La pobreza infantil: un desafío prioritario

En esta edición retomamos el análisis de la pobreza infantil abordada en el primer Desafíos. En el artículo central se presentan datos sobre la pobreza infantil en América Latina, pero en esta ocasión se incorpora explícitamente un enfoque de derechos en la medición. Esto implica considerar pobre a un niño ante el incumplimiento de al menos uno de sus derechos, por presencia de una privación básica, aunque en la pobreza infantil suelen concurrir múltiples privaciones que se refuerzan entre sí y atentan contra el desarrollo de las potencialidades de los y las menores.

At the heart of celebrity: celebrities’ children and their rights in the media

Based on a comparative analysis of celebrity magazines in Portugal and Brazil, this article analyses the representation of children of celebrities. Those magazines privilege an extreme personalisation of the stories and a strong valuation of the photographic image, representing children as a source of happiness and affection within the family. Nonetheless, drawing on celebrity studies and on children’s rights and their implications for journalism, we concluded that this positive representation frequently collides with the children’s rights to privacy, to be protected from public embarrassment and to be heard in the issues that affect them.

Cultural relativism in the Universal Periodic Review of the Human Rights Council

This Working Paper aims to offer an up-to-date list of cultural relativist players and arguments with respect to human rights, constituted by China, Viet Nam, Myanmar, Iran, Pakistan, Yemen, Syria, Malaysia and Cuba. This working paper argues that Indonesia, Iraq, Colombia and Mexico are not in the same cultural relativist group of states maintained by renowned scholars, notably Cristina Cerna and Dianne Otto. As such, apart from this form of cultural relativism based on the respect for the self-determination of indigenous peoples and communities, this working paper exposes two different categories of radical cultural relativism based on revolutionary discourse and/or radical Islamism, as well as targets the credibility on the latter two based on the information facilitated by the United Nations (UN) Human Rights Council (HRC) Universal Periodic Review (UPR).

EU report on the implementation of the UN Convention on the Rights of Persons with Disabilities

On 5 June 2014, the European Union published its first report on the implementation of the UN Convention on the Rights of Persons with Disabilities (UN CRPD). This document follows the ratification of the Convention by the EU in 2010 and its obligation to prepare and submit a report on its actions to support the implementation of the Convention. Factsheet on case-law on the rights of older people

The Press Service of the European Court of Human Rights published in June 2014 a factsheet on the Court’s case-law on the human rights of older people. This collection shows that even though the European Convention on Human Rights (ECHR) does not explicitly refer to older persons nor to age discrimination, the Strasbourg Court can play an important role as a guardian of the rights of older people. Proposing a 'Consent Commons' in open education - balancing the desire for openness with the rights of people to refuse or withdraw from participation

A new 'Consent Commons' licensing framework is proposed, complementing Creative Commons, to clarify the permissions given for using and reusing clinical and non-clinical digital recordings of people (patients and non-patients) for educational purposes. Consent Commons is a sophisticated expression of ethically based 'digital professionalism', which recognises the rights of patients, carers, their families, teachers, clinicians, students and members of the public to have some say in how their digital recordings are used (including refusing or withdrawing their consent), and is necessary in order to ensure the long term sustainability of teaching materials, including Open Educational Resources (OER). Consent Commons can ameliorate uncertainty about the status of educational resources depicting people, and protect institutions from legal risk by developing robust and sophisticated policies and promoting best practice in managing their information.

Quality uncertainty and allocation of decision rights in the European protected designation of origin

The paper considers some issue in the governance of the European Protected Designation of Origin (PDO). The PDO systems are the outcomes of both farmers and consumers expectations and connect the valorisation of the agricultural and rural resources of given territories to the quality of typical products. A critical point in the governance of the PDO systems is represented by the connection between the quality strategies and the uncertainty. The paper argues that the PDO systems can be thought of as strictly coordinated subsystems in which the ex post governance play a critical role in coping with quality uncertainty. The study suggests that the society's inducements given raise to complex organizational systems in which the allocation of decision rights to PDO collective organizations play a major role. The empirical analysis is carried out by examining ten Italian PDO systems in order to identify the decision rights allocated.

Droits du patient: ce que le nouveau Code civil va modifier dans les soins aux enfants [Patients' rights: what the new swiss civil code will change in the health care of children].

Recent progress in medicine allow to provide treatment, to cure or to extend the lifespan of people that would have not survived before. Doctors and healthcare providers have become indispensable actors in Western societies. This is particularly true for children's health issues. With the new information technologies, knowledge is now available to everyone, which enables patients to dialog on an equal footing with the physician. Nowadays, therapeutic choices are discussed and negotiated. The new tensions caused by this relationship between therapist and patient have created the need for new regulations. The Swiss Confederation has modified its Civil Code with the objective of a better protection of vulnerable individuals. This article summarizes the consequences of the new regulations with regard to the care and treatment provided to children.
