The United States is home to a private prison industry, which allows for the detention of human beings to be transformed into a multi-billion dollar industry. This paper traces the parallels between the post-civil war convict leasing system and the current system of prison privatization, which encourages the commodification of black bodies in order to maintain a racial hierarchy. It analyzes the incompatibility of prison privatization with the US Constitution. Private prisons, which hold African American men at a higher rate that state-run prisons, take cost-cutting measures in order to increase profit, which expose prisoners to higher rates of abuse and increased recidivism rates. Private prisons have significant political power to determine crime control legislation, which has led to harsh laws which increase the number of men of color behind bars. This paper provides a three-phase plan for abolishing private prisons and reducing overall incarceration rates in the United States.

Concern remains regarding the efficacy of legal sanctions to reduce drink driving behaviours among repeat offenders. The present study examined the impact of traditional legal sanctions (e.g., fines and licence disqualification periods), nonlegal sanctions, alcohol consumption and the frequency of recent offending behaviour(s) on intentions to re-offend for a group of recidivist drink drivers (N=166). The analysis indicated that participants perceived legal sanctions to be severe, but not entirely certain nor swift. In addition, self-reported recent drink driving behaviours and alcohol consumption levels were identified as predictors of future intentions to drink and drive. The findings of the study confirm the popular assumption that some repeat offenders are impervious to the threat and application of legal sanctions and suggests that additional interventions such as alcohol treatment programs are required if the drinking and driving sequence is to be broken for this population. This study investigated the factors considered by forensic examiners when evaluating sexually violent predators (SVP) for civil commitment under Florida's “Jimmy Ryce Act.” The project was funded by a pre-doctoral research grant awarded by the Association for the Treatment of Sexual Abusers (ATSA). ^ This study proposed two specific research questions. First, what is the direct relationship between actuarial risk assessment scores and recommendations for sex offender civil commitment? Second, which other variables are likely to influence SVP commitment decisions, and to what degree? The purpose of the study was to determine if risk assessment practices are evidence-based, and whether offenders selected for commitment meet statutory criteria. ^ The purposive sample of 450 SVPs was drawn from the population of sex offenders evaluated for civil commitment in Florida between July 1, 2000 and June 30, 2001. Data were extracted from SVP evaluations provided by the Florida Department of Children and Families. Using multivariate logistic regression, this correlational research design examined the relationship between the dependent variable, commitment decision, and several sets of independent variables. The independent variables were derived from a review of the literature, and were grouped conceptually according to their degree of correlation with sex offense recidivism. Independent variables included diagnoses, actuarial risk assessment scores, empirically validated static and dynamic risk factors, consensus based risk factors, evaluator characteristics, and demographics. This study investigated the degree to which the identified variables predicted civil commitment decisions. ^ Logistic regression results revealed that the statistically significant predictors of recommendations for sex offender civil commitment were actuarial risk assessment scores, diagnoses of Pedophilia and Paraphilia NOS, psychopathy, younger age of victim, and non-minority race. Discriminant function analysis confirmed that these variables correctly predicted commitment decisions in 90% of cases. ^ It appears that civil commitment evaluators in Florida used empirically-based assessment procedures, and did not make decisions that were heavily influenced by extraneous factors. SVPs recommended for commitment consistently met the criteria set forth by the U.S. Supreme Court in Hendricks v. Kansas (1997): they suffered from a mental abnormality predisposing them to sexual violence, and risk assessment determined that they were likely to reoffend. ^

Formal education programs in prisons have had success in reducing recidivism, but the introduction of informal learning can have additional benefits and longer lasting effects. This paper addresses recidivism and its effects on inmates and society at large and how prison educators can facilitate self-directed learning in prisons through Garrison’s model.

Corrections literature maintains the profound utility of postsecondary education programs in reducing recidivism rates among ex-offenders (Anders & Noblit, 2011). Notwithstanding, financial restrictions often impede the abilities of correctional administrators to offer college-level courses. Alternative avenues for postsecondary correctional education are addressed and policy issues and recommendations provided.

This research examined sex offender risk assessment and management in Ireland. It focused on the statutory agencies with primary responsibility (Garda Síochána and the Probation Service). The goal was to document the historical, contextual and current systems, in addition to identifying areas of concern/improvements. The research was a mixed-methods approach. Eight studies were conducted. This incorporated documentary reviews of four Commission to Inquire Reports, qualitative interviews/focus groups with Garda staff, Probation Service staff, statutory agencies, community stakeholders, various Non-Governmental Organisations (NGOs) and sex offenders. Quantitative questionnaires were also administered to Garda staff. In all over 70 interviews were conducted and questionnaires were forwarded to 270 Garda members. The overall findings are: •Sex offender management in Ireland has become formal only since 2001. Knowledge, skills and expertise is in its infancy and is still evolving. •Mixed reviews and questions regarding fitness for purpose of currently used risk assessments tools were noted. •The Sex Offender Act 2001 requires additional elements to ensure safe sex offender monitoring and public protection. A judicial review of the Sex Offender Act 2001 was recommended by many respondents. •Interagency working under SORAM was hugely welcomed. The sharing of information has been welcomed by managing agencies as the key benefit to improving sex offender management. •Respondents reported that in practice, sex offender management in Ireland is fragmented and unevenly implemented. The research concluded that an independent National Sex Offender Authority should be established as an oversight and regulatory body for policy, strategy and direction in sex offender management. Further areas of research were also highlighted: ongoing evaluation and audits of the joint agency process and systems in place; recidivism studies tracking the risk assessment ratings and subsequent offending; and an evaluation of the current status of sex offender housing in Ireland.

BACKGROUND: In light of evidence showing reduced criminal recidivism and cost savings, adult drug treatment courts have grown in popularity. However, the potential spillover benefits to family members are understudied. OBJECTIVES: To examine: (1) the overlap between parents who were convicted of a substance-related offense and their children's involvement with child protective services (CPS); and (2) whether parental participation in an adult drug treatment court program reduces children's risk for CPS involvement. METHODS: Administrative data from North Carolina courts, birth records, and social services were linked at the child level. First, children of parents convicted of a substance-related offense were matched to (a) children of parents convicted of a nonsubstance-related offense and (b) those not convicted of any offense. Second, we compared children of parents who completed a DTC program with children of parents who were referred but did not enroll, who enrolled for <90 days but did not complete, and who enrolled for 90+ days but did not complete. Multivariate logistic regression was used to model group differences in the odds of being reported to CPS in the 1 to 3 years following parental criminal conviction or, alternatively, being referred to a DTC program. RESULTS: Children of parents convicted of a substance-related offense were at greater risk of CPS involvement than children whose parents were not convicted of any charge, but DTC participation did not mitigate this risk. Conclusion/Importance: The role of specialty courts as a strategy for reducing children's risk of maltreatment should be further explored.

Durant les dernières décennies, les différences intersexes en matière de conduite avec les capacités affaiblies par l’alcool (CCAA) ont suscité l’attention, alors que le comportement est en augmentation chez les femmes tandis qu’il diminue chez les hommes. Les données suggèrent que, chez les femmes, la CCAA s’associe à des caractéristiques psychologiques différentes de celles qui se retrouvent chez les contrevenants masculins (c.-à-d. davantage de problèmes liés à l’alcool et aux drogues et de psychopathologies, mais moins de recherche de sensations et de comportements délinquants). Malgré ce profil différentiel, les femmes contrevenantes de la CCAA demeurent une population hautement méconnue, particulièrement en ce qui a trait au profil des récidivistes. Alors que chez les hommes, des données émergentes indiquent que des limitations cognitives sont présentes chez les récidivistes et qu’elles constituent potentiellement un mécanisme sous-jacent au comportement, le profil cognitif des femmes récidivistes demeure inexploré. Des données exploratoires obtenues chez les contrevenantes et la documentation de champs de recherche connexes suggèrent que les femmes se distinguent notamment en ce qui concerne leur fonctionnement exécutif qui pourrait être préservé, alors que leur fonctionnement visuospatial serait déficitaire en comparaison de leurs vis-à-vis masculins. L’objectif de la présente thèse est d’approfondir les connaissances sur les caractéristiques des femmes récidivistes, ce qui permettra de mieux comprendre l’hétérogénéité de cette population et de générer des hypothèses au regard des mécanismes cognitifs sous-jacents à la répétition du comportement de CCAA. Plus spécifiquement, la thèse a pour objectif premier d’étudier les différences entre les sexes en matière de fonctionnement visuospatial et de mémoire visuelle, d’attention et de fonctionnement exécutif (c.-à-d. flexibilité cognitive, abstraction, inhibition). L’objectif secondaire consiste à comparer ces contrevenants au regard de leurs caractéristiques psychologiques (problèmes liés à l’alcool et aux drogues, impulsivité, recherche de sensations, traits antisociaux, anxiété et dépression). L’hypothèse examinée soutient que les femmes et les hommes récidivistes de la CCAA performent moins bien que les femmes et les hommes non-contrevenants en termes de fonctionnement visuospatial, attentionnel et exécutif. En outre, il est attendu que les femmes récidivistes présentent des performances inférieures à celles des hommes récidivistes en ce qui a trait aux fonctions visuospatiales. Par ailleurs, l’hypothèse prévoit que les hommes récidivistes aient des performances inférieures à celles des femmes récidivistes sur le plan exécutif et attentionnel. En matière de caractéristiques psychologiques, il est attendu que les femmes et les hommes récidivistes présentent significativement plus de problèmes liés à l’alcool et aux drogues, d’impulsivité, de recherche de sensations et d’indices de psychopathologies (tendance antisociale, dépression, anxiété) que les non-contrevenants. En outre, il est attendu que les femmes récidivistes présentent plus de problèmes liés à l’alcool et aux drogues et d’indices de dépression et d’anxiété que les hommes récidivistes. Enfin, il est attendu que les hommes récidivistes présentent significativement plus d’impulsivité, de recherche de sensations et de traits antisociaux que les femmes récidivistes. Ces hypothèses se confirment partiellement, alors que les hommes récidivistes (n = 39) présentent des performances inférieures à celles des hommes non-contrevenants (n = 20) et des femmes récidivistes (n = 20) sur le plan attentionnel et exécutifs. Toutefois, les femmes récidivistes ne se distinguent pas des femmes non-contrevenantes (n = 20) en matière de fonctionnement neuropsychologique. En ce qui a trait aux caractéristiques psychologiques, les résultats soutiennent partiellement les hypothèses. La discussion met en lumière que les femmes et des hommes récidivistes présentent des caractéristiques similaires, hormis en ce qui a trait au fonctionnement attentionnel et exécutif qui semble jouer un rôle dans la récidive au masculin, alors que cela n’apparaît pas être le cas chez les femmes chez qui le comportement pourrait être davantage situationnel. La nécessité que des études futures soient réalisées au moyen de devis expérimentaux, de même que les difficultés inhérentes au recrutement des femmes récidivistes sont discutées.

The VRAG-R is designed to assess the likelihood of violent or sexual reoffending among male offenders. The data set comprises demographic, criminal history, psychological assessment, and psychiatric information about the offenders gathered from institutional files together with post-release recidivism information. The VRAG-R is a twelve-item actuarial instrument and the scores on these items form part of the data set. Because one of the goals of the VRAG-R development project was to compare the VRAG-R to the VRAG, subjects' VRAG scores are included in this data set. Access to the VRAG-R dataset is restricted. Domestic violence is a serious, widespread public, social and health problem that affects the lives of many women, children and men. There is also evidence to suggest it has one of the highest rates of recidivism. This comprehensive book provides an overview of what the research tells us about the perpetrators of domestic violence and what works, and what doesn’t, in promoting positive change.

Collecting together the most up-to-date evidence from the international literature and bringing psychological, sociological, gendered and socio-political theoretical perspectives to bear on the issue, the book explores:
- what domestic violence is, why it happens and how it can be measured
- who the perpetrators of domestic violence are, including discussion of non-stereotypical patterns such as male victims, female perpetrators, couples where the abuse is mutual, and couples with abusive relationships who want the abuse to end but the relationship to be sustained
- strategies for engaging perpetrators in interventions and for promoting behaviour change
- evidence-informed interventions, programmes and policies for working with perpetrators
- where robust evidence is lacking and more research needs to be undertaken.

For the past three decades or so, criminal justice policies have been enacted under the assumption that individuals who have been convicted of a sex offense are life course persistent sex offenders. In that context, research has been heavily focused on the assessment of risk and the prediction of sexual recidivism.Simultaneously, little to no attention has been given to the majority of individuals convicted of sex offenses who are not arrested or convicted again.Researchers have witnessed a growing gap between scientific knowledge and the sociolegal response to sexual violence and abuse. The current legal landscapecarries important social implications and significant life course impact for a growing number of individuals. More recently, theoretical and research breakthroughs in the study of desistance from crime and delinquency have been made that can help shed some light on desistance from sex offending. Desistance research, in the context of sex offending, however, represents serious theoretical, ethical, legal, and methodological challenges. To that end, this article introduces a special issue exploring current themes in desistance research by examining the life course of individuals convicted of a sexual offense while contextualizing their experiences of desistance.
