales a partir de los periódicos Página 12 y La Nación. La relación entre estos tipos de conflicto está históricamente determinada y es por lo tanto, cambiante. En la década se observa desacople mas que coincidencia en ambas protestas, sin embargo, el análisis de las huelgas generales del período cristaliza ciertas transformaciones vividas por el movimiento obrero organizado en nuestro país.

En este artículo se reconstruye la evolución del peronismo bonaerense en el período 1959-1962. El objetivo es exponer algunos aspectos relativos a la dinámica interna de esa fuerza política, a sus equipos políticos y la relación con el liderazgo de Perón. De esta manera, el artículo se presenta como un aporte a los estudios interesadas en indagar en torno a la evolución del peronismo durante la década de 1960. Pero en este caso desde una perspectiva que valoriza del funcionamiento "político" del peronismo y no solo su relación con las organizaciones sindicales.
